Olsen, Treasurer; and Ethel E. ~`~hite, i~eputy Clerk and Deputy Treasurer. On motion by Stone, seconded by Shavor, it was voted to approve the ?~?inutes of i;~ay 9th as submitted. LICE_n?SI.S: On motion by Nilsen, seconded by Shavor, it was voted to annrove the following licenses to sell at retail Cigar- ettes, cigarette paper, and cigarette wrappers. pioneer Vending at Shell Oil Co., Larpenteur & Albert. Audit: Letter of July 10th from ?~4r. ~=.ginning of Haskins & Sells was read. It advised that r:4r, Olsen indicated that for the present the office of the State ?ublic Examiner would not take exceptions to the records currently maintained by the Village but reserved the right to take a different posi- tion after the Village becomes larger and it's operations more complex, He did indicate that he felt that the Village should maintain a memorandum record showing the compa§ition of it's fixed assets and receivables. Weeds: Inspector Wm. P. Carroll advised they were proceeding with the weed cutting on the Julia and Art Lindig properties. HeT~tes Business Complaint that water from the roof and alley of the Hermes Property: Business Property is draining into the abutting yards on St. `.?cry's, and that the dust from the parking lot is a big 1777 problem was read. The Clerk was instructed to write R4r. Hermes regarding the^iat;ter. Traffic: Letter from James Gillesuie; Pine City, :Minnesota was read and referred to Police Co~unissioner Arndt. Clerk ivas instructed to write Pair. Gillespie thanking him for his letter. Sidewalks: Paul Coppinni was present and. urged that the Council iniate action to h-eve existing sidewalks on F~oyt Avenue repaired or replaced and to have sidewalks installed where they do not already have them. Engineer Lemberg was in- structed to make a survey and present his recommendations to the Council at the next meeting. Coppini also reported many burning violations in the ItiTOrthome area. The mat+er will be reported to the Police Department with instructions to issue citations to violators. Curb and gutter: Stan Seaborn, 1>1?_3 W. Iowa, presented the Council with a petition for the instal~.ation of curb and gutter on one block of Iowa and. sug~°ested that the Council hold up the matter until they could iniate a program for the in- stallation of curb and. gutter for all streets in the Village. After .consideration, the Council feels that it is best to go ahead v~rit;h the Iowa Avenue project now inasmuch as many of the residents are anxious to have the curb and gutter installed this year. Sipes property: John T,iacGregor, 1795 Fairview, was present. He said the people on Fairview favor a ~0' set-back from Fairview if an apartment is built on t;he Sipes property. Attorney Gal~rin reported he had talked to Howard Dahlgren, the planner, who feels the 30' side yard when abutting a street is adequate, and that a requirement of 50' would constitute about 1~3 of Sipes property and might lead to a law suit which the Vills,ge might lose. P.iacGregor asked the Council to consider the problem of traffic on the corner of Fairview and Larpenteur. I~Iilsen advised PaacGregor that, at present;, we do not have any plat plan, or any application for a building permit. ~~~e have simply heard that the construction of an apartment on the Sipes proper- ty is being considered. Cross walk Letter of June ?9th, from A. D. Crampton, was read, in part, lighting: as follows: "P~~ir. Chenoweth, safety director, Ramsey County, can find no objection to the installation of the flashing yellow lights because they indicate caution only and have nothing to do vrith the control of movement as faF as a signal is concerned. They reco~?merd lights be placed on mast-arm type brackets that would extend over the roadway from either side of the road. '?lwo amber lights should be mounted on each a.rm so approaching traffic would have no difficulty seeing them. It is estimated that an installa- tion of this tT-pe would. cost approximately X2,000.00. 1778 Action was deferred until the last meeting in September, it being the feeling that the sable results could be obtained by running a cable across the street with a flashing amber light suspended therefrom. Signs: Shavor moved that Huber Sign Comt~any be issued a permit for the alteration and moving of the sign at Shell Oil ' Company, La.rpenteur and Albert, to a more restrictive non-conforming use under section l~.3 (!~) of Ordinance blt. Seconded by ~>»rkentien and carried. Curbs and Gutters, On motion by Stone, seconded by Shavor, it was voted to Iowa. adopt the following resolution ordering preparation of report on improvement: WHEREAS, it is proposed to improve Iowa Street between Hamline Avenue and the Snelling-Idaho Bonding Area by the installation of curb and putter, and to assess the benefited property for all or a portion of the cost of the improvement pursuant to Adinn. Stats., Secs. I~29.011 to !~?_9.111 (Laws 1Q53, Ch 398, as amended), NCW TF?EREFORE, BE IT P,ESOLVED BY `?'HE VIL£.AGE COUNCIL OF FALCON HEIGHTS, ^~INPd,SOTA: That the proposed improvement be referred to Bonestroo, Rosene ~C Associates for study and that they are in- structed to report to the council with all convenient speed advising the council in a t~reliminary way as to whether the proposed improvement is feasible and as to whether it shoultd best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as reco~rnended. Lee requested a variance on his property located at the Southeast Corner of L=~rpenteur and rairview. He was given standard "Variance" blank which he will fill out and return to the Council. Justice of peace V'darkentien moved that Clarence ??ekstad be authorized to Bench: proceed with the construction of the Jus±,ice of Peace bench as per specifications he submitted in a neat, workman- like manner at a price of X368.00. Attorney Galvin reported he had received hi owners p report Report: from the St. Paul Abstract Company which showed Roberts had bought 110' abutting Larpenteur Avenue from Carroll and Sipes. ''_'his leaves Sipes about 158' and Carroll 61'. 1779 Stone moved that Attorney Galvin be authorized. to draft a Sub-Division Ordinance. Seconded by Shavar and carried. The hydrant for which St. .Paul billed us for repairs belongs to the University of '"~innesota a.~d St. Paul will bill the University of ~~linnesota. Swimming Pools: Nilsen moved that, the Attorney be instructed to prepare an amendment to Ordinance No. ~~ making swimming pools a plumbing fixture. Seconded. by Shavor and carried. Investments: It was moved by Prarkentier~, seconded by Stone and voted ', to purchase with funds in the b"Jatermain Imnrovemert I, 1960 No. 1 Sinking Fund approximately three thousand ', dollars worth of Treasury Sills, bearing 2.82 interest, to mature August 30: 1962, and that the First National Bank be instructed to hold them in Safekeeping for the Village Also to purchase with func's in the Sanitary Sewer Imnrovemen t No. 1 Sinking Fund approximately five thousand dollars vrorth of Treasury Bills, bearing 3.02% interest, t mature January 3, 1963, and that the first P~lational Sank be instructed. to hold them in Safekeeping for the Z~illage.
