A RESOLUTION ACCEPTING A PUBLIC DRAINAGE AND UTILITY EASEMENT AT
1670 LARPENTEUR AVENUE
WHEREAS, the City Council pursuant to Minnesota Statutes Section 412.851 desires to
consider the vacation of a Storm Sewer Easement that was established by Document Number
2186355, recorded in the Office of the Ramsey County Recorder on September 25,2012;
and;
WHEREAS, on April 8,2026, the City Council approved the Fairway Commons Planned
Unit Development Amendment (Development) that required relocation of the existing public
storm sewer infrastructure located on the property at 1670 Larpenteur Avenue; and;
WHEREAS, relocation of the storm sewer infrastructure is necessary to accommodate
construction of the approved Development; and;
WHEREAS, as a condition of the approved Development, the Developer, Fairway
Commons, Limited Partnership, has agreed to grant the City a perrnanent Public Drainage
and Utility Easement over the relocated storm sewer infrastructure; and;
WHEREAS, the proposed easement grants the City the right to access, inspect, maintain,
repair, reconstruct, and replace public drainage and utility facilities located within the
easement area; and;
WHEREAS, the City Council finds that acceptance of the Public Drainage and Utility
Easement is necessary to preserve public access and maintenance rights associated with the
relocated storm sewer infrastructure and is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Falcon Heights,
Minnesota:
The Public Drainage and Utility Easement from Fairway Commons, Limited
Partnership, to the City of Falcon Heights, substantially in the form presented to the
City Council, is hereby accepted.
City staff is hereby authorized and directed to record the easement with Ramsey County
and take all actions necessary to implement this resolution.
