REGULAR MEETING MAY 23, 1962.
Meeting was called to order at 7;10 P. M., the following Council Members being
Aresent: George J. Shaver, Acting Mayor; Willis ~"~arkentien, Trustee; Charles
P. Stone, Trustee; W. A. Mortensen, Clerk. Also present were M. J. Galvin,
Village Attorney; Brad Lemberg, Village Engineer; Vdm. E. Olsen, Treasurer; and
Ethel E. White, Deputy Clerk and Deputy Treasurer. Absents Harold C. Nilsen,
"Mayor.
Tress: Report of tree damage by Roy Smith, 1765 No. Arena was referred
to Engineer Lemberg.
Parks and Notice of the meeting to discuss parks and. playgrounds, to be
Playgrounds: held at the New Brighton Village Hall rMay 2!~ at 8 P. hM., was
read. No one on the Council was free to attend.
Ramsey County Shavor moved that ~1. A. Mortensen be named Falcon Heights'
League of Official Representative to the Standing Legislative Committee
??unicinalities: of the Ramsey County League of Municipalities. Seconded by
Stone and carried.
Cross walk: James Corson, 1697 No. Fry, appeared to call attention to the
fact that the cross walk was not kept up in accordance to
state standards. The matter was referred to Engineer Lemberg
who is presently studying it in connection with a traffic elan
for the business section at Larrenteur and Snelling.

Study:
Shavor advised that the Council had taken no further action and
were pre-disposed to terminate the hearing.
Vlarkentien moved that the hearing be terminated without action
by the Council on the Street Use ?'lan. Seconded by Mortensen
and carried.
J. 'iacGregor: ~!Tha.t is the difference between the Land Use Plan and Street
Use Plan?
Galvin: The Land Use Plan is an over-all plan for the entire Village
which includes not only the area under discussion at this time
but the entire Village. 3efore the hearing, it was the inten-
tion to file the Street Use Plan with the Registrar of Deeds
so it became a part of the Public Record. The Land Use Plan is
not filed with anyone except the Village.
Shavers The Public Haring on the Street Use Plan is hereby terminated.

There has been a "hold" on your lot, but with the Street Use
Plan completely aban~?oned, I can see no reason for continuing

".Rrs. ~~. Young- I would like to know what can be built on my lot. They tell me
per: I have to have a 90 foot frontage before it can be used for
multiple dwellings. ~~1y lot is not that wide. She was told
she could continue to use it as a residence until such time
as some developer might approach her with a proposal to buy
her lot and other property sufficient to enable him to con-
struct his proposed project. A+,torney Galvin advised her
that the Council did not iniate these proposals. All they
did was review the proposals submitted to see if they com-
plied with regulations. P~Irs. Youngner then said she felt
she had been injured, and. would like to know what could be
built on her property. She eras advised the Council ~.aould
check and report to her later.
J. Bianchi, Zhe zoning map shows a 30~ set back from Fairview. The

Attorney Galvin who will report back at the next meeting,
June 13th.
Sanitary Attorney Galvin reported he had received a letter from Hanson's
Sewer, Harvey attorney advising that, in the process of hooking up to the
Hanson: sewer, they had run into problems which led to inconvenience
and damage to the house for which Hanson feels he should be
compensated.
Engineer Lemberg reported tha± it was due to Hanson's ovm
neglect to contact reco^imended plumbers that he vras without
sewer service as long as he was. He did nothing to mitigate
the damage or improve the s9..tuation. He had been advised
that, through his negligence, he tivas permitting a condition to
continue that might lead to a serious health problem.
Stone moved that a±torney Galvin be instructed to deny +.,he
claim. Seconded by Z'iarkentien and carried. At±orney Galvin
has referred the claim to the Village insurance company in the
interim.
Sanitary Sewer, The Deputy Clerk was instructed to call those people who have

Voting .Pre- There was a discussion regarding dividing the present Precinct 1

Cleveland, South side of Roselawn and North side of Larpenteur
to continue to vote at the Village hall. The balance of the

Northwest Greenhouses, at one time known as the Gibbs-1~?elson
Greenhouses, located on the South side of Larpenteur and about
a block 'dVest of Gleveland Avenue for the final election this
coming Fall. ~,Rr. Galvin will complete arrangements with the
University of ?~dinnesota.

Albert Attorney ~'Talvin reported on H. P. ~'runcke's claim. Stone
Street moved that Galvin be authorized to deny the claim of negligence.
Grade: Seconded by rkiortenson and carried. Tdr. Galvin has referred this
claim to the Village insurance company.
Idaho-Snell. Vdarkentien and S+.,one will r~~et Lemberg on location and determine
Perm. Imp.: placement of Hockey and Free skating rinks. Lemberg also dis-
played plans for fence and discussed relocation of gate.
Dogs: There was a discussion regarding passing a resolution, as per-
mitted under the pr: sent dog ordinance, enforcing a leash laar
from April 1st to September 30th. The ma+.ter will be acted on
at the next Council meeting, June 13th.
