Utecht, Mayor; George J, Shavor, Trustee; Harold C. Nilsen, Trustee; Willis Warkentien, Trustee; Clyde J, Stewart, Clerk. Also present: William E. Olsen, Treasurer, and Frank N. Graham, Attorney. ~~~4 Hearing, The hearing reconvened at 7:10 P.M. Engineer V.L. L~ungren Alley reported to the council and to Mr. Rixgus'and Dr. Risbrudt who Improvement were present, that it would require an inuestmea:t of about $2,000.00 to bring the alley in Block 1, Northome Addition, to a standard comparable with the seven improved alleys. Mr. L~ungren suggested that the alley might be fixed up for two or three years with soma regt~.ding and patching of chuck holes, and when storm sewer is put ia, it would be feasible to go in and bring the alley up to standard. The matter was then dis- cussed with Mr. Steffes and Mr. Barney, of our Sanitary Sewer Engineers' staff, who arrived at this stage of the hearing. Mr. Steffes indicated he would arrange. with Mr. Barney tc3 have the ditch on Hamline deepened and to do some work in the alley, including the hauling in of waste material which is being removed from the streets in connection with sewer digging operations. Hearing It was agreed to see how this would work out, ~ d on motion by recessed Stewart, seconded by Utecht, the hearing was ordered recessed • to July 25 until 7:f?0 P.M., Thursday, July 25, 1957. Minutes The council proceeded with the regular meeting at 8:00 P.M. No one wishing to hear the minutes read, it was agreed to dispense with reading of the minutes of June 13, 1957 and to approve same as submitted, Req'n. #121, covering shut-off keys for resuscitator cylinders, axe handles, Fire Dept, insect sprayer, weed killer liquid, etc., was approved on motion by Nilsen, seconded by Stewart. Boxing Exhibition, Letter of June 25, 1957 was .read from Mgr. John J. Raleigh, State Fair .President, St Paul Boxing Club, Inc., stating his intention to promote a boxing exhibition at the Fair Grounds, Friday night, August 23, 1957, with license from the State Athletic Commission sub,~ect to consent of the Village Council. .The Village Attorney's letter of June 4, 1957 on the matter was also read, in which it was stated that '~An opinion of the Attorney General dated February 20, 1950, held that the State Athletic Commission could issue one license for the Village of Falcon Heights but only after the Falcon Heights Village Council has consented to the issuing of the license; Utecht moved that Mr. Raleigh be permitted to hold a boxing or sparring exhibition at the State Fair Grounds on Friday night, August 23, 1957. Seconded by Stewart and motion carried by a ~t/5 vote of the council, Trustee Shavor voting no. • Additional plans and specs. reed. for Sanitary Sewer project & street resurfacing As requested, one additional set of plans and specifications for Sanitary Sewer System Improvement No. 1, Part 1, and one set of plans and specifications for Sanitary Sewer System Improve- ment No. 1 Part II (Street Resurfacing) were received from Mr. Steffes and delivered to Building Inspector Christensen at the meeting. ~r~l t~ ~ J ~I Gas mains on Northern States Power Company letter marked 'tduplicate copy Fry St. between Larpen taut & of letter dated March permission to install 5, 1957," was read requesting gas mains on Fry Street between Maple Knoll Larpenteur Avenue and t~gaple Knoll.. On motion by Utecht, seconded by Warkentien, it was voted unanimously to approve the request. Village Hall The matter of .utilizing waste material from the streets for grvur~ds to be surfacing of the Village Hall and Fire Station grounds was surfaced with discussed with Messrs. Steffes and Barney, of our Sanitary material from Sewer Engineers. Warkentien then moved that our Sanitary streets Sewer Engineers be authorized to instruct the contractor to place the material removed from the streets in the roadway and parking lot at the Village Hall and Fire Station, and to authorize payment for the rolling equipment at the AGC standard rental rate for such equipment. Seconded by Nilsen and motion carried unanimously. Mr. Barney said this would be done when F-ry Street is stripped. Hoyt Avenue The council received a petition submitted by Mr. D, 0. Spaeth, Curbing petitions for the installation of Curbing on the North side of Hoyt Avenue between the Easterly line of Arona Avenue and the Westerly line of Pascal Avenue, signed by the owners of seven properties affected, also a petition submitted by Mr. H. N. Gammel for the installation of Curbing on the North Side of Hoyt Avenue between the Easterly line of Northome 2nd Addition and the Westerly line of Arona Street, signed by the owners of four of the properties affected. Utecht moved that both of the petitions be referred to the Village Attorney for checking and report. Seconded by Shavor and motion carried unanimously. North Snelling In connection with the petition signed by W.H. Deubner and Sewer Petition others, requesting the installation of a sanitary sewer on the west side of Snelling Avenue between Maple Knoll Addition and ftoselawn Avenue.; the Attorney reported that he had checked the petition against ownership records and finds the petition to be sufficient. On motion by Utecht, seconded by Warkentien, the petition was referred to Mr. Steffes, of our Sanitary Sewer Engineers, who reported that the project is feasible and estimated the construction cost at ~G20,000. and that the pro3ect could be included in the financing of the present construction program with approval of the council. On motion by Nilsen, seconded by Warkentien, the following Resolution was adopted by a unaszimous:vote: Resolution WHEREAS, pursuant to Resolution of the Counci~~-.~~ report has been prepared by Mr. A, M. Steffes, of Toltz, King, Duvall, Anderson and Associates, Inc., with reference to the installation of a sanitary sewer on the west side of Snelling Avenue from --- Roselawn Avenue to Clapp Thomsen A~aple Knoll Addition, statixig that the proposed improvement is feasible and can best be made in connection with the installation of the Sanitary Sewer System being put in at the present time, and that the estimated cost is $20,000.00; NORt THEREFORE, BE IT RESOLVED by the Village Council, : "` Village of Falcon Heights, Minnesota: ~ ,aL ._ g~~ resolution - (1) The Council will consider the installation of a Sanitary Sewer in accordance with the report and the assessment North Snelling of the abutting property for all or a portioxi of the cost of the Sewer (Cont'd). improvement pursuant to M.S.A., Sec. lt29.011 to 1129.111, at an estimated total cost of the improvement of $20,000. M. daylight saving time, and the Clerk shall give published notice of said hearing as required by law. ,_ Sewer crossing In connection with our Sanitary Sewer Engineer's report that of Water Main, it is necessary to cross the 6-iMCh water main in Snelling Iowa and Drive at Iowa Avenue, and that the Water Department, City of Snelling Dr. St Paul reserves the right to replace said water main at an estimated cost of X350.00; Warkentien moved approval of the request that the City of St Paul perform the ~rork aid bill the Village for same. Seconded by Nilsen and motion carried unanimously. Trees on Hemline The condition of trees ox Hamlitte Aveatue between Idaho and between Idaho Larpenteur Avenues is connection with sewer digging operations, ar:d Larpenteur was discussed. Utecht moved that Trustee Nilsen be requested to inspect the trees in this area, ~d if he determines that they are dangerous, that he be authorized to have the contractor remove the firees. Seconded by Shavor and motion carried unanimously. Relaying 18" After discussion, Warkentien moved that the Engineer be authorized Storm Sewer to negotiate an extra order to the contract of the Peter Lam®tti extra Construction Company for relaying the 18" storm sewer crossing the east Service Drive from the State Highway Department catch basin located in the divided strip to the Village pond area, the price quoted by the Contractor to install the 18" pipe with new pipe and replacing the Service Drive cut, $7.62 per foot, approximately 90 feet to be replaced at an estimated cost of X685.80. Larpenteur, under date of June 11t, 1957, was read relative to proposed improvements in the appearance of the station, includirsg landscaping, additional hard surfacing, ranch type fence and replacement of present lighting~rith overhead island lighter that will focus directly on the pumps. Also copy of Trustee Warkentien's letter of June 19, 1957 to the District Manager, of the Shell Oil Company, was read, thanking them for their cooperation. BE IT RESOLVED by the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota as follows: _1 1. The Village sha:11 forthwith issue its negotiable coupon general obligation bonds in the aggregate principal amount of $800,000,, all dated July 1, 1957, for the pur- po~-8~ providing money for the construction of Sanitary Sewer System Improvement No. 1 of the Vi1:Lage of Falcon Heights. Said bonds shall be 900 in number and numbered from 1 to 900, inclusive, each in the denomination of $1,000 and shall mature serially, lowest numbers first, on January 1 in the amount of $~+5, 000 in each of the years 1959 through 1978, inclusive. ' y___ This bond is one of an issue in the total principal amount of $900,000, all of like date and tenor except as to serial number, maturity, interest rate and redemption privilege, issued by said Village ` for the purpose of defraying expenses incurred and to be incurred in the construction of a sanitary sewer system for the Village which improve - ment has heretofore been designated as Sanitary Sewer System Improvement No. 1 and is issued pursuant to and in full conf ortnity with the resolu- tion duly adopted by the Village Council after hearing as required by law and pursuant to and in full corfnrmity v~ith the laws of the State of Minnesota thereunto enabling them. Said bonds shall be prepared under the direction of the Village Clerk and shall be executed on behalf of the Village by the signature of the Mayor, attested by the Village Clerk, and the corporate seal of the Village shall be affixed thereto, and the appurtenant interest coupons shall be executed and authenticated ~ by the. printed, engraved, or lithographed facsimile signatures of said Mayor and Clerk. When said bonds have been so executed and authenticated, :they shall be delivered by the Treasurer to the purchaser thereof, upon "`;;payment of the purchase price heretof ore agreed upon and said purchaser JJshall not be obliged to see to the application thereof. ` 1~ ~+. There is hereby created a special fund to be designated ~~ "Sanitary Sewer System Improvement No. 1 Fund", to be -held and administered by the Village Treasurer separate and apart from all other funds of the Village. Said fund shall be maintained in the manner herein specified until all of the .bonds herein authorized and the interest thereon have been fully paid. In said fund there shall be maintained two separate accounts, to be designated as the "Construc- ~- tion Account" and the "Sinking Fund Account", respectively. The proceeds 'of sale of the bonds herein authorized, less accrued interest. received ;thereon, shall be credited to the Construction Account, together with any such other monies as shall be appropriated to said account from -~-- _ ~W.~~~.-_-_ other Village funds, and from said account there shall be paid all costs and expenses of making said improvement, as incurred and allowed, -and the monies in said account shall be used for no other purpose; proy- vided, that if upon completion of said improvement there shall remain any unexpended balance in said Construction Account, such balance shall be transferred to the Sinking Fund Account. There shall be credited to the Sinking Fund Account all collections of the special assessments and general taxes herein agreed to be levied, and all accrued interest received upon delivery of said bonds, and any other monies which may from time to time be appropriated for the payment of the bonds herein authorized. The monies in said account shall be held and used only for the payment of the principal of and the interest on said bonds as such payments become due. The full faith and credit of the Village shall be and are hereby pledged to pay said bonds and interest, and the principal and interest thereof shall be paid out of any funds in .the treasury, if the monies on hand iti said sinking fund account are at any time insufficient to meet the payme~+t of maturing principal and interest. ~ 853 - .r .a . . . ., _ ~, - - ~'~ - 5. It is hereby determined that no less than Six Hundred Twenty Thousand Dollars ($620,000) of the cost of said improvement shall be paid by special assessments to be levied upon all assessable lots, pieces and parcels of land within the area heretofore determined to be assessable for said improvement in amounts proportionate to the benef its received by each such lot, piece or parcel; and the Village hereby covenants and agrees that it will do and perf orm, as soon as may be, all acts and things necessary for the final and valid levy of such assessments. If any assessment be at any time held invalid with respect to any lot, piece or parcel of land, due to any error, - defect or irregularity in any action ors proceeding taken or to be taken Eby the Village or this Council or any of the Village's officers or em- ployees, either in the making of such assessment or in the perf ormance of any condition precedent thereto, the Village and this Council hereby 'covenant and agree that they will forthwith do all such further acts and take all such further proceedings as may be required by law to make such assessment a valid and binding lien upon such property. Said assess- menu shall be payable in twenty (20) equal, consecutive, annual instal- ments, the first of said installments to be payable with general taxes ~`f or the year 1957 collectible with such taxes during the year 1958• Deferred installments shall bear interest at the rate of six (6J) percent per annum. To the first installment shall be added interest on the entire assessment from the date of the resolution levying the assessment until. December 31st of the year in which the first installment is payable. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 6. It is hereby determined that the remainder of the cost of said improvement, not paid by collections of said special assessments, shall be paid from general ad valorem tax levies upon all of the taxable property in the Village. The Village Clerk is hereby authorized and directed to ° f ile a certified copy of this resolution with the County Auditor of Ramsey County, together with such other information has he shall require, and to obtain from said County Auditor a certif~.cate that said bonds have been entered on his bond register and that the tax required by law for the payment of said bonds has been levied. 8. The officers of the Village and the County. Auditor of <• Ramsey County are hereby authorized and directed to prepare and furnish to the purchaser of said bonds and to the attorneys approving the legality of the issuance thereof certif ied copies of all proceedings and records relating to said bonds and to the financial affairs of the Village, and such other affidavits, certificates and in- f ormation as may be required to show the facts relating to the legality and marketability of said bonds as the same appear from the books and records under their custody and control or as otherwise known to them, and all such certificates, certified copies and affidavits, including any heretof ore furnished, shall be deemed representations of the Village as to the correctness of .all statements contained therein. 1' ..
