Shavor, Trustee; David P. Cartwright, Trustee; Harold C. Nilsen, Trustee; Clyde J. Stewart, Clerk. Also present: William E. Olsen, Treasurer and Frank N. Graham, Attorney. Minutues of regular meeting, September 26, 1956, and of special meeting, October 8, 1956, were heard and approved as read. Dean Lundholm After discussion, Nilsen moved that the bill of the Cons tructinn Co. Dean Lundholm Construction Company, Inc., St Paul, Minn.., Inc. bill. covering labor Aadomaterial to October 1, 1956, for remodel- ing of the Village Hall, in the amount of X1,280.00 be paid and that the certified check of Dean Lundholm Construction Co. Inc., which had been submitted with their bid, be returned. to them. Seconded by Cartwright and motion carried unanimously. Treas., street work, Sept., $62.97 Meeting recessed- Meeting recessed at 9:15 P.M. and reconvened at 9:35 P.M. reconvened Juvenile Services As requested, Mr. M. J. Gerraghty, Supervisor, Juvenile report Services, Ramsey County, appeared at the meeting to discuss ~uuenile matters with the council. Mr. Gerraghty said that Juvenile Services has contact with no local resident of Falcon Heights at this time, that two or three years ago they had upward to four bow in the area, but have had no probation cases in the Village since then. He said they do have business in surrounding areas, and attributed Falcon Heights good record to a generally high income bracket per family. Mr. Gerraghty said ,the record indicated good policing and gave special c~ddit to Falcon Heights' parents and home standards. The advisability of adopting a curfew ordinance was also discussed with Mr. Ger~a~l~y. He favored setting the curfew time not later than 10 P.M. and said a curfew ordinance should work out all right if used wisely. Dr. D.M. Garrow, 1488 West Iowa, called attention to the Dip at Arona sharp dip at Arona and California and asked if such dips and California could not be eliminated by filling in or putting in culverts. `23 Inquiry re A4r. John Capetz, 1265 .Berkeley, St Paul, asked if the lot_ zoning of lot. on the southwest corner of Larpenteur and Pascal avenues (John Capetz) was zoned for a commercial building or an apartment. He was informed that the present zoning permitted apartment house construction. Robert P. Folsom, who said he had been a resident and tax payer of the Village 1835 Arona for five or six years, stated he understood the council was considering the employment of a fiscal agent for our proposed sewer project. Mr. Folsom said that prior to a year ago he was in the fiscal business for a period of years, having set up over 200 bond issues, also that he was a licensed attorney and qualified to speak on fiscal services. Mr. Folsom questioned our need of employing a fiscal agent, stating that some municipalities have been induced to employ a fiscal agent on the basis that he could do certain things for the community that a fiscal agent could not possibly do. On interest rates,' he said these were determined by market conditions and, the credit and character of the municipality. Said the only place where a fiscal agent could possibly effect a saving is when the bond issue is set up. Mr. Folsom stated that the essential services needed by the Village can be provided by our engineer and attorney. P4Qr. Folsom said that whether a fiscal agent is employed or not, the services of a qualified municipal fond attorney will be needed. Folsom said that if we are going to employ fiscal agent service, he would suggest T.G. Even son ~ Associates, Inc., of Minneapolis, on the basis of their experience and qualifications. He also indicated he would be glad. to work with the c ouncil in connection with the seer financing matter at any time. Neon Sign - Building Inspector Christensen recommended approval of Jane Garrott the Neon sign for Jane Garrott Candies in the new shopping Candies center. On motion by Shavor, seconded by Cartwright, it was voted unanimously to authorize the building inspector to issue the permit. Fireman Ray Fire Chief Grumke's letter of October 9, was read, reporting Merkel injury on injury sustained by Fireman Ray Merkel while answering a call at 1636 Garden Avenue. Reports of the injury for our insurance company were attached to the letter. After discussion, Cartwright moved that the papers be referred to the Village attorney authorizing him to file the claim. Seconded~by Utecht and motion carried unanimously. Tank truck Letter of October'9, 1956 from Fire Ghief Grumke was read, requested by relative to the need for securing a tank truck in order ~o Fire Chief improve fire protection in areas west of Snelling Avenue, and for meeting emergencies such as bursting of the 36" water main on .North Dale street resulted in. The matter of working out a mutual aid arrangement with Roseville was discussed in this connection. It was agreed that Mayor Utecht should contact Mayor Kitts of Roseville to see if a meeting could be arranged at which Falcon Heights would be represented by l:4ayor Utecht, Trustee Cartwright and Fire Chief Grumke. X24 Newell turns in Fire Chief Grumke's letter of October 10, 1956, was read Vol. fireman relative to the controversy with Volunteer Hal Newell badge on request at the October 9 Department drill about fire calls which of Fire Chief. he claimed were not being put thru to his home whereas Fire Department records show calls were put thru to the Newell home but no ane answered the phone. On this basis the Chief asked Newell for an apology,.but this lead to further argument, resulting in Newell ~~el~-te turn in his badge which he did. In connection with discharging Newell, the Village attorney advised. this may be done bider the ordinar3ee~b~~a two-thirds vote of the recorded membership of the Volunteer Firemen. Fireman Merkel The matter of Fireman Merkel's illness and having him examined illness exam. by a doctor as ordered at the September 26, 1956 meeting, was discussed with Fire Chief Grumke. Because of '~ferkel's recent injury which the Fire Chief said would. keep Fireman Merkel out of work for about four weeks, it was agreed to defer taking action on the examination matter until Merkel returns to work. Fire Engineering, year's subscription On recommendation of the Fire Chief, Stewart moved that we authorize payment of X3.50 for one year's subscription to Fire Engineering for our Fire Department, the subscription to.start November 1956. Seconded. by Cartwright and so ordered. Extra time relieving The matter of payment for extra time put in by Firemen Slama Fireman Merkel to be and Schultz, account Firemen Merkel on sick leave, was dis- paid at rate of cussed. Utecht moved that said time be paid for at the rate X300 per month. of $300.00 per month. Seconded by Shavor and motion carried unanimously. ~~4aple Knoll traffic Letter of September 25,.1956, from A.D. Crampton, Principal suEVey report. Assistant to the County Engineer, was read as to results of the traffic survey made in the Maple Ifnoll area, indicating that there are no violations as to excessive speed and that the topography does not encourage or permit speed. However, Mr. Crampton said it may be advisable to install necessary signs to control traffic at the following locations: Fry Street - northbound, install advance warning' sign reading, "Winding Road" with an advisory speed sign of 15 M,P.H. St Mary's St. - Install "Stop" sign to stop northbound traffic at Maple Knoll Drive. Garden Ave. - Install "No Left Turn" sign in center of the intersection on the west side immediately west of Snelling Ave., prohibiting left turning for west bound traffic on Garden Avenue." "Right Turn Only" Don Arndt, Public Safety Supervisor, appeared before the signs, Larpenteur & council and urged now that our new shopping center is Snelling finished that there is greater need for installing 'No Right Turn' signs on Larpenteur coming off the four services Lanes on Snelling as recommended by the County Traffic Engineer. After discussion, Stewart moved that a letter be written to X25 'Right Turn Only' the State Planning and Traffic Director, requesting that signs "Right Turn Only" signs be installed on Larpenteur coming off the four service lands at Snelling, and that they consider the possibility of placing sidewalks across Snelling Avenue to permit pedestrian traffic to cross Snelling safely at Larpenteur Avenue. Seconded by Cartwright and motion carried unanimously. Extend Idaho Ave. Stewart moved that the proposal to extend Idaho avenue to to SnellingA~enrre.. the northbound lane of Snelling Avenue be referred to Public Safety Supervisor Don Arndt and Trustee Nilsen for study and recommendation. Utecht seconded and motion carried unanimously. r~~I.G.I. licenses Issuance of Master Gas Installer's licenses Nos. 83 81~ Noy. 83, $!~ & 85 , and 85 to the Ace Heating Company, Inc, of St Paul, The Mitchell Company of St Paul, and the Equipment Supply Corporation of St Paul, respectively, received approval on motion by Utecht, seconded by Cartwright. League's regional In connection with the League's regional meeting and dinner meeting !~ dinner, at Hastings, October 25, 1956, Cartwright moved that the Hastings Cle rk be authorized to make the necessary reservations. Seconded by Utecht and motion carried. Secure oxygen tanks Letter from P~Ir.E. Pdi. Lawrence, Safety Rc Audit Department, to wall of fire barn Indemnity Insurance Company of North America, in connection with liability policy LB 21211, suggesting that the oxygen tanks next to the east wall of the fire'station be secured to the wall to prevent falling. Agreed that a letter should be written to D,4r. Lawrence, stating that our Fire Chief reports the tanks will be secured as suggested as soon as permanent location for them is decided on. St Paul City Clerk Letter of September 27, 1956 was read from the City Clerk, letter re sewer St Paul, enclosing copy of Ordinance No. 10829, passed by connection the St Paul City Council, September 1l~,-1956, granting permission to Falcon Heights to connect to the St Paul sewer system, and calling attention to the ordinance section requiring the Vill~.ge to adopt an acceptance ordinance within 60 days from the effective date of the St Paul ordinance. Village insurance- In connection with advertising for bids for insurance Advertisement for `coverage as recommended by our Insurance Committee; Cartwright bids moved that the Clerk and Village Attorney prepare the ad and publish it in The Rose Tribune, October 18, 1956, and call for bids to be in at 7:00 o'81ock PD.4, November 1l~, 1956, the insurance to be effective December 1, 1956. Seconded by Utecht and motion carried unanimously. Meeting with U.of M. The proposed meeting of. representatives of the Board of Regents R~ Staff. Regents, University staff members and. representatives of our Village council, was discussed. Poster re election On motion by Utecht, seconded by Stewart, Trustee Shavor dists. &. voting was authorized to arrange for and post four posters with places details as to the three election districts and three voting places. X26 Payt. damage Letter of October 8, 1956 was read from the Loyalty Group to pedestrian Insurance, Claim Department, Minneapolis, enclosing check cross walk for $14.71 in payment of the Village claim against Alfred sign. Keller for damages to the pedestrian crosswalk. Nilsen moved that the Mayor be authorized to sign the release and that our Treasurer deposit the check for 3~11t.71 and credit to the Street and Bridge fund. Election Judges On motion by Utecht', seconded by Shavor, it was voted to appointed appoint the following Election Judges for the November 6, 1956, General Election, to serve from 7:00 AM. to 8:00 P.M. when the polls close: Election District No. 1 Janet B. Otis Ann Hustrulid Vera Thorne Election District No. 2 Rhodie E. X27 Meeting of October 10, 1956, reconvened at 7:35 PM, October 15, 1956, the following council members being present: William R. Utecht, Mayor; George J. Shavor, Trustee; David P. Cartwright, Trustee; Clyde J. Stewart, Clerk. Also present: YVilliam E. Olsen, Treasurer, and Frank N. Graham, Attorney. Tank truck Mayor Utecht reported on contacting Mayor Kitts of Roseville & mutual about the proposed meeting with representatives of our aid - meeting council and Fire Chief Grumke on mutual aid matters, and with Roseville that Roseville is agreeable to the meeting at a time to be set by Mayor Kitts. Associated Investors Shavor reported on discussing with Don Julen a number of vacant property times the requirements to.be met by the owners of the property west of Arona and. south of the business district. Shavor said he was informed by Julen that (1) grading and. sodding would be completed as soon as more soil which had been arranged f.or could be hauled in (2) that plans are to put the catch basin in and. some plantings this fall (3) that the water way on the south side and planting strip are established but have to be finished and shrubs put in. Only thing not agreed on, Shavor said, is the recordable agreement as to maintenance of grass and plantings which would involve title to the land. Shavor recommended holding the matter over until our October 24, 1956 meeting, After discussion, it was agreed that in lieu of a recordable agreement that our attorney should condition the proposed rezoning on the property owners' sodding and maintenance of the area. Complaints re The lUiayor reported on complaints received regarding the Shell Oil Station Shell Oil Station operating until midnight, that neighbors report that the station seldom closes on time and that work is done in the back of the station after hours. On motion by Utecht, seconded by Cartwright, the following resolution was adopted by a unanimous vote: Resolution - WHEE.EAS, the council has had many complaints with respect to noise and. late operation at the Shell Gasoline Station located at 1l~07 Larpenteur Avenue West; NOW THEREFORE, BE IT RESOLVED, under Section IV of Ordinance No. 27, that the license heretofore granted to Carroll J. Nelson, .Shell Oil Company, to operate a filling station at 1l~07 Larpenteur Avenue uVest be, and it is, hereby expressly conditioned upon the limitation that the station will be closed and all operations upon the premises shall cease at 10:00 P.M.-each day, and that the station shall not be opened nor any operations conducted on the premises before 7:00 A.M. on any day. RESOLVED FURTHER, that the Clerk write a letter to the operator advising him of the passage of this re¢lso~ution and informing .him that if the provisions of this resolution are violated, steps will be taken under Section IV of Ordinance No. 27 to revoke the said license. Leroy D. Humphrey Account Officer Earl Smith being hospitalized for several employed as part weeks, Cartwright moved that Leroy D.Humphrey,.19l~0 Nebraska, time police officer St Paul, be employed to take over the duties of police officer relieving Earl Smith, Earl Smith during the latter's disability, at the same rate injured. of pay, and that the Clerk confirm this by letter. Utecht seconded and motion carried unanimously. X28 Ownership of Copy of letter of October 9, 1956, from the Village attorney to Water mains A4ayor Utecht, relative to determination of ownership of existing water mains in the,Village, together with map showing all mains in the Village at this time. Tree Trimming It was agreed to ask N1r. Schultz, St Paul tree trimmer, what costs his daily charge would be for his crew. Trustee Nilsen will contact. Dead or injured The question of disposing of dead or inured animals found. on animals public streets, was discussed and referred to Trustee Nilsen for checking. Police patrol after discussion of police matters and especially a squad car car equipped with radio, Cartwright moved that we request the Public .Safety Committee to submit to the council at the earliest possible date, specifications for a police patrol car and radio, including the type of car (station wagon or other), type of radio, type of accessory equipment needed and. a list of equipment presently owned. Seconded by Stewart and motion carried unanimously. Tiling of floor, The matter of tiling the floor in the Village Hall was discussed. Village Hall Trustee Nilsen was asked to get some informal prices. Sanitary Sewer Attorney Gra}~gm reported that he had checked with Mr. Duvall, of survey progress- our Sanitary Sewer engineering firm, who stated the survey work ing in the Village is going ahead, that the engineer's crews are out in the Village, and~with a break in the weather, Mr. Duvall. hopes to have the information available by November 15, so an information sheet can be made up in connection with the proposed public hearing on the sewer project. The Village Attorney also reported he had sent copies of the plats to our sanitary sewer engineers, showing the location of the water mains and copies showing location of existing sewers. 'Mays of financing roughly estimated costs were discussed. Brigg,s,Gilbert, Attorney Graham was asked whether the law firm he represents, Morton,Kyle &. Briggs, Gilbert, Morton, Kyle and Macartney, would provide the Macartney services- services offered by a fiscal agent in connection. with our sanitary sewer sanitary sewer project. He said they could see that the bonds are issued properly, that the proceedings are handled in a legal and proper manner from the beginning to the end, that they would work closely with Mr. Duvall, our sanitary sewer engineer,~~pare pre~eri~i.ton,.>a~t~~~s~aanswer questions at the hearing along with Mr. Duvall. Attorney Graham estimated on the basis of a $500,000.00 bond issue that the cost to the Village would-not exceed X2,000.00 and that this would be handled as a separate account. 1956 Bu: et Some further work on setting up the 1956 budget was done.
