HomeMy WebLinkAboutCCMin_57Mar14o~~ REGULAR MEETING, THURSDAY, MARCH 11t, 1957 Meeting called to order at 7:30 P. M., the following council members being present: William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee; Willis Warkentien, Trustee; Clyde J. Stewart, Clerk. Also present: William'E. Olsen, Treasurer, and Frank N. Graham-and Bernard Friel, Village Attorneys. No one wishing to have the minutes read, Utecht moved that reading of the minutes of March 7, 1957, be dispensed with and that said minutes be approved as submitted. Seconded by Warkentien and so ordered. Drainage Trustee Nilsen reported on drainage problems caused by the matters heavy rain coming at this time with culverts frozen, Said he had talked with the County regarding the matter, but was s}g~ wt informed they have similar work of their own which keeps them C~lvcr-~'S busy 12 hours a day. Nilsen asked if he could not check with the County to see if they could work just in Falcon Heights on Saturdays on an overtime basis, steaming out culverts. Utecht moved that Nilsen be authorised to check with the County Engineer and if agreeable to have them work in Falcon Heights on Saturdays, steaming culverts whenever necessary. Seconded by Stewart and motion carried unanimously. Variance Letter of March Ill, 1957 was read from the Falcon Heights Planning request - Commission, recommending that Beim Investment Company and Grudem Beim Investment Brothers Company be permitted to continue the construction of the Grudem Brothers .building at about 1790 Larpenteur Avenue West, but in no event closer than ~2 inches from the property line of Christina R. Kelley's Planning Com. property, the Planning Commission finding as follows: recommendation "(1) There are special circumstances affecting the premises for which the variance is requested; "(2) The granting of this request is necessary for the preser- vation and enjoyment of substantial property rights; and "(3) The granting of this request will not materially affect adversely the health, safety or general welfare, or public or pri vate property." Resolution After discussion. and acting in accordance with the Planning Commission's recommendation and the consent and request of Christina R. Keller, owner of the adjoining property to the west, Warkentien moved that the request of Beim Investment Company and Grudem Brothers Company for a variance in the sideyard provisions of Section 10, of Ordinance No. 8, to permit the erection of the west wall of a building on property at approximately 1790 Larpenteur Avenue West, to be completed but in no event to be closer than !t~ inches from the west property line, instead of 5 feet from the said line as required by said section of Ordinance No. 8, be, and it hereby is, gran ted subject to the condition that provision shall be made to insure that roof water from the building will not be permitted to reach the adjoining property to the west, and subject to the condition that the wall will not be closer than !t? inches from the west property line. Seconded by Nilsen and motion carried unanimously. (The Clerk was directed to mail a copy of the resolution to the petitioners' attorney, Mr. Conrad Sheets, New York Bldg., St Paul.) 1 J (9N Water in yards and basements Flooded base- ments to be pumped out by Fire Dept. Treasurer Olsen reported that because of the rain and frozen condition of the ground, the property immediately south of the Congregational Church is flooded and asked if the Village could do anything about it. Warkentien reported that the County had checked on this drainage problem a few years ago which they found was caused by construction of the new church, .and that the drainage problem could be solved by running a shallow ditch on the south side of the wall from the low ,point in the yard to the Hol ton Avenue gutter. 'Hater in some basements was also reported and discussed. Utecht then moved that the Fire Chief be instructed that the policy of the Fire Department shall be to answer calls to pump out basements flooded by storm water. Seconded by Ni]s en and motion carried unanimously. Load limits & Because of water conditions and the State load limit of It tons, Bus operation. Street Commissioner Christensen reported that buses could not be parked along Snelling Avenue. Load limits for Village streets were also discussed. The following resolution was moved by Stewart, seconded by Nilsen and passed by a unanimous vote: Resolution By reason of rain, snoR and climatic conditions, streets will be seriously damaged or destroyed unless use of vehicles thereon is restricted; THEREFORE, BE IT RESOLVED, that the County Engineer post all Village streets, excepting Pascal A,.venue from Roselawn Avenue to Larpenteur Avenue, for not over 3 tons axle weight at the same time they post County roads. Seconded by Nilsen and motion carried unanimously. Borden's Pure Building Inspector Christensen reported that Borden's Pure Oil Oil Service Service, 1525 Larpenteur Avenue West, wants to replace their to install present oil tank with a tank of larger capacity. Since the oil tank ~ proposed installation xorK~woutfl cost more thaw X150.00, the building inspector was requested to ad~ri.se Borden's Pure Oil Service that a permit will be necessary, and that they should submit plans, showing the location of the proposed tank, etc. Recgz. #110 for postage stamps, paper clips and other supplies for Clerk ' was approved on motion by Utecht, seconded by Shavor. Greater St Paul Letter of March 6, 1957, was read from Mr. William V. Chenoweth, Safety Council- Director of Safety, suggesting that one or more persons to Village member- represent Fal con Heights be appointed to membershi n the ship Greater St Paul Safety Council. It was mated tha appointees could alternate in attending meetings. Stewart moved that each of the following be appointed to membership on said Committee and that the Village pay membership fees and luncheon costs in connection therewith. Seconded by Utecht amd motion carried unanimously..- Willis Warkentien David P. Cartwright Donald E. Arndt ~._. ~~ X93 Alley account Nilsen reported on receiving check from G.S. Seaborn made payable paid up. - to the Village in the amount of ~J~2.31, covering balance due_for Seaborn work on the alley between Iowa and Idaho Avenues from Albert to Pascal last summer. It was stated that previous payments on the total bill amounting to $111.31, were X640.00 on July 11t, 1956 and ~2~.00 on November '~, 1956. Nilsen moved that a letter be written to Mr. Seaborn by the Clerk, acknowledging payment of the account in full. Seconded by Utecht and motion carried unanimously. Tree trimming Nilsen. moved that Schultz Tree Service be authorized to carry on boulevard tree trimming work up to 46~t75.00. Shavor seconded and motion carried unanimously. Treasurer's Treasurer Olsen reported on a bill he received from the 3ruce monthly. state- Publishing Company, of St Paul, in the amount of $15.00 for went form printing of Treasurer's monthly statement forms. He said that matter the forms which they did over a second time were unsatisfactory and that he had so advised the Bruce Publishing Company. He was directed to return the bill to the Bruce Publishing Company and all of the statement forms they had turned out for him. Village Hall Attorney Graham summarized his letter of March 13, 1957, to ~6r. Sewer Connection James Gallaher, Faxmers Union Grain Terminal Association, regarding Easement this matter. He said our engineers had prepared a plain to show how the Village Hall cesspool would connect with a manhole in the alley on Hollywood Court, and that he had discussed this with Mr. Gallaher as to getting a permanent easement across FUGTA property. He said Mr. Gallaher requested a copy of the plan in order that the matter could be taken up with the management, suggesting that the easement contain a provision requiring the Village to agree to relocate the line at Village expense if building on or use of the property by the FUGTA requires such relocation. Attorney Graham said he believed such a provision could be properly a part of the permanent easement. Falcon Woods B. L. Gage, of Gage Construction Company appeared before the Addition -, council and said the suggestion had been made to delay finishing of Autumn Street and Prior Avenue, Falcon Woods Addition, until B.L. Gage re the sewer comes into the Addition. On behalf of the home finishing owners in the area, Mr. Gage asked that the council approve his Autumn St. & application for surfacing of the roads just as soon as the Prior Ave. Village Engineer says conditions are suitable for doing the work. Verne I~ungren, of our Village Engineers, said he had ioe~~edtoder the road, that it is impassible and doubted if the road could be surfaced before May 1st. Mr. Steffes said that in connection with the sewer progress plan, that Falcon Wood Addition could be put in the first stage so that construction work could btart in May. Mr. Ljungren said his check of the street showed about 200 feet below grade out. of a total of 1,200 feet, that there was some work to be done by Mr. Gage on~the road before resurfacing could be done, including some blading, and that it was dir. Gage's responsibility to keep the road serviceable. It was pointed out that putting the Falcon `rYoods area in the first stake of sewer construction would enable th developer to brim; the streets up to a standard acceptable for maintenance by the Village. The matter of deferring final resurfacing of the street until the sewer comes in was discussed with Ray Garcia, 1906. Prior Ave., and Clarence j94 Falcon Woods Stowa, 195G. Autumn. Seconded by Utecht and motion carried unanimously. FHA deposit Mr. Gage reported he had. on deposit with the F.H.A. some $5,000 for street as a guarantee for completion of street ,grading and surfacing surfacing on Autumn Avenue, and inquired how he could get release of this money since the street surfacing will be delayed. He also inquired as to the recent installation of a street light where Prior turns south, stating that the people living in the area do not want the light. In the discussion that followed with residents of Falcon Woods Addition who were present, Mr. Gary Atkins, 1916 Prior Avenue, said he had requested this light at F~oselawn and Prior, but did not request the one at Prior and Autumn. The residents agreed to get together and let the council know the majority's wishes with respect to the street lights. Harvey Hansen The Mayor reported on a phone call received from Mrs. Harvey Hansen, complaint re 1551 Idaho Avenue -'+Pest, about water flooding her basemen+,, - that water in base- she had taken the matter up with Mr. Stepnitz who said it was a ment Village problem, and that she also had called the Village Engineer. The matter of drainage in the area and ~'ir. Stepnitz' responsibility for water coming off his firm's property was discussed. Bar. Hansen who was present, was informed that this is a private matter and that it should be handled between him and Mr. Stepnitz. Property west After discussion drainage problem and requirements to be met by of Arona & the owners of the property Mr. Stepnitz represents, Utecht south of Biz moved that the Mayor be instructed to contact the property district a~rners' agent, Mr. Stepnitz, and advise him to construct an impervious bank across the back of his property to divert the water from the lots adjoining the parking area, such bank to be established by March 15, 1957; and if such action is not taken, the Village Council will prosecute the owners of the property for violation of the zoning ordinance and the nuisance ordinance. Seconded by Warkentien and motion carried unanimously. Sanitary Server- The seven items in Mr. Steffes' memorandum, covering matters Mr. Steffes discussed at the council's March 7, 1957, meeting were reviewed memo by Mr. Stepnitz and the council. On the matter of resurfacing the Village streets, discussion was held with Messrs. W. L. Hindermann and Stanley Water; Engineers, who formerly served Street with the State Highway Department. Mr. Steffes, of our sanitary resurfacing sewer engineers, and Mr. Ljungren, of .our Village Engineers, participated in the discussion, It was pointed out that in digging the sewer the underlying sand and gravel might be utilized for resurfacing our streets, treating the top three inches with oil. It was stated that this type of base without blacktopping would provide better streets than we have at present. After r 9 ~~ Sanitary Sewer- considerable discussion, the council agreed that resurfacing of the streets should be done as proposed, including the Street resurfac- oil treatment. It was also agreed to take separate bids ing (cont'd) on the sewer project and street resurfacing, advertising first for bids on the sewer and advertising about two weeks later for bids on the street work so as to be covered by the one bond issue, Special Meetings- In order to complete unfinished business, Utecht moved that Mar. 19 & 21 a special meeting of the council be held in the Village Hall on May 19, 1957 beginning at 7:30 PM, also that a special meeting of the council be held in the Village Hall on May 21, 1957, beginning at 7:30 PM. Seconded by Stewart and motion carried.
