It was agreed to defer reading of minutes until the next regular monthly meeting, April 25, 1950. Mental health Information relative to Mental Health Week was presented week proclam- and the Mayor was requested to-issue a Mental Health 1~eek ration. proclamation. Taxicab license The application For taxicab license and franchise of I. -and Franchise YlTiae, of Minneapolis, Minnesota, was discussed. It was denied. then moved by Lindig, seconded by Henry, that it is not in the interest of the Village, nor wise to incur the expense necessary, to pass a taxicab ordinance or to grant an ex- clusive franchise at this time, and that the clerk so inform the applicant. Motion parried by unanimous vote and application denied. Vacations, sick Harry Anderson inquired as to what the council wished to do time, Fire school, Firemen's Convention. with regard to vacations for firemen and about having someone to relieve them at such times and during periods of aipknesa. Also mentioned the Northwest Fi re School, to be held in St Paul May 1,2,3 and 4, and question of attendance by Swanson or Imhoff. Also the question of their attending the State Firemen's convention, to be held at New Ulm, Minnesota, June 12, 13 and 14. Stewart moved that these questions be referred to the Fire Protection committee for their repommendations and an estimate of expenses involved. Seconded by Lindig and carried. AppllanaeStore The committee, consisting of Shavor, Rekstad and Reiohow, Building Permit recommended that building permit be granted to Mr. Douglas approved. Rees, on the south 50 feet of the east 22 Peet of Lot 13, Block 10, Falcon Heights, with the provision that the remain- der of said lot be brought to grade and blaaktopped for park- ing purposes. Stewart moved acpeptance oP the committee's recommendation. Seconded by Henry and carried. Pure Oil Co. asked The clerk was requested to write the Pure Oil Company, of to grade & surface St Paul, suggesting that they grade and surface their lot at rear of their lot. 1525 Larpenteur Avenue West, for parking purposes. Bond for Clerk The clerk reported that his corporate surety bond would expire as .of April 19, 1950. Henry moved, seconded by Lindig, that the bond be renewed in the amount of #500.00. Carri ed. Special meeting The clerk also reported on contacting Buatow and A. V. Winterer to be held re regarding balance due the latter on plu~bing and heating con- plumbing and tract. As recommended by Mr. Buetow and concurred in by Mr. heating. Winterer, Rekstad moved that John Rysgaard be notified to call 1` a special meeting to be attended by Winterer, Buetow, Harry Anderson, the Reichows and the Council. Shavor seconded and motion carried. Canteen night Henry brought up for discussion the matter of having for youngsters Canteen night for young people in the Pillage Hall. proposed. Consideration was given to parking and policing problems in this connection, also to having a committee study and act on a youth activities program. Local Planning Shavor read a letter regarding establishment of a Local Commission Planning Commission. Increasing membership on said proposed com~q,ission from five to seven was suggested, and names of likely appointees were offered and considered. Graham, Attorney Absent: Clarence Rekatad, Trustee Meeting called to order at 7:45 pm. Minutes of Regular Meeting, April 11, and of special meeting, April 17, were approved as read. Communications: Letter of April 21 from Lewis L. Anders,,,i, Attorney, suggesting that the Village purchase certain lots in Barthol Villas for drainage purposes from his client, Mrs. Mary Barthol. The letter was ordered planed on file. Privately owned William Torgerson, Village Assessor, reported on the statue real estate in of privately owned real estate in the State Fair grounds. State Fair Grounds. Said he was informed by the County Assessor's office that this in the past had been considered as personal property and would be taxed on that basis.. John Rysgsard proposed that a special meeting to be atteadd~d by Winterer, Buetow, Harry Anderson, the Reichows, Rysgsard and the council, be called for Tuesday, May 9. It eras agreed to hold the meeting on that date ~bginning at 6:30 pm. Attorney Graham reported on the status of the Dunham vs. Village of Falcon Heights case which is on the court calendar Po r Monday, May 1, 1950. Local Planning Shavor and Graham reported on the proposed Local Planning Com- Commission mission. Discussion followed ss to membership on said committee, voting rights and duties, also as to question of introducing a Local Planning Commission ordinance or resolution. RESOLUTION ESTABLISHING PLANNING COA~ISSION BE IT RESOLVED By the Village Council of Falcon Heights as follows; Section 1. Establishment of Commission. A planning commission for the Village of Falcon Heigkits is hereby established to be known as the "Falcon Heights planning Commission". Section 2. C~om~o__s~ition. Such planning commission shall consist of five members. --fi r~®e members shall be appointed by the village council and may be removed by afour-fifths vote of the council; the village street commissioner and the village building inspector shall also be members and shall hav® the right to vote. Of the members ofx,the commission first appointed, one shall be appoint®d for the term ending January 1,,1951, one for the term ending January 1, 1952, and one for the term ending January 1, 1953. Their successors shall be appointed for terms of three years. Both original amd successive appointees shall hold their offices until their successors are appointed and qualified. The terms of the village street commissioner and the village building inspector shall correspond to their respective official tenures. Vacancies during the term shall be filled by the council for the unexpired portion of the term.. Every member shall before entering upon-the discharge of his duties take an oath that he will faithfully discharge the duties of his office. All members shall serve without compensation. Section 3. prganiza,timn l~eetin s, Etc. The commission shall elect a chairman and a score ary'~rom among s appointed members for a term of one year; and the commission may create and fill such other offices as it may determine. The commission shall hold at least one regular meeting each month. It shall adopt rules for the transaction of business and shall k®ep a record of its resolutions, transactions, and findings, which record shall be a public record. On or before January first of each year the commission shall submit to the grillage council a report of its work during the preceding year. Expenditures of the commission shall be .within amounts appropriated for the purpose by the village council. Section 4. Adoption of Program of 1Nork. Upon the appointment and organization of tie commission, it shall proceed with the preparation and adoption of a program of work, outlining activities proposed to be undertaken in the exercise. of its powers and the performance _of its duti®B. Such a program will. include; (a) An outline of data and information to b® assembled as a basis for the village plan; (b) An outline of sub3ects to be covered by the village plan; (c) An outline of types of procedure necessary to make the village plan effective. The planning commission may, by resolution, revise its program of work from t ime to time . Section b. preparation of Village Plan. It shall be the function and duty of the planning commission to prepare and adopt a comprehen- sive village plan far the physical development of the village, inclu- ding proposed public buildings, street arrangements and improvements, public utility services, parks, plgygrounds, and other similar devel- opments, the use of property, the density of population, and other matters relating to the physical development of the village. Such plan may be prepared in sections, each of which shall relate to a mayor subject of the plan, as outlined in the commissionts program of work. Section 6. A~eans of Eaecuti Plan. Upon the adoption of the village plan or any section thereo., t shall be the duty of the planning commission to recommend to the village council reasonable and practicable means for putting into effect such plan or section th®reof in order that the same will serve as a pattern and guide for the orderly physical development of the village and as a basis for then efficient expenditure of the funds thereof relating to the subjects of such village plan. Section 7. Zoning. The plaruaing commission shall study the zoning plan of the village and make recommendations to the village council for changes. as the need arises. The village council sha31 refer to the planning commission far recommendation all applications for changes in zoning plan. Section 8. Building Cod®. The planning commission shall study the building code of the village and-make recommendations to the village council for changes as the need arises. Section 9. pfficial ~a of Street Extensions. The planning com- mission may and upon nstruction y t e v llage council shall prepare an offieaial map of the platted and unplatted portions of the village and adjoining territory, or portions thereof, indicating upon such map the proposed future extension or xidex~ing of .streets of the village xithin such existing platted and d®veloped territory or across such un- platted territory. After such map has been prepared it shall be submitted to the council, xhich shall thereupon consider such map and may adopt it or any part of it xith such amendments as it deems advisable. Before such adoption by the council, a public h®aring shall be held upon_the pro- posal as required by lax. After such map has been adopted by the council xhenever any existing street or highway is widened or improved, or xhenever any new street is opened or acquired by action of the village, it shall not be required in such proceedings to pay for any building or structure xhatsoever construetted upon such mapped street, or situated outside of any building line that may have been established upon the e~cisting street, or xithin any area thus reserved by the map for public purposes, if such building or structure has been placed there xithout a permit or in violation of the conditions of a permit after the adoption and publication of such map. -2- 1~ 1 s Section 10. Plats. Every proposed plat of land within the • village shall be su m teed to the village eo until before being fil®d and no plat of land shall be filed unless and until the same sha~.l first have been approved by the village council. Before acting~on such plat the village council shall submit the same to the p~.anning commission for its recommendations.. The planning commission shall prepare and recommend to the village council for adoption regulations governing the platting of land. The planning commission, within forty days after any such plat has been ref®rred to it by the village council, shall sat on the same and shall make its recommendations with respect Chereto. Such recom- mendations may consist of: (a} recommendation that the village council approve such plat; or (b) recommendation that th® village council dis- approv® such plat, in which case such recomm®ndation shall include a stet®ment of the specific reasons for such recommendation; or (c} re- c®mmendation that the village council approve such plat after speacfied changes or revisions are made therein, which recommendations may include the condition that a revised plat, containing such changes or revisions, be submitted to the planning commission, in which ease such revised plat shall be so submitted to the planning commission for its further con- sideration and recommendations before action thereon by the village council. Section ll. Procedure for Changes. ~o change shall be made in the zoning plan, future street and public lands plan, or regulations governing the platting of land after such plans or regulations have been adop, d by the village council, until the propos®d change shall hav® been referred to the planning commission for report thereon and an attest copy of such report shall have been filed with the council.;. and no or finance or resolution establishing any of such plans or speci- f ieations shall be adopted by the village council until such ordinance or resolution shall have been referred to the planning commission for a report thereon and an attested copy of such report shall have been filed with the council. Failure of the planning commission so to report within forty days or such longer period as may be designated by the council after such reference shall be deemed to b® approval of the pro- posed change. Section 12. List of Recommended public forks. Each officer, de- partm®nt, board, or comet ss ©n o or in t e v llage whose functions include recommending, preparing plans for, or constructing public works shall, at least Four months before the end of ®ach fiscal year, submit to the planning corsmissien a list of the proposed public works recom- mended by such officer, department, board, or commission for planning, initiation, or constructing during the ensuing fiscal year. The planning commission shall request from the local school district a similar list of its proposed public works. The planning commission shall list and classify all such proposed public works and shall prepar® a coordinated program of proposed public works for the ensuing fiscal year. Such program shall be recommended by the commission to the council and to such other officer, departments, boards, or public bodies as have jurisdiction ov®r the recommending, planning, or constructing of such public works. -3 - Local Planning Said resolution seconded by Stewart and adopted by a unanimous Commission vot1~,~ (cont'd) Adding Machine The clerk reported that he had been furnished with a~esk model Burroughs Adding Machine on atrial basis by the Wager Offioe Equi ment Company, and that the machine could be purchased For 75.00, which price seemed reasonable compared with what ~nein~.~ar*u~keh~nd mo:i~d be obtained Po r elsewhere. It was decided to postpone action on the purphase until a later meeting. Street Light Reporting for Commissioner Seaborn, Mayor Henry stated that the at Hamline street light at Hamline and Iowa will be installed at County and Iowa expense.
