Nilsent P;Rayor; George Shavor, Trustee; Charles Stone, Trustee; A, W. Mortenson, Clerk,: Also present were Pd. J. Galvin, Village Attorney, Wm. E. Olsen, Treasurer; Brad Lemberg, Engineer; and Ethel E. V~hite, Deputy Clerk and Deputy Treasurer. Absent: Willis Warkentien, Trustee. Governor's Notice advising that conference was to be held October Conference on 17, 18 and 19 in the State Capitol was read. The Deputy Clerk was instructed to call Mrs: Berdie to ask if she could attend, the Village to pay her eye penses, Roof Repairs: Quotations on repairing the roof of the Village Hall were reviewed. Engineer Lemberg was requested to make an inspection and recommendation. Fa11~~0ut Shelters The Deputy Clerk was instructed to advise Resident that a building permit would be required for a fall-out-shelter, but that the newspaper stated Assessors had been instructed not to assess for afall-out-shelter, Curb and Gutter It was recom~oended that curb and gutter should be assessed on the frontage of a lot as well as the dez~th of a corner lot. 'Sewer Trouble After discussion, it was moved by Stone, seconded by 15lt0 Iowa. Shavor and voted to open the sewer line at 15l~0 Iowa to determine the cause of the numerous sewer blocks, the Village to pay the cost from the main in the street to the stub. If the trouble is not found there, the resident is to pay the cost of digging up the line from the stub to the house. Engineer Lemberg is to supervise the work. Publ~.c Hearing, Pers. Carl F. Peterson, Victor Cooke and a representative of Curb and gutter, Pure Oil Company were present. Arona: Clerk Mortenson opened the Hearing by reading copies of Notice as published, posted and mailed to the affected parties. After discussion, it was moved by Shavor, seconded by Stone and unanimously voted to approve the following resolution adopting the assessment: RESOLUTION ADOPTING ASSESS?~~NT: WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the improvement of the Village of Falcon Heights, Minnesota, by the .Arona 1650. ,• ,, . i j Avenue Improvement between Larpenteur Avenue ar~d ~ Crawford NCNB, `~?EREFORE, BE IT RESOLVED by the Village Council ,~ of the Village of Falcon Heights, Minnesota: 1. Such proposed assessment, a copy of which is on file in the Clerk's Office, is hereby accepted and. shall constitute the special assessment against the lands named therein, and and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessmen t levied against it. 2. Such assessment shall be payable in equal annual in- stallments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January, 1962 and shall bear interest at the rate of 6~ per annum from the date of the adoption of this assessment resolution until December 31, 1962. To each subsequent installment when due there shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any, time prior to certification of the assessment to the Gounty Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the Village Treasurer, except that no i~teres.t shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time, thereafter, pay to the County Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31st of the year in which such payment ' is made. ~.. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the county, and such assessments shall be collected and paid over in the same manner as other principal taxes. Burning The Deputy Clerk was instructed to ask the Fire Chief to stop at 1:4rs. Peterson's, 1522 Crawford and advise her where to burn leaves, etc. Zoning Cdr. Bilski and Mr. P,4oder vrere present to discuss the re- zoning of property on Cleveland Avenue. '~dayor Nilsen . suggested they write a letter to the Council so the Council can refer the matter to the Manning Commission. It was moved. by Stone, seconded by Shavor and voted that the Engineer and 1~ttorney be authorized to proceed as outlined above and that the engineer be authorized to meet with the fire department regarding hose. ' There was a citizen's committee present. The following points. were brought out. The Citizen's Committee will lay the sod if the Village provides it. There will be steps from the small children's play area. to the sidewalk. A wooden ramp to the skating rink is„being considered as a temporary measure. Citizens will buy the physical equip- . ment. The Village hopes to seed the banks next Spring. They still have to be shaped. The warming house will be set over in the Northeast corner. There will be two rinks. • One for small children and non-hockey players. The other - for hockey. Supervisors should see that the rinks are used as specified. Citizens requested a light. The barricade will be put back. Until the concrete steps can be put in, Brad suggested that 3 or !~ 2x10s be used. It was re- quested that the warming house be taken out. Nilsen recommended that citizens talk to Warkentien regarding super- vision. If the puma doesn't take care of the water, they may have to fence the low area. The East,T~lest and North banks will be seeded. It is a 3 to 1 slope and grass should grow on it. Budget, Fire The three paid men, Chief Nelson, Asst.. Chief Helbig and Department Capt. '-3aden were present. It was decided to forego the hospitalization insurance plan until the State comes out with it's plan, and then take the matter up again. Sick leave was discussed. It was decided that each case would be decided on it's merits -- length of employment, devotion to duty, value to the department, etc. Helbig suggested equal nay scales for both firemen and police. Uniforms and vacations were discussed. No decision was reached. The Council will meet October 16th to try to resolve the ma±ter. Attorney's report ?t?r. Friel drew up a suvey of Wending and past litigation. Forty percent of the total time spent by the attorneys represent- . ing the ViJ_lage during the month of September was spent preparing and trying ordinance violations and traffic cases.
