Shavor, Acting 2~'ayor; David P. Cartwright, Trustee; and Clyde J. Stewart, Clerk. Absent: Robert E. Stenzinger, Mayor, and Andrew Hustrulid, Trustee. Also present: V~'illiam E. Olsen, Treasurer, and Frank N. Graham, Attorney. ~~inutes of August 17, 1955., meeting were heard and approved as read. Reqn. #62 covering supplies for Clerk was ordered approved on motion by Shavor, seconded by Cartwright. was Asbury driveway Building Inspector Christensen reported that a driveway/installed too high at 1877 Asbury without a permit by Henry Lutz, contractor. Also that the driveway was too high and extended too far into the street according to ±the ordinance. The council asked Shavor to check and report on what had to be done to the Village attorney so that the contractor could be written accordingly. Area at Letter of August 2~i from Donald I. Carley, of our Village Engineer's Arona south staff, was read, reporting on his inspection of the blacktopped of Larpenteur area on Arona street, south of Larpenteur, and t:he drainage or run- off problem which nearby residents had complained about. Our engineer questioned that the run-off from an area this size could be increased measurably, but said that the situation should be watched and if any floodi.n~; of property occurs that steps be taken to divert the run-off in another way. Cartwright moved that the Clerk forward. a copy of P.Rr. Carley's letter to "'?r. Fred Rahn, Chairmanof the homeowners' group. Seconded by Shavor and motion carried. Douglas Rees Condition of the alley behind the Rees business block north of alley Larpenteur, was discussed. Agreed that Engineer Don Carley should. check the alley and advise Trustee Shavor as to what should be done with respect to fixing holes and making other repairs. Street ~ After discussion of a proposed. street program, Cartwright moved program that the Village Engineer be authorized to make periodic inspections of the Village streets and that he make recommendations for the maintenance of same from time to time. Seconded by Stewart and :notion carried. Village Hall The matter of improving the parking area at the Village Hall and parking area Fire Station was considered. Engineer Carley advised having a contractor haul in some sand for surfacing the area. Public Safety Don Arndt, representing the Public Safety Commission in Sid Bumgardner's absence, said he checked with P:~r. Clewett of the State High~~~ay Department on the recent routing of trucks on Snelling serRice lane from the post office to Larpenteur avenue. Said that only thing that could be done is to put up two signs reading "No Thru Traffic." The Highway Department informed Swanson asked Arndt: nothing could re done .about the turn. Arndt also reported to turn in traffic ta s he had talked with Cens~able George Swanson about turning in to the public safety supervisor the traffic tags belonging to the g Village which Swanson still had in his possession. Swanson deC1 fined to do this, Arndt• said, stating' he would return the traffic tags to the Village if the council requested him to do so. Public Safety Supervisor Don. Arndt, all Village policing equipment that he may have in his possession, such as traffic tickets, oolice badges, billy clubs, etc. Seconded by Cartwright and mo+.,ion carried unanimously, Hydrostatic test Letter from Fire Chief Swanson was read, explain.in~-.that pump the hydrostatic test pump requisitioned August 5, 1Q55, would be used for testing Yiose, that heretofore such tests have been made by use of the pump on the apparatus, but that such continued use might result in damage to the pump. Swanson said the Nalprin Supply Company, of Los Angeles, offers this test equipment complete for ~'~72.OU, After dis- cussion, Shavor moved that the question of purchasing a hydrostatic test pump be referred to the Village Clerk for pricing and additional information. Seconded by Stewart and motion carried.. Fireman Schultz Don Arndt informed the council that DeputYSheriffs Earl cooperates in Smith and James +~aller had reported on the cooperation emergency case they received from. our Fire Department. in an emergency heart case, Sunday, August 21, 1955. They said that Fireman Stanley P. Schultz, on duty at, the time, had. the resuscitator ready when the deputies and the patient arrived, that Schultz' action in operating the resuscitator on the patient, !~dr. William Teter, of Logo, &~issouri, at the fire station and until the patient reached Ancker Hospital, contributed much towards saving dir. Te~er's life according to the doctor's .report. After discussion, Cartwright moved that the Clerk be instructed to write Fireman Scfialtz a letter of commendation on his action in the -natter. Seconded by Shavor and. motion carried unanimously. Insurance on Attorney Graham's letter of August 19 was read, relative to fire trucks insurance policies Nos. CAL X9561 and Itr 73305, covering the two fire trucks against liability and physical damage, stating he had checked these against the previous policies and that the coverage is the same. ?fir. Graham's letter also noted that we did not have collision or comprehensive insurance covering the fire trucks, and that the council mip~ht want to revieti^r the decision made in not providing this coverage. The Clerk was asked to discuss this matter with the League of ?Municipalities office as to what. other communities-•do on collision insurance on their trucks, also to talk with Lynn iatteson regarding the matter. Street lights R. Street Commissioner Suborn being present, was asked to street signs, determine and report on the number of street lights needed Klatt.'s addi±,ion, in Klatt's addition and the estimated costa He was also Maple Knoll asked to check and report on the number of street signs required for A~aple Knoll and Klatt's additions and on Remove sand estimated costs for eachg subdivfbn. Seaborn reported tramline R= Idaho he had been asked to have sand at. Hamline near Idaho and Iowa removed. Shavor moved that the Street Commissioner be authorized t~ have the sand at. said location removed. Seconded. by Stewart and so ordered. ,~ ~ 1 so; 1 1 Fire Dept. After discussion, Cartwright moved that in accord with the working minutes•of July 13, 1955, that the Fire Chief be notified hours that the new schedule of working hours for the three paid. schedule firemen be made effective°beginning August 28, 1Q55; that said schedule calls for 2~. hours on and ~8 hours off for each paid fireman, with each working an additional overtlapping eight-hour day per week, and that the Fire Chief be asked to prepare a detailed working schedule mutually satisfactory to the three paid firemen in conformance with the above requirements, furnishing the Clerk a copy of same. Seconded by Shavor and so ordered. Paint The Clerk reported on the special need during S+ate Fair week crosswalk for repainting of at least the lines bordering our pedestrian crosswalk. Shavor moved that the Clerk be authorized to have the County do this work, Seconded by Cartwright and motion carried. Attorney reports Attorney Graham's letter of August 22, 1955, wa read, regard- on private use the private use or junking of Village property and related or junking of matters. The letter stated that generally speaking the Village property "Village may acquire and use property only for public purposes." In some cases, the attorney said, the council may authorize the use of Village property for private purposes where a reasonable rental is charged, examples being rental of the Village Hall by private groups and the use of the Fire Depart- ment by Lauderdale. The a±torney said there is no authority for any other private use of village property, and that he believed it improper for the Village council or any village official or employee to authorized the lending of village equipment for private uses or the use of village supplies or Copy to property. After discussion, Shavor moved that the Clerk send Fire Chief a copy of the attorney's letter to the Fire Chief, instructing him to be governed accordingly.
