M., with roll call recording all council members present as follows: Robert E. Stenzinger, Mayor; George J. Shavor, Trustee; Andret+v Hustrulid, Trustee; David P. Cartwright, Trustee; Clyde J. Stewart, Clerk. Also present, 1~illiam E. Olsen, Treasurer, and Frank N. Graham, Attorney, University Letter of May 25, 195!1, from Mr. Leonard M. Sankstone, Engineer, request to Physical Plant Department, University of Minnesota, stating that ' remove in connection with other improvements made necessary by changing ~ trees over to buses for intercampus transportation, that the University requested permission to remove four trees on Cleveland at Buford and one tree at the northeast corner of Cleveland and Carter so as to provide an increased corner radius at Cleveland and Carter avenues. Trustee Hustrulid, who had discussed the matter with Mr. Sankstone prior to our meeting, recommended that the request be approved, especially from a safety standpoint,. Shavor then moved that the request be granted with the understanding that the Clerk notify Mr. Sankstone as to the council's action as soon as possible. Seconded by Cartwright and motion carried unanimously. Protest parking A petition dated May 18, 19511 and signed by Mr. M. G. ?.?iller, trucks & car 13119 '~. California and 10 other persons, was read, requesting carriers, Falcon the council to take action to restrict the Falcon Oil Company, Oil service sta. 1350 Larpenteur Avenue 'Jest, and Oscar J. Husby, in connection - with using said property for daytime, overnight, and week-end parking of convoy trailers and trucks. After discussion, Stewart moved that Cartwright be appointed to call on the Falcon Oil Company people to see what ca.n be worked out regarding the situation complained of. Shavor seconded and motion carried unanimously. Protest resolution A petition dated May 18, 19511, bearing 20 signatures, as trans- against baseball mitted by Robert J. Moder, protesting the action of the council stadium on May 12, 19511 in adopting and sending to the Regents of the University a resolution opposing the erection of a baseball stadium within the Village, came up for consideration, After brief discussion, it was pointed out for recording that Mr. Moder is not a resident of the Village, that he is in the real estate business, and that the petition does not represent a 4 ~r majority of opinion in the Village based on results from ~.hecking into the matter. Shavor then moved that the petition be filed, Hustrulid seconded and motion carried unanimously. Five Dept. Requisition No. 29, covering. supplies needed for Fire Department, Regn. #29 was heard. On motion by Hustrulid, seconded by Cartwright, same was ordered approved. State Fire Fire Chief Swanson's letter of May 19 was read, requesting that Dept. Assn. the council authorize the Fire Chief and. one elected volunteer convention, fireman to attend said convention with expenses paid, also per Hibbing - diem for the volunteer member. After discussion with respect June llt-15-16 to how allowances and attendance at this convention fits in with the proposed educational program for the Fire Department, Shavor moved that the Fire Chief and one. volunteer be authorized to attend the A1linnesota State Fire Department Association convention to be held at Hibbing, Minnesota, June 1~, 15 and 16, 195l~, and that they each be allowed X10.00 per day to cover expenses and transportation and that an additional allowance will Eae granted to cover registration fee, also that the volunteer will be granted an allowance to offset loss of salary, if any, during his attendance at said convention, not to exceed X15.00 per day. Seconded by Stewart and motion carried unanimously. lie ed Inspector Copy of Attorney Graham's .letter of May 20 was read, regarding statutes on weed inspectors, Sec. 20.11 providing that the trill pay Mayor is the local weed inspector but may appoint an assistant share of weed inspector. Consideration was also given to the proposal weed. notice that the Village pay its proportinate share of weed notice cost publication cost within the County for 195Lt. Hustrulid moved that said payment be authorized. Shavor seconded and motion carried. unanimously. Egg The Clerk read a memo based on a phone call from Mrs. George Vending C. Harrison, 32 Mid Oaks Lane, St Paul, regarding her brother Machine who is in the wholesale egg business in southern Minnesota, wanting to establish a retail outlet by installing an egg vending machine at the Falcon Oil Co., 1350 Larpenteur Avenue bYest. After some discussion, the matter was referred to Attorney Graham for examination and report, with suggestion that he secure any avails ble printed matter the League of Minnesota Municipalities may have on vending machines. Farmers Union Attorney Graham's letter of May 21, 1954, was read, enclosing a Grain Terminal report dated ~~ay 3, 1954 of the ~hstract Clerk o~ Ramsey County, Assn. Rezoning showing the record ownership of all property within a radius of petition five hundred feet of the property sought to be rezoned by Farmers Union Grain Terminal Association, as well as a rezoning petition dated May 3, 1954 and a second petition dated May 12, 1954, .relat- ing to the petition of Farmers Union Grain Terminal Association to rezone from Farm Residence District to Business District (in the case of the May 12, 195~t petition "for automobile parking lot only') covering the following described property: ~r~~ The Southerly 217 feet of the East 250 feet Rezoning of the North 500 feet of the Northwest 1/~ petition - of the Northeast 1/1~ of the Northeast 1/It Farmers Union of Section 21, Township 29, Range 23, Vest Grain Terminal of the Fourth Principal Meridian, according to Assn. the United States Government survey thereof and the plats on file in the office of the P~egister of Deeds, Ramsey County, Minnesota. The attorney's letter also stated that he had checked the signatures obtained against the Abstrac±, Clerk's report, and believes that the petitions have been properly signed by more th an fifty per cent by number of the property owners within 500 feet of the property sought to be rezoned. After discussion, Stenzinger moved that a public hearing upon said petitions be held on June 8, 195, at. the Village Hall, commencing at 7:30 P.M-, and that the Village Clerk be instructed to post notices in the Village's three posting places and to inform the Farmers Union Grain Terminal Association. as to the date of the public hearing. Cartwrigh t seconded. and motion carried unanimously. Landscaping The matter of grading and landscaping the Village Hall grounds Village Hall to conform with similar improvements to be made by the Farmers grounds Union Grain Terminal Association on its ad3oining property, was discussed. Stenzinger moved appointment of Trustee Shavor to work with Mr. Gallaher of the Farmers Union Grain Terminal Association in this connection. Seconded by Stewart and motion carried unanimously. t.2.G.I. License On motion by Huc~trulid, seconded by Cartwright, it was voted No. 21 to approve issuance of Master Gas Installer's License No. 21 to John D. Nassinaer, of Hassinger-Stroud Heating, 1569 Selby Avenue, St Paul, as of May 15, 1951, for period May 15 thru June 30, 195>a. Gas Inspection, In connection with his r event inspection of the gas installation Falcon Dry at the Falcon Dry Cleaners, Mr. Larson, Village Gas Inspector, Cleaners reported that the previous stack temperature of 960 degrees with oil had been reduced with gas installed to 6l~0 degrees. ~'Phile the fire hazard has thus been reduced considerably, Larson pointed out that in the City of St Paul where the space above the boiler is as limited as this that wire lath and plaster are required. After discussion, it was agreed that the Fire Chief should ask the Falcon. Dry Cleaners to comply with Sec. 1t-28 of the Building Code ordinance. Zenon After discussion, Cartwright moved that the action of the council M.G.I. at its b".ay 12, 195Lt meeting, approving conditionally the request license of ?fir. Ralph E. Zener, 203J~ Asbury, for a Master Gas Installer's license, be rescinded upon recommendation of our gas inspector, with the understanding that if Mr. Zenon takes and passes the St Paul examination that the council will reconsider his application, also that the council authorizeSrefund of X30.00 covering Master Gas Installer's license fee, which Mr. Zenon paid at the time of filing his application. Supply Corp., b lite bulbs, 3-22, 1~7¢ Zenor Heat Co., Refund MGI license fee, $30.00 Lighting of Trustee Hustrulid reported that Mr. Bishop, of .the Falcon business area Heights Businessmen's Association, indicated that the report on the proposed lighting of the Snelling Avea ue- Larpenteur business area would not be ready for presenting to the council until the next regular meeting of the council. Legislative Mayor Stenzinger reported that at a recent meeting of our committee Legislative committee matters were considered pertaining to (1) securing of Railway express service for residents of the Village (2) possibility of getting a sewerage connection thru Lauderdale (3) checking into natural gas rates in the Twin City suburbs and in outlying areas (!~) forming a metropolitan planning commission. In connection with the latter, Trustee Shavor reported that the League of Minnesota Municipalities is sponsoring a metropolitan planning commission and agreed to discuss this with our Legislative corn~nittee Chairman. Public Safety The Mayor also reported that the Public Safety committee have Village policing in operation. Ordinance No. 28 A proposed firearms ordinance was read and discussed. Stenzinger then moved adoption of Ordinance No. 28, AN ORDINANCE PROHIBITING THE SHOOTING OR DISCHARGING OF GUNS, AIR GUNS, PISTOLS, REVOLVERS, OR O'"HER FIREARMS ~'lITHIN THE VILLAGE OF FALCON HEIGHTS, ~D PROVIDING A PLfi1ALTY THEREFOR. Seconded by Hustrulid and the following vote taken and recorded: Ayes: Stenzinger, Shavor, Hustrulid, Cartwright, Stewart Nays: None Ordinance No. 28 was then declared duly adopted by a unanimous vote and publication of same was ordered. `~~~ Alleys Street Commissioner reported he had secured a price of X60.00 per alley, including oiling, seeding and labor on improved alleys. In connection with alleys it was proposed be accepted by the Village for maintenance, Seaborn was asked to bring in details on same with minimum specifications to be accepted and estimated annual maintenance costs, not including snow removal. Adding machine - In connection with adding machine needed in the Treasurer's Treasurer office, several bids secured by the Clerk and Treasurer on adding machines of different companies were reported on. Following a discussion, Cartwright moved that the Treasurer be authorized to purchase a Contex portable adding machine at the quoted price of X49.50. Stenzinger seconded and motion carried unanimously. Maple Knoll As to possible drainage problems in the Maple Knoll area, drainage Street Commissioner Seaborn stated he and "r~gineer Carley planned to check into this matter and report back to the council. Re-deposit checks As to Village checks No$. 70, of July 28, 1949; 1Vo. 509, returned by June 30, 1950; No. 1004, June 26, 1951; No. 1468, June 24, University 1952; and No. 2092, June 10, 1953, offered as rental for Village Hall property but returned by the University of Minnesota, Treasurer Olsen reported he had been informed by the Public Examiner's office that these checks should be redeposited in the Village's account- After discussion, Stenzinger moved that the treasurer be authorized to handle said checks returned by the University as advised to do so by the Public Examiner's office. Cartwright seconded and so ordered. Insurance policies The analysis of Village insurance policies as prepared by analyzed Mr. W. A- Mortenson was read and discussed. Cartwright then moved that the Villa ge Clerk be instructed to write Mr, Mortenson, thanking him for reviewing our insurance policies and inviting him to bid on same on renewal dates, Stenzin~?er seconded and motion carried unanimously.
