Home My WebLink AboutCCMin_86Aug13MINUTES REGULAR CITY COUNCIL MEETING AUGUST 13, 1986 A regular meeting of the Falcon Heights City Council was called to order at 7:00 P.M. by Ciernia ~I PRESENT Ciernia, Hard, Chenoweth and Wallin. Also present were Barnes, Schroeder and Schunicht ABSENT Baldwin. CONSENT AGENDA APPROVED Hard moved, seconded by Wallin, approval of the Consent Agenda. Motion carried unanimously. MINUTES OF JULY 23, 1986 APPROVED Hard moved, seconded by Chenoweth, approval of the Minutes of July 23, 1986. Motion carried unanimously. RAMSEY COUNTY ENGINEER TO BE ASKED TO ATTEND HAMLINE ASSESSMENT HEARING Schunicht recommended that Council have the Ramsey County Engineer in attendance at the Hamline Avenue Assessment Hearing since the project is under the jurisdiction of the County and he would have first hand knowledge on any questions relating to construction. Council concurred, and Schunicht will make the arrangements. HAMLINE SIDEWALK WILL NOT BE EXTENDED TO LARPENTEUR TIM HENDERSON, 1341 W IDAHO, stated he was a new resident and was shocked to learn there was to be an assessment against his property for Hamline Avenue improvements and was opposed to a sidewalk being constructed in conjunction with the street project. He felt the sidewalk was totally unnecessary. Ciernia explained that the matter arose when the area between Idaho and Iowa were polled in response to a request to remove the section of sidewalk in that area, and many of those residents indicated they objected to removal and would like to see the walk extended to Larpenteur Avenue. MARVIN DEMARTINO, 1345 W. CALIFORNIA, questioned the installation of a sidewalk which would be three different dimensions, 4 feet to 7 feet to 8 feet, why the sidewalk would end at the California alley forcing pedestrians to walk through the service station drive, felt the walk was unnecessary and was opposed to it. Schunicht explained the sidewalk width must vary due to the widening of Hamline Avenue in some areas, and the walk was not extended through the service station drive as most of the drive is concrete. Mr. Henderson and Schunicht will discuss the possibility of placing a retaining wall along the Henderson property. Following a discussion Wallin moved, seconded by Chenoweth, that the sidewalk not be extended. Motion carried unanimously. 6 ~. MINUTES REGULAR CITY COUNCIL AUGUST 13, 1986 PAGE 2 MEETING LETTER FROM RICHARD TALBOT, 1531 W. IDAHO, EXPRESSING CONCERN OVER PROPOSED REDEVELOPMENT OF SE CORNER OF LARPENTEUR/SNELLING Ciernia explained Council has for the past two or three years been looking at various options to improve the SE corner of Larpenteur/Snelling, there have been proposals by developers, and an appraiser and market study have now been ordered to determine a viable use for the area. RICHARD TALBOT, 1531 W. IDAHO, presented his letter dated July 31, 1986 (a copy of which is on file in the clerks office) and a petition signed by 249 residents opposing any redevelopment of the block bounded by Snelling, Arona, Larpenteur, and Idaho which would displace persons residing therein. He also requested the the citizents advisory committee be re-instituted and offered to serve on the committee. RACHEL ZUBRZYCKI, 1536 W. IDAHO, felt a shopping mall would change the street from a quiet one to a street full of traffic. PAUL BERGE, 1522 W. IDAHO, asked how advisory committes are formed and Ciernia replied the Mayor recommends a list of committee members which must be approved by Council. The Mayor will be given a list of persons previously serving on the SE Advisory Committee together with names of other interested parties. 8:00 P.M. HEARING ON SUBDIVISION REQUEST FROM CLEON GARLEY, OWNER OF APARTMENTS AT 1845 AND 1855 W. LARPENTEUR, TO ALLOW PURCHASE OF THE EASTERLY 80 FEET OF LOT 3, BLOCK 1, LINDIG ADDITION, FOR A PARKING LOT Ciernia opened the Public Hearing on the Garley subdivision request at 8:00 P.M., presented the Mayors memo dated August 11, 1986 (a copy of which is on file in the elerk~s office), and explained the Planning Commission had denied the request at the August 4th meeting. Mr. Garley asked if there was any point in presenting his plan in view of the opposition, and he could present alternatives. JOSEPH BIANCHI, 1725 FAIRVIEW, commented that at the time the apartment buildings were constructed the neighbors were assured there would be no parking problems, and felt the problem should not be solved at the expense of neighboring properties. Mr. Bianchi was concerned that run off water from the parking lot would damage neighboring gardens. Council briefly discussed ob~eetions raised at the Planning Commission Meeting, i.e. noise, water drainage, refuse, and unsightly barriers. HEARING RECESSID AT 8:15 P.M. Ciernia recessed the hearing temporarily to convene the hearing scheduled for 8:15 P.M. 8:15 P.M. HEARING ON REQUEST FROM CLEON GARLEY, TO REZONE THE EASTERLY 80 OF LOT 3, BLOCK L, LINDIG THIRD ADDITION, FROM R-1 TO R-4 FOR CONSTRUCTION OF A PARKING LOT - NO ACTION TAKEN, HEARING CLOSED AT 8:16 Ciernia opened the hearing at 8:15 P.M., however there was no discussion, or action taken, and the hearing was closed at 8:16 p.m. V~ MINUTES REGULAR CITY COUNCIL MEETING AUGUST 13, 1986 PAGE 3 PUBLIC HEARING ON SUBDIVISION REOPENED AT 8:18 AND CLOSED AT 8:18 Ciernia reopened the hearing on subdivision at 8:17 P.M. and as there were no others wishing to be heard, closed the hearing at 8:18 P.M. SUBDIVISION AND REZONING REQUESTS FROM CLEON GARLEY DENIED - ALTERNATE PLANS TO BE REVIEWED Wallin moved, seconded by Hard, denial of Mr. Garley~s requests for subdivision and rezoning. Council directed Barnes to schedule a meeting with the Planner, Fire Department, and Mr. Garley, to discuss a remedy for the parking problem (cost of the Planner to be borne by the city). GARLEY PRESENTATION Mr. Garley explained that he presently has 53 tenants and 53 ears, with only 41 parking spaces, and the parking shortage became acute when the Fire Department decided more emergency vehicle access was needed eliminating several spaces. BEHRENS, 1816 TATUM, IRENE MACGREGOR, 1795 FAIRVIEW, AND SPING LIN, 1785 FAIRVIEW, REQUEST FOR CONDEMNATION OF 1 FOOT STRIP ON LINDIG STREET Ciernia presented letters from Behrens, MacGregor, and Lin requesting Council consider condemnation of the 1 foot strip on Lindig Street which they have been unable to purchase from the present owner, such strip being needed for street extension to allow construction of homes at the end of the Lindig Cul-de-sac. Schunicht explained he had met with all parties involved in an attempt to solve the problem, to determine possibile costs of utilities and street, and recommended Council consider participating in the amount of $13,000 to $15,000. MALCOM MACGREGOR, REPRESENTING IRENE MACGREGOR, 1795 FAIRVIEW, informed they have been unable to negotiate for purchase of the strip after several attempts. Council discussed whether or not the city should participate in the cost, if so how much, the amount of taxes to be generated from the new homes if constructed, and condemnation vs. private purchase. Council concurred they would prefer private negotiations for purchase, and agreed to consider participation in the cost to the amount that might be generated by increased taxes from the proposed new homes. Chenoweth will compute the estimated increase in taxes to be generated by the new homes if the area were in a tax increment district, and each of the parties involved will be made a formal written offer for city participation. IRENE MACGREGOR, 1795 FAIRVIEW, felt the problem with the 1 foot strip was created by the city and, therefore, the city has some responsibility to remedy the situation. STORM WATER UTILITY DISTRICT TO BE ESTABLISHED Schunicht reviewed his letter dated August 7, 1986 (a copy of which is on file in the elerk~s office) outlining the procedure for establishing a storm drainage utility. Motion carried unanimously. Barnes was directed to determine an approprtiate levy to establish a fund. COFFMAN/TATUM IMPROVEMENTS UPDATE Sehunicht reviewed his report dated August 7, 1986 (a copy of which is on file in the clerks office) relating to the Coffman/Tatum improvements which are now complete. REQUEST TO BARRICADE IDAHO, PASCAL TO ARONA, ON 9/13/86 FOR BLOCK PARTY APPROVED Ciernia moved, seconded by Hard, approving a request from Eleanor Chu, 1490 Idaho, to barricade Idaho, Pascal to Arona, on 9/13/86 for a block party. Motion carried unanimously. PROPOSED RESOLUTION RELATING TO WILLIAMS PIPELINE DEFERRED TO 8/27/86 Council briefly discussed a proposed resolution based on a resolution adopted by the City of Roseville, after which staff was directed to rewrite the resolution and place the item on the agenda for 8/27/86 AMBULANCE TO PROVIDE EMERGENCY COVERAGE FOR MARATHON FOR NON-PUBLIC EDUCATION ON 10/4/86 Wallin moved, seconded by Hard, approval of a request from Nazareth Council No. 4021 that the city ambulance provide emergency coverage for the Marathon for Non-Public Education on October 4, 1986. Motion carried unanimously. COUNCIL TO REQUEST HEARING ON HARVEST STATES REQUEST FOR TAX ABATEMENT Following a brief discussion regarding a letter dated August 4, 1986 from the State Department of Revenue informing Harvest States Cooperative has filed an application for reduction in the assessed valuation of their property, Chenoweth moved, seconded by Wallin, requesting a hearing on the matter. Motion carried unanimously. REQUEST FROM JOHN CARVES, 1775 N. SNELLING, FOR REIMBURSEMENT FOR SEPTIC TANK CAVE-IN DENIED Council reviewed a letter from John Carnes, 1775 N. Snelling, dated July 28, 1986 requesting the City pay for filling his septic tank after a cave-in, after which Chenoweth moved, seconded by Wallin, denial of the request. Motion carried unanimously. PUBLIC HEARING FOR ASSESSMENT OF DELINQUENT SANITARY SEWER CHARGES SET FOR SEPTEMBER 10, 1986, 7:15 P.M. Chenoweth moved, seconded by Wallin, scheduling of the public hearing on assessment of delinquent sanitary sewer charges for September 10, 1986 at 7:15 P.M. Motion carried unanimously. Chenoweth moved, seconded by Wallin, scheduling of the public hearing on assessment of University Grove Street Light Repairs for September 10, 1986 at 7:30 P.M. Motion carried unanimously. ELECTION JUDGES FOR SEPTEMBER 9TH PRIMARY AND NOVEMBER 4TH GENERAL ELECTION APPROVED Hard moved, seconded by Chenoweth, approval of the election judges for September 9, 1986 Primary and November 4, 1986 General Election. Motion carried unanimously. CITY TO PURCHASE GENERATOR FOR PUBLIC WORKS EMERGENCY USE Barnes explained since a lift station has been constructed at 1666 Coffman Public Works will need a generator for emergency use, and has requested the attorney render an opinion on whether or not the cost may be paid from tax increment funds. Ciernia moved, seconded by Wallin, purchase of a Kohler Model 20RZ generator from Interstate Power Systems at a cost of $7,800, such funds to be paid from tax increment funds. Motion carried unanimously. If the attorney finds this is not possible the matter will be referred back to Council. DISCUSSION OF SALE OF BONDS FOR DEVELOPMENT OF SE CORNER OF LARPENTEUR AND SNELLING Schroeder commented on a letter from Piper, Jaffray and Hopwood dated July 28, 1986 (a copy of which is on file) relating to the advantages of the city issuing variable rate tax increment bonds for the southeast corner of Larpenteur and Snelling prior to September 1 when the law governing such bonds will be changed, and indicated there would be no risk to the city. Chenoweth objected to bonding for $5,000,000 to $6,000,000 when there are no definite plans for redevelopment and felt it could be risky. Following the discussion all other couneilmembers agreed that such bonding would be premature and no action was taken. AJOURNMENT Chenoweth moved, seconded by Wallin, adjournment at 10:26 P.M.
