Shavor, Trustee; David P. Cartwright, Trustee; .Harold C. Nilsen, Trustee; and Clyde J. Stewart, Clerk. Also present- Gilliam E. Olsen, Treasurer, and Frank Pd. Graham, Attorney. Minutes of March 28, 1956 were heard and approved as read. Fire & Extended First year premium of $G76.85, due April 21t, 1956, on Fire Coverage and Extended insurance policy No. 55C53~t305 (General Insurance Company of America) was considered. Cart~rght moved that said premium be paid. Seconded by Shavor and so ordered. Firemen express Letters from Firemen Bertrand J. Slama and Stanley P. Schultz thanks for were read, thanking the council for salary increases effective salary increases March 1, 1956. Engineers - Letter of April 9, 1956, from E.C. Bather and Associates E.C. Bather and relative to their opening an office in Falcon Heights at Associates 1673 Arona Avenue, and engineering services they offer. Mr. Bather stated he is college trained and has just finished 35 years service with the Minnesota State Highway Department in highway planning, construction and da$ign. Parks ~ Playgrounds- B. J. Rechtiene, Chairman, Parks and Playgrounds Committee, initial dance, Falcon in a letter dated April 10, 1956, reported that the initial Heights Canteen dance of the Falcon Heights Canteen (teen-alters) would be held in the Village Hall on Friday evening, April 13. Assurance was given that adequate supervision and chaperoning had been provided for. Fireman Raymond L. Fire Chief Grumke's letter of March 30, 1956, was read Merkel suspended. relative to suspension of Fireman Raymond L. Merkel for 15 days effective April 1, 1956, because of his arrest in Mounds View township for drunken driving and in view of repeated warnings he had received in this connection. The Chief reported that Firemen Stanley P. Schultz:: and Bertrand J. Slama will operate on a 21t hours-on and 2It hours- off basis until Merkel returns to the job or we get a new man. The Mayor reetd a mono regarding facts he had developed on the arrest of Merkel and probable sentence, also his proposal to the Fire Depar~hment for having a man on a standby basis, qualified to take over in emergencies so as to eliminate the need for working the regular paid firemen for prolonged extra-hour periods. He said that the Chief and two assistant Chiefs had discussed Merkel's case and agreed that Merkel should be suspended, but that an4Y further action should be taken by the council. After a full discussion of the matter, Utecht moved that if Merkel's chauffeur's license is not revoked, and he can get his driver's license re-instated to the extent of driving to and from work, that he be reinstated as a paid fireman. McLean problem in his area, Arona and California, where water has been backing up for some time. Street Commissioner Christensen was asked to discuss the matter with Village Engineer Carley. Speeding Fairview John i~, b~acGregor, 1795 North Fairview, called attention to speeding on Fairview between Larpenteur and Roselawn, especially mornings when children are on the road, walking to the corner for the school bus, Cartwright moved that the matter be referred to the Public Safety Committee for investigation and report. Seconded by Stewart and carried. unanimously. Service Lanes, Sumner E. Hood, 1597 Hollywood Court, reported. on the problem Snelling of driving from the Court onto the Service lane becaus~~'of_~ Snelling avenue motorists using the service lane as a thorough fare in spite of posted. signs reading, "No Thru Traffic." After discussion, Shavor moved that we write to Mr. Darrell, State Traffic Engineer, regarding the matter, asking if the 'No Thru Traffic' sign has any legal effect and 7.f 10-mile speed limit signs can be installed on service lanes to discourage th ru traffic. Seconded by Cartwright and motion carried. unanimously. Jansen Bros. Inc. R. J. Moder, of coder Real Estate, St Paul, submitted a petition petition datedrApr:~~l~hsigned by Jansen Bros., Inc. and others, requesting that the property approximately at 1790 West Larpenteur Avenue be rezoned from Farm Residence to Industrial District. After discussion, Stewart moved that the petition be referred to our attorney for checking, and if he finds the petition sufficient that it be referred to our Plann~.ng Commission for study and recommendation, also that ~ hearing be held on the petition at our next regular meeting, April 25, 1956, at 8:30 P.M., the Cle rk to post the required notice. Seconded by Cartwright and motion carried unanimously. N.L. Hermes N. L. Hermes and his contractor, Ivar Johnson, of '~inneapolis, Store bldg permit submitted plans in connection with request for a building ,permit to construct a store building, 40x80, on property adjoining the N.L. Hermes Floral ~ Gift shop, 1709 N. Snelling. Installing of a basement hose inlet box in the proposed building was discussed. Shavor then moved that our building inspector be authorized to issue said permit, subject to the plans conforming to .code requirements. Seconded by Stewart and. motion carried unanimously. ss~ Proposed Consideration was then given to the proposed Dog Registration Dog Ordinance ordinance. A summary of the proposed ordinance, as prepared by the Village attorney, was read for the information of some thirty citizens who were in attendance. The P~ayor asked if anyone wished to be heard. Sumner E. Hood, 1597 Hollywood Ct. urged that the proposed ordinance be strengthened to restrict dogs from running at large, at least during the summer months. Richard Pantzar, i~ asked how the ordinance is going to be policed where an -1865 Snelling Av. N. owner keeps .his dogs on his own property as he does. Leonard Beatty, Sr., said that anyone raising puppies cannot safely take them 1808 Asbury from the mother dog until the puppies are. six weeks old. He said the owner would have to sell them, destroy them or give them away at a big loss without sufficient time. Ben W. Wilson, said he has resided in Falcon Heights for 11 years and has 1835 Simpson owned two dogs all that time, that they never have been on the street unless on leash. Wilson said the w~ d "habitual" _ should be eliminated from the ordinance so dogs could not run at large at all. Priscilla Nelson said she agreed with Pdr. Wilson. As to a kennel, she said 1627 Hollywood Ct. she owned four puppies each four months old, that she doesn't like to sell puppies too young, and thinks six months time should be given. l~rs. Nelson said she received no complaints about her dogs. W.H. Deubner, thought the dog registration f ce was a little stiff, and 1859 N. Snelling suggested changing the defini#~ion of a kennel from more than two dogs to six or ten dogs. He said that Mrs. Deubner rather than give up her three little dogs would give up her home. Walter Rand, said he was very much in favor of the proposed ordinance 1527 California Ave.W. and commended the council for beginning something in the way of as ..dog ordinance. J.F. Dixon, said he was in agreement with the proposed ordinance and 1l~95 ~4T. California the leashing requirement. George Geist said that all dogs should be leashed or kept on the owner's 1873 N. Simpson property, but wondered what would happen to people with more than two dogs. Geist said he owns three dogs and that one is old and. blind. Agreed dogs should be registered, but thought a X35.00 kennel license fee was out of line and that the ordinance should state more than four doge constitutes a kennel. Said if puppies must be sold at three months, the owner would not come out even. Donald J. Peterson, said he was in agreement with the proposed ordinance, that 1625 Hollywood Ct. he lives next door to Priscilla Nelson, that her dogs are restricted and not allowed to run at large, but that he favors limiting an owner to two dogs. ss~~ Ben Wilson, asked to be heard a second time. Said he wanted to speak in 1835 Simpson behalf of George Geist who is his neighbor. Wilson said he knew some people had complained about Georges dogs, but that the dogs never bothered him and that it is only when the dogs are molested that they bark. John C. Kelsey, asked regarding enforcement of the ordinance. Mr. Kelsey said 1lt70 West California there is a difference between dogs, but that all should be registered so it can be determined which dogs are giving the trouble. L.M. Nolan, said he owass a dog and keeps it on a leash the year around, 11185 West California Thinks those who keep dogs as a hobby should be given consideration. Ordinance No. 39 No one else wishing to be heard, the council discussed. the proposed ordinance further and suggested corrections. Dog Registration Nilsen then moved adoption of ORDINANCE N0. 39, AN ORDINANGE REGISTERING AND REGULATING THE KEEPING OF DOGS. Seconded by Utecht and the following vote taken and recorded: Ayes: Utecht; Shavor, Cartwright, Nilsen, Stewar t Nays: None The Mayor declared Ordinance No. 39 adopted by a unanimous vote and ordered publication of same. Group insurance Letter from the Village attorney relative to the letter and questionnaire from the Minnesota Benefit Association relative to a statute providing that the Village may pay all or part of the premiums. on group insurance for Village employees, was discussed. It was agreed to refer the matter to Cartwright who will develop information as to costs. Street plan for After discussion, Shavor moved that the Planning Commission be unplatted areas requested to continue their study of a proposed street plan for the remaining unplatted areas of the Village, and that the Commission be authorized to employ technical assistance in connection with the project if necessary, with the suggestion that the area south of Larpenteur, between Cleveland and Snelling, be given first consideration. Seconded by Cartwright and motio carried unanimously. Associated Investors- Complaints were considered regarding continued parking of Parking cars on Residence district A property in the rear of Associated Investors' business block adjacent to Arona. Cartwright moved that our attorney write the present owner and the rumored future owner, notifying them that they are s~o 1 1 Associated allowing parking there in violation of the ordinance and Investors- that. this should be stopped by the 1st of May, 1956, or parking that the Village will prosect~te~under the ordinance. Sand on The Clerk said that a report received from Don Arndt Larpenteur stated that people using the pedestrian cross walk were exposed to blowing sand and sharp stones ~ad~~hat,;#;his Paint Cross walk material should be removed from this area of Larpenteur. Street Commissioner Christensen will inform the County accordingly. Also place order for painting in the crosswalk lines. Cub Scouts In connection with the scooting program at the Village Hall, use of Hall .Monday evenings, it was reported that conditions are unsatisfactory with respect to excessive noise,. use of Village property, and condition that the Hall is left in. The Clerk was asked to notify Scout authorities that unless these problems are eliminated thru closer supervision, that we will have to refuse use of the Hall. Propoer~d combining The Clerk presented three bids on removing the electric of electric meters meter from the second floor of the Village Hall and combining upstairs and downstairs circuits, as follows: Kehne Electric Company, !~l~0.00; Quality Electric Company, X35.00; and. Tieso Electric Company, X22.75. It was agreed to postpone acting on bids until we can determine whether apartment electric service costs warrant the expense of making the change over. Police report- Officer Dachtera's report in connection with summoning Dachtera the deputy sheriff before answering a call at the E.R. Schriefer home, 1880 Roselawn avenue, was discussed. Stewart moved that this matter, including the report, be referred to the Mayor for investigation and report. Seconded by Cartwright and motion carried unanimously.
