SPECIAL CITY COUNCIL MEETING
NOVEMBER 19, 1986
A special meeting was called to order at 7:00 p.m. by Baldwin.
ALL MEMBERS PRESENT
Baldwin, Chenoweth, Wallin, Hard, and Ciernia. Also present were Barnes,
Schroeder and Maurer.
CONSENT AGENDA APPROVED
Hard moved, seconded by Wallin, approval of the Consent Agenda. Motion
carried unanimously.
MINUTES OF NOVEMBER 12, 1986 APPROVED
Chenoweth moved, seconded by Ciernia, approval of the Minutes of November
12, 1986. Motion carried unanimously.
APPROVAL OF AGREEMENT WITH RAMSEY COUNTY RELATING TO COST, MAINTENANCE,
AND OPERATION OF PRE-EMPTION SYSTEM ON LARPENTEUR AT ARONA
Ciernia moved, seconded by Wallin, approval of the agreement with Ramsey
County relating to cost, maintenance, and operation of the pre-emption
system on Larpenteur Avenue at Arona Street. Motion carried unanimously.
DISCUSSION - DEFINITION OF "FAMILY" IN CITY CODE - PRESENT CODE TO BE
ENFORCED
Schroeder explained enforcement o,f portion of the code could be challenged
as has been in the past, and if Council desires to reduce the number of
persons allowed in definition of "family" from four to two or three, there
must be some justification for the change. Council commented on the fact
that according to information obtained from other Minnesota communities,
the present city code is more restrictive than most, and discussed
possible legal ramifications, whether there is a need for a more detailed
ordinance, and specific goals of the code such as traffic control and
retaining the residential character of the neighborhood. Staff was
directed to enforce the existing code by notifying violators they must
come into compliance at the earliest date possible, such period not to
exceed six months. Schroeder will review the matter further for
discussion at a later meeting.
SNELLING AVENUE RECONSTRUCTION DISCUSSION
Bob Cartford, Assistant District Engineer, Tom O'Ryan, Design Engineer,
Jim Swanson, Site Engineer for the project, and Sue Kline, Hydrolygist,
for MN/DOT were in attendance to answer questions.
TOM O'RYAN reviewed and explained the plans for upgrading Snelling Avenue
from Como Avenue to Highway 36, and Tom Swanson informed they are doing
the two year project in one year to alleviate problems for residents and
businesses.
KEITH HEUER, 1840 N. SNELLING, asked how much lawn he will lose, and if
the trees will be replaced, and was informed the service road will be 4
feet nearer the home, of which two feet is curb and gutter, and that some
trees will be planted twenty to thirty feet apart.

LIZ WOODWARD, 1612 HOLLYWOOD COURT, wanted to know how residents in
Hollywood Court will be affected and was told the cut into the boulevard
is approximately 6 feet and that during construction access will be
allowed to Snelling Avenue.
KAY DOWDELL 1632 HOLLYWOOD COURT, was informed State Fair visitors will
not be allowed to use the service road; it will be policed as it is now,
and that the service road will be two way.
ROGER AND CONNIE AIKEN, 1589 HOLLYWOOD COURT, expressed concern that the
large trees, which provided a sound barrier to the area, were removed.
There will be some trees/shrubs planted but no sound barrier will be
constructed.
MARVIN FLODIN, OWNER OF THE APARTMENT BUILDINGS AT 1642 AND 1634 SNELLING
DRIVE, was informed there will be no changes in that service road except
for the adding of curb and gutter, and closing of the frontage road at
Larpenteur.
RON JOHNSON, 1836 SNELLING, inquired about possible assessments to which
Baldwin replied the only possible assessments would be for storm sewer and
Council is negotiating with MN/DOT to pay the costs.
Chenoweth explained there is an area north of Larpenteur on the west side
of Snelling with no city water and the city is interested in running water
across Snelling and placing fire hydrants in conjunction with the Snelling
Avenue construction. MN/DOT has been asked to include the water main as
an alternate so if residents desire city water it will be extended to
those residences, otherwise, the water line will only be extended across
Snelling and hydrants installed.
GLEN OLSON, 1780 N. SNELLING, questioned the need for the project, why it
was necessary to remove the trees from the median and reduce the size of
the median, to which O'Ryan replied the median is being reduced to allow
space for the service road on the west as it is felt necessary for safety
of the residents.
In reply to questions from CHAR NELSON, 1893 Snelling, RON JOHNSON, 1826
SNELLING, KEITH HEUER, 1840 SNELLING, and MARV FLODIN, 1634/1642 SNELLING,
the engineer explained whether or not there will be on-street parking on
service roads is a determination to be made by Council.
JOHN CARNES, 1775 SNELLING, felt MN/Dot has been very responsive and
cooperative during the construction planning period.
JIM KORF, FALCON BARBERS, was informed both Crawford and Garden will be
open during construction.
CITY TO OBTAIN QUOTE ON UNDERGROUNDING UTILITIES IN CONJUNCTION WITH
SNELLING AVENUE CONSTRUCTION
Council directed Barnes to obtain a quote from NSP and Northwestern Bell
on undergrounding utilities on Larpenteur from Fry to Arona Streets, and
Snelling Avenue, Hoyt to Roselawn.

ENGINEER TO PREPARE PRELIMINARY PLANS FOR ARONA (HOYT TO LARPENTEUR)
WATERMAIN INSTALLATION
Chenoweth moved, seconded by Ciernia, directing the city engineer to
prepare preliminary plans for the proposed Arona waterline in conjunction
with the water tower under construction on the State Fairgounds. Motion
carried unanimously. This project would increase water pressure in the
Northome area.
Engineer Terry Maurer explained MSA funds may be used for the
Larpenteur/Arona signal repair project, and the impact on the city's MSA
funding. Chenoweth requested an accounting of the city's MSA monies and
what amounts are already committed as he recalled one instance when the
funds were already committed and the city had to wait for funds.
Chenoweth moved, seconded by Wallin, adoption of Resolution R-86-47.
Motion carried unanimously.
RESOLUTION R-86-47
A RESOLUTION DESIGNATING USE OF MINNESOTA STATE AID FUNDS
FOR PARTICIPATION IN THE UPGRADING OF THE TRAFFIC SIGNALS
AT LARPENTEUR AVENUE AND ARONA STREET
MCCOMB & ASSOCIATES MARKET ANALYSIS DEFERRED TO DECEMBER 10, 1986
Council deferred to McComb report to December 10, 1986 to allow time to
review McComb's reply to the Dahlgren report.
PAYMENT FOR CITY'S SHARE OF MARKET ANALYSIS AUTHORIZED
Hard moved, seconded by Wallin, payment of the City's share for the Market
Analysis prepared by James B. McComb and Associates ($5,200.00). Motion
carried unanimously.
PROBLEMS WITH LACK OF COMPLETE PLANS FOR STRATFORD OFFICE PARK
Baldwin reviewed problems city inspectors have encountered with lack of
plans for the office park development, and the fact that plans are
constantly being changed. Maurer stated they have also encountered
constant changes on the utility installations and have been informed of
the changes but do not have corrected plans. Following a discussion
Council directed Barnes to inform the developer they must adhere to the
ten day plan review requirement, that the city understands the developer
wants maximum flexibility due to the customizing of the offices, however,
if any work is completed without proper inspection, and it is necessary to
open walls or in any other way disturb the structure for proper
inspection, the developer will be responsible for any costs.
NO ACTION ON BILLBOARDS ON NORTHOME SHOPPING CENTER
Schroeder reviewed the history of the billboards which were to be phased
out in 1985 and presented several options as follows: (1) attempt to get
the attorney general to change the opinion rendered previously, (2) file
declaratory judgment action in court, (3) proceed with condemnation, or
(4) hold off to see if there is redevelopment on the southeast corner.
He recommended the 4th option and Council concurred. It was stressed that

any development agreement would prohibit billboards.
APPROVAL OF AGREEMENT WITH UNIVERSITY OF MINNESOTA AMENDING PREVIOUS
AGREEMENT RELATING TO GROVE PARK PROPERTY
Council reviewed the proposed amendment, which is necessary to revise the
premises leased to exclude land required for 1666 Coffman construction,
after which Ciernia moved, seconded by Chenoweth, approval of the
agreement and authorizing signing of the same. Motion carried
unanimously.
BALDWIN MEETS WITH BAHA'IS
Baldwin informed he had met with representatives of the Falcon Heights
Baha'is and distributed to Council copies of booklet "The Promise of World
Peace" which was provided by the Baha'is.
ADJOURNMENT
Ciernia moved, seconded by Hard, adjournment at 10:27 P.M. Motion carried
unanimously.
