P,4eeting was called to order at 8 p. I'.'L, the follovring Council ~,Zembers being
present: Harold C. Nilsen ',?ayor; George J. Shavor, Trustee; Millis ~~~rarkentien,
Trustee; Charles °. Stone, Trustee. Also present were David P. Cartwright,
Chairman of the Manning Commission; I~~, J. Galvin, Village Attorney; Ethel
E. 45'hite, T~eputy Clerk and Deputy Treasurer and. ?5 residents. Absent: V1. A.
ZJlortenson, Clerk.
Nilsen read portion of t.~inutes of Special Hearing of December 7th, setting a
continuation of the Hearing for 8:00 P. ?.~i. December ?_lst, and introduced David
P. Cartwright, Chairman of the planning Commission.
Cartwright displayed the revised, proposed zoning map and explained permitted
uses in the various classifications. He stated they had considered the petition
presented at the bast meeting, also the proposals made, and they and the Planner
had agreed on the revisions shown on the map displayed tonight and feel it is a
reasonable compromise for the land now zoned "Farm Residence." and "'Single
Family Residence." They had considered the proposals made by the oil industry
and agreed to permit them to use Pylon signs 12' high instead of 16' but could
not go along vt~ith them on their other sugges+.,ions. They changed the procedure
for obtaining building permits and h°ve made it mandatory ±,hat all permits in
B-1, P-2, and R-3 districts be referred to the Council. The Planning Commissior.
recommended that the Council adopt the map displayed as the Official Zoning 'slap,
also the Zoning Ordinance and Comprehensive Land Use plans as submitted tonight.
':Iayor Nilsen asked if there vrere any questions regarding zoning East of Snelling.
There were none. Nilsen asked `.f there were any questions regarding +.,he B-lA
land South of Larpenteur. There were none. He then asked if there were any other
questions.
Schwantes, V;hat is the proposed width of the R-3 and. R-2 strips?
1815 Fairview. Nilsen: 230' along Fairview t.o the edge of i~1rs. Sommers'
south lbt line, the first one North of Larpenteur on Fairview.
Schwantes: ti'trould the proposed R-2 stria be the same width? Nilsen: It
would go as far North as the North property line of Emil
Anderson's and then carry on :est and would take in lots 12
and 13 of Labalestra Park although lot l~. is in the R-3.
F. Lauer: ti~Jhat is the propsoed access for the R-2 area? Nilsen:
Possibly a street running North from Larpenteur. No access
on to Tatum.
Lindig: I have a question about that 33'. Nilsen: It straightens
out the line.
Lindig: ti'Ihat is the zoning on those 33'? Cartwri~hts You can use
either zoning within 50' of a zoning line.
Emil Anderson: ~:y home will be due East of the R-2 going North. This, I
feel, will have some effect on the value of rqy property.
This is only going to protect those homes that are not there
at present. I think it should be zoned R-1. Further East,
it is zoned R-1 right after R-3. I don't see any reason why
there should have to be R-2 between R-1 and R-3. I cannot

see why we should be protecting homes that have not
been built and not protect those that have been there
a long time.

Cartwright: You can have either R 1 or R-2.
.Anderson: VJhy is it there ~t, all? I do not like it.
Gartrvright: This eras intended as a compromise to eliminate the building
of apartments and to permit 1 or 2 family homes. I don't
think having single family residences next to rental dis-
tricts is harmful to be+,ter residential areas.
`?rs. Ohnstein, ti~Jhy doesn't the line go right through from Tatum to
17lr2 Tatum Fairview R-3 and then R-1? Nilsen: The Vest side of
Tatum seems to lend itself to that.
'~~rs. Ohnstein: How deep is it? Nilsen: 4pproximately ?_80' to the North
end of the Gasparro property on the ti"pest side of Tatum.
Lauer: Z`e'hat is the zoning of this area at the present time?
Nilsen: Residential District A on Tatum from Larpenteur
North to the back of the property abutting Tatum on the
~r`rest and between Tatum and Fairview except part of
Lindig's.
Lauer: That. was my impression when I bought my property. I
think the R-2 zoning would penalize my property as well
as Emil Anderson's.
'ors. Sommers; ti'~'hen ~rre bought we understood t.,hat there might be a duplex
on the corner. Apartments would. hurt my home. Nilsen:
The size and number of apartments would depend on the size
of the property. ti~re will see that there is no over-crowding.
Tdrs. Sommers: V,jhat are the rules for set-backs? Nilsen read zoning
restrictions covering set-backs and parking.
~:1r.s. Sommers: ~:4aybe they will build closer to the street than our house
is built. Cartwright: the set-backs will ha~re to conform to
the existing set ~~ack.
~:2rs. Sommers: ,'w'hen ~^re bought, vre unders+,,ood it vrould be residential. Is
that 20' set back from my house? Nilsen: From your property
line. It could be put to R-2 use.
'.4rs. Sommers: If you put duplexes back of us and apartments on Larpenteur,
we would be surrounded by apartments and duplexes. I paid
a lot of money for that home and I don't .giant to be crowded.
out. Cartwright: Before anything can 'oe built in an R-3
zone, the building plans have to be brought before the
Council. No one will be permitted to crowd you out. In

the east, we have had requests for "spot zoning." Our
purpose here is to establish a general plan so you don't
have people come in and build under the old zoning and
then, later, have someone come in an try to put up a
building that would be objectionable. Again I say R-3
or R-2 is a compromise, In all honesty, we feel, after
spending two years stud~ri;ng this, that the proposed zoning
is right; that it vrill hurt fewer people than having people
come in for snot zoning month after month.
Jaros, 178 Tatum ~fi11 there be off-street narking requirements on all
apartments? Nilsen: Yes, 1-1/3 narking spaces per unit.
Frank Irving, I would like to know more about the double bungalow concept.
17115 Tatum: Do we ha~.~e any in the Village? Does the code control the
size, value and design of these structures? Nilsen: Besides
the apartments, all the buildings on the North side of
Larnenteur, between Arona and Pascal, are double bungalows
except some single family residences near and. to the
Pascal corner. Shavor: Some cities and villages have
clauses tha+., Hermit consideration of the aesthetic features
and we are planning some changes in the building code which
should give us some control. Calvin's Z"e are aut'rorized to
set certain standard as to size, height, building materials,
and manner of construction. Crofts ldost of the Cities and
Villages have minimum requirements on room sizes so if a
double bungalow is going to be built, it vron't be so small,
it won't be suitable. I don't think we cal have an ordinance
that says you can't build a duplex on R-2 property.
Cartwright: All plans have to be submitted. to the building
inspector, and I suppose you check with the neighbors.
Croft; Yes, if I think +,here is any question.
~3ianchi: Can we place a monetary restriction on double bungalows, say
nothing can be built for less than 930,000.00? Galvin: It
can be done but L~ahlgren doesn't particularly recommend that
because of fluctuation; shell building (Vthere a person has the
main ':wilding done by contract and finishes the inside himself,
thereby reducing the cost considerably) or some-one at the
University may design something that could. be built for
45,000.00 but would still be acceptable.
Schmiege, tiF!ha+., effect does this have on existing buildings? Cartwright:
1739 Tatum. If there is a building on the property worth :1,000.00 or
more, the building can be used for it's present use. It
can be rebuilt in case of fire or storm damage. It .cannot
be down-graded or expanded.
Schmieges I would be in favor of R-1 rather than R-2 abutting the R-3.
Is there any advantage to the Village such as a larger tax
base on P~-2 property? Cartwright: Yes. However, that is not
the purpose of the R-2 zoning. ode °elt it would serve as a
buffer, but it seems there would be no problem.

I think introducing rental properties would down-grade the
Vi::.1aF.e as a whole. I think the property on the corner of
Larnenteur and Fairview should be made R-2.
I own that corner and I would object to R-2.
Lauer: I think the people who bought and built their homes under
the impression that the prox~erty v4~as R-1 v-ould be Haying a
penalty. T +hink the corner at Fairvietiv and Larnenteur
should be R-2. That vrould at least give them some buffer.
Schwantes: I don't see any objection to the R-2 on the Greenhouse
property.
Janos: i~dhat was the reason for changing tha±. street and bringing it
in on Tatum? ti'hy couldn't it go straight to Larnenteur?
Nilsen: I feel that it was a mistake +„hat Crawford wasn't
extended to Fry years ago. Novrvre have heavy traffic going
through ;Taple Knoll. I feel vre should have a street
system that wi_l enable traffic to move without injuring
residential areas. Labalcstra: V;e have a 12' walkway on
my lots. .Nilsen: ~TTe have hid other walkways in the
Village and have b.en petitioned by +.,he property ov~~ners to
have them vacated. u,re haven't been able to vacate them rut
we have put traffic restrictions on them. That is the
best we can d.o until we have sidewalks on Larnenteur.
Curtis Larsen, Regarding the East and ti~est Street, I am representing a
1885 Tatum: group that. feels vre need an access to the playground area.
so tha+., vrhen children ~f~ant to skate in the winter time,
they will not have to :~ralk so far nor on the Heavily
traveled streets. I think it might be desirable to have
access to that ska±ing rink farther North.
Janos: ~lthen you nut in a nevr street and someone finds+hat, because
of it, he is on ? corner lot, do his taxes go up?
Nilsen: Yes, but on assessments for water and. sewer vre
have charged for just the frontage. Sidewalks and curbs,
if put in, would be assessed for depth and width of lot.
Emil Anderson: This 33' niece of land that Lindig owns, next to ?=qrs.
Sommers' property, is left out of the prey ent zoning?
Nilsen: The ordinance ca~_ls for ~0' variance one vray
or another. It could fell v~ri±,hin R-2 or R-l. An.~erson:

sides and I would like to continue to have them around me.
Labalestra: Yes I agree vlith that. T~ihy don't you extend the line the
same depth across to Tatum and knock off the R-2?
Lindig: I vjill go along with the R-2. You need a buffer between
R-3 and R-l. v"~'ho is going to build next to R-3? Nilsen:
R-2 from Tatum? I think R-2 is better than v;hat is ~~est
of Tatum now.
Cartwright: I think most of the embers of the Planning Commission are
still here. I think we could convene and resolve ±his
problem this evening.
Nilsen, resole- I move that the R-?_ from Tatum to Fairview be referred to

Nilsen ca~led a 15 minute recess.
T,geeting resumed. Cartwright: ti?e have agreed we will take out the R-2 district
and at the same time the R-3 line ti~•i:_1 be moved up so it
bi-sects the Lindig Greenhouse by projecting the North R-3 -
line on the u~est of Tatum to the East to a point about the
East of the Greenhouse. The Planning Commission recommends
acceptance of the corrected zoning man.
Nilsen: ~','e have discussed this at some length this evening. The
Planning Commission has studied it for tyro years, they held a
Public Informational Hearing, the Council held a Hearing
December 7th and this meeting tonight.
Lauer V~hv does the R-3 line bisect a lot on the North? Nilsen:
The property ovme_^ asked for it. He intends to use about a
lot and. a half for himself. Plant: The lo+, lines do not
coincide ~;ast and wsrest and ti~re have tried to straighten them out.
Lindig: You still don't have a buffer 'oetween R-3 and R-1. Shavor:
Nick will furnish tha-t. Nilsen: It is a questionable thing
in certain areas. There are a lot of things desirable but
not necessary. Vie have other areas where we have R-3 anc' R-1
without a buffer strip. U~'e '- az.e had a recommendation from
the Planning Commission and it is my opinion that we should
abide by the decision of the Planning Commission which seems
to be a reasonable solution to the problem.
Resolution:
Nilsen moved adoption of the following resolution:
RESOLtTED that Ordinance No. 61~ be adopted as recommended
by the Planning Commission together with the zoning mab of

the Village incorporated therein by reference.
