SPECIAL MEETING - TUESDAY, JULY 5, 1919 Present: Lynn Matteson, George Shavor, Trustee Art Lindig, Trustee E• B. Rovrley„ Deputy Clerk Ralph pan Hoven, Treasurer Absent: John Rysgaard 2`9 The meeting was called to order by Matteson at ,7:30 p. m. Electrical Bids The bids for the electrical work for the village hall fire station were open. They are as follows: (Each bid includes X1200 for fixtures) Tieso & Ko#tka X3,577 Peoples Electric 3,459 St. Paul Electric 2,785 Ernest Nelson 3,175 The bids were referred to Architecht Buetow. Buetow~s report on Buetow reported he had gone over the general contract on the Witcher~s bid fire station with the other low bidder, Dean Witcher. After making the various changes specified, his bid was X36,070. Bills: The following bills were presented for payment: Geo. Swanson, Fire Chief, volunteer firemen for May ~ 11.00 n n n n n June 35.00 S• Berglund Lumber, for fire dept. 9.54 St. Paul Legal Ledger, advertising bids fire hose 2.90 St. Paul Legal Ledger, advertising bids for pumper 2.90 Northwest Publications, publishing weed law 2.88 Stan Seaborn, services for April, May, and June 57.00 R_ysgaard moved, seconded by Lindig, that-bills be paid. Motion carried. Licenses for Rowley reported he had received a request from Mr. Berntson of Berntson the Falcon Hts. Pharmacy for an off-sale beer license and ciga- rette license, together with a X17.00 check in payment. Shavor y moved, seconded by Lindig, that both licenses be granted to Mr. Berntson. Motion carried. Van Hoven Report on Van Hoven reported completion of the township affairs as far as To:rnship affairs. the books were concerned. Matteson Stepnitz Petition stated the necessary notices of the hearing had been posted. A petition was filed by Associated Investors for the rezoning of 3 parcels of land -- Parcel A, located on Arona between Arona and the Norther~,States Power sub-station, rezoned from farm resi- dance to business; Parcel B, located between the sub-station and the land owned by the Minnesota Amusement to the-west of the sub- station, from farm residence to business; Parcel C, located on Arona between Parcel A and the residences on Idaho, extending over to the Minnesota Amusement property, with provision for an alley to form an entrance from Idaho, rezoned from farm residence to residence ~. Matteson outlined the procedures to be followed din conducting the hearing. Matteson called first on the people presenting the petition and asked them to state their reasons for requesting this rezoning. 30 W. F• SteFnitz, 7.l~91 W• Larpentear, business address 1550 west Larpenteur, stated the Associated investors wished to have Parcel A rezoned to business to enable them to build a one-story California style building to be used for his own office, doc- tbr~s office, and a barber and beauty shop; Parcel B to be used for parking space, and Parcel C to be used for two mul- tiple raw houses housing six families each. Stepnitz stated that if this property were rezoned in this manner the Associa- ted Investors planned to put in a culvert on the west side of Arona to take care of the drainage problem existing there. John Bouthilet, 1517 Idaho, spoke in favor of the rezoning as he thought the purpose for which the zon°.ng is planned would form a proper buffer between the Northez•n States Power sub- station and the residential property, would furnish the vill- age with additional tax base, and the proposed culvert would take care of the drainage problem. Carl Keller, 1319 W. Idaho, also spoke in favor of the rezoning. Opposition to re- Matteson asked if there was any one present who wished to speak zoning in opposition to the rezoning. Mr. Altman, attorney, .stated he represented 31~ property owners living immediately adjacent to the property to be rezoned. These property owners objected to the proposed rezoning on the grounds that at the time they purchased their homes they were told that the property was re- stricted to residential and that they felt a commercial de- velopment of this kind would depreciate the value of their homes. Mr. Altman, therefore, suggested that the petition for rezoning Parcels A and C be denied and that Parcel B be rezoned bo business for parking space only. E. C. Day, 1506 '8r• California, C. H• Thompson, 1507 W. Cali- - forma, and C. L. Hetfield, 1503 W. Californis, stated that at the time they purchased their homes they were told that s some multiple dwellings were considered on Larpenteur but that the remainder of the Northome Addition was restricted to single family residences. They were definitely opposed to the rezoning. H. M• Dunham, 1511 W. Idaho, stated he was opz~osed to the re- zoning and that he did not want any multiple houses or any more business along Arona. About 5 years ago a request was made to the Northome Civic Assn. to build multiple dwelli~ags on Arona Avenue. The request was denied. A•year ago George Sauer, who is connected with Associated Investors, sugges- ted building duplexes along Arona and Dunham told himc~he thought duplexes would be satisfactory. W• C. Groth, 1502 W. California, C. H. Muggenberg, 1512 W• (California, and doe Jorgensen, 1512 W. Idaho, spoke in oppo- sition to the rezoning. Kennet~Z Hanson, 1l~8~ W. California, stated he was not speak- ing for his neighbors but he was sure they wanted some type of development on the property under question and wondered if it would not be possible for the people opposing the rezoning to meet with the petitioners for the rezoning and work out something that would be satisfactory to both 31 Five minute Recess - The council asked for afive-minute recess. As the area has developed, it`3~as~ ~ to July 12, 9:00 p.m. become evident that the business area is not sufficiently large ~~` to serve the residents and from time to time it has been necessary to rezone property to business. We are all residents of the vill- age and are all interested in seeing the .property developed. It is the decision of the council to continue this hearing until 9:00 p.m. July 12. This is being done to give those of you who have appeared favorable t o the petition and those of you who have appeared opposed to the petition a chance to get together to see if it is possible for you to work out something that will generall~ meet with the approval of the majority. Mr. Altman asked about having certain portions of the area zoned for a particular use. It was the thought of the people he repre- sented that after the property waa zoned business, the petitioners would be able to build any type of construction they desired. Frank Graham, Attorney, advised that zoning and type of building were covered by two separate ordinances. For this reason the questions had to b e considered separately. He further stated that the building code provides '~A11 structures in business dis- trict, except those permitted in residence districts, require a special permit, such permit to be issued by not less than a 3/5 vote of the members of the Council.~~ Bdatteson stated the council not only wanted to but were willing and expected to assume full responsibility for this rezoning and for the type of building that would be erected on any portion f ,. zoned business.
