Home My WebLink AboutCCMin_86Jul9MINUTES REGULAR CITY COUNCIL MEETING JULY 9, 1986 ~~ A regular meeting of the Falcon Heights City Council was called to order at 7:00 P.M. by Baldwin. PRESENT All members present, Baldwin, Wallin, Hard, Ciernia, and Chenoweth. Also present was Barnes. ADDENDUM TO CONSENT AGENDA Baldwin moved, seconded by Chenoweth, addition of the July 9, 1986 Planning Commission Minutes to the Consent Agenda. Motion carried unanimously. CONSENT AGENDA Ciernia moved, seconded by Hard,°approval of the Consent Agenda. Motion carried unanimously. MINUTES OF JUNE 25, 1986 Hard moved, seconded by Wallin, approval of the Minutes of June 25, 1986. Motion carried unanimously. VARIANCE GRANTID TO CRAIG SCHAUFFERT, 1885 N. SNELLING Chenoweth moved, seconded by Wallin, approval of a variance request from Craig Sehauffert, 1885 N. Snelling, to construct an extension to the existing garage 5 Peet from the property line as recommended by the Planning Commission. Motion carried unanimously. VARIANCE GRANTED TO GERALD WALLIN, 1859 N. SNELLING, CONTINGENT UPON UNIVERSITY OF MINNESOTA APPROVAL Hard expressed concern that Wallin~s request to place a second garage not less than one foot from the north property line was too close to University property in the event the University land is ever developed. He also felt run off Prom the garage roof would go onto the adjacent property, and asked if the University had been made aware of the proposed structure. Wallin explained he had chosen the site as the structure would be least visible to the neighbors, and he anticipates placing it two to three feet fra~m the property line. Following the discussion Chenoweth moved, seconded by Ciernia, approval of the variance request contingent upon unconditional approval by the University oP Minnesota. Upon a vote being taken the following voted in favor thereof: Baldwin, Wallin, Ciernia, and Chenoweth, and the following voted against the same: Hard. Motion carried. 7:15 - PUBLIC HEARING ON SUBDIVISION REQUEST FROM SPING LIN, 1785 FAIRVIEW, AND IRENE MACGREGOR, 1795 FAIRVIEW - CONTINUID TO 8/13/86, 7:15 P.M. Baldwin opened the public hearing on subdivision requests from Sping Lin, 1785 Fairview, and Irene MacGregor, 1795 Fairview, at 7:15 P.M., presented the Affidavit of Publication, and explained it is not possible to go forward with the hearing as the matter has not been heard by the Planning Commission, and the petitioners have been unable to resolve the purchase of the one foot of land which is necessary for installing improvements to ~~ MINUTES REGULAR CITY COUNCIL MEETING JULY 9, 1986 PAGE 2 1 the area to be subdivided. IRENE MACGREGOR, 1795 FAIRVIEW, stressed that all parties are interested in going ahead and requested Council continue the hearing to a later date. Following a short discussion Chenoweth moved, seconded by Wallin, continuation of the hearing to August 13, 1986 at 7:15 P.M. Motion carried unanimously. SUBDIVISION AND REZONING REQUEST FROM CLEON GARLEY, OWNER OF APARTMENTS AT 1845, 1855 W. LARPENTEUR, REFERRID TO PLANNING COMMISSION, PUBLIC HEARINGS SCHEDULED Mr. Garley explained the apartments are short on parking spaces (44 stalls for 34 apartments), many of his tenants have received parking citations, and for that reason he has arranged to purchase abutting property presently owned by the resident at 1708 Lindig for 18 additional parking spaces. Following a discussion Hard moved, seoonded by Chenoweth, referral of the subdivision request to the Planning Commission. Motion carried unanimously. Chenoweth moved, seoonded by Hard, scheduling of the following public hearings: 1) Hearing before Council on Subdivision „ August 13, 1986, 8:00 P.M., 2) Hearing on Rezoning before Planning Commission, August 4, 1986, 8:15 P.M., and 3) Hearing before Council on Rezoning, August 13, 1986, 8:15 P.M. Motion carried unanimously. REQUEST FROM SCHOOL DISTRICT 623 TO PLACE PORTABLE CLASSROOMS AT F.H. ELEMENTARY SCHOOL APPROVED WITH CONDITIONS Paul Borg, representing the School District, explained their reasons for placing the structures to the west and north of the school, that they hope to construct a protected walkway from the portables to the permanent school structure, and that the Planning Commission approved placement in the northwest area. Council discussed the preliminary list of requirements prepared by the City Fire Marshal, parking, traffic, safety of the children moving from the temporary classrooms to the permanent structure, and the desirability of placing a time limit on the temporary buildings. Following the discussion it was decided no variance was needed as the structures will be more than 50 feet from the lot line and the moving in of the structures will be governed by Section 9-2.02, Subd. 10 (Relocation of Structures). Hard moved, seconded by Wallin, approving moving in the buildings contingent upon compliance with. the city code, fire codes, approval by the building inspector and fire inspector, an appropriate parking/access plan, and limiting the term of permit to August 31, 1988 (the 2 year limit was recommended by the Planning Commission). Motion carried unanimously. 8:00 P.M. PUBLIC HEARING ON CODE AMENDMENT RELATING TO HOME OCCUPATIONS At 8:00 P.M. Baldwin opened the public hearing on a proposed code amendment relating to home occupations (employment) and presented the Affidavit of Publication. There being no one wishing to be heard Baldwin closed the hearing at 8:05 P.M.. Hard moved, seconded by Chenoweth, adoption of Ordinance No. 0-86-14 as approved by the Planning Commission. Motion carried unanimously. 55 MINUTES REGULAR CITY COUNCIL MEETING JULY 9, 1986 PAGE 3 ORDINANCE 0-86-13 AN ORDINANCE AMENDING SECTION 9-14.01, SUBD. 25, HOME RELATING TO HOME OCCUPATIONS REQUEST FOR REIMBURSEMENT FOR MUFFLER REPLACEMENT FROM MAR% F. SUPPES, 1885 TATUM Baldwin presented a letter from Mark Suppes, 1885 Tatum, requesting the City reimburse him the amount charged for muffler replacement ($53.69) as he alleged the damage was caused by improper construction of his driveway. Following a discussion Chenoweth moved, seconded by Wallin, that Mr. Suppes be reimbursed for 50¢ of the amount as the muffler was five years old. Upon a vote being taken the following voted in favor thereof: Baldwin, Wallin, Ciernia, and Chenoweth, and the following voted against the same: None. Hard abstained. Motion carried. SIDEWAL% ON HAMLINE, IDAHO TO IOWA, TO REMAIN INTACT At the June 25th E.M. Ahlberg, 1340 W. Idaho, and P.M. Kingsley, 1341 W. Iowa, had requested removal of the sidewalk on Hamline running Prom Idaho to Iowa, and Council had directed staff to request input from residents. After reviewing the response from residents (all responders were in favor of having the sidewalk remain) Wallin moved, seconded by Hard, denial of the request Por removal. Motion carried unanimously. ESTIMATE TO BE OBTAINED ON EXTENSION OF HAMLINE SIDEWALK (IDAHO TO LARPENTEUR) Since a number of residents had commented on possible extension of the sidewalk Prom Idaho to Larpenteur, Ciernia moved, seconded by Wallin, that an estimate of costs to extend the sidewalk be obtained for further discussion. Motion carried unanimously. DESIGNATION OF STREETS TO BE POSTED "NO PAR%ING" DURING STATE FAIR Hard moved, seconded by Ciernia, the following streets be posted "No Parking" for the duration of the State Fair: (1) All of Northome Addition, waterside, (2) All of Hollywood Court including alley, (3) St. Marys, Fry, Maple Knoll Drive and Garden Avenue west of Snelling on both sides, (4) North of Larpenteur, between Snelling and Hamline running to Roselawn, except Holton, Albert and Sheldon north of Ruggles, water side, (5) Tatum 1,300 feet north of Larpenteur, (6) Lindig Street on water side including the cul-de-sae, and (7) Larpenteur Avenue from Snelling to Cleveland. Motion carried unanimously. BILLBOARD ORDINANCE U~ATE DELAYED The City attorney has not as yet obtained an opinion from the Attorney Generals Office and will provide information to Council as soon as it is made available. QUOTES ON APPRAISALS FOR SOUTHEAST CORNER OF LARPENTEUR/SHELLING REVIEWED - DAVIS & LAGERMAN, INC. LOW BIDDER Council reviewed and discussed the following quotes: C.E. LaSalle & 5~ MINUTES REGULAR CITY COUNCII. MEETING JULY 9, 1986 PAGE 4 Associates, $17,500.00, Dahlen & Dwyer, Inc., $13,150.00, and Davis & Lagerman, Inc., $8,450.00. Following the discussion Chenoweth moved, seconded by Wallin, hiring of Davis & Lagerman, Inc., contingent upon an opinion from the city attorney regarding any conflict of interest, and checking of references. Motion carried unanimously. TERRY IVERSON APPOINTED FULL TIME FIREFIGHTER/PUBLIC SAFETY OFFICER Council discussed at length the attributes of the candidates for the position, concurred both were excellent candidates, and commented on the fine fob done by the consulting firm. Chenoweth then moved, seconded by Ciernia, appointment of Terry Iverson to the position. Upon a vote being taken the following voted in favor thereof: Baldwin, Hard, Ciernia, and Chenoweth, and the following voted against the same: None. Wallin abstained. Motion carried. SALARY ESTABLISHID FOR TERRY IVERSON Ciernia moved, seconded by Chenoweth, Iverson~s yearly salary be set at $23,000.00 plus fringe benefits. Motion carried unanimously. PRESENTATION OF LATEST SITE PLAN AND REQUEST FOR VARIANCE FOR PROPOSID OFFICE BUILDING AT 201 W. LARPENTEUR David Olson, owner of the property at 2061 W. Larpenteur, presented the site plan and explained that due to the eonf'iguration of the plan a variance will be needed to construct the building ten feet from the west lot line. Following the discussion Chenoweth moved, seconded by Hard, approval oP the variance request (as recommended by the Planning Commission) contingent upon the Clerk/Administrators negotiations on landseaping/land swapping purchase of land/easement to the north. Motion carried unanimously. ENGINEERING PERFORMANCE UPDATE Baldwin informed he and Barnes had met with representatives of Bonestroo & Associates to discuss performance problems, and the firm is now aware the City may make some changes in the delegating of duties on future pro3ects requiring an engineer.
