SPECIAL MEETING, WEDNESDAY, MAY 22, 1957
MCeting called to order at 7:10 P.M., the following council members being present:
William R. Utecht, Mayor; George J.Shavor, Trustee; Harold C. Nilsen, Trustee;
Willis Warkentien, Trustee; Clyde J. Stewart, Clerk. Also present: Frank N.
Graham, Attorney. Absent: William E. Olsen, Treasurer.
Minutes: On motion by Utecht, seconded by Sh}~vor, reading of the minutes
of May 9, 1957 and May 11t,. 1957, was dispensed with and same
approved as submitted.

that the award be made to the Jay W. Craig Company in the

Legality of Letter of May 16, 1957, from the-Village Attorney was read,
bid advising that the Jay W. Craig Company bid was legally
sufficient and that it could be accepted by the council if
the council determined that the Jay W. Craig Company is
the lowest responsible bidder.
Resolution - On motion by Utecht, seconded by Stewart, the following
resolution was adopted by a unanimous vote:
WHEREAS, pursuant to Advertisement, Bids for the Sanitary
Seger System, Improvement No. I, Part II (Street Resurfacing)
were received, opened and tabulated according to law and the
following bids were received complying with the advertisement:
Jay W. Craig Company; amount, X71,228.00.
Bituminous Surface Treating Company; amount, X72,927.00.
Ray Sina Contracting Company; amount, $76,392.00.
Ashbach Construction Company; amount, X97,374.50.
WHEREAS, it appears that Jay W. Craig Company, of 'Minneapolis,
is the lowest responsible bidder;
NOIP THEREFORE, BE IT RESOLVED by the Village Council, Village
of Falcon Heights, Minnesota:
(1) the Mayor and Clerk are hereby authorized and directed
to enter into a contract with Jay W. Craig Company, of
Minneapolis, Minnesota, in the form attached to the
specifications, in the name of the Village of Falcon
Heights, for the construction of Sanitary Sewer System,
Improvement No. I, Part II (Street Resurfacing), according
to the specifications and addendum approved by the Village
Council and on file in the office of the Village Clerk;

Resolution - (2) the Village Clerk is hereby authorized and directed
to return forthwith to the bidders the deposits or bonds

State of Minn. Letter of May 13, 1957 from the State of Minnesota,
Water Pollution Water Pollution Control Commission, ryas read, approving
Control Commission plans recently submitted to the Commission for sewerage

plans construction. The letter stated that when the pro3ect
is c ompl'eted in accordance with the plans and specificati ons,
that the Commmission should be advised so that a permit can
be issued for the use of these facilities.

State Investment Letter of May 16, 1957, from the State Treasurer was read,

The State Treasurer's letter indicated that small applications
were preferred and that applications for more than $250,000,00
could not be accommodated. The Village Attorney reported he
had talked with the State Treasurer after the Treasurer's
letter was written, suggesting that if the Board could
purchase X100,000 to $200,000 of our bonds that this would
not only help on the interest rate, but would permit the

on receiving a call from Kenneth Schurhamer, of St Paul,

met with Mr. Schurhamer, Mr. Bonestroo and 13 homeowners
in the Falcon Woods area who had proceeded with laying of
sewer pipes from their houses to the street to a point five
feet short of t:~e stub in the street.
Mr. Bonestroo said he wanted his house connection in, so called Mr.
Schurhamer for an estimate for running the house service
in. Also said he called Building Inspector Christensen
and asked him if he knew what the requirements were and
was informed the pipe could bd laid five feet from the
property line. Said others also called but in every instance
are five feet short of the stub in the street, and that there
is a total of 65 feet of sewer involved, which he suggested
be made a pant of the sewer contract.

Nick Christensen ~Ir. Christensen said. he was asked if they could lay
the pipe to avoid tearing up their lawns later, and
that h@ informed them the pipe could be laid in their
property and five feet out in the boulevard, but that
no connection to the sewer in the street could be made
until a permit was taken out.
After a full discussion of their request to permit the
connection of their house sewer pipes to sewer stubs in
the streets and the conditions and matters involved,Utecht moved
that the Village Attorney ~e~ directed to clear the matter
with the City of St Paul, and if agreeable to them, to
prepare an agreement to be signed by the thirteen property

their house sewer to the sewer being put in by the Village
Falcon Woods in the street at this time, to save them expense later,

the house sewer for sewage or arty other purpose until the

for use, at which time they would apply for the sewer
connection permit and pay the fees required under the
ordinance for the connection, and upon their further

any damage which may be occasioned by reason of the

connection to the street sewer is made. Seconded by Nilsen
and motion carried unanimously.

Oliver C. Statham inquired regarding a receipt he had received from the

Hoyt Avenue and whether his property would be assessed

Village. The City of St Paul will be contacted regarding
the matter and refund of Mr. Statham's permit fee.
G.F. Schmidt, appeared before the council to inquire regarding house

would be permitted .a~.
Applications for Building Inspector Christensen presented permit applications
street curbing from Robert J. Pugleasa, 1523 W. Hoyt Avenue, and Hans M.
Gammel, 1535 W. Hoyt Avenue, for curbing along the front
of their properties. The permit applications were referred
to our Village Engineer for study and recommendation.
Clean-Up requests The Building Inspector reported on complaints received
regarding the dumping or storing of material on vacant

Clean-Up requests properties in Blatt's Addition by the. Bentley Construction
(cont'd.) Company, Ray Wagner ~cRaymond Schommer, also on properties
in Falcon Woods by the Gage Construction Company. The Clerk
was furnished with descriptions of the properties involved.
Utecht moved that the Clerk be instructed to write each of
the parties concerning these matters. Seconded by Shavor
and motion carried unanimously.
Street Grade Street grade corrections on Arona south of Larpenteur for
Crossings improving drainage were discussed with Lr. Steffes and the
resident engineer, Lr. Barney, also the matter of replacing
culverts where necessary after clearing with Trustee Nilsen.
In connection with any extra work required for street grade
correction by the sewer contractor, Mr. Steffes said a
change order covering such extras would be submitted to the
council for approval. Mr. Steffes agreed to prepare a
memo for the council covering the items discussed.
Bell & Light Letter under date of May 17, 1957, from the State Civil
installation Defense Director, was read, enclosing check in the amount
refund of $30.00, covering the Federal Civil Defense Administration's
50~ reimbursement on the Village's Bell andLight installation
for the period ending June 30, 1956. The letter also stated
that paper work was being completed for reimbursement for
the period July 1, 1956 thru June 30, 1957.
Maintenance of A proposed letter to Commissioner Frank D. Larzitelli, City
Sewer System of St Paul, relative to the City of St Paul servicing sewers
in the Village upon call at charges to be agreed upon, was
considered. Utecht moved that the Clerk be authorized to
sign and submit the proposal to the City of St Paul. Seconded
by Warkentien and motion carried unanimously.

The Police Commissioner, Warkentien said, suggested that
the business men be informed of these matters when inspections
of the properties are made by the Fire Department. Inquiry
will be made to see if the suggestion is agreeable to the
Fire Department.
Machine Accounting, The Cle rk reported he had talked with Mr. Spear, Director,
Ramsey County Lachine Accounting Department, County of Ramsey, who
indicated that he and his supervisor would be glad to
attend a council meeting when requested to do so for the
purpose of discussing machine accounting matters.

Seger bond The attorney was requested to arrange a special meeting
issue meeting for Monday evening, May 27, 1957, with Mr. B.B. Knopp,
Manager of the Municipal Bond Department, of the First
National Bank of Saint Paul, to discuss matters relating
to the proposed sewer bond issue.
Adjournment: On motion, the meeting adjourned at 11:lt0 P.M.
