Also present were Wiessner and Schroeder ABSENT Hard. MINUTES OF JULY 8, 1987 APPROVED Wallin moved, seconded by Baldwin, approval of the July 8, 1987 Minutes. Motion carried unanimously. ADDENDUM TO AGENDA Wallin moved, seconded by Ciernia, addition of the following items to the Agenda: (1) Item E(11), Business Licenses for Rock-A-Fellas, 1544 W. Larpenteur, and (2) Item F(7) Underground Sprinkler System/Landscaping at Bullseye Center. Motion carried unanimously. CONSENT AGENDA APPROVED 1. Fire and Ambulance Reports 2. Motion carried unanimously. 7:05 P.M. - HEARING ON VACATION OF ALLEY NORTH OF LARPENTEUR, PASCAL TO HOLTON Baldwin opened the hearing at 7:05 P.M. and presented the Affidavit of Publication. Robert D. Bentson, 1701 Holton, the resident who has been using a portion of the alley for garage access and who requested council consider vacating the alley, was present but had no comments. There being no others wishing to be heard, Baldwin closed the hearing at 7:09 P.M. Cierna explained he and Park and Recreation Director Pat Bush had discussed whether or not the alley would be desirable for a bike/hiking path, and concurred it was not a good area for a bike path. Wallin moved, seconded by Chenoweth, adoption of Resolution R87-29, vacating the alley with the understanding that the alley would be equally apportioned between the abuting property owners. Motion carried unanimously. RESOLUTION R-87-29 ~i A RESOLUTION VACATING THE ALLEY NORTH OF LARPENTEUR, PASCAL TO HOLTON MINUTES JULY 22, 1987 PAGE 2 7:15 P.M. - HEARING ON PLATTING FOR STRATFORD OFFICE PARK Baldwin opened the hearing at 7:15 P.M. and presented the Affidavit of Publication. Wallin stated the Planning Commission had unanimously approved the platting at the July 6, 1987 meeting, however, he was concerned that the plat drawing does not show access to the buildings on the west. Jack Klepp, representing Stratford Investments, Ltd., explained the purpose of the platting is to divide the property into six parcels for the proposed six office condominiums, that this is a flexible condominium development with two buildings on the site at present with four more to follow as they are sold, and that parking and access to the parcels are held in common. Schroeder examined the condominium declaration document and was of the opinion it was a proper declaration and nothing in addition was needed. There being no others wishing to be heard, Baldwin closed the hearing at 7:33 P.M. Ciernia moved seconded by Wallin, adoption of Resolution R87-30. Motion carried unanimously. RESOLUTION R-87-30 A RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF STRATFORD OFFICE PARK AS SUBMITTED REQUEST FROM CARL BLOMBERG, 1579, 1583 NORTH HAMLINE FOR A VARIANCE TO THE FIRE CODE - DEFERRED TO 8/12/87 UNLESS THE MATTER IS RESOLVED PRIOR TO THAT DATE. Jay McNabb, representing Mr. Blomberg, commented on the letters from Fire Chief Lindig and Building Inspector Larson upholding the code which supported the City Fire Marshal's opinion regarding the need to either install sprinklers in the basement of the building or provide adequate openings for access by firefighters. Baldwin explained Council provided for professionals with expertise to make decisions in these areas and questioned why Council should go beyond their decisions. Discussed at length was interpretation of the fire and building codes, conversations held with Steve Anderson, State Fire Marshal's Office and Bob Miller who drafted this particular portion of the Fire Code. Fire Marshal Iverson stressed that although adequate exterior access would help provide for safety of firefighters, it would not save the the building as sprinklers would, nor would it reduce fire insurance premiums. Council suggested the parties involved attempt to find a suitable solution to the matter, and if it is not solved by the August 12th meeting, it will be discussed further. PROPOSED CHANGES IN CODE REGARDING LOITERING AND CONSUMPTION AS A METHOD OF CONTROLLING PROBLEMS IN REAR PARKING LOT AT ROC-A-FELLAS Deputy Larry Janke commented on the problems encountered in the parking lot, such as drinking, speeding cars, drug dealing, and stated the deputies would like some stronger wording in the code to control this type of activity. Prosecuting Attorney Filla was of the opinion it would not be of any benef it to amend the code as loitering is a vague and diff icult activity to prosecute. He indicated a willingness to discuss the matter with the deputies to determine what City and State laws would apply, and to determine whether or not the code needs to be amended. Dan Dahlin, owners of Rock-A-Fellas, stated he had just this week become aware of the problem and will meet with the deputies, city prosecutor, and manager of the shopping center to work out a solution. Mr. Dahlin will then report back to the city. ~~ MINUTES JULY 22, 1987 PAGE 3 59 ROCK-A-FELLAS LICENSES APPROVED FOR A 90 DAY PERIOD Baldwin moved, seconded by Wallin, approval of Rock-A-Fellas licenses (Lunchroom, Pool Tables, Amusement Machines, Cigarette, and On-Sale Non-Intoxicating Malt Liquor) for a period of 90 days, and if efforts to solve problems at the establishment have been satisfactory, the licenses will automatically be extended, if not satisfactory, Mr. Dahlin will be notif ied of .that fact 10 days in advance of the end of the 90 day period. Motion carried unanimously. NO ACTION TAKEN ON WINFIELD DEVELOPMENT Representatives of Winf field Development were not in attendance to make their presentation. AMENDMENT TO CHAPTER 6-1.01, ALCOHOLIC BEVERAGES Wiessner explained State Statute has been amended to allow sale of intoxicating malt liquor at establishments holding both an on-sale wine license and an on-sale non-intoxicating malt liquor license, and that Chinatown Restaurant and Shakey's would both be eligible. Wiessner stated that the owner of Chinatown has expressed interest in selling intoxicating malt liquor. Following a short discussion Ciernia moved, seconded by Chenoweth, adoption of Ordinance 0-87-5. Motion carried unanimously. ORDINANCE 0-87-5 AN ORDINANCE AMENDING SECTION 6-1.01, SUBDVISION 3 (ALCOHOLIC BEVERGES) OF THE CODE BY ADDING SECTION (C) WINE AND INTOXICATING MALT LIQUOR REQUEST FOR SEWER REPAIR REIMBURSMENT FROM MRS. C. F. PETERSON, 1522 CRAWFORD, DENIED Baldwin presented a letter from Mrs. Peterson dated July 1, 1987 requesting reimbursement in the amount of $862.50 for repair of her sewer line. Based on information provided by Vince Wright and Plumbing Inspector Richard Alquist, Ciernia moved, seconded by Wallin, denial of the request as there was insufficient evidence the problem was City related, and there was strong evidence the problem was due to tree roots. Motion carried unanimously. NEW TRUCK TO BE PURCHASED FOR PUBLIC WORKS DEPARTMENT Wiessner informed that the City's one ton 1974 Ford Public Works truck died on July 7, 1987 and mechanics at Harvest States felt the truck is not worth repairing. After discussing the options available Ciernia moved, seconded by Wallin, replacing the truck with a new truck at a cost of approximately $20,000, and directing Wiessner to appropriate the funds for payment from standing reserves. Motion carried unanimously. PUBLIC WORKS TO RENT TRUCK FOR IMMEDIATE USE Wiessner explained there is immediate need for another truck while awaiting purchase of the new vehicle, and requested Council consider the options, truck rental, or use of an employee's vehicle. Chenoweth moved, seconded by Wallin, rental of a truck for use during the interim period. Motion carried unanimously. MINUTES JULY 22, 1987 PAGE 4 DISCUSSION - DAMAGE TO LANDSCAPING AND UNDERGROUND SPRINKLER SYSTEM AT 1)~ BULLSEYE PLAZA Wiessner presented an update on a meeting with Don Orgeman of MN/DOT,Bob Paine of Ramsey County Public Works, and Dennis Hunt, owner of Bullseye Plaza, regarding damage done to the landscaping and sprinkler system during the Larpenteur/Snelling reconstruction project, and recommended Council consider the recommendations made in her memo dated July 22, 1987, a copy of which is on file in the Clerk's Off ice. Following a short discussion Ciernia moved, seconded by Wallin, accepting the recommendation for resolution of the problem contingent upon obtaining a release from Dennis Hunt ending any further City involvement in the matter.
