HomeMy WebLinkAboutCCMin_54May5_Special~~ Lauderdale As to a proposed meeting with the Lauderdale Village council Standby for adjustment of the standby fire protection charge, the contract clerk reported that upon request of the Mayor the letter referred to in the minutes of March 2lt, 1954 was not mailed, with the understanding that arrangements were to be made that the council or representatives of the council would meet with the Lauderdale council and discuss the matter of adjusting the standby contract. Upon motion by Hustrulid, seconded by Stewart, this action was unanimously approved and Mayor Stenzinger and Trustee Shavor were designated as representatives of the council to meet with the Lauderdale council .regarding the proposed standby contract adjustment. Outside phone Stewart reported that in case approval is not secured by booth the Telephone company for an outside phone booth on the northeast corner of Larpenteur and Snelling, that assurance has been given by the owner of property at the southeast corner of this intersection that the booth may be placed there. adjournment: On motion, the meeting adjourned at 11 P. M. ..~ ~. Approved a-~~i-~ Mayor SPECIAL MEETING, WEDNESDAY, May 5, 19511 Meeting called to order at 8:10 P.M. Roll call recording the following council members present: Robert E. Stenzinger, Mayor; George J. Shavor, Trustee, David P. Cartwright, Trustee; and Clyde J. Stewart. Absen t: Andrew Hustrulid, Trustee, William E. Olsen, Treasurer. Present: Frank N. Graham, Attorney. Also about 110 persons, including citizens, representatives of the oil industry and Twin City filling station operators were in attendance. The Mayor opened the discussion by stating the meeting had been called for the purpose of hearing representatives of the oil industry, Twin City Filling Station representatives, and }~terested citizens on the proposed ordinance for licensing gasolin~e`'~ ~~9a.tions. The proposed ordinance was then read. After discussion, it was agreed to re-read the proposed ordinance section by section, with the Mayor asking for comments or questions. ~.~ ~, L.A. Rossiter 1300 Harmon, Place, Minneapolis, Standard Oil Company representative, inquired as to proposed license fees and period covered. H.P. Bruncke 1710 N. Albert, asked if additions could be made to the proposed ordinance for control of 2!t-hour parking of trailers and trucks. Trustee Shavor inquired whether a filling station business includedzenting of trailers, selling used care~Attorney Graham stating no ordinance provision precluded a station operator from doing so. Mr. Rossiter inquired how different hours of operation could apply to different stations. As examples, Trustee Cartwright cited one station surrounded by Residence A properties where 2!t-hour operation would interfere with children in the area getting their proper restf-with another station in a 100 commercial area where there would be no reason for limiting hours of operation on the basis of public health. Harry Franklin, Secretary, Ramsey County Petroleum Retailers Association, questioned the authority of the Village tb fix different closing hours for one filling station as against another. Attorney Graham replied that the council has the power to limit the hours of operation of a filling station, and in a proper situation it is not unconstitutional. Samuel J. Cavallaro, 1697 N. Hamline, inquired regarding provisions for hearings on license applications. Raymond ~S3y, 1365 ~, Larpenteur, inquired as to the number of filling stations that may be permitted to operate in the Village, and. was advised that the council does not have the power to limit the number of stations, Mr. Rossiter stated that if the council has general powers, would it be necessary to mention in the ordinance the matter of regulating hours of operation. He was informed that this was specified in the proposed ordinance at the councils request. Mr. Franklin said he had talked with some of the dealers about the licensing provision and that the dealers expressed the opinion the Village needs money and probably will license all bum.-Hess. In doing so, he said the license fee should"be on the same level for each business, Attorney Graham reported that in charging a license fee, that it is not for revenue purposes, but for policing and looking after the general welfare of the Village, covering the cost of Fire Department inspections and approximating the cost of seeing that the ordinance provisions are carried out. A comparison with other business would have to be on the basis of the cost of regulating other businesses, the attorney said. Mr. Rossiter questioned that the applicant for a license should be required to see that all real and personal property taxes assessed against the filling station property have o will be paid, In replying, it was pointed out that. the owner of a property would be receiving his rent from the operator of the station, and. in a situation of that kind. that no one should be allowed to let the taxes go where there is money available. L.T. Gasink 1402 @Y, Larpenteur, who arrived at the meeting after the point had been discussed, inquired as to restrictions on types of business which a filling station may operate, such as a garage. Kenneth Liedholm 100 N. Albert, said the filling station in his neighbor- hood was being used as a truck terminal. Ernest E. Taylor who is leasing the station at Albert and Larpenteur,stated that he is a family man trying to make a living, th at the property occupied by his service station is zoned commercial, ' acrd that trucks he services are used for hauling parcel post packages from various business places to the postal department. Mrs.Ydm.P. Mock 1397 ~. Larpenteur Avenue, said she lives across the street from Mr. Taylors station and that at times a truck arrives, loads smaller trucks and then moves out. Also that trucks coming into the station at night have damaged the boulevard, adding to a drainage problem in the area. Said the station lights are not hooded and that they shine into homes in the area. Mr. Taylor referred to thin~?s that the Shell Company agreed to do at his station after holding, a meting with two members of the council. One of these things he said was putting up a fence, which he said was shipped about two weeks ago. Said he is making every effort to maintain a clean station, and assured the council all the things agreed to will be taken care of in due time.
