Rekstad reported that heating contractors he had contacted wish to know type of heating to be installed in the Village Hall before submitting bids. It was agreed to have Rekstad consult a heating engineer for recommendation as to type of heating and for drawing up plans. Recess At this point, the meeting was recessed. Hearing, Grant At 8:30 P.M., Acting Mayor George J. Shavor declared open & Weber petition the hearing on the petition of Iioward G. Grant and Nick B. vacate alley. Weber to vacate the platted alley bet+veen Lot 2 and Lots 3, 4 and 5, Keller Re-arrangement of B~~ok 10 of Falcon Heights Addition. On request, the clerk read from the minutes of Augus$ 26, 1952, the record as to receipt of the petition and the council's action in voting to hold a public hearing on said petition. Notice of public hearing also was read and report made th at it had been. published and posted as required by law. Ira Karon, Attorney appeared before the council and stated he represented the petitioners. If the proposed alley is opened, Cdr. Karon said it would destroy the present landscaping which serves to screen in the commercial area. As between private and general public interests, Karon stated that all properties in the area were served by the east and west alley except Weber's property and lots 4 and 5 owned by ter. Rees. The only one to benefit from opening of the proposed alley, he Traffic said, would be the owner of Lot 4. Said that a recent check of traffic thru the present east and west alley recorded 15 trucks in 5 minutes, and that a second check later in t3~e day recorded 6 cars and two trucks in a 5 minute period. If the proposed alley is opened, this traffic will move via Crawford over residential streets, Karon said , resulting in danger, noise, dust and di s- 10 ft. added turbance from truck traffic. If the proposed alley is vacated, 10 feet would be added to Rees' property, providing for a private alley running from the present alley to Lot 4, Mr. Karon said, and added that a 10 ft. driveway would be sufficient to serve Lot 4. If the proposed alley is opened, present east and west alley will serve no useful purpose, No use for east fir. Karon asserted, stating that a request might then be & west alley made to vacate the east and west alley. Karon said that private interests in this area can be taken care of~ with a private driveway and that opening of the proposed alley would create damage and be contrary to the public interest. Sided by 28 Also stated that the petition was signed by 28 property owners, property owners asking that the petition be granted and that some who were present wished to be heard at this time: i~ilton H. Bohn, said if alley is opened, trucks coming out will make turn 1717 Asbury in his front yard so that lights would shine in their bed- room. Does not want truck traffic in front yard. R. J. Curran, would have same situation with respect to his property as 1718 Asbury described by Mr. Bohn. ~ ~~f R. J. Stenberg, Opposed to opening of alley account heavy trei'fic and 1540 Crawford danger it would create on Crawford. Howard G. Grant, Owns land close to proposed alley. Opening alley would 1546 Crawford bring kind of traffic not wanted on a residential street. Community as a whole wants streets kept residential, h® said. Buildings can be served with present alley. Mrs. Crist t~erkle expressed opposition to the proposed alley. 1732 Asbury Wm. O'Reilly, said he sold a home once to get away from traffic. 1738 Asbury Can+t afford to move again and is opposed to opening of the alley. Frank B. Spindler, Asked the council not to authorize opening of the alley. 1532 Crawford G.F. Schmitt, Definitely against opening alley. 1729 Asbury J. Borchet Expressed his opposition. 1715 Arona Kenneth A. Mousseau Does not want any more traffic on Arona. 1510 Crawford Vincent Landis lloes not want trucks on Crawford. 1538 Crawford Leo A. ~+deyer, Said traffic out of this proposed alley would make speed- 1794 Asbury way out of Asbury. Carl F. Peterson Stated he has enough now with present alley as a speedway, 1526 Crawford and definitely against opening of the proposed alley. John G. Bouthilet, appeared in opposition to the petition, stating he Attorney represented Mr. Rees and that the petition was insufficient because it was not signed by s majority of the property owners affected. He stated that vacation of the alley will petition not sufficient be in the public interest when the enti re public benefits, not just adjoining owners. Bell eves such is not the case in this instance. Said the alley does abut on commercial property and was put in as a buffer. Consequently only alley as buffer logical to have stores on lots 4 and 5 and such buildings must be aerved by trucks. Mould be greater detriment, .he said, if trucks were in front of property loading and un- loading. Suggested making proposed alley one way from Crawford so as to eliminate traffic thru residentail area one-way alley on ~rawfo rd. Trucks would enter alley from Crawford, not from alley onto Crawford, he sai~d• Also must prove it is in the public interest to vacate the alley. It i s an existing alley, he said, and they were only asking to open an alley that has been platted for some time. As a possibl consideration, Mr.°outhilet stated that i f the counci I would waive the 30 ft. setback, his client would join in the move to vacate the praposed alley. ~~~ Douglas Rees B6r. Rees asked t o be heard and said that instead of a hearing he wished we were talking informally. Stated he has owned the property 14 years that is on the alley it is proposed to close. That the condition of the present alley is the result of a com®dy of errors. :ties tried hard to work out the problem of alleys. Does not want trucks in front of buildings which may be put up on Lots 4 and 5. Said he would willingly give letter stating he would never ask to vacate the east and west alley. Said he had recently told Engineer Carley he hated to see the proposed alley opened, that he never wanted it opened and never wants driveway to Crawford, depending on what can be done abcu t the setback . Ira Karon in rebuttal stated that granting of the petition will add attorney 10 feet to Rees' property. ~s to sufficiency of petition, said the statute (which he read) is very clear. ~s to alley serving as a buffer, said it would be extending commercial operations right into the residential area. As to making a one-way alley so that trucks will only come in off Snelling and not thru the Crawford residential area; this, he said, would not cut down on the number of trucks, and said that placing restrictions on trucks using certain streets would be invalid. Said the public interest means a sufficient number of people are involved to exceed the interests of an individual. Opening of the proposed alley may also create problems in various other parts of the Village, Mr. Karon said. Mr. Karon presented snap shots with respect to drain- age; and debris in the existing alley and indicated similar conditions might prevail in the proposed alley if opened. John G. Bouthilet in rebuttal said he would like to point out a few things. ®ttorney As to Mr. Karon's suggestion that if vacation of the alley is granted there would still be sufficient room to serve Mr. Rees' property on Lots 4 and 5; Bouthilet said th ere would not be room for backing up trailer trucks or post office trucks, the latter requiring a 14 ft. drive. 6s to public interest; Mr. Bouthilet said it does concern the public who will patronize a post office as to the amount of traffic going from Snelling to the proposed alley, a distance of 150 feet. Hearing adjourned No one else wis king to be heard, t~cting ~dayor Shavor declared the hearing closed at 10 P.9Q., stating that the council would take the matter under advisement and endeavor to reach a decision at their next regular meeting. Meeting resumed. Rbgular meeting was resumed and conducting of same was taken over by Mayor Henry who arrived at this time. . 7-alley impvt. Engineer Carley's letter of Sept ember 11, with partial payts. estimate No. 2 for Gust ~. Holm Construction Co., for ?-alley improvement work, amounting to $8,514.72, and letter and statement of September 11, 1952, covering partial payment for engineering services by Mr. Carley, amounting to X750.00, was considered. Rekstad moved payment, Stewart seconded and motion carried unanimously. ~~ Alley Letter of September 4, 1952, from Richard N. Prahke complaints and letter of S®ptember 9, 1952, from G.W. Carver, both addressed to Mayor Henry, protesting conditions allegedly due to surfacing of alley in the rear of their homes, were read. The clerk was asked to inform Engineer Carley of these complaints. Rees alley Engineer Carley's letter of September 11, 1952, quoting price from Mr. Holm, contractor, of X600.00 for repairing alley adjacent to the Rees property north of Larpenteur as stated in Mr.Carley's letter. After discussion, Shavor moved to retain Carley to make a survey and to provide recommendations for the improvemen t of the east and west alley bounded by Arona, Snelling Drive, C$awford and Larpenteur. Seconded by Rekstad and carried unanimously. Iowa-Hoyt alley Letter from Attorney Graham relating to petition to petition improve alley between Iowa and Hoyt avenues from Albert to Pascal, suggesting withholding of council action on this and similar petitions until early next year. On motion by Stewart, seconded by Rekstad, it was voted unanimously that the petition b® held over and that Elmer T. Nelson, 1452 hest Iowa, whose name appears first on said petition, be so advised. Natural gas Attorney Graham's letter as to availabilty of natural gas for Falcon Heights was read and referred to the clerk who will inform those who made inquiry. Trash can - Rekstad reported the businessmen had agreed to replace Sickle bar mower - the trash can reported damaged at a previous meeting. He also reported on proposed purchase of a sickle bar mower. After discussion, it was agreed to defer purchase and to hire the work done. Weeds It was reported that John Leinen could be hired to cut weeds in the Village at X3.75 an hour, including labor and weed cutting machine, with no charge for transportation to and from the Village area. Fire runs to 1860 N. Snelling I~iatter of securing a full report on the two Fire runs to 1860 Snelling Drive the evening of August 29th, was referred to the Fire Department committee. Firemen's salaries Joint letter from Firemen Robert D. Locke and Kenneth J. Barthel, referring to their previous request for salary increases was referred to the Fire Department committee for recommendation. 40 mile speed limit, Rekstad moved that the County be notified to have 40-mile Cleveland speed limit signs placed on Cleveland avenue between Larpenteur and Roselawn.
