REGULAR MEETING, WEDNESDAY, DECEMBER 26, 1956

Meeting called to order at 7:35 P.M. Following council members
were present: William R. Utecht, Mayor; David P. Cartwright,
Trustee; Harold C. Nilsen, Trustee; George J. Shavor, Trustee.
Also present: William E. Olsen, Treasurer; Frank N. Graham,
Attorney, and Willis Warkentien, newly elected Trustee. Absent:
Clyde J. Stewart, Clerk.
Minutes of the December 12, 1956 Village Council meeting were read
and approved.
The following citizens appeared before the council:
.Falcon Ray Garcia, 1906 North Prior Avenue, appeared and
Woods stated that although a petition had been circulated
Sewer among Falcon Woods home owners requesting that the
proposed sewer not be extended to the Falcon Woods
area, approximately 8 to 10 of 2~+ owners in this
area want the sewer and it had been determined by
the owners who do not wish the sewer at this time
that they would not oppose the installation of this
sewer in Falcon Woods. The petition was therefore
not submitted to the Council.
Ralph G. Strutzel submitted a petition signed by 8
ners in the Falcon Woods area requesting the
installation of the sewer in that area.
Robert Rudd, 1915 Prior Avenue, raised questions as
to whether there would be any limitation on the use
of the sewer for garbage disposal or home air con-
ditioning units. He was informed that no restrictions
of this type were contemplated at this time.
Grudem Mrs. Christina Keller appeared before the Council and
Building, asked if a report had been received from the Planning
1790 West Commission pursuant to the hearing on the Grudem vari-
Larpenteur ante request. She was informed that no recommendation
of the Planning Commission had been received b.y the
Council.
Fire Chief Earl W. Grumke appeared before the Council and
Department submitted letters covering the following matters:
Matters
1. The Fire Department's electric clock has stopped
running. Upon motion by Trustee Shavor, seconded
by Cartwright and unanimously carried, Mr. Grumke was
authorized to order and install a new motor.
2. Mr. Grumke submitted a second letter setting out
the work which has been done on the tank truck and
asking whether the Council has found out from Civil
Defense if any of the equipment requested is available

through that source. He was informed that Civil
Defense had not been contacted .yet; that this
would be done as soon as Clerk Stewart returned.
Donald William 3 • Mr. Grumke submitted a letter dated December
26, 1956 suggesting Donald William Schoen as a
Schoen proposed replacement as paid fireman for Ray Merkel and
for Fireman suggesting that the starting salary be set at
vacancy. 280.00 per month. Upon motion by Mayor Utecht,
seconded by Cartwright and passed unanimously,
Trustee Cartwright was requested to procure a
credit report on Mr. Schoen.
Resignation - 4. The written resignation of Raymond L. Merkel,
Fireman Rsy Merkel signed Thursday, December 20, 1956, was read to
the Council. Upon motion by Mayor Utecht, seconded
by Cartwright, the Council unanimously accepted the
resignation of Raymond L. Merkel as of January 1,
1957, and directed that a letter be written to Mr.
Merkel advising him of the acceptance of his resig-
nation.
5. Trustee Cartwright moved, seconded by Mayor
Utecht and unanimously passed, that Raymond
Merkel be paid his salary to January 1, 1957, plus
ore week's paid vacation time.
6. Fire reports and personnel and drill reports
of the Fire Department were received, noted
and ordered filed.
Northome Mr. Christensen submitted the application of North-
Shopping ome Shopping Center, Inc, to remodel office space on
Center, Inc. the second floor of the west wing at 1550 West Lar-
Building penteur Avenue. Upon motion by Mayor Utecht, seconded
Permit by Cartwright and unanimously carried, the Village
inspector was authorized to issue the necessary permit.
Nuisance Walter Hermes of Rose Town Sanitation, 1768 Pleasant
Matters Street, Lauderdale, appeared before the Council as
requested by Trustee Nilsen. He stated that one of
his drivers had dumped a quarter load of affluent near
17+5 Tatum a few weeks ago. He was advised that he
could not dump anywhere within the Village of Falcon
Heights. There was some discussion about the difficulty
of finding places to dump and it was suggested that he
contact Dr. Schoch, County Health Officer, to see if
some place in the County could be found where this
could be done. Upon motion by Mayor Utecht, seconded
by Cartwright and unanimously carried, it was directed
that a letter be written to Rose Town Sanitation ad-
vising them that they cannot dump anywhere in the
Village of Falcon Heights.

Bills On motion by Mayor Utecht, seconded by Cartwright
and unanimously carried, the following bills were

Ordinance Mr. Graham reported that the publication of Ordinance
No . ~+1 No . ~Fl had been completed and that the affidavit of
Publication publication had been received. He also reported that
and Filing certified copies of the ordinance had been filed with
the City Clerk of Saint Paul and with the City
Controller of Saint Paul as required by the Saint
Paul Ordinance.
Sewer A petition signed by 8 owners of property on Fairview
Matters Avenue requesting that the sewer be pub in on Fairview
Avenue was submitted to the Council and a petition
signed by 9 other owners of property along Fairview
Avenue requesting that the sewer not be put in on
Fairview at this time was also submitted. The petitions
and names were read to the Council.
A letter dated December 10, 1956 from H. P. Smith,
1+36 Roselawn Avenue, requesting that the sewer not
be installed in front of his house was read and noted.
.Falcon
Heights Mr. Steffes raised the question of the sewer connection
Congregational for the Falcon Heights Congregational Church. He stated
Church that the basement of the Church was low and that if it
connected on Pascal the Pascal sewer would have to be
deepened an additional 2 feet all the way to Larpenteur.
However, if the Church would connect to the Holton Ave.

sewer, no deepening would be required because the
Holton Avenue sewer was deep enough at that point.
He is to discuss this matter with trustee elect
Warkentien who is a Church member to see if it
can be worked out satisfactorily.
Resolution After considerable discussion, Trustee Cartwright
Ordering introduced the following resolution and moved its
Sewer adoption which was seconded by Mayor Utecht:

WHEREAS, a Resolution of the Village Council
adopted the 7th day of November, 1956, fixed a date
for a Council hearing on the proposed sanitary sewer
system improvement for the Village of Falcon Heights
to consist of the construction of sanitary sewers and
stubs on:
1. Iowa Avenue from Snelling to Hamline.
2. Idaho Avenue from Snelling to Hamline.
3. Hollywood Court for approximately 650 feet to
Snelling.

5. California Avenue from Arona to Hamline.
Larpenteur Avenue from approximately 1000
feet West of Cleveland to Hamline. (Both
sides from Arona to Hamline and both sides
from Fry Street approximately 150 feet East
and approximately 300 feet West).
6. Crawford Averue from Asbury to Pascal.
7. Maple Knoll Drive from Fry to Snelling.
8. Garden Avenue from Fry to Snelling.
g. Garden Avenue from Holton to Hamline.
10. Ruggles Street from Snelling to Albert.
11. Autumn Street from its Westerly intersection with
Roselawn to its Easterly intersection with Rose-
lawn .
12. Roselawn Avenue from the Westerly intersection of
Autumn to Fairview.
13. Roselawn Avenue from approximately 150 feet West
of Holton to Holton.
14. Roselawn Avenue from approximately 350 feet West of
Hamline to Hamline.
15. Hamline Avenue from Roselawn to Hoyt.

WHEREAS, l0 days published notice of the hear-
ing through 2 weekly publications of the required
notice was given and the hearing was held thereon on
the 5th day of December, 1956, at which all persons
desiring to be heard were given an opportunity to be
heard thereon,
NOW THEREFORE; BE IT RESOLVED BY THE COUNCIL OF
THE VILLAGE OF FALCON HEIGHTS:
1. The sanitary sewer system improvement for
the Village of Falcon Heights is hereby
ordered as proposed in the council resolution adopted
November 7, 1956 except that the following portions
of the improvement shall be omitted:
1. Arona Avenue from Crawford to Larpenteur.
2. Snelling Avenue, west side, from Garden to
Roselawn.
3. Cleveland Avenue from approximately 1300
feet north of Larpenteur to Larpenteur.
~+. Larpenteur Avenue from approximately 1000
feet west of Cleveland to approximately
730 feet east of Cleveland.
2. The proposed sanitary sewer system improve-
ment for the Village of Falcon Heights, as
amended in paragraph "1" hereof shall be hereafter
designated as "Sanitary Sewer System Improvement No. 1."
3. Toltz, King, Duvall, Anderson & Associates,
Inc. are hereby designated as engineers for
this improvement. They shall proceed to prepare plans
and specifications for the making of Sanitary Sewer
System Improvement No. 1.
The foregoing resolution was adopted by unanimous
vote of the four council members present.

Fair Letter dated December 21, 1956 written by Mayor
Grounds Utecht to Ramsey County Board of County Com-
Matters missioners with respect to use of Fair Grounds
was read and noted.
Toltz, Mr. Steffes submitted a proposal and proposed
King, contract dated December 26, 1956 by which the
Duvall, Village would employ Toltz, King, Duvall, Anderson
Anderson and Associates, Incorporated as village engineers
Sewer in connection with the sewer project. There was a
Contract discussion as to whether or not the resident engineer
should be employed by the village or by Toltz, King,
Duvall, Anderson and Associates, Incorporated. There
was a discussion as to whether the street resurfacing
should be part of the sewer system plan or handled
separately. There was discussion as to the procedure
which would be followed in connection with putting in
the system. There was discussion as to whether or
not certain additional water mains should be put in
at the time the sewers are put in.
At the conclusion of the various discussions, it was
determined that the Council would pass consideration
of the proposal and proposed contract until its next
meeting set for January g, 1957.
Advertising Nick Christensen reported that he had advised
Sign General Outdoor Advertising Company that their
request for a permit to modify signs at 1550 West
Larpenteur Avenue had been denied.
Northern A copy of the Mayor's letter to Northern States
States Power Company dated December 21, 1956 requesting
Power reduction in gas rates for the Village was noted
and ordered filed.
Gas Tax A letter of Mayor Robert 0. Ashbach of Arden Hills
Matters dated December 20, 1956 addressed to John Tracy
Anderson, representative, was read. A copy of this
letter was given to Trustee Shavor with directions
. to check the matter and do whatever he felt necessary
for the Village of Falcon Heights in this connection.
Regional A letter from the Twin City Area Regional Planning
Planning Board referring to a conference to be held December
27, 1956 was read and noted.
Voting A circular of the City of Minneapolis stating that
Booths voting booths and ballot boxes were for sale was
noted and filed.

Village After discussion and considering samples of tile,
Hall Mayor Utecht moved, seconded by Shavor and unanimously
passed, that Trustee Nilsen be authorized to have the
St. Paul Linoleum. Company put Kentile Corktone Random
Tile on the floor of the council chambers and both
rest rooms and to install Brown Cove Moulding at a
total cost of $33.00.
Police Earl Grumke suggested that all calls received by the
Department Fire Department after the day officers are off duty
Matters should be referred to police officer Dachtera and
that Dachtera should call the Sheriff if necessary
rather than having Dachtera ask the Fire Department
officers to call the Sheriff's office. The Mayor
is to take this matter up with Public Safety
Commissioner Arndt.
Adjournment The meeting adjourned at 11:20 P.M.
