M., the following Members of the Council being presents Willis Warkentien, Acting Aitayor; W. A. Mortenson, Clerk; C. P. Stone, Trustee. Also present w:~re M. J. Galvin, Village Attorney; Wm. E. Olsen, Treasurer; Brad Lemberg, Engineer; and Ethel E. White Deputy Clerk and Deputy Treasurer. Absents George Shavor, Trustee. Pdayor Nilsen arrived at 8s05 as previously arranged. It was moved by Stone, seconded by Warkentien and voted that the Minutes of March 21st be approved as submitted. Licenses All requirements having been met, it was moved by Warkentien, seconded by Stone and voted to issue Master Plumbers License #78 to Geo. B. Waterman, 1l~91 No. Hamline Avenue, St. Paul, Minnesota. Bus Service: Notice from the Railroad and'~rarehouse Commission advising that the Hearings on the Curtailment of Bus Service have been post- poned indefinitely was read and filed, Unemployed Governor Andersen's letter of March 16th, advising that he was Youth: calling a Statewide Conference on Youth Employment and Training for Ahonday and Tuesday, April 23rd and 2l~th, at the Leamington Hotel in Minneapolis, was read. A member of the council will attend if possible. Barthel Letter of April 3rd from D-~uglas, Sheets and ~3e11, regarding lots Villas: 13, 11t, 20 and 21, Block 1, Barthel Villas, was read. The Deputy Clerk was instructed to advise them that the situation has not changed. If they wish to present their case to the Council, they may call the Deputy Clerk for a Hearing any Council Meeting Night at 8s30. Regular Council Meetings are held'the 2nd and ltth Wed- nesdays of each month. Fire It was moved by Stone, seconded by Warkentien and voted that the Schools Village authorize Don Schoen, Stan Schultz, and A1. Helbig to enroll at the Fire School April 23rd to 26th, the Deputy Clerk to send a check for their registration fees to the University of Minnesota. Boy Scouts: Letter of appreciation from L. Edson Tribble, District Executive of the Indianhead Council 295 Boy Scouts of America for the use of the Village Hall, Adarch 30th, was read and filed. Office It was moved by Warkentien, seconded by Stone and voted to approve Supplies: ordering 3 thousand #10 Mailing Envelopes, Sub. 21~, white wove density, at X9.63 per thousand, from Northern States Envelope Co. League of Letter from the League of Minnesota Municipalities regarding the il2inn. Mun.: Clarence C. Ludwig Memorial Fund was read, members of the Council to do as they see fit. Safety The 1961 Traffic Safety report was referred to Police Commissioner, Reports Don Arndt.. 1739 Street It was moved by Stone, seconded by ~varkentien and voted that Sweeping: McPhillips be engaged at 115.50 per hour to do the necessary street sweeping and that the Village Engineer be .instructed to order the work done at the earliest possible moment. Street Engineer Lemberg will make up a map showing which streets are Maintenance: Village Streets, County Roads, State Highways and Municipal State Arid Streets for use of the men who are doing street maintenance work. Chain Link Engineer Lemberg advised they had let out 5 sets of vlans Fence: for the Chain Link Fence to be constructed a.t the Idaho- Snelling Playground and Ponding Area. Land Use It was moved by Stone, seconded by Mortenson and voted to Plans approve the following resolution: WHEREAS, the Village of Falcon Heights has retained a Vi~.lage Planning Consultant, and said Planning Consultant has recommended a Land Use Plan and Street Plan for adoption by the Vi7.lage of Falcon Heists, and WHEREAS, the Village Consulting Engineers have reviewed the Land Use Plan and Street Plan and made such recommendations that are consistent and rec}uired by local engineering and construction problems, and WHEREAS, said future Land Use Plan, dated the 2ltth day of February, 1962, has been submitted to the Village Council of the Village of Falcon Heights, together with a Street Use Plan dated February 2~, 1962, and WHEREAS, said future Land Use Plan and Street Use Plan, copies of which are attached hereto and made a part hereof, are hereby approved by the Village Council of the Village of Falcon Heights; NCW THEREFORE, BE IT RESOLVED: (1) That the future Land Use Plan and Street Use Plan are hereby adopted by the Village Council of the Village of Falcon Heights. (2) The Clerk is hereby instructed and directed to file and maintain copies of said plans in the Village Office, 16l~1~ W. Larpenteur Avenue, and to publish notice of a public hearing to be held R4ay 9, 1962 on the Street Plan, said notice to appear at least ten (10) days prior to the date of hearing in the official Village newspaper, and said notice to state that the hearing will commence at $ p. m. in the Village Hall, . 16l~l~ West Larpenteur Avenue, St. Paul, 13, Minnesota. Mayor Nilsen arrived at this point. 17l~0 Sewer Stubs It was moved by Stone, seconded by Mortenson and voted to damaged by approve the following resolutions Herbst: WHEREAS, the Village of Falcon Heights has previously commenced a law suit in District Court in and for Ramsey County against Herbst Construction Company, 8180 Eastwood Drive, Minneapolis, 21, Minnesota for alleged damage to it's Sanitary Sewer System by disrupting such sanitary sewer system by cutting a sewer line, and WHEREAS, the Herbst Construction Company have offered the sum of X1500.00 {fifteen hundred dollars) as a compromise settlement - of the claim of the Village of Falcon Heights, axed WHEREAS, upon the full review of all financial records and in- formation, the Village of Falcon Heights damages are limited to to approximately $1500,00 (fifteen hundred dollars) NG~V' THEREFORE, BE IT RESOLVED that said claim against Herbst Construction Company be fully settled upon payment of the Maryland Casualty Company of the sum of X61500.00 (fifteen hundred dollars), and that the Mayor and the Clerk be authorized and hereby directed to execute such releases, dismissals and any other documents necessary to compromise such claim, and the Village Attorney is hereby directed to dismiss said claim upon payment of said X1500.00 {fifteen hundred dollars}. It was moved by Stone, seconded by Warkentien and voted to accept the X1500.00 (fifteen-hundred-dollar) check from Maryland Casualty Company, to deposit same in the General Fund, and that 4k1000.00 {one thousand dollars) of the funds still remaining in the Larpenteur Avenue Waterma~,n & Pumping Station Construction Fund be released to Herbst Construction Company. Traffic Lemberg suggested that Al Helbig take care of the Traffic Counters. Count: Lemberg will e~ive Helbig instructions. Sinking Inventory of '3onds, Sills, and Notes held in safekeeping for the Funds: various Si.nkingFunds was received from the First National Bank. The Original copies were given to the Treasurer for con- firmation, signature, and to be returned to the bank. The dupli- cate copies to be filed in the Clerks office. Police Car: Clerk Mortenson read Ad for bids as published in the Rose Tribune. One bid was received from Midway Ford Company. The following reso- lution was offered; Pursuant to an advertisement for bids for the purchase of a 1962 police car in accordance with the resolution adopted March 21, 1962, and pursuant to statuatory notice being published on r4arch 29, 1962, bids were received, opened and tabulated according to law, and the following bid was received complying with the adver- tisements Midway Ford Company, 1850 University ?venue, St. Paul, I~, Minn., 17111 1 - 1962 Ford Galaxie Tudor, Police Guardian Special, complete to attached specifications 562727.00 Lesss 1961 Ford ("As-Is" condition), SN 1P31W13947? 1100.00 Net cost 1627.00 Delivery 30 to 45 days. Bid was accompanied by a Certified Check in the amount of $300.00, and WHEREAS, it appears that Midway Ford Company, 1850 University Avenue, St. Paul, !~, Minnesota, is the lowest responsible bidder NOW THEREFORE, the Mayor and ~~lerk are hereby authorized and directed to enter into a purchase agreement with Midway Ford Company of St. Paul, in the name of the Village for the t~ur- chase of said Police Car according to the specifications a~?oroved by said Village Council. (2} The Village Clerk is authorized to hold the deposit of the successful bidder until such purchase agreement has been executed. The above resolution was moved by Warkentien, seconded by Stone and carried. League of 'It+PO representatives of Unit 3 of the League of Women Voters Women were present. Mayor Nilsen advised them that Leo J. Fleet, Voters: Falcon Heights' Director of Civil Defense, would like a state- ment from the League of Women Voters up-holding Civil Defense which he could incorporate into a letter he intends to send to each home-owner in the Village. Mrs. Johnson said she would take the matter up with Mrs. Jenkins who is to take office as President of the League of Women Voters and she is sure P~tr. Weet will hear from Mrs. Jenkins. Audit: Mortenson movedthat the Village engage the firm of Haskins- Sells to make an examination of the Village Books for the year 1961, and that. they begin the examination April 16, 1962. Seconded by Stone and carried. Grade, Mr. Bruncke's letter regarding the grade of Albert Street, Albert St. and correspondence from the engineers pertaining to same, was turned over to Attorney Galvin. Smoke- It was moved by Warkentien, seconded by Stone and voted that Eater: the subscriptions to the Smoke-Eater be continued for those individuals listed. Traffics Mr. 'gown who lives at Asbury and Garden was present to re- quest that the Council do something to discourage the flout and seed of traffic on Garden Avenue which he says has doubled in 17l~2 the two years he has lived at his present location, and is dangerous to children. He feels more "Stop Signs" would be in order. '~arkentien advised the placing of additional stop signs on Maple Knoll did not decrease the amount of traffic, but did slow it down. Mayor Nilsen said a Traffic Study was scheduled for July. The Deputy Clerk was instructed to con- tact Engineer Lemberg regarding the traffic count on Garden. It may be necessary to send the Health Inspector over. The Village has made Hanson a final offer of X5300.00. Dogs: The Deputy Clerk was instructed to ask the newspapers to print a news item advising that dog licenses are due and that the dog catcher is coming into the Village and will pick up all unlicensed dogs.
