Stenzinger, Mayor; George J. Shavor, Trustee; David P. Cartwright, Trustee; Clyde J. Stewart, Clerk. Absent: Andrew Hustrulid, Trustee. Also present - William E. Olsen, Treasurer, and Frank N. Graham, Attorney. Minutes of February 2~t, 1955 were heard and approved as read. Reqn. X51 500 3¢ postage stamps, 1 Scripto pencil, 100 sheets bond Clerk's paper, letter size, and refill for ball point pen. Approved on motion by Cartwright, seconded by Shavor. Reqn. #52 b pair wide vision goggles, 1 gal. solvent, and 500 each Fire Dept. of report forms 106 and 113. Cartwright moved approval for securing the goggles and solvent, but that said forms requested be referred to the Volunteer firemen for study and recommendation. Stenzinger seconded and so ordered. Reqn. #53 covering 4,000 Civil Defense cards per sample attached, Civil Defense 100 arm bands (25 police - 50 warden - 25 plain), and 75 helmets, Ras discussed. Shavor moved. that the requisition be held over until we are informed as to the cost of the items. Seconded by Stenzinger and motion carried. Rork schedule Letter of March 6 from Earl Grumke, Secretary, Volunteer study by Vol. Firemen's Association, asking that the Volunteer's operational firemen Board be given additional time to study the suggested watch schedule for the three paid firemen before making recommendations. Cartwright moved that the request be granted. Seconded by Stenzinger and motion carried unanimously. Fire Dept. rules Letter of March 7 from Hal Newell, Secretary, Falcon Heights & regulations Fire Department, submitting proposed manual of rules and regulations for the Fire Department. After discussion, Cartwright moved that the rules and regulations as submitted by the Volunteer firemen be referred to the Village attorney for comparison with the ordinance, for recommendations with respect to additions or corrections which may be necessary, and that copies be sent to members of the council. Seconded by Shavor and motion carried unanimously. Mutual aid fire After discussion of letter of March 8 from Hal Newell, Secretary protection agree- of the Falcon Heights Fire Department, with respect to the ments mutual aid fire protection agreement now in effect with Roseville, Cartwright moved that Mr. Newell's letter be referred to the Mayor for consultation with the Secretary of the Fire Department and to find out what the present oral agreements are and the possibility of establishing new agreements. Seconded by Shavor and so ordered. Sheriff's arrests- As to question regarding the governmental unit which should fines collect fines on traffic violation tickets issued by the County Sheriff on County roads and Village streets within Falcon Heights. In writing under date of March 5, Attorney Graham advised as follows: nThe Sheriff and his deputies paid by the_County and their duty are are County officials~. _ ~ is to enforce the State law.- Arrests made by, them and tickets issued by them are for violations of State law and the Pines arising out of such arrests and violations are to be turned in to the County Treasurer." 55f Questions re Letter of March 5 from Village attorney Graham, relating to Fire Dept. questions raised by Fire Chief Swanson pertaining to Ordinance Ordinance X31 No. 31, was read. Stewart moved that the letter be referred to the Volunteer Firemen and that copy also be referred to Fire Chief Swanson. Seconded by Shavor and so ordered. The Clerk was asked to point out that some suggested changes have been or will be included in the rules and regulations. Larpenteur, Farm Mutual Ins. reported that he and Trustee Cartwright had called on the Co. Building local manager of the State Farm Mutual Insurance Company relative to the Insurance Company's proposed office building, and that plans were to contact Mr. Middlebrook of the University also. Cartwright told of his phone conversation with Mr. Middlebrook who indicated that the State Fair Board had for some time been interested in purchasing the property ~lropc~sdd for the Insurance Company's building. The under- standing was that Mr. Middlebrook would contact the State Fair Board regarding the matter and that Mr. Cartwright would keep in touch with him, After discussion, Shavor moved that the Mayor be authorized to xrite a letter to the proper officer of the State Mutual Insurance Company, of Bloomington, Illinois, presenting the advantages of the proposed Falcon Heights site and offering council cooperation. Seconded by Stewart and motion carried unanimously. Proposed bldg., cif. F. Stepnitz and Don Julen appeared before the council, Mr. SE cor. Larp & Stepnitz stating they were doing so in behalf of the Snelling Rr Associated Investors and Mr. Cohn, the owner of vacant property variance request - at the SE corner of Larpenteur and Snelling. Mr• Stepnitz Stepnitz presented a letter and new plan relating to proposed construction of a shopping center in the area. The proposed building, 120 x190, would face north with off-street parking facilities frontin ~taiaason Larpenteur. Mr- Stepnitz' letter requested a modifi- cation of the ordinance to permit a five or ten-foot setback to the west of the proposed building.. After discussion, Stenzing moved that the letter be referred to our Planning Commission for further processing under Ordinance No. 16. Stewart seconded and motion carried unanimously. N. L. Hermes reported that a prospective purchaser of one of Hermes residential properties along Fry street had decided against buying on the basis that there was an estimated $300 special assessment Mgr lot in this area. The Clerk reported that any inquirers rho had contacted him had been informed there were no assessments pending or outstanding against said property. In connection with St Paul's offer to extend a water main along the north side of Larpenteur avenue west of Snelling to a point opposite the Village Hall, the matter of supplying St Paul rater to St Marys and Fry streets was also discussed xith Mr. Hermes. Pitot equipment - In connection xith Pitot equipment on Fire Department requisition of February 15; Trustee Cartwright presented Test &. inspection letters he had received in following up th.is_matter from of .pumping equipmen t the State Fire Marshal, the Fire Underwriters Inspection Bureau, City of St Paul Water Department, and from the Superintendent of Apparatus, Public .Safety Repair Shop, City of St Paul. Cartwright then recommended that xe defer purchase of the Pi tot equipment, and moved that the Fire Chief request the Fire Underwriters Inspection Bureau to conduct a test and inspection of all of our pumping equipment, and that he secure from the Water Department, City of St Paul, a record of the static pressures at all of the hydrants. Seconded by Shavor and motion carried unanimously. It was also agreed that the Clerk sh ould ask the Fire Chief to let the council know as to cost of the Fire Underwriters inspection and when it can be made. Water Main In discussing the cost of the extension of a water main extension by the City of St Paul along the north side of Larpenteur from Snelling to a point op os to the Village Hall, Attorney Graham's letter xas answering questions on this matter as referred to him at our February 24 meeting. Trustee Cartwright was asked to check on costs of supplying water from the proposed main to St Marys and Fry streets. Public Safety The Commission's report dated March 9, 1955, xith respect to financial summary for 1954, general summary of police activity in 1954, etc., xas presented. Stenzinger then moved that the report be accepted, Seconded by Shavor and carried unanimously. Action on Commission's In connection xith the Commission's recommendations (1) recommendations that the position of Public Safety Supervisor be clarified and (2) if the Public Safety Supervisor is to record tags, .that the tags be entrusted to his care and issued to the police officers by him. After discussion, Shavor moved that the Public Safety Commission be authorized to prepare a set of rules covering the operation of all police activities for council approval. Seconded by Cartwright and motion carried unanimously. Sxanson's powers A portion of Attorney Graham's letter of March 5 xas as spl. police & read xith respect to council authority to direct and constable control the activities of George Swanson as a special police officer, and about Sxanson's duties as Constable elect and council authority in this respect. After discussion, Cartwright moved that all traffic tickets, ~J~ to Public Safety including partially used books, be turned over/the Public (cont~d) Safety Supervisor Who shall issue such traffic tickets only to duly appointed police or other authorized Traffic tickets individuals, and that the Public Safety Supervisor maintain a record of the issuance of such ticket books and report periodically on same to the Council, Seconded by Stewart and the following note taken and recorded: Ayes - Stenzinger, Cartwright and Stewart Nays - Shavor The Mayor declared the motion passed by a three-fifths vote. Insurance covering As to Whether the Village has insurance coverage in case psgr. in Village of a person Who might be inured While a passenger in a police car.. car being used by a Village police officer. it was agreed that our attorney should Write the insurance company to see if our present insurance would protect the Village in such case. Tunnel for cross- On proposed widening of Larpenteu r avenue and possibility walk of constructing a tunnel to replace the cross walk; the Public Safety Commission Chairman Was informed that the matter had been referred recently to the County Engineer. SWanson~s special After discussion, Stewart moved that any authority delegated police polders to the Fire Chief and others as special police officers under terminated the resolution of the council of August 23, 1919, be and hereby is terminated and rescinded, Seconded by Shavor and motion carried unanimously. Sewer survey Shavor reported on his talks with Village Engineer Carley, proposed. and Mayor Stenzinger reported on his discussions With Mayor Olsen of Roseville and with Mr. Banister, of Banister Engineering Company, relative to a program for sanitary sewerage for the Village and proposal for joining with Roseville in a suburban area program. The Mayor recommended that the council hold an informal ~.,,. meeting with Mayor Olsen With the Village attorney, Mr, Carley and Mr. Banister in attendance, to find out exact costs and what part we would take in their program. Stenzinger. said the cost to Falcon Heights for the Banister study and report would be about X2,000.00. Meeting It being 11 P.M., Cartwright moved that time for adjournment extended be extended to complete unfinished business. Seconded by Stewart and so ordered. Fires not attended After discussion of report that Fire Chief Swanson Was not by Fire Chief in attendance at two fires, one on February 1 and one on February 28, Cartwright-moved that the Mayor be authorized to ask the Fire Chief for an accounting, Seconded by Shavor and so ordered. Chief to instruct After discussion, Shavor moved that the Fire Chief be Fire Dept. operational directed to instruct our Fire department operational officers officers in all phases of operation of the department, including functions of the office of the Chief in its entirety, and that the Chief submit a monthly report to the council covering such instructions to operational officers. Stenzinger seconded and motion carried un- animously. J e)~~ Bill relating Shavor reported on the bill amending lairs 19119, Chapter 102, to payment from in which it is proposed to change the baae for allocating County's Road payment from the road and bridge fund from ~l~0,000 to 10~ & Bridge fund of the road and bridge fund, with payment to be made in cash instead of a credit ~-1r~la the County. Shavor said a hearing could be held on the bill in the near future and that Mayors ~rould be invited. Tree trimming Attorney Graham reported that the League of ~dinnesota Municipalities is sponsoring a bill for summary assessment for tree trimming and that he would like to await the outcome before going ahead in this matter. Letter from Received from Mayor Stenzinger was a letter to him from Volunteers re the Falcon Heights Volunteer Firemen's Association, dated personnel & January 1t, 1955, recommending in the best interests of operation of the Fire Department and Village that certain changes be Fire.Dept. effected with respect to operation and personnel of the Fire Department. Notice to Terminate After discussion, Attorney Graham was instructed to tenancy - Geo. Swanson prepare a Notice of Termination of Tenancy with respect apartment to the apartment occupied by George Swanson in the Village Hall. Adjournment: On motion, the meeting adjourned at 11:115 P.M.
