HomeMy WebLinkAboutCCMin_87Apr22MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 1987 Baldwin opened the meeting at 7:00 P.M. ALL MEMBERS PRESENT Baldwin, Ciernia, Chenoweth, Wallin and Hard. Also in attendance were Schroeder and Maurer. CONSENT AGENDA APPROVED Chenoweth moved, seconded by Wallin, approval of the Consent Agenda. Motion carried unanimously. ADDENDUM TO AGENDA Chenoweth moved, seconded by Hard, addition of Item 6 (j) to the agenda, Authorize Progressive Contractors, Inc. to Repair Alley South of Larpenteur, Hamline to Albert. Motion carried unanimously. MINUTES OF APRIL 8, 1987 Hard moved, seconded by Ciernia, approval of the Minutes of April 8, 1987. Motion carried unanimously. PROPOSED CONTRACT COMPLIANCE ORDINANCE DISCUSSED Schroeder briefly reviewed changes in the latest draft of the proposed ordinance after which Hard presented changes requested by the Human Rights Commission. This item was discontinued to allow for the scheduled 7:15 P.M. public hearing. 7:15 P.M. - PUBLIC HEARING ON SNELLING AVENUE WATERMAIN IMPROVEMENT (GARDEN TO CRAWFORD) Baldwin opened the hearing at 7:15 P.M. and presented the Affidavit of Publication. Maurer explained the improvement will provide water service to five homes and fire hydrants on the west side of Snelling, and commented on the estimated assessment, $2,750 per lot. JOHN CROWLEY, 1769 N. SNELLING, stated when he purchased their lot the contractor was told there was no water service, so a well was installed at a cost of $5,000, and he has now been informed the contractor working on Snelling Avenue found an existing line. He felt it unfair to be required to pay an assessment for a water service when it was already in place and Council concurred. Council commented on the fact that they recently learned the John Carnes property at 1775 Snelling already has water service and cannot be included in the assessment. STANLEY STROMMER, 1729 SNELLING, was of the opinion Hermes Center should also be assessed and commented on the fact that at a previous meeting Council had indicated there would be no assessments. He felt he would not benefit service because he did not want city water. Baldwin explained making the available will benefit the property even though Mr. Strommer does not desi re to use the service at present and stressed that Council had informed residents there would be no assessments for the state project but the city project will be assessed. Council also explained that this was the only area in the city without water service and it was prudent to install the watermain in conjunction with the Snelling reconstruction project. 2~ MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 198 PAGE 2 ROSE WITCHER, 1757 SNELLING, did not feel there was any benefit if she did not use the system. Mr. Strommer again asked why Hermes Center was not being assessed and Baldwin replied if the northernmost lot ever becomes a separate distinct property they could be assessed. Baldwin stressed that assessing the Hermes property would not decrease the amount of assessment to each property owner and explained the city is already paying a large share of the project cost. Council discussed payment options for the $2,750 per property assessment, such as assessing $2,000 with a $750.00 charge at time of connection, or allowing the entire $2,750 be assessed to property owners who wish to connect to the system immediately. There being no others wishing to be heard, Baldwin closed the hearing at 7:57 P.M. Chenoweth moved, seconded by Hard, approval of Resolution R-87-13. Motion carried unanimously. RESOLUTION R-87-13 A RESOLUTION ORDERING THE SNELLING AVENUE WATERMAIN IMPROVEMENT (CRAWFORD TO ROSELAWN) SNELLING AVENUE CONTRACTOR GRANTED PERMISSION FOR POSSIBLE NIGHT TIME WORK Arnie Laingen, Concrete Division Engineer for Progressive Contrctors, Inc., presented his request for a variance to the 6:00 A.M. to 10:00 P.M. construction hours approved by Council previously, and explained the timing of the sawing of the concrete must wait until the concrete is hard enough to run the saw on, but not so long that cracking can start. This could be any hour of the day or night depending upon the temperature and humidity. He also stressed it will not be an excessive noise and compared it to the sound of a semi truck passing on the street. Chenoweth moved, seconded by Wallin, granting the variance. Motion carried unanimously. CONTINUATION OF CONTRACT COMPLIANCE DISCUSSION Hard explained the Human Rights Commission recommended Council include the sexual preference category in the ordinance (which had been deleted by Council at a previous meeting). Council did not feel it appropriate to add the classification as it is not at present a part of State Statute, concurred the ordinance should follow State Statute, and suggested the Human Rights Commission lobby the Legislature for addition of that category to the Statute. Following the discussion Hard moved, seconded by Ciernia, adoption of Ordinance 0-87-4, with recommended changes. Motion carried unanimously. ORDINANCE 0-87-4 2~ AN ORDINANCE AMENDING PART 6, CHAPTER 2 OF THE MUNICIPAL CODE RELATING TO HUMAN RIGHTS CONTRACT COMPLIANCE MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 1987 PAGE 3 CABLE TV UPDATE Cable Commissioner Ron Eggert presented the following information: (1) Cable TV North Central made an error in computing franchise fees for six communities, one of which was Falcon Heights resulting in an increase in franchise fees from $245.00 to $2,500 for Falcon Heights; (2) Cable Commission is proposing a change in voting and assessment structure based on gross revenues rather than population which will reduce charges to the city by $2,900; (3) New character generators are being purchased which are more reliable, have more capabilities, and will allow running remote broad casts; (4) A book on using public access has been prepared by League of Women Voters and is now available, and (4) Access Corporation does not feel public access effort is as good as it could be, access is not in the Cable Company's interest and they may attempt to turn public access over to the Access Commission. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR ARONA AVENUE WATERMAIN IMPROVEMENT (HOYT TO LARPENTEUR) Hard moved, seconded by Ciernia, adoption of Resolution R-87-14. Motion carried unanimously. RESOLUTION R-87-14 A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS FOR THE ARONA AVENUE WATERMAIN IMPROVEMENT (HOYT TO LARPENTEUR) AND AUTHORIZING ADVERTISMENT FOR BIDS RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR 1987 SEALCOATING (NORTHOME) Wallin moved, seconded by Chenoweth, adoption of Resolution R-87-14. Motion carried unanimously. RESOLUTION R-87-15 A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS FOR THE 1987 SEALCOATING (NORTHOME AREA) AND AUTHORIZING ADVERTISEMENT FOR BIDS DISUCSSION - IMPROPER DRAINAGE OF ALLEY SOUTH OF LARPENTEUR, ALBERT TO HAMLINE Baldwin reviewed a letter dated April 22, 1987 from former City Engineer Schunicht recommending that Ashbach Construction be allowed to proceed with patching and sealcoating the alley, which Schunciht feels will maintain the drainage along the center of the alley. Maurer presented a quote in the amount of $4,996.00 from Progressive Contractors, Inc. to install 125 feet of storm drainage pipe and an additional catch basin to remedy the drainage problem. He felt this was a fair price and recommended approval. Council discussed at length, amounts charged by the former engineers for the alley reconstruction, amounts previously paid, amounts withheld from the engineering firm and Ramsey County, and if the engineer was authorized to turn preparation of plans and specifications over to the County. 4~ 2~ MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 1987 PAGE 4 Additional payment to the engineer and County will be discussed at the May 13th meeting to allow time for staff to check charges/payments and review minutes relating to the project. PROGRESSIVE CONTRACTORS, INC. AUTHORIZED TO REPAIR ALLEY SOUTH OF LARPENTEUR, ALBERT TO HAMLINE Council discussed whether to allow Ashbach Construction to patch and sealcoat the alley, or authorize PCI to install the additional storm drainage pipe and manhole, and concurred it would not be prudent to attempt patching as a remedy. Chenoweth moved, seconded by Wallin, authorizing Progressive Contractors, Inc. to repair the alley at a cost of $4,960.00. Motion carried unanimously. APPOINTEMENT OF LINDA MC LOON, 1818 MOORE, TO PARKS AND RECREATION COMMISSION Wallin moved, seconded by Hard, appointment of Linda McLoon, 1818 Moore, to the Parks and Recreation Commission, term to expire December 31, 1989. Motion carried unanimously. CONDITIONAL USE REQUEST FROM SUPER AMERICA, 1350 W. LARPENTEUR, REFERRED TO PLANNING COMMISSION - PUBLIC HEARING SCHEDULED FOR 5/13/87, 7:30 P.M. Hard moved, seconded by Ciernia, referral of the conditional use request from SuperAmerica, 1350 W. Larpenteur, to the Planning Commission, and scheduled a public hearing before Council for May 13, 1987, 7:30 P.M. Motion carried unanimously. SPECIAL COUNCIL MEETING SCHEDULED FOR APRIL 25, 1987, 2:00 P.M. Hard moved, seconded by Wallin, scheduling a special meeting for April 25, 1987 at 2:00 P.M., for the purpose of selecting a Clerk Administrator. Motion carried unanimously. IMPROVEMENT OF MINI PARK ON LINDIG Ciernia informed that the Parks and Recreation Commission will be considering some tree planting and other possible improvements to the mini-park on Lindig Street.
