Nilsen, rtlayor; George Shavor, Trustee; Paul Coppini, Trustee; Willis Warkentien, Trustee; and Wm. R. Utecht, Clerk. Also present were Brad Lemberg, Engineer; Frank N. Graham, Attorney and Ethel E. Whitey Dep. Clk. and Dep. Treasurer. Hearing on Mayor Nilsen opened the Hearing by reading Affidavit of Proposed ?~tiailing Notices and Affidavits of Publishing and Posting Assessment notices. Watermain Improvement Engineer Lemberg advised the Watermain has been completed. 1960 No. 1. The contractor will start the street repairs tomorrow morning, and, with good weather, he should be through in two weeks. Another contractor will complete the re-sodding after that. He advised the net assessment, including street and boulevard work, East of Snelling would be 967.35 per front foot; on Fairview 968.03 x~er front foot; on Tatum, 9~~;1.2 per front foot; all projects costing less than the original estimates. Those fully assessed for the Larpenteur Avenue Watermain were not assessed for the first 126' of their side yards abutting Tatum and Fairview. Attorney Graham advised that, assessments were based on front footage only. Those living on corner lots were paying for only the front footage. Mayor Nilsen advised that the assessment was set up on the 20 year plan, at 6~ interest. Attorney Graham advised that those residents affected would receive a letter adving their total assessment; that, under the law, this entire amount may be paid without interest on or before November 16th, 1960, to the Deputy Village Treasurer, Mrs. Ethel White, at the Village Office in the Village Hall, 1644 W. Larpenteur Avenue. After November 16th, the assessment roll will be certified to the County Auditor to be extended on the tax lists of the County and thereafter the entire assessment remaining unpaid at any time, may be paid to the County Treasurer, with interest to December 31st, of the year in which said payment is made, or in the installments mentioned above. The first installment to become due on the first tdonday in January, 1961. To the first installment shall be added interest on the entire assessment from November 16th 1960 until December 31st, 1961. Tb each subsequent installment when due shall be added interest for one year on all unpaid installments. George Zaier, 1892 A.rona, said that he and Robert E. Jacobs, 1900 Arona, had made an agreement with one of the foremen of the St. Paul Water Department whereby they were to save 9640.00 each by having both their water lines laid. in the same trench. Limberg advised the City Engineers said they didn't know anything about it. Tars. White advised she had contacted Richard Delaney, Tom Hausen and Pete Fabio, of the St. Paul l~!ater Department, none of whom knew anything about the agreement. 52c, Attorney Graham stated that undoubtedly Zaier and Jacobs had such an agreement. The Village would endeavor to collect on it, but the savings would have to be deducted from the entire cost and the assessment equalized. Even with this adjustment, the total being assessed. will be somewhat less than the total cost of the entire project. Lemberg explained that while trey had originally antci- pated running the main down the boulevard, they found there would be so many driveways to repair, that they decided it would be better to run the main in the street. This procedure, including putting the streets back in good condition, resulted in a savings of about X76.00 per home owner. ~t4ayor Nilsen said the Council hasn't .felt that it would set any time limit for hooking up to the water. The Council felt hooking up to the sewer was the important thing, and that the deadline for hooking up to the sewer had been set for October 1st, 1961. The need for the correction of the drainage at the corner of Albert and Ruggles and Ruggles at Hamline was called to the attention of the Council and. Engineers. After discussion, Utecht moved adoption of the following resolution: RESOLUTIOPJ ADOPTING ASSESSTdENT WHEREAS, pursuant to proper notice duly given as required by law, The Council has met and heard and passed upon all objections +,o the proposed assessment of the costs of Watermain Improvement of 1960 No. 1 upon the following streets: 1. Fairview Avenue from Larpenteur Avenue to a point X62' north of Larpenteur Avenue. 2. Tatum Street from Larpenteur Avenue to a point !}85' north of Larpenteur Avenue. 3. East side of Snelling Avenue from Ruggles to Roselawn. !~. Asbury Avenue from Ruggles to Roselawn. 5. Arona Avenue from Ruggles to Roselawn. 6. Simpson Avenue from Ruggles to Roselawn. 7. Pascal Avenue from Ruggles to Roselawn. 8. Holton Avenue from Garden to Roselawn. 9. Albert from Ruggles to Roselawn. 10. Roselawn Avenue from Snelling to A1_bert. 11. Ruggles Avenue from Holton to Albert. and has amended such proposed assessment as it deems just. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF FALCON HEIGHTS, MINNESOTA: 1521 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of twenty (20) years, the first of the installments to be payable on or before the first Monday in Jan- uary, 1961 and shall bear interest at the rate of six (6~) per cent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added. interest on the entire assessment from the date of this resolution until December 31st, 1961. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The proposed assessment has been amended by removing _._,:_ from assessment at this time lots 20 and 21, block one, Barthel Villas Addition, since building permits have been refused on these lots because they are low lots, and. the erection of build- ings upon them would interfere with natural drainage. It is hereby declared to be the intention of the Council to reimburse itself in the future for the co st of this improvement of X551.25 per lot, by levying additional assessments on notice and hearing as provided for the assessments herein made, upon these lots when changed conditions relating to such properties make such assessment feasible. 1~. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the Village Treasurer, except that no interest shall be charged. if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the County Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 5. The Clerk, at the end of the 30-day period, shall transmit a certified duplicate of the unpaid assessments to the County Auditor to be extended on the proper tax lists of the county and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Warkentien and unanimously carried. The Hearing on the Proposed Assessment WatermainImprovement 1960 No 1 was concluded. Playgrounds The Council was advised that the bleachers at the Falcon Heights Elementary School are in horrible condition. The one nearest Hamline has hardly a seat left on it, and the other is not much better. Fire Deft. 9 P. td. Chief Gordon Nelson and approximately 16 members of the Falcon Heights Volunteer Fire Department were present. After discussion, Utecht moved that the paid firemen be given an additional 9612.00 per month increase over and above the 4625.00 per month increase specified in the budget which has already been certified to the County Auditor and that the Volunteers pay be raised from X2.00 per drill night to 42.50 per drill night; that inspection time be paid for at the rate of 442.25 per hour, not to exceed 9fi200.00 per year. These changes to be effective with the new budget year starting January 1st, 1961. These increases to be absorbed partially by a 96250.00 reduction in the other budgeted items for the Fire Department, other fire department items to remain as budgeted by the Council.
