Stenzinger, Mayor; Trustees, George J. Shavor, Andrew Hustrulid, and David P. Cartwright, and Clerk, Clyde J. Stewart. also present were William E. Olsen, Treasurer, and Village Attorney, Frank N. Graham. Minutes of Decemb er 22, 1953, were heard and with reference to 'Lindig's permit', page X31, stateme nt with regard to property zoned commercial was corrected to read zoned "farm residence.' The minutes were then approved as corrected. Summons re In connection with the summons dated December 21t, 1953, registering naming the Village of Falcon Heights a defendant in the title ?~aple matter of application of Cetera Realty Corporation to Knoll Addn. register title to Clapp-Thommsen t1~Jlaple Knolls' addition, Attorney Graham's letter of January 11, 19511, was summarized, the attorney reporting that since the Village has no interest in the property he would not advise putting in an answer to the summons, and that while he knew of no special assessments against the property that tYie clerk could determine this, Cartwright moved approval of the attorney's recommendation subject to check by the clerk of any special assessments against the property. Hustrulid seconded and motian carried unanimously. Doan spout Letter from the ~;r,F. 5tepnitz Agency, by Don Julen, water, Natl. relative to water from the dawn spout at the northeast Tea Store corner of the National Tea Store running into the alley, Shavor moved that the S±,epnitz Agency be asked to connect the downspout to the underground drain as early in the spring as possible~t. Seconded by Cartwright and so ordered. (Don Julen being present, the clerk filed the request with him.) 4 ~ ~! Civil Letter relative to our Civil Defense program was read. Defense Attorney Graham stated that the suggested Civil Defense ordinance conforms wi th State statutes, and that Civil Defense Directors, Kruse and Kruglac, would like to have the proposed ordinance considered. Ne then furnished each council member a Civil Defense manual, calling their attention to a proposed ordinance on page 107. The r~Iayor announced that a Ciitil Defense meeting had been called for January 19, 195l~, starting at 8s30 P.M., at which time the proposed ordinance would be read and discussed. Stewart moved that Stenzinger and Cartwright be appointed as a committee to attend. and to submit their report at the next council meeting. Hustrulid seconded. and motion carried unanimously. Civil Letter of December 3, 1953, from 49. Gayle Starnes, Staff Defense College, Olney, Marjrland, relative to the College's regular course in Civil Defense Administration, was read and ordered filed. Annual Letter of January !~, 195~t, from J.L.P. Darrell, Traffic Traffic Engineer, Department of Highways, requesting report from Safety the Village covering traffic safety activities during 1953, Report was read. Stewart moved that the request be referred to our Fublic Safety Committee Chairman for handling. Shavor seconded and motion carried. County credits Letter of January 11, 1951, from the County ~.ngineer as charged on to the County after discussion with Arthur Lindig agreeing Dec. street dot to charge the Village for drainage work performed in Sept. bill. 1952 in the amount of ~21t6.51. To conform with the County's request and bookkeeping procedure in giving the Village credit, Shavor moved that the Clerk be asked to request the County Engineer to deduct the sum of ~21~6.51 from the Falcon Heights 1954 allotment with the understanding that the County give the Village a credit on our December 1953 bill of ~2~t7.21. Seconded by Cartwright and carried unanimously. Fire Dept. Annual Report of the Fire Department for 1953 was presented Report 1953 and discussed with the Fire Chief, Shavor then moved that the report with respect to activities of the department for 1953 and as to inventory be accepted. Seconded by Stewart and motion carried. Civil Service Letter of January 2, 19511, signed by Fire Department paid for Fire Dept. employes, George E. Swanson, B. J. Slama and Stanley P. Schultz, was read requesting the Council to establish civil service for the Fire Department. After discussion, Stenzinger moved that the communication be referred to our attorney with request to check applicable statute and to report back at the next meeting. Stewart seconded and so ordered. Fire Dept. Letter was read from Henry J, Dachtera, Secretary, Volunteer Committee Fire Department, relative to reactivating the Fire Department committee as provided for in Ordinance No. 1. It was agreed that Dachtera's letter would be considered when appointments to the Fire Department committee are made. -. ~~ Ei ?aster Gas On motion by Cartwright, seconded by Shavor, it was voted Installers' unanimously to approved applications for f42aster Gas Installers' licenses licenses to the following firms and of issuance of said Nos. 16 R~ 17 licenses as dated: A~i.G.I. license No. 16 to Theo. Helle ~ Company, 12-28-53 " " " 17 to Standard Heating Company, 1-7-5l~ Street Appraisal In connection with Minnesota Highway Study Commission's letter and Report of December 23, 1953, Shavor moved approval of order placed on hecember 29, 1953, requesting the County Engineer to make street appraisal and report as desired by the Study Commission. Seconded by Cartwright and carried unanimously. Pre fab Don Julep, of the Stepnitz Agency and Arthur Tieso, representing home Tiesto Gontractors, appeared before the council in connection with a proposal to build a P. ?~ H. Pioneer Nome (pre fab home) at Pascal and Larpenteur to be used as an office by the Tieso. Contracting Company. after discussion, 1~tessrs. Julep and Tieso were informed that construction of the home is not permiss- ible under the ordinance without rezoning of the property. Plans for the proposed P&H Pioneer home were then turned over to Building Inspector Christensen for checking against requirements of the building code. On motion by Hustrulid, seconded by Cartwright, it was voted to approve same. Revolvers, badges, The Clerk reported that Village property, consisting of two helmets 38 special Smith ~ ~Teston revolvers, 2 police badges and 12 helmets were turned over to him recently. (revolvers in holsters). Also that the 19119 books record the following items purchased for policing: Acct. Stenzinger then moved that the revolvers, badges and helmets be left with the Village Clerk until further council action, and that other items as listed be left with the Fire Department. Seconded by Stewart and so ordered. Le~tal newspaper The following resolution was moved by SteRa~t~gerseconded by w $#~etrt}lt1[i, and adopted unanimously: RESOLVID, That the Rose Tribune, a legal newspaper of general circulation in the Village of Falcon Heights be and it hereby is designated as the official newspaper of the Village of Falcon Heights, in~which shall be published such ordinances and other matters as are required by law to be so published, and such other matters as the Council may deem it advisable and. in the public interest to have published in this manner far the year 195 Bank Depository The following resolution was moved by Stewart, seconded by Cartwright and adopted unanimously: f 1 "'RESOLVED, That Falcon Heights State Bank of Falcon Heights, *s~innesota, be and hereby is designated as a depository for the funds of the Village of Falcon Heights, and that the Village Treasurer is authorized to deposit village funds therein to the amount of forty-five thousand doll ars(~45,000.00) ..~ Bank Depository RESOLVED FURTHER, That the present collateral furnished by (cont'd) Falcon Heights State Rank consisting of forty thousand dollars (~1a0,000,00), face value, of U.S. government obligations, accompanied by an assignment providing that in case of default on the part of Falcon Heights State Bank the council has full power and authority to sell the collateral or so much as may be necessary to realize the full amount due the municipality, is hereby approved, said collateral having a market value in excess of 10~ over the amount of the above authorized deposit in excess of the amount guaranteed by the Federal Deposit Insurance Corporation. RESOLVED FURTHER, That checks of the Village of Falcon Heights drawn upon the said bank account shall be honored by said bank only if signed by all three of the following: .Robert E. Stenzinger, Mayor; Clyde J, S+,,ewart, Clerk; and bdilliam E. Olsen, Treasurer. RESOLVED FURTHER, That this designation shall be effective only until the end of the present council year, and. that a copy of the resolution duly certified by the Clerk be delivered to the Falcon Heights State Bank. Village Attorney Stenzinger moved that the firm of Briggs, Gilbert, Morton, Kyle and ?.tacartney, of St Paul, Minnesota, be engaged as attorneys for the Village for 19511. Seconded by Stewart and carried unan imously. Posting Places On motion by Cartwright, seconded by Shavor, the following posting places were designated for 19511: (1) Blomberg's Store, Iowa and Hamline avenues (2) National Tea Store, Larpen±eur and Snelling avenues (3) Gibbs School, Cleveland and Larpenteur avenues Council Meetings Hustrulid moved that regular meetings of the council be held on the second and fourth Wednesdays of each month, in the '" Village Hall, peginning a t 7:30 P.M., with provision that if the meeting date falls on a legal holiday that the meeting be held on the next secular day. Seconded by Stewart and carried unanimously. Safety Deposit Stewart moved that the Village continue renting a safety deposit box box at the Falcon Heights State Bank at a rental of X5.00 per year. Seconded by Cartwright and carried unanimously. Village Assessor On motion by Shavor, seconded. by Hustrulid, it was voted unanimously to recommend William Torgerson as Village Assessor for 1951. Street Commissioner Stenzinger moved appointment of G.S. Seaborn as Village Street Commissioner for 1951. Seconded by Cartwright,axct motion carried unanimously, and Seaborn declared duly appointed to office. Building Inspector On motion by Hustrulid, seconded by Cartwright, it was voted unanimously to appoint Nick Christensen to the office of Building Inspector for 1951. The Mayor then declared Christensen duly appointed Village Building Inspector. ~~ ,u Public On motion by Stenzinger, seconded by Cartwright, it was Safety voted to defer appointment of a Public Safety Committee Committee Chairman until a hearing can be held with the present '? Public Safety Committee Chairman, representatives of the Sheriff's office and citizens of the Village, Planning Commission In connection with vacancy on the Village Planning Commission as of December 31, 1953, Stewart moved that. C. K. Otis be appointed to membership on said Planning, Commission for a term of three years, commencing January 1, 195l~. Stenzinger seconded, motion carried unanimously, and Otis declared duly appointed to office. Board of Health Shavor moved appointment of Dr. Thos. Krezowski as Chairman, Board of Health, for term of office expiring on the first business day in January, 1955. Stewart seconded, motion carried unanimously, and Dr. Krezowski declared duly appointed to office. Gas Inspector Stewart moved appoint e~ E. D. parson as Village Gas Inspector for the year 195, Seconded by Hustrulid, motion carried unanimously, and Larson declared duly appointed Village Gas Inspector. Salaries: Shavor moved that salaries for the Mayor and Trustees for the year 195 be set in amounts as follows: Mayor, X50.00 monthly Trustees, each, Sk35.U0 monthly Hustrulid seconded and motion carried. Shavor moved, seconded by Cartwright, that the salary for 'T'reasurer for the year 1951 be set at 9~l~0.00 per month. i~~otion carried. After discussion, Cartwright moved that the Clerk's salary for the year 1951 be ~6150.OU per month, Seconded by Shavor and so ordered. Financial statement In connection with preparation of the Village financial statement for year ended December 31, 1953; Shavor moved that. the Clerk be authorized to arrange for assistance on the same basis as last year and for publishing the 1953 financial statement in the Rose Tribune. Seconded by Cartwright and so ordered. Treasurer's Reports Ralx~h Van Hoven, former treasurer, reported on the Treasurer's 1954 Budget Estimate and about proposed arrangements for furnishing_ a copy of said estimate to each member of the council, Justice of the Bond for newly elected Justice of the Peace was considered. Peace bond Cartw~rght moved that the surety bond for the Justice of the Peace be set in tree amount of X500, and that said bond be secured for a two-year period, beginning January 1, 195l~. Seconded by Hustrulid, and motion carried. ,j I I Treasurer's A~atter of setting the amount of the Treasurer's bond was Bond considered. Letter from the Village Attorney was read in this connection, and the matter was discussed with the former Treasurer, Ralph Van Hoven. Stewart then moved that the surety bond of the .Treasurer be set in the amount of X1,000 and that the treasurer be authorized to secure said bond on a two-year basis. Seconded by Shavor and so ordered. Treasurer's Monthly Treasurer Vtiilliam Olsen asked the council if the treasurer's Reports monthly reports with copy for each council member, showing balances in the various fundd~should be continued. Stenzinger moved that the treasurer be-asked to continue said reports. Hustrulid seconded and motion carried unanimously. Lauderdale Letter from the Village of Lauderdale was read, enclosing Standby check for ~lOG.00 covering January 195lt standby charge, Fire run but stating that the Lauderdale council had tabled the X75.00 .charges charge for fire run Dec. 31, 1953, pending investigation. Fire Chief Swanson reported that Lauderdale had informed him subsequently that check for the fire run charge would be forwarded to our treasurer. Lauderdale The Clerk inquired if the Fire Contract with Lauderdale should Fire Contract be revised to include protection for a three-block strip between Pleasant and ~Pdalnut to be annexed by Lauderdale. Our Attorney then reviewed terms of our standby fire contract with Lauderdale, seating_ that ~gid matter should be considered by the council when the new area becomes a part of Lauderdale effective February 11, 195lt. 1 Master Gas On motion by Cartwright, seconded by Hustrulid, it was voted Installer's to approve~t application for Master C=as Installer's license License #18 by the A.B.C. Heating Company, of St Paul, and of issuance of master Gas Installer's license No. 18 to said Company as of January 16, 1951.
