REGULAR CITY COUNCIL MEETING
NOVEMBER 12, 1986
A regular meeting of the Falcon Heights City Council was called to order
at 7:00 P.M. by Baldwin.
PRESENT:
Baldwin, Chenoweth, Hard, and Ciernia. Also present were Barnes and
Schroeder.
ABSENT:
Wallin.
ADDENDUM TO AGENDA
Hard moved, seconded by Ciernia, the addition of item 5 (1), Letter from
John Burkard, 1717 Pascal, Requesting Amendment of The Zoning Code to
Allow Automobile Restoration. Motion carried unanimously.
CONSENT AGENDA APPROVED
Ciernia moved, seconded by Hard, approval of the Consent Agenda with the
deletion of the Bonestroo Statement. Motion carried unanimously.
MINUTES OF OCTOBER 22, 1986 APPROVED
Chenoweth moved, seconded by Hard, approval of the Minutes of October 22,
1986. Motion carried unanimously.
WALLIN ARRIVES
Wallin arrived at 7:08 P.M.
BULLSEYE GOLF WILL NOT BE REQUIRED TO REMOVE SNOW FROM SIDEWALK BETWEEN
ENTRANCES
Dennis Hunt, Bullseye Golf, explained it is very difficult to keep the
sidewalk shoveled along the parking lot area between the entrances/exits
of his parking lot as the County snowplows throw the snow back on the
walks, and requested Council not require shoveling of that area.
Following a short discussion, Chenoweth moved, seconded by Wallin,
allowing snow removal as proposed in Mr. Hunt's drawing with the
understanding the City may ask for additional removal if snow piling
becomes a hazard. Motion carried unanimously.
WARMING HOUSE AT UNIVERSITY GROVE RINK TO BE DESTROYED
Ciernia informed the Park and Recreation Commission concurred with the
report from the building inspector and fire marshal relating to the
condition of the Grove warming house and recommended the structure be
dismantled. Council also concurred, but will discuss the matter at a
later meeting after the Grove Association has notified Grove residents.
7:15 P.M. - PUBLIC HEARING ON PROPOSED LIQUOR CODE AMENDMENT
At 7:15 P.M. Baldwin opened the public hearing and presented the Affidavit
of Publication. Schroeder explained the amendment is necessary to be in
compliance with newly adopted State Statutes and that he has drafted a
letter to the Attorney General requesting an opinion on the new

Statute which has caused Council some concern. There being no one present
wishing to be heard, Baldwin closed the hearing at 7:19 P.M., after which
Chenoweth moved, seconded by Ciernia, adoption of Ordinance No. 0-86-15
Motion carried unanimously.
ORDINANCE N0. 0-86-15
AN ORDINANCE AMENDING CHAPTER 6 OF THE MUNICIPAL CODE
RELATING TO ALCOHOLIC BEVERAGES
DISCUSSION - ONE FOOT STRIP AT END OF LINDIG
Baldwin commented on his meeting on October 23, with Barnes, Steve Ozanne,
and Heinrich Loos, resulting in his memo dated October 28, 1986, a copy of
which is on file in the Clerk's office. He stressed the fact that Council
had previously been dealing with incorrect numbers and Loos and Ozanne had
actually paid for utilities on both sides of Lindig at the time the
properties were developed. Therefore, the one-foot strip is a tool by
which they may be reimbursed if the lots on the east side are developed,
and at the October 28th meeting Loos and Ozanne had indicated they expect
a resonable return on their investment in the 3 to 4y interest range.
IRENE MACGREGOR inquired if this was a reversal of the last decision to
which Baldwin replied it is a reversal as they were previously dealing
with incorrect numbers, but there would be very little change from the
cost originally quoted.
JOANNE BEHRENS asked if they would be required to bring the utilities to
their north property line and was informed the utilities to the lot to the
south were only installed to the middle of that lot and Behrens would be
required to pay for utilities from the middle of the lot to the south to
approximately the middle of their lot which would be equal to a normal
lot. Following the discussion, Council concurred as follows: (1) the city
does not feel responsible to participate in the cost of a street or
cul-de-sac for any extension of Lindig, (2) agreed Behrens would not be
assessed for utilities for more than the width of one lot, and (3) the
city does not wish to purchase the one-foot strip and hold it until
development takes place. Baldwin and Barnes will arrange a meeting with
Irene MacGregor and Sping Lin to explain the figures.
PROPOSED CONTRACT COMPLIANCE ORDINANCE RECOMMENEDED BY HUMAN RIGHTS
COMMISSION
Wallin and Human Rights Member Bob Lamb presented the policy statement and
proposed compliance contract requiring all contractors to take affirmative
action to ensure all employment practices are free of discrimination,
Following a discussion relating to the possible impact on the city
obtaining bids, whether or not there is a need for such a document, and
enforcement, Council directed Schroeder to review the language and make
recommendations for presentation to all city commissions. Council will
review the attorney's recommendations at the January 14, 1987 meeting.
CITY TO DELAY PAYMENT OF CHARGES FOR RECONSTRUCTION OF ALLEY BETWEEN
LARPENTEUR AND CALIFORNIA, RUNNING FROM HAMLINE TO ALBERT

Ciernia commented on the fact that the reconstructed alley does not look
good, he doubted the alley is serviceable or could be maintained properly,
and suggested some action be taken, such as denying full payment, or no
payment until there is a written agreement explaining how the problems
will be remedied. Council concurred the purpose of the project was to
drain the alley, it does not drain properly, so the job has not been
accomplished. Council agreed to withhold payment of the entire cost of
alley reconstruction ($19,557.64), and any other charges (such as city
engineering fees) relating to the alley. Barnes was directed to schedule
a meeting with Ramsey County and the city engineer to inform them when
they present a plan for correcting the situation the city will pay 50% of
the cost, and after the alley is completed satisfactorily the remaining
50% will be paid. Chenoweth moved, seconded by Wallin, cancellation of
Check ~k19706, dated October 8, 1986, issued to Ramsey County Treasurer in
the amount of $58,627.72. Motion carried unanimously.
LETTER FROM JOHN BURKARD~ 1717 PASCAL, AND PETITION REQUESTING COUNCIL
AMEND THE CODE TO ALLOW VEHICLE RESTORATION IN RESIDENTAL DISTRICTS
REFERRED TO PLANNING COMMISSION
Council reviewed and discussed the request that the zoning code be amended
to allow automobile restoration, after which Council agreed the code might
be amended to allow for such restoration in a residential zone with the
following stipulations: (1) the vehicle must be licensed to the property
owner, (2) the work must be done in a garage, and (3) the work must not
institute a public nuisance. Chenoweth moved, seconded by Wallin,
referral of the matter to the Planning Commission. Motion carried
unanimously.
AMENDMENT OF RESOLUTION RELATING TO HARDSHIP DEFERRALS FOR SENIOR CITIZENS
Schroeder presented the recommended amendment and explained that to be in
compliance with State Statute it is necessary to add the following item to
the conditions whereby the deferred assessment will become due and
payable: the death of the owner, provided that the syouse is otherwise
not eligible for the benefits hereunder Chenoweth moved, seconded by
Hard, adoption of Resolution No. R-86-46. Motion carried unanimously.

A RESOLUTION AMENDING RESOLUTION N0. R-86-41 RELATING
TO HARDSHIP DEFERRALS FOR SENIOR CITIZENS
AMENDMENT TO FIRE DEPARTMENT BY-LAWS APPROVED
Chenoweth moved, seconded by Hard, approval of the amendment to the Fire
Department By-Laws (Addition of Section 6A). Motion carried unanimously.
CITY APPROVES $2,500 DISBURSEMENT TO FIRE DEPARTMENT RELIEF ASSOCIATION
Ciernia moved, seconded by Chenoweth, approval of a $2,500 disbursement to
the Fire Relief Association as budgeted for 1986. Motion carried
unanimously.

PUBLIC SAFETY OFFICER/FIRE MARSHAL INSURANCE REIMBURSEMENT, COMPENSATION
FOR WEEK END AND NIGHT CALLS, RETIREMENT PLANS, AND FINALIZATION OF JOB
DESCRIPTION
Chenoweth moved, seconded by Wallin, including this employee under the
present policy for use of a private vehicle on city business, an allowance
of $75.00 per quarter plus $.20 per mile. Motion carried unanimously.
Chenoweth moved, seconded by Hard, payment of time and a half for fire and
rescue calls after 40 hours including back pay from the time of hiring
(July 28, 1986). Motion carried unanimously.
Chenoweth explained Fire Department Member Jay McNabb has requested an
Attorney General's opinion on whether or not the Fire Marshal is eligible
for both PERA and Relief Association pensions, and at this time the fire
pension is on "hold". Baldwin inquired why this is being questioned when
others are allowed to have two pension funds, and indicated no city funds
are to be expended for this investigation.
Baldwin and Chenoweth indicated they had met with Chief Renchin and Terry
Iverson, discussed Iverson's duties, and commented on Renchin's memo dated
October 31, 1986 regarding the Fire Marshal's duties. Following a brief
dicussion item 12 on the list of proposed responsibilities was deleted
(liaison between Fire Department and City ) as it was felt this was the
Chief's duty, and replaced with a new item, "be responsibile for
establishing time lines in meetings with developers". It was stressed
that the Fire Marshal will not have authority to negotiate any code
requirements, the 10 day plan reviewal requirement will be followed, but
he may, for instance, permit pouring footings on Friday if a letter of
intent is in hand on Thursday. Council also established Iverson's title
will be Fire Marshal, not Public Safety Director.
APPROVAL OF APPRAISAL FOR SOUTHEAST CORNER OF LARPENTEUR AND SNELLING AND
REVIEW OF FISCAL CONSULTANT'S REPORT ON POSSIBLE TAX INCREMENT REVENUES
FOR THE CORNER
Council concurred the appraisal was acceptable and authorized payment of
$8,450.00 to Davis and Lagerman, Inc. for the appraisal.
Chenoweth presented and reviewed Fiscal Consultant Apfelbacher's report
dated November 12, 1986 projecting tax increment revenues which would need
to be developed from the site to provide a100% land write down based on
information from the apprisal and market analysis.
STORM UTILITY DRAINAGE ORDINANCE ADOPTED
After reviewing and amending the proposed ordinance, Hard moved, seconded
by Wallin, adoption of Ordinance No. 0-86-16. Motion carried unanimously.

Due to the fact that the November 26th meeting falls on Thanksgiving eve
and the December 24th meeting on Christmas eve, Hard moved, seconded by
Wallin, cancellation of those meetings and scheduling of a special
meeting on November 19, 1986 at 7:00 P.M. Motion carried unanimously.

Ciernia moved, seconded by Hard, adjournment at 10:33 P.M. Motion carried
unanimously.
