Utecht moved Trials. that the Attorney be contacted and asked to advise us, in writing, who pays the cost in the event the individual loses, and who pays the costs if the individual v;ins. Should the Justice costs be all inclusive to cover the trial, and whether under those circumstances, the Justice should not turn that money over to the Village and have trat money dispersed through the Village Office. Seconded by Conpini and carried. San. Sewer Sink- Letter of December lath from Attorney Graham vras read. It ad- ing Fund vised: There is a payment of 9fi64,736.58 due January 1, 1960. Vde have a balance in the Sanitary Sewer Sinking Fund Account of 952,219.88. The First National Sank is holding in safekeeping ~'~9,000.00 of U. S. Treasury Bills which will be paid off December 15th 1960, and another 937,000.00 of U. S. Treasury Bills which are due January 15th, 1961. He has directed the First National 'dank to cash in these bonds a.nd deposit the proceeds to our Sanitary Sewer Sinking Fund Account at the Falcon Heights State '3ank prior to Friday, December 23, 1960. This will make our balance in the account approximately 9fi~8,000.00. He has directed Eugene r~.4onick, the County Auditor, to advance to the Village the sum of :20,000.00 out of the Sanitary Sewer Assessment pa~nnents and bond and interest sinking fund by Tuesday, December 20th, 1960, if the October tax settlement has not been sent to the Village by this date. He directed that deposits be made as soon as checks are received, and that, a check be written payable to the American Na±ional Bank, in the amount of ~6~,736.58, dated December 23rd, delivered to him by Friday morning, December 23rd, for delivery to the American National Bank. Coppini moved that the Engineer be instructed to come up with preliminary costs by visual inspection. Seconded by Nilsen and carried. Oath of Clerk Utecht administered the Oath of Office to Trustee Shavor Office and Shavor was handed Notice of Election. Streets - Nilsen moved that, check #8887 issued to Armor Coat Company Armor-Coat be voided, and that; the bill he referred back to f3onestroo Check & Associates because of the unsatisfactory condition of Pascal 1513 and Albert. Seconded by Coppini and. carried. License All requirements having been met, D~7ASTER PLUT,4BER'S LICENSE #61 was issued to N1m. G. Dunkel, 1471 Crawford A-.-e., St. Paul, 13. Moved by Utecht, seconded by Nilsen and carried. Streets Utecht moved that the Village Council write a letter to Commissioner Ed Salverda, sending a carbon copy to Robert Blomberg, advising Salverda that snoNr ploUring operations in front of the Blomberg Drug and Grocery have, in the past, been entirely unsatisfactory, to the property owner, and that it be pointed out that since the Village of Falcon Heights has no snow plowing equipment, and also since the plowing is done by the County and paid for by the Village, that it is expected that any future operations be such as to clear the snow out from in front of Blomberg's store; and ±h at the Maintenance Crew for the County be requested to keep that street in front of that business area. in such condition that it will not constantly break away from the curbing. Seconded by Coppini. Carried. Utecht made a further resolution that the engineer be instructed by mail, with a carbon copy to P.Zr. Blomberg, to furnish the Clerk with a copy of all correspondence they have had with T,4r. Blomberg in the last year so that the Clerk can take this matter up per- sonally with ~~.4r. Blomberg, and that the Attorney be requested to advise the Cilerk, in writing, the legal restrictions as to why Falcon Heights cannot spend Village funds for the repair and maintenance of Hamline Avenue. Seconded by Shavor. Carried. Underpass, Snell- Copy of letter tivri+ en by Bonestroo to the Minnesota Highway ing & Larpenteur Department December 13th was read. Letter read as follows: "The Vi7.lage of Falcon Heights would like to set a meeting with the r~Zinneso to Highway Department relative to discussing the proposed grade separation at Larpenteur & Snelling. At a Council meeting on December 8th, 1960, a tentative date of January 19 , 1961, at 7:3~ P. ~~d. was agreed upon. We would appreciate your confirmation of this meeting to the Village office." No reply having been received, the Deputy Clerk was instructed to write the Highway Department, referring to the above letter and asking for a reply. Dog Catcher Utecht moved that B & E Patrol be instructed, in writing, not to answer any calls unless called in either by the Village Office, Police, or a P.4ember of the Council. Seconded by Warkentien and carried. P~dinnesota The Clerk was instructed to send notice of the annual meeting Safety to be held Tuesday, Janu~:ry 10th, 1961, at 12:15 noon at the Council Hotel Lowry to David P. Street F?.epairs The Clerk was instructed to send Estimate No. 1, File #60Ctlal, Dunkley Surfac- Dunkley Surfacing Co., Inc., in the amount of ~10,231.lt7, ing Co. covering street resurfacing, to Bonestroo & Associa±,es, telling Bonestroo the Council feels that there should be a greater hold-back than 15~. 15~~ General There was a general discussion regarding Decals advertising Discussion Falcon Heights, a camera for the Police Car, a Check Protector, a Plaque listing the names of the Fast Mayors, and a Petty Cash Fund. No definite action was +.,aken. Police, Salary, ti^Iarkentien moved that we pay each of the Police Officers Overtime 352.50 per hour for overtime effective at once (December 19th). Seconded by Utecht and carried. Don Arndt, It was pointed out that sometimes Don Arndt is, erroneously, title referred to as the '"Police Chief". His position is that of '"Police Commissioner" not "Police Chief'".which implies bower to make arrests which P~4r. Arndt does not have and~does not want. Road and Bridge The Deputy Clerk Naas instructed to call Eugene P~Zonick, Fund County Auditor, asking when the Road and Bridge Fund checks would be mailed. Utecht will make inquiries regarding the services and costs of a certi- fied public accountant to audit the books for 1960.
