Rezoning Request dated April 11, 1956) The hearing was declared open at 8:30 P.M., with the following council members present: ~Yilliam R. Utecht, Mayor; George J. Shavor, Trustee; David P. Cartwright, Trustee; Harold C. Nilsen, Trustee; Clyde J. Stewart, Clerk. Also present: Villa ge Attorney Frank ~d. Graham and Treasurer William F,. Olsen. About 25 persons were in attendance. Mayor Mayor Utecht said the purpose of the hearing was to consider the petition dated April 11, 1956, signed by Jansen Brothers and others, requesting that the property at about 1790 West Larpenteur be rezoned from Farm Residence District to Industrial District. Attorney Village Attorney Graham reviewed previous action taken by the council in voting to accept the petition subject to checking by the attorney, and to hold a public hearing on the petition in accord with the posted notice. He said the Clerk's affidavit of postt+li~ stated that copies of the notice were posted on April 11t, 1956, i-n the three Village posting places. Attorney Graham said there were no buildings on the property described in the petition. The petition, he said, was referred by the council to the Planning Commission. He then read a letter from the Planning Commission, dated April 23, 1956, stating that after consideration of the Planning petition for rezoning, it was the Planning Commission's recommendation Commission that the property be rezoned to Business District, with the recommendation recommendation that any buildings be set back 100 feet from Larpenteur avenue. ~ ~ Mayor The Mayor asked if any of the citizens present wished to bpeak for or against the petition. Plans which the Planning Commission had considered, were then submitted and discussed. These showed the proposed building to be one story building, 75x172, which it was stated would be used by the Waterbury-St Paul Company as a sales and show room for furnaces and for doing some duct work. Killmer, 1700 West Larpenteur Following a full discussion of the proposed rezoning, the building setback, how close the proposed building would be to the property line, character of the Waterbury St Paul Company operation, and what effect if any the rezoning would have on taxes of property Discussion owners in the area, Mr. Jr~+~t~. Keller stated he favored the rezoning. Mrs. Peter Keller said she would have no objection if the proposed business was a quiet and clean operation. Mr. Killmer said he would suggest not because he was in the nursery business that those putting up the building be required to spend about #1,000 for a good landscapes jcb_-on the front of it. No one else wishing to be heard, the question was asked ~iether 6~ there were any objections to rezoning of the property to Business. There being none, Cartwright moved adoption of ORDINANCE N0. 1t0 Ordinance No. !~0 (which was read), AN ORDINANCE AMENDING THE ZONING MAP tiVHICH IS A PART OF ORDINANCE N0. 8. Seconded by Stewart, and the following vote taken and recorded: Ayes: Utecht, Shavor, Cartwright, Nilsen, Stewart Nays: None The Mayor then declared Ordinance No. !t0 adopted by a unanimous vote and ordered publication of same. In connection with the Planning Commission's suggestion of April To consider 23, 1956, that the present business district south of Larpenteur Business rezoning _ be extended west to the west boundary of the lot in question for Hof strip south a depth of 318 feet from the center line of Larpenteur, Cartwright of Larpenteur moved that we request the Planning Commission to consider the rezoning of the entire strip along the south side of Larpenteur avenue to the west boundary of Fairview to Business District, and that the Planning Commission be asked to recommend a street plan for the area. Seconded b3' Shavor and motion carried unanimously. W.C. Sipe 'N. C. Sipe, 1.1132 W. Broadway, Robbinsdale, urged that the northwest Art Lindig corner of Larpenteur and Fagrview avenues be rezoned from ~eaxdence District to Business District, and Arthur Lindig, 1879 yYest Larpenteur, suggested that property along the north side of Larpenteur to Cleveland be rezoned Business District.
