Utecht, Mayor; George J. Shavor, Trustee; David P. Cartwright, Trustee; Harold C. Nilsen, Trustee; Clyde J. Stewart, Clerk. Also present: William E. Olsen, Treasurer, and Frank N. Graham, Attorney. Minutes of May 9, 1956 meeting were heard and approved as read. Bills: On motion by Utecht, seconded by Shavor, the following bill was ordered paid: St Paul Book Rc Stationery Co., office supplies, Clk., X7.29 Sheriff's letter Sheriff Gibbons' letter of May 16 to the Mayor was read, re radio system relating to the Sheriff's proposal to install and operate for County a two-way radio communication system for the entire County. The letter stated that combining the present four systems of police communication in the County under one station with a transmitter operated by the sheriff's office would. greatly assist with policing problems in subdivisions of rural Ramsey County. After discussion, Stewart moved that the letter be referred to our Public Safety Committee for study and reco~nendation as to (1) the Village's share of costs and horn determined (2) degree of Village participation in the plan (3) xhether the Village is to supply equipment, such as cars and radio, and (!~) that the Committee submit its report on or before June 13. Seconded by Utecht and motion carried unanimously. 6VN Regent's letter Letter dated May 11, 195b, to Mayor Utecht from Mr. W.T. re condemning Middlebrook, Secretary, University of Minnesota Board of Larpenteur Regents, was read relative to the Board of Regents' property decision not to reconsider the Board's action to begin condemnation proceedings on property generally described as four-fifths of the area along the south side of Larpenteur avenue between St Mary's and Fairview avenues. Resolution Following a full discussion of the matter, and on motion by Shavor, seconded by Cartwright, the following resolution was adopted by a unanimous vote: Approves action. RESOLVED, that the Village Council, Village of Falcon Heights, of Mayor in asking Minnesota, hereby approves the action of the Mayor taken by Regents to reconsider letter dated May 1, 1956 to the Board of Regents, University decision to con- of Minnesota, requesting the Board of Regents to reconsider demn property its decision to condemn certain property in the Village of Falcon Heights, and the Mayor's subsequent statement to the Press on May 13, 195b on the same subject; and BE IT FURTHER RESOLVED, that the Village Council, Village of Falcon Heights, hereby goes on record as opposing acquisition by the University of Minnesota of any additional property in the Village of Falcon Heights by condemnation or otherwise, since such acquisition will reduce the tax base and deprive the Village of land needed for normal growth; and BE IT RESOLVED, that copies of this resolution be sent to Governor Orville L. Freeman, Senator Elmer L. Andersen, Representative Claude H. Allen and to the Board. of Regents. Municipal Court, Copy of Attorney Graham's letter of May 11, 1956 to Mayor Roseville Kitts, Village of RoseviLle"~~n'gi~iring in connection with our possible use of Roseville's municipal court as to probable cost and whether fines assessed under Falcon Heights ordinances would, be turned over to the Village of Falcon Heights. Board of Health Letter of May 15, 1956, from Dr. Thomas K. Krezowski, submitting Chairman resigns his resignation as Chairman, Board of Health, was read. Utecht moved that the resignation be accepted as submitted, that Doctor Krezowski be so advised by letter, thanking him for past services, and that tthe matter be referred to Trustee Shavor. Seconded by Stewart and motion carried unanimously. Garbage Proposal In connection with a meeting of community representatives on May 18, 1956, at the Mounds View Town Hall, Trustee Harold C. Nilsen who attended, reported that a tentative plan was presented by Messrs. Edward H. Willmus and Raymond J. Kroiss who proposed to erect an incinerator for disposal of refuse and garbage in rural Ramsey County. The plan, Nilsen said, provides for payment of ~5 cents per housing unit by each participating municipality, the charge to be subject to certain adjustments annually. The majority, Trustee Nilsen said, felt it would be difficult to set up an organization like this and doubted that people would go along with it. Said the main problem was for the municipality to set up an ordinance for putting 683 Garbage it on the tax rolls. A letter addressed to Villages and disposal (cont'd) Townships by Messrs. Willmus and Kroiss relative to the proposal was referred to ~hb?Yillage attorney. Trustee Nilsen was asked to keep in touch with the matter and report on any further developments. Asks re improv- Letter from Mrs. .G.H. Tormsend, 1lt1.2 Towa Nvenue West ing alley , asking as to procedure for improving the alley in the 1l~00 block of Iowa Avenue West, between Hoyt and Iowa Avenues, was read. Shavor moved that the Clerk be requested to inform Mrs. Townsend that a petition for improvement of the alley xill have to be filed. Seconded by Cartwright and motion carried anon imously. Keller rezoning Ralph Keller, 1830 West Larpenteur, submitted a petition petition dated May 15, 195b, requesting that property located south of Larpenteur avenue and described in said petition be rezoned to Business district. After discussion, Cartwright moved that we refer the petition to the Planning Commission and ask them, in view of our previous request for rezoning in this area that the Commission consider this petition and report at the Council's June 13, 1956 meeting on what rezoning the Commission would recommend. Seconded by Stewart and motion carried unanimously. Minors employed Public Safety Supervisor Don Arndt and Of icer~ Da~htera ' in bowling alley reported that minors below the legal ag~;,~re employed at .the bowling alley at 1550 West Larpenteur. After discussion, Arndt was instructed to inform the bowling alley owner that such employment of minors is a violation of State law and of our Village ordinance, and that employees below the legal age must be replaced not later than May 28, 1956, and that. further violations in this respect will result in prosecutions under the Village ordinance. Street, drainage Messrs. Don Carley and Vern Lundgren, of our Village Engineer's and maintenance staff, appeared before the council in connection with street recommendations drainage and maintenance matters. Mr. Carley's letter of May 23, 1956, was read with recommendation for correcting drainage at Arona and California, maintenance of surfaced alleys, drainage west end of Hollywood Court Drive, and recommendation on oiling of streets. After discussion of these and other matters previously referred to our Vi11a ge Engineer, Shavor moved. that we proceed with the repair and Repair and mainten- maintenance of the improved alleys, including Hollywood Court, ante of streets and the streets in accordance with the Village Engineer's and improved alleys recommendation, the work to be done by County forces under ordered. the supervision of our Village Engineer. Seconded by Cartwright and motion carried unanimously. Shavor moved that the Village Engineer discuss the problem of repairing Arona avenue between Larpenteur and Crawford with the County Engineer, pointing out that the work done last year in this area at a considerable cost has not stood up as expected, partially due to improper grade, and that the Village Engineer endeavor to have the County make the necessary repairs at ~bunty expense if possible, also that lowering of the catch basin on the west side of Arona and seal coating of the road surface is authorized, all work to be done by County forces as specified 1 1 684 by the Village Engineer. Seconded by Utecht and motion carried unanimously. Culvert, Holton After discussion, Shavor moved that the Village Engineer at Ruggles be authorized to arrange for the installation of:a drainage culvert at the intersection of Ruggles and Holton at a sum not to exceed X150.00, the work to be done under the Village Engineer's supervision, Seconded by Cartwright and motion carried unanimously. Sanitary sewer Messrs. N. L. Hermes and Nick Labalestra inquired regarding service inquiry, sanitary sewer connections for business properties they N L Hermes are developing. It was suggested that they handle the Nick Labalestra matter direct with the City of St Paul. Fairview Ave. The Clerk read copy of a letter dated May 16, 1956, from speed limit the Board of County Commissioners, indicating the County signs will investigate speed zoning on Fairview Avenue between Larpenteur and Roselawn in connection with the posting of proper speed limit signs on Fairview. Fire Trucks Letter of May 12, 1956, from Howard Stiff, Superintendent, replacement value Minnesota Motorized Fire Truck Company, St Paul, was read. Mr. Stiff said to replace our 600 GPM Pumper would cost approximately X16,000. today - that the original price was ~7,795.~ - and that to replace our 750 GPM Pumper would cost about X17,500, the original price being ~12,t~95.00. He also said these figures are exclusive of hose and miscellaneous equipment, and that the National Board of Fire Underwriters figure the life span of afire truck at 20 years. Shavor moved that the Mayor and Village attorney be authorized to attend the League's Annual Convention at Village expense as provided by statute. Seconded by Stewart and motion carried unanimously.
