SEECIAL MEETING, MONDAY, OCTOBER 18, 1954
Meeting called to order at 7:45 P.M., roll call recording the following council
members present: .George J. Shavor, Acting b;ayor; Andrew Hustrulid, Trustee; David P.
Cartwright, Trustee; Clyde J. Stewart, Clerk.
Also inattendan ce were: Gilliam E. Olsen, +~reasurer; Frank N. Graham, Attorney,
Milner 1~'. Carley, Engineer; Planning Commission Chairman Lorris Williams and members,
C.K. Otis, J.A. Gallaher and Nick Christensen. Mr. N. L. Hermes and his attorney,
Mr. Charles E. Nieman, also were present.
Acting Mayor Shavor briefly reviewed the discussion held with Messrs. Hermaes and
his attorney, Mr. Nieman, at our regular meeting of October 13, as toa`re'arrangement
of the Crossroads Addition plat submitted by I~r. Hermes and the council's decision
to hold this special meeting for discussing the matter further with Engineer Carley
and the Planning Commission members present.
The Clerk was asked to read the Planning Commission's letter of August 21 , 1954,
recommending that the plat be re-drawn tm s~imx a 60-ft. roadway for Fry street.
Engineer Carley's letter of October 11, 1954, also was read, recommending that
Fry street be dedicated to a full 60-foot width, with recommendations as to necessary
construe tion if the street is to develop with houses being built on each side of it.
Mayor Stenzinger At this point (8:00 P.M.) Mayor Stenzinger arrived and took
charge of conducting the meeting.
Hermes-Nieman Mr. Hermes and his attor~aey, Mr. Nieman, were asked if they
wished to be heard. Mr. Nieman stated that since acquiring
a 12 foot strip, rdr. Hermes' property abuts on Fry street
which is 33 feet wide. Mr, Nieman said the developer is in
a position to do nothing~or sell his property off along Fry
street, stating it was a question of how much he could spend
and still have enough left to come out properly. Agreed from
the standpoint of the Village that it would be desirable ta~timately
to have a 60-foot street, but pointed out that qtr. Hermes as
one individual cannot afford to carry the freight that will benefit
property owners on both sides of the street, and that Mr. Hermes
does not control property to provide for a 60-foot roadway on
Larpenteur. Said there was a question whether we ought to have
a 50-foot street 100 to 150 feet off I,arpent,eur and then 60 feet,
or if the proper thing is to lay out the 50-foot street at the

present time. Mr. Nieman stated he believed most of the Village
streets have a 30-foot roadway, and to require the developer
to show a 60-foot road would pile to much expense on I~1r.
Hermes, and in that case would consider withdrawing his plat j
and doing nothing.
Engineer said he appreciated the position Mr• Hermes is in and the problem
Carley he has to develop his property as cheaply as possible, but that
he did not follow the reasoning for not opening up the 60-foot
street. Carley said the 60-foot street has no connection with
what has been done elsewhere, also where this has not been done
properly that we are paying the price, and that it never will be
corrected unless we open streets at a standard width. He said
if homes are.to be constructed on the east side, the Village will
be forcad in the not distant future to widen the street. If a
performance bond is secured, this assures that the street will be
improved according to Village standards, Carley said. ndr. Carley
said the Village may require a performance bond or assess the
cost against the benefited property.
Attorney Graham In questioning Cdr. Carley, Attorney Graham brought out that the
questions Carley present roadway is on the 33 foot strip and that this is a 20-foot
street. As to the Village roadways being 30 feet, Mr. Carley
said that the new plan calls for 32 feet, allowing for boulevard
tree planting and snow plowing service. As to construction
cost, ?Ar. Carley said this could be done from a long range
standpoint for $~Lt,,.~iQO. CtO... He said thg counc~.l may assess the
costs but this is something that will have to be worked out.
The other way he said would be to add 10 feet on the east side.
Mr. Carley advised the councii~that they should have a policy
of asking for 60-foot streets or half of 60 feet on the property
line of teach proposed plat, stating that this had been the custom
from the beginning in filing plats in this County.
Attorney Graham said he believed it was for the Planning Commission and Council
to determine if they should waiver from the 60-foot street,
and asked if the council is willing to assume part of the cost,
assuming we are going to require 60 feet. It was also pointed
out that a survey would be needed before putting in the road
and to determine what the costs would be,
Planning Commission Lorris ~lilliams, Chairman, Planning Commission, in restating
their position, said that they stand for the b0-foot width
and believe this is good community planning.
Council sets Cartxri.ght then moved that the Village concur with the Planning
60 ft. width Commission in setting the street at a width of 60 feet, Stenzinger
seconded and motion carried unanimously.
Survey Cartwright also moved that Engineer Carley be asked to survey
ordered the property in question and submit a street plan, a survey
and an estimate of the costs necessary to run a standard
Village section down the middle of the right of way., including
the boulevards. Seconded by Shavor and carried. unanimously.
procedure After discussion, Shavor moved that the procedure for putting
in the roadway and for distributing the costs be referred to
Attorney Graham and Engineer Carley for study and recommendation.
Seconded. by Hustrulid and carried unanimously.

Street lights- After discussing the question of providing. additional street
Maple Knoll lights, Cartwright moved that the Clerk be authorized to ask
Tatum Street the Power Company for estimate of cost and recommendation as
to number of street lights required for Maple Knoll and on
Tatum street, estimating costs for each area separately.
Seconded by Hustrulid and motion carried unanimously.
Catch. basmas Building Inspector Christensen reported that there was consider-
not covered, able caving in around dry wells in the Maine Knoll area and
caving around that catch ba~rhns ware not covered, creating an unsafe condition
dry wells, for children playing in the area. It was agreed that our attorney
Maple Knoll would write the developer regarding this matter.

Plan for It was agreed to dispenBe withthe regal ar order of business
improving in order to hear Engineer Carley~s report on the survey of
Fry Street and the proposed plan for improving Fry street.
Engr. Carley After completing the survey, 'r4r. Carley stated that he found
reports ~ the cost for rebuilding Fry street as proposed would be about
the same on each side of the street. Said he estimated the
cost of grading, graveling and stabiiizing Fry street from
Larpenteur avenue to the south line of Clanp Thomsen Maple
Knolladdition, including salvaeing material now in the road
bed, at 4b6,900.00. This he said, was on the basis of. the
total frontage of 2,117 feet, and that an assessment, if levidd~'.
against the property fronting on this street would amount to
$3.26 per front foot.

and files same had prepared. at the request of our Planning Commission, An
