REGULAR MEETING, TUESDAY, MAY E6, 1953

Pfeet ing called to order at 7:45 P.M., and minutes of regular meeting,
iday 12, 1953 and of special meeting, May 15, 1953, were heard and approved as read.
Wm. P. dock appeared before the Cou noil to request more time for complet-
1397 Larpenteur ing a petition to rezone the Keller property on the northwest
Avenue West corner of Albert and Larpenteur . George Keller was present
and agreement was reached that the petitioners would submit
th sir rezoning petition about June 2 or 3rd for sufficiency
cheok by the Village Attorney. The Council then agreed to
set a hearing on said petition for Tuesday, June 16, 1953,
beginning at 8:00 P.~fl., at the Village Hall, provided the
petition is found to be sufficient.
Bills: On motion by Lindig, seconded by Shavor, the following bills
were ordered paid:

R. N. Weatherston, Stated he had learned that natural gas would be extended to
1867 N. Simpson Falcon heights in the near future, and urged adoption of a
strict ordinance providing for installation fees and for
posting of bonds to insure proper and safe installations.
Mr. Weatherston also called attention to what he considers
unsatisfactory drainage conditions fn his neighborhood, and
was informed by the Mayor that repairs to portions of the
streets and driveways have been ordered.
Dairy far, John Bouthilet, Attorney, appeared in connection with request
Douglas Rees of LRr. Douglas Rena far variance in setback requirements in
property co nnection with secu ring a permit to build a dairy bar at
1702 Snelling. Letter of raay to^, 1953, from the Village
Planning Commission, recommendi ng that the building proposed
by %r. Rees be erected in line with the houses Pacing Snelling
Drive no rth of Crawford Avenue or that said building conform
with the Yillag a ordinance, was read. The matter of issuing
a license under the drive-in provisions of Ordinance No. 12
for operating a Dairy Bar at 1702 Snelling was then discussed.
Mr. Bouthilet agreed there would be no purpose in granting
the building permit if licensing of the dairy bar might not
be approved. It was then agreed to have the proposed dairy

Dairy Bar bar operator submit an application for license for consider-
ation at a properly scheduled public hearing.
Parks & Clarence Rekstad, 1790 N. Pascal, told the council that he
Playgrounds - believes the two dry wells installed on Village property at
dry wells. Idaho and knelling drive are functioning as intended. He
requested authority for securing roto tiller to break up
and prepare the grounds for seeding to grass. After discussion,
Shavor moved that Rekstad be authorised to arrange for use
of the roto tiller for the purpose requested, with the under-
standing that total cost to the Village shall not exceed
X100.00. Seconded by Henry and carried unanimously.
Larpenteur Attorney Graham suaunarized letter of May 15, 1953, from the
Federal aid State Highway Department, requesting the Council to peas
route a resolution, designating that part'of Larpenteur Agenu6
within the Village limits as part of an Urban Federal-aid
route. After discussion, the following resolution was
adopted by a wnanimous vote upon motion by Shavor, seconded
by Stewart -
"BE IT RESOLVED, By the Village Council of the
Village of Falcon Heights, Minnesota, that it approves
designation of that part of Larpenteur Avenue located within
the Pillage limits as part of an Urban Federal-aid route,
and that the Clerk transmit a certified copy of this resolution
to Mr. 0. L. Kipp, ~ssistant Commissioner and Chief Engineer,
Department of Highways, State of Minnesota."
Civilian In connection with proposed Civilian Defense budget for the
Defense bal~ae of 1953, Shavor moved that the Council authorize
an expenditure up to X240.00 for necessary Civilian Defense
supplies, all purchases to be requisitioned through th e
Council. Seconded by Stewart and carried unanimously.
Pedestrian Pedestrian cross-walks in the Larpenteur-Snelling business
Cross-walks area with traffic oontrols, were again discussed. Shavor then
moved that the matter be referred to County Commissioner Tony
Schmidt by Trustse Lodahl for further investigation. Stewart
seconded and motion carried.
Natural Gas On the question of natural gas, Attorney Graham reported that
the League of ~t~nnesota Municipalities has appointed a special
oommittee to study arri to report on this matter. "rhe League
' is also working on a model ordinance, he said, ancat the
Council take no action on the matter until the Northern States
Power Company presented a request for installing mains.
Beer and In connection with letter of April 27, 1953, signed by the
Bingo permits, Fire Chief, requesting that the Fire Department Relief
Fire Dept. Association of Falcon Heights be permitted to hold a bingo
Carnival game and to sell beex«~nt its carnival to be held on the
southeast corner of Larpenteur and Snelling, June 12, 13 and
14, 1953. On motion by Shavor, seconded by Stewart, it was
voted unanimously to issue the Association an on-sale beer
license, at no Pee, to sell bear +~its carnival June 12, 13
and 14, 1953.

-Beer and With respect to the bingo permit, Attorney Graham advised the
Bingo per- council that the statute governing regulation of bingo games,
mite, Fire Sec. 614.054, provides that bingo dames esn be conducted by
Dept. religious charitable, fraternal or other associations if the
carnival proceeds ~ o not inure to any individual and if the assodiatt~an
(cont'd). before conducting the same gives thirty days' written notice of
the time and place to the Village Council, and the Village
Council does not pass a resolution ob3ecting thereto.
Said written request from the Fir® Chief, dated April 27, 1953,
for a permit for the Fire Department Relief association to
operate a bingo game in connection with its carnival to be held
June 12, 13 and 14 at the southeastw corner of Larpenteur and
Snelling, was considered and upon motion by Stewart, seconded
by Shavor, was unanimously approved.
Lauderdale Letter of May 19, 1953, from Helena Gunde rson, Clerk, Village
stand-by charge of Lauderdale, was read, advising that the Village Council of
increased Lauderdale at a regular meeting May 12, 1953, voted unanimously
to accept increase in its fire protection standby charge as
per notification from Falcon Heights to $100.00 per month
effective June 1, 1953.

variance request Recommendation of the Village Planning Commission on the
Leslie G. ~fficklund variance request was considered. On
motion by Henry, seconded by Lodahl, the following resolution
was adopted unanimously:
RESOLVED, that the recommendation of the Planning Commission
in its letter of I~ay 25, 1953, that the request fora variance
submitted by Leslie G. Nicklund be granted to permit him to
erect his attached garage so that the north wall of said garage
will be four f eel south of the northerly line of Mr. Wicklund's
lot described as Lot 18, Keller Manor.
Bonds Letter of April 28 from Piper, Jaffrey and Hopwood, offering
to sell ~o the Village at par and accrued interest to date
X5,000 Falcon heights 1.60% bonds due September 1, 1953,
was again discussed. Treasurer Van Hoven wai requested to
write Piper, Jaffrey and Hopwood that the Village is not in a
position to purchase the bonds before maturity.
Health The clerk reported receipt of another request from the State
" Health Department for the name and address of the Village
Health Officer. The request was referred to the Mayor for
handling.
Hose Clamp The clerk submitted bids from the following companies on
a Hydra shut-off hose clamp -

Shavor moved that the Clerk be authorized to purchase said
hose clamp from the Auel Equipment Company at a price of X40.00,
delivered. Seconded by Lodahl and carried unanimously.

Lodahl then moved to authorize purchase of said 2~" Jumbo
mystery nozzle with adapter from the Luverne Equipment
Company at a price of X63.00, delivered. Seconded by Shavor
and carried unanimously.
Treasurer van Hoven requested authority for payment of
X17.86 to the Fire Department Relief hssociation,
covering insurance aid to fire departments, being 12~
balance of 1951 apportionment. Henry so moved, seconded
by Lodahl, and motion carried unanimously.
Bus operation The clerk presented a petition signed by about 50 persons,
on Hoyt requesting that the council pass a resolution against
opposed operation of Street Railway buses on Hoyt avenue between
Hemline and Pascal. The council agreed to defer action on
the request in order to give those in favor of present
bus operation on hoyt an opportunity to be heard.
Fire Chief is The clerk reported that in connection with receiving bids
sales representative on the Hydra hose clamp and Jumbo mystery nozzle, that the
for fire equipt Fire Chief reported he was sales representative for D.J.
Company while ti9o11 Company, Minneapolis, and asked to file bids. The
off duty. matter of equipment or supplies purchased by the Fire
Chief for the village was then discussed. The clerk was
requested to write Fire Chief Swanson, info rming him
that no equipment or supplies needed by the Falcon heights
Fire Department shall be purchased by Swanson from any
company or person he represents.
Adjournment: On motion, the meeting adjourned at 12:20 A.M., iuiay 27th.
