Stenzinger, ?~"ayor; George J. Shavor, Trustee; Andrew Hustrulid, Trustee; David P. Cartwright, Trustee; Clyde J. Stewart,~Clerk. Also present - Gilliam E. Olsen, Treasurer, and Frank N. Grahams;-sAttorn~y.:~ Minutes of Public Hearing on Associated Investors, Inc. rezoning request, May 26, 1955, were heard and approved as read, also minutes of regular meeting, same date, were heard and approved as read. F.D. R.egn.#55 was ordered approved on motion by Cartwright, seconded by Hustrulid. Reqn. #56, Cartwright moved approval, seconded by Hustrulid, and so Clerks ordered. Fireman Fire Chie£ Swanson's letter of June 5, 1955, was read, Schultz' certifying that S.P. Schultz, full-time fireman, had passed salary the necessary requirements under Sec. 7, Ordinance No. 31. increased After discussion, Cartwright moved that beginning with the last half of June, 1957, that salary of Fireman Stanley P. Schultz be increased to X6285.00 per month as provided in " Sec. 7 of Ordinance No. 31. Seconded by Hustrulid and motion carried unanimously. House trailer Letter of May 31, 1955 from J. K. Scott, 17511 Arona, regard- parking permit ing his lb-foot house trailer and request to park it on his property at 175l~ Arona, was read and. discussed. Cartwright moved that the Clerk be instructed to reply to Mr. Scott's letter, quoting Sec. 3, paragraph 5-27 of our building code ordinance, stating that the council is granting him permission to park his trailer as requested until further notice, with the understanding that the trailer cannot be used for residence purposes while so parked. Seconded by Shavor and the following vote taken and recorded: '., t)O~ • House trailer Ayes: Shavor, Cartwright, Stewart parking permit Nays: Stenzinger and Hustrulid (cont'd) The motion was declared passed by a three-fifths vote, Maple Knoll Village Engineer Carley's letter of June 5, 1955, referr- streets into to recommendations he made last year for stabilization of streets in Maple Knoll addition, together with a brief specification. In his letter of June 6, Mr. Carley stated that a cash settlement with the Village would be desirable, permitting the Village to have the work done, but that it may not be practical or possible. After discussion, Street Commissioner Seaborn was asked to inform the developer that the work must be completed by the middle of August this year, also to see about securing engineering assistance to check the job. Magazine The Clerk reported receiving a call from Tommy Lehman, soliciting Parkway Hotel, 'Minneapolis, crew manager of magazine salesmen, who inquired regarding one of his salesmen calling on residents of Falcon Heights. Mr. Lehman, the Clerk said, reported that St Paul and Minneapolis require magazine sales solictors to register with the police. Attorney Graham stated that the Village has no ordinance covering the matter. Mr. Vriinfrey, businessmen's representative, said he felt such an ordinance is needed. Hustrulid moved the Clerk inform Mr. Lehman that the Village has no ordinance pertaining to magazine soliciting. Seconded by Stewart and motion carried unanimously. Off-sale license Attorney Graham's letter of June 6, 1955, was read, enclos- fee increased ing copies of a proposed amendment to Ordinance No. 5 which would increase the Off-sale beer license fee to Sfi1~,C0 a Ordinance No. 33 year. .The proposed ordinance was read. After discussion, Cartwright moved adoption of ORDINANCE N0. 33, AN ORDINANCE AMENDING ORDINANCE N0.5, EPITZTLED "AN ORDINANCE LICENSING AND REGULATING THE SALE AND CONSUMPTION OF NON-INTOXICATING MALT LI~UORS.'~ Seconded by Hustrulid and the following vote taken and recorded; Ayes: Stenzinger, Shavor, Hustrulid, Cartwright, Stewart Nays: None The Mayor declared Ordinance i3 o. 33 adopted by a unanimous vote and ordered publication of same. The Street repaired Commissioner said he would have the County scrape up the gravel so as to keep it off lawns. As to the oiling of streets at this time, W.L. Linderman, 1512 N. California, said this could b e done at a temperature as low as 60 degrees. After discussion, Shavor moved that the streets this year be repaired and. oiled as soon as possible. Seconded by Hustrulid and carried unanimously. Associated Investors Letter of June 3, 1955, from the Planning Commission about Rezoning request. a meeting at Mr. Gallaher's home on May 27, which the Planning Commission held with representatives of the home owners and developers who expressed their willingness to work out a mutually satisfactory blan for developing the area in question. After the meeting, the letter stated the Planning Commission met and decided on the following recommendations to the council: 1. - "That the request for rezoning be ~rrithheld because of strong opposition by home owners of the area who have presented some logical objections to the plan for developing the area." 2. "That the Planning Commission be authorized to hold meetings with representatives of the home owners and the developers # ~ # to try and work out a plan for rezoning the property in question to the satisfactoon of all concerned." 3, ~ ~ # "That action on any request for building permits on any part of the area being considered., be postponed until the meetinQS have been held and a compromise proposal for the entire remaining vacant area is worked out." Don Julen, Associated Investors reported that the developers had preapred a new plan, changing the size of the building and providing for better control of traffic and for eliminating as much traffic as possible on Arona. Jule" said the developers would be happy to meet with the Planning Commission and representatives of residents in the surrounding area at any time. Hustrulid moved that copies of the Planning Commission's letter of June 3, 1955, be made available to Mr. `Jule" and to the home owners' representative, Mr, Fred Rahn, 1525 +Nest Iowa. Seconded by Cartwright and carried unanimously. ass Parks & M. J. Elnicky, 1532 West Iowa, inquired as to when the Playgrounds drainage area at Idaho and Snelling would be made into a park. He suggested getting donations from local businessmen for the purpose and that he would donate two ~ benches. It was agreed that the Mayor and Howie Rose would inspect the area and make recommendations. ', Voting A. W. Johnson and Robert T. Liaves appeared before the council Machines to try and interest the Village in the purchase of automatic voting machines. The Clerk was asked to write Mr. ~riaves as to the 1952 General Election vote total in Falcon Heights so they may submit a written proposal. Pedestrian cross- Street Commissioner Seaborn reported that Justice of the walk - painting Peace, Lloyd Riley, said he would not assess any fines ', policing for cross-walk violations until painting of the cross-walk is done. Seaborn said that St Paul was going to eliminate ', the cross-walk between the Golden Rule and Emporium, and ', that if we were going to continue with our pedestrian ', crosswalk it must be policed and policed properly. Mr. Winfrey, representating the businessmen, stated that the problem is not policing, but rather that the cross-walk is not properly painted. He said-there is no comparison between our crosswalk situation and the crossing between the Emporium and Golden Rule. Sid Bumgardner reported having talked with the County ~r.~ffcrEngineer about painting of the crosswalk, After discussion, Shavor moved ', that the Street Commissioner be authorized to have a private contractor repaint the cross-walk and paint in ii the wor ds~Crosswalk~ in each lane. -Stenzinger seconded and motion carried unanimously. ', Village Assemby Hustrulid submitted drawings a.nd specifications covering Hall improvements proposed improvements to the Village assembly hall, includ- ing acoustical insulated oiling, painting, plastering, venting and remodelling of the heating system. Attorney Graham was asked to prepare advertisement for bids covering this work for consideration at the councils June 22 meeting. Sanitary Sewer- Hustrulid reported that in checking with Mr. Duvall recently the question of not including any possible sewage from Question of University-owned real estate within the Village was dis- including Univ. cussed in connection with our sanitary sewer plans, owned land Recommending that it would be desirable to have commitments in this matter, Hustrulid moved that, our attorney be directed to write the University and the State Fair Board, advising them that if any of their property is to be considered in connection with the proposed sanitary sewer project that they let us know immediately. Seconded by Stewart and motion carried unanimously. Lauderdale The matter of adjusting charges in the standby fire standby contract protection contract with the Village of Lauderdale was discussed. It was agreed to have our attorney write the Mayor of Lauderdale that our committee was asked to meet with representatives of the Village of Lauderdale on June 15 regarding this matter, or on some other date prior to our June 22 meeting. J el~C Newspaper wires Stewart reported on the handling of a complaint by Public at National Tea Safety Supervisor Don Arndt in connection with a pedestrian corner tripping hazard caused by wires from newspaper bundles , dropped off at the National Tea store corner. Arndt reported he found a rusted barrel at the corner chuck full of wires and trash. At his request, the State Highway department donated a new metal barrel, delivered it and carted away contents of the old barrel, all at no cost to the Village. Arndt recommended that the St Paul Dispatch circulation department be notified to instruct their carriers to deposit wire and old paper wrappings in the new barrel. Stenzinger moved that the Clerk write letters on the matter to the Circulation managers of The St Paul Dispatch and The Minneapolis Star. Seconded by Hustrulid and motion carried. Meeting extended. It being 11 P.M., Cartwright moved that the meeting be extended in order to complete unfinished business. Seconded by Hustrulid and so ordered. Ordinance No. alt - The matter of a proposed amendment to the zoning plan, providing that no building permit or special permit shall Off street be issued by the council until the applicant has satisfied parking the council that adequate parking facilities will be avail- able, was discussed. The proposed ordinance was read. Cartwright then moved adoption of ORDINANCE.NO. alt, AN ORDINANCE AMENDING ORDINANCE N0. 8 ENTITLED " AN ORDINANCE PROVIDING A ZONING PLAN FOR THE VILLAGE OF FALCON HE;IGHTS." Seconded by Hustrulid and the following vote taken and recorded: Ayes: Stenzinger, Shavor, Hustrulid, Cartwright, Stewart Nays: None. The Mayor declared Ordinance No. 31t adopted by a unanimous vote and ordered publication of same. Tree Trimming After discussion, Stenzinger moved that our attorney be directed to draft a proposed ordinance covering tree trimming for consideration at our June 22, 195 meeting. Seconded by Cartwright and motion carried unanimously. Juvenile matters In connection with the expressed willingness of Mr. Troje, Assistant Probation Officer, and Mr. McCourt, Clerk of the Juvenile Court, to discuss operation of the Juvenile Court with Village representatives, the Village Attorney was asked to write Public Safety Commission Chairman Sid Bumgardner about the Commission holding an informal meeting with Messrs. Troje and McCourt with the idea of inv~~ing members of the council who wished to attend. Village map The matter of having our Village Engineer include additional information on our Villa ge street map was discussed. It was agreed that Trustee Shavor should discuss this with Village Engineer Carley. Adjournment: On motion, the meeting adjourned at 11:25 F.M. App
