Lindig, Trustee George I. Lodahl, Trustee Clyde J. Stewart, Clerk Frank N. Graham, Attorney Meeting called to order at 7:50 P.M. Minutes of April 28, 1953 meeting were heard and approved as read. Hills: On motion by Lindig, seconded by Shavor, the following bills were ordered paid: Falcon Heights Hardware, supplies, 4-53, $19.82 George E, Swanson, expenses and tuition refund, Geo.E. Asked by the Mayor Station permit if they wished to be heard, Mrs. William Mock, 1397 Meat Larpenteur presented a petition dated May 11, 1953, which she eaid was signed Mrs. Mock by residents of Falcon Heights who are opposed to the installation of a service station on Kelley's property at the northwest corner of Elbert and Larpenteur. Mr. H. H. Cowie, Attorney, stated he Attorney represented Mrs. Mock and her neighbors in the matter. Mr. Cowie Cowie said that the character of the neighborhood in which it is proposed to build the Shell Oil Company service station, has changed consider- ably since the Keller property was zoned commercial in 1941. Referr- ing to the petition, Mr. Cowie said it was signed by about 75 home owners. He asked that the council reopen the matter of authorising issuance of the permit and that a date be set for a hearing on the Mrs. Mock petition. Mrs. ldock stated she did not see why the Shell Oil Company wished to locate there when the people are opposed to it, and mentioned that in her opinion the station would create traff%c ~azards fpr ohildren on their way to and from school. Dr. D.E. McCoy, 1749 Iv'. Dr. McCoy Albert, said he has resided at his present address since last fall, that he realized that the property on the northwest corner of Larpenteur and Albert was zoned for business, but that recent construction of a school in the area makes traffic resulting from erection of a.service station on this corner of serious concern. Dr. McCoy urged the council to consider rezoning the Keller property, stating that a service station in this location would alter the character of the neighborhood. Mr. ;dock ldr. t'Pilliam Mock, 1397 West Larpenteur, said the Keller building was originally built as a home and later used as a home and store with gas pumps. ~ ) -~, ~~ Shell Oil Station At this point, Mr. Robert F. Leach, Attorney for Mr. Keller, pe rn-it (cont'd) stated he was a little confused as to whether the nature of the request involved a question of rezoning the property or Attorney Leach fora hearing to revoke the permit. Village Attorney Graham replied that in his opinion that apparently this is a request Village Attorney to the council to reconsider their action of April 15, 1953, Graham in authorizing issuance of the permit. Attorney Cowi® Attorney Cowie stated the petition merely requests that the council deny permission to construct a service station on this corner. Attorney Leach Attorney Leach said that to rezone the property so that it could not be used commercially would deprive Mr. Keller of the laxful .use of his property. Mr. Leach also said he understood plans were to wid en Larpenteur Avenue into a substantial highway from Rice Street west to Minneapolis, and referred to the large area on Larpenteur between Snelling Avenue and Lexington Avenue which is now zoned commercial, also stating that Mr. Keller has Dr. i~eCo operated a business on the northwest co rner of Albert and L y arpenteur for some time. Dr. McCoy replied there was no ob3ection to Keller continuing to operate as at present, but that the proposed Shell Oil station operation would change the character of the neighborhood. Council action No one else wishing to be heard, the Mayor announced the council would take the matter under consideration. After discussion, Lodahl moved, seconded by Lindig, that the request on the council to revoke issuance of permit to the Shell Oil Company, of Minneapolis, for construction of a service station on the Keller property, be denied. The following vote was then taken and recorded: Ayes: Lodahl Nays: Shavor Lindig Stewart Henry The Mayor then declared the motion lost. :dearing Following a further discussion, Stewart moved that an informal voted hearing be held in the Village 'Mall, beginning at 8:00 P.M., Friday, May 15, 1953, on the question of whether issuance of the permit to the Shell Uil Company of Minneapolis should be reconsidered. Shavor seconded and motion carried..' Wicklund request Mr. Leslie G. Wicklund presented an agreement dated May 6 1953 for variation in Zonin Ordinance , , by which Bdr. and Mrs. V.a. Wisniesski agree to waive any ob3ection t th g o e 5-foot side yard provision in connection with an attached garage Mr. Wickland intends to build. After discussion, Stewart moved, seconded by Henry, that under Ordinance No. 1Fr the agree- ment be treated as a request for a variance and be referred to the Planning Commission fora hearing, with the request that after said hearing they report back to the council at the council's meeting set for May 26, 1953. Fire Equipment Fire Chief Swanson appeared at the meeting to answer questions pertaining to the hose clamp, Jumbo mystery nozzle and fire hose, purchase of which had been recommended by the Fire Department committee. To advertise After discussion, Lodahl moved that the Village advertise For Fire hose for bids Por 500 feet of 22" fire hose according to specifi- cations. Seconded by Stewart and motion carried unanimously. Jumbo mystery Lindig then moved that the Village purchase one 22" Jumbo nozzle mystery notale with handle. Seconded by Lodahl and motion carried unanimously. Hose Clamp Stewart moved purchase of one hose clamp. Seconded by Shavor and oarri ed unanimously. Village The D~ayor read an agreement dated May 4, 1953 and signed by dry wells George DaBruszi, stating he would do certain wo rk and black topping aroundti''~wo Village dry wells at Idaho and Snelling, labor and materials not to cost the Village in exoess of X100.00. Stewart moved that the work be done by Mr. DaBruzzi as stated. Seconded by Lindig and so ordered. Streets Street Commissioner Seaborn reported on work being done in the way of repairing the streets. He also reported raising of load limits on Village streets to 4 tone per axle load. Load limits After discussion, Lindig moved that the load restrictions imposed by resolution adopted Marsh 10, 1953, be removed effective May 20, 1953, and that signs be removed at that time. Henry seoonded and motion carried unanimously. Civilian Defense Letter was read from Mary L. Kruglak, Falcon Heights divi3ian budget defense director, requesting X240 for budget year to provide local civilian defense emergency supplies. Attorney was asked to check the statute to see if the Village may properly incur such expense. Fire Dept. Lindig moved approval of Requisition No. b, covering supplies requisition needed by the Fire Department, excluding the lawn mower item. Shavor seoonded and motion carried. Clerk's requisition On motion by Lindig, seoonded by Henry, requisition No. 4 covering supplies needed for Clark's office, was ordered approved. Budget change The clerk reported on difference of $4,000.00 between the tax levy approved October 9, 1952 and certified to the County Auditor and the Treasurer's 1953 budget estimate. On motion by Henry, seoonded by Lindig, it was voted to ask the Treasurer to change the budget and to place the X4,000 in the general fund. Street Bill covering work on streets by the County during period bill March 26 to April 25, 1955, amounting to X266.76 and payable from 1953 allotment, was noted by the council. Bonds Letter of April 28 Prom Piper, JaPfray and $opwood offering to sell to the Village at par and accrued interest to date X5,000 Fal oon Heights 1.60E bonds due September 1, 1953, which they had taken in, affording a saving in interest charges to the Village. The clerk was asked to discuss the question with the Public Examiner's office. Vital Statistics Letter from Deputy State Registrar enolosing copy of a bill passed by the 1953 state legislature and signed by the Governor, providing that townships and villages will .not be continued as registration districts for vital statistics after July 1, 1953. Fire Dept. Letter of April 27 from Fire Chief Swanson requesting Convention - authority Por attendance of State Fire Department Carnival Convention to be held at Sauk Centre, June 8-9 and 10, 1953. Also re carnival to be held June 12-13 and 14, 1953 at Larpenteur and Snelling and beer and bingo permits desired by fire department for those dates. The clerk was asked to secure a schedule of such conventions and meetings for the balance of the year with amounts voted to date for this purpose for the council's consideration.
