SPECIAL MEETING, THURSDAY, AUGUST 15, 1957
The meeting was called to order at 7:10 P.M., the following council members
being present: George J. Shavor, Acting Mayor; Harold C. Nilsen, Trustee; Willis
Warkentien, Trustee; Clyde J. Stewart, Clerk. Absent: W311iam R. Uteeht, Mayor.
Also present: William E. Olsen, Treasurer; Frank N. Graham, Attorney.
Assessment Acting Mayor Shavor announced that the hearing on the
Hearing proposed assessment for Sanitary Sewer System Improvement
No. 1, waa being held pursuant to the Notice of the Hearing
as published. He then called on the Village Attorney to
explain the procedure. The audience included 15 persons.
Attorney Attorney Graham stated that the Village has gone ahead and'
put in a sanitary sewer system which connects with the City
of St Paul system. He said that X620,000 of the X900

approximate cost was assessed against the benefited property,
and that the statute sets up the procedure for levying the
assessments. Attorney Graham reported that the assessment
rol]. had been prepared by the Clerk, the Engineer and•the
Attorney, and that the assessment roll has been at the
Clerk's home for inspection for about three weeks, He said
the total assessable footage was about 69,000 feet and the
total amount of the assessment about X620,000, making the
total cost per foot, $896 It was also pointed out that the
cost is assessed over 20 years in 20 equal installments.
Purpose of The purpose of the meeting, he said, was to permit anyone
meeting to be heard with reference to the assessment.
Payment of The entire assessment, the attorney said, may be paid
Assessment without interest if paid on or before September 16, 195?,
and after the assessment has been. certified to the County
Auditor, that the entire assessment, or the unpaid portion
of same, maybe paid to the County Treasurer with interest
to December 31 of the year in which payment is made, He
said the 1 aw does not provide for partial payment of the
assessment, and that the assessments are collectible the
same as taxes.
Asks if wished Persons in the audience were then asked if they wished
to be heard to be heard with reference to the assessment -
A.J. Struck, asked when he could pay up his assessment and was informed

in full without interest up thru September 16, 1957•
G.F. Schmitt, asked regarding paying up the assessment after a year or

along the line of 20 years by paying up the balance to
December 31 of that year.
Armond Hinkle, inquired if the X280,000 added to general taxes could be

had been adopted and certified to the County Auditor, which
wero necessary to make up X280,000 over the next 20 years,
with 6 per carat interest added so we can get in enough to

assessment taxes. He was informed the lew for 1957 was ~l~3,000, then
hearing X31,000 for each of the next tiro years, dropping to X20,000
{cont'd} by 1960 with a continuing drop off each year. It was estimated
on the basis of the Vital mill rate that this would result in
a 10 per cent tax increase for next year and 7 per cent the
year after.
George Bauman, asked what the assessment was on his Snelling Itanor property
123 So. Lexington and was informed the amount was X722.17 based on a frontage
St Paul of 806 feet.
Nick Christensen said his assessment was X1330. and since the apartment and
1910 Snelling Ave.N. 50-foot lots were getting the same benefit, h® thot the
' method of assessing was unfair. The attorney reported that
the assessment probably could have been made on an area
basis, but that the basis decided on by the Councilis used
customarily in St Paul and that it was chosen as having the
least ob3ection for the Village. Mr. Christensen also asked
regarding extra subs in the street in his area and was
informed that the engineer reported these were installed
for possible future commercial development.

asked Asbury, Alvin A. Benson, 1l~22 W. Larpenteur and L.M. Larson,
1$97 N. Albert, each inquired regarding the amount of his
assessm®nt. Mrs. E.F. Hutton, 1365 California Avenue West,
also asked about her assessment and about inspection that
had to be made prior to making of the house connection.
Hearing No one else wishing to be heard, the h®aring was declared
closed closed at 8:15 P.M.
Resolution - On motion by Stewart, seconded by Shavor, the following
Assessment resolution accepting and adopting the assessment roll,
roll adopted was passed by a unanimous vote:
WHEREAS, pursuant to propa~/~~~~c ~ given as required
by lair, the Council has me a and passed upon all

Improvement System No. 1, assessing property upon the
following streets and avenues:

NOW THEREFORE, BE IT RESOLVED by the Village 6cS'uncil, Village
of Fal con Heights, Minnesotas
as„ corrected
1. Such proposed assessment,la copy of which is attached
Assessment hereto and made a part hereof, is hereby accepted and shall
accepted constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby
found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal installments
Payable ov®r extending over a period of 20 years, the first of the install-
20 years menu to be payable on or before the first Monday in January,
1958 and shall bear interest at the rate of 6 per cent per
annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest
on the entire assessment from the date of this resolution
until December 31, 1958. To each subsequent installment when
due shall be added interest for one year on all unpaid
installments.

3. The owner of any property so assessed may, at any time
prior to certification of the assessment to the county auditor,
Preparying. pay the whole of the assessment on such property, with interest
assessment accrued to the date of payment, to the Village treasurer,
except that no interest shall be charged if the entire assess-
ment is paid within 30 days from the adoption of this resolution;
and he may, at any time thereafter, pay to the county treasurer
the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such
payment is made.

Resolution
assessment, !~. The clerk shall transmit a certified duplicate of this
contd. assessment to the county auditor to be extended on the
proper tax lists of the county, and such assessments
shall be collected and paid over in the same manner as
other municipal taxes.
Lord .Salisbury Application for building permit to install sheet rock
permit partition in the Lord Salisbury cafe, 1526 W. Larpenteur,
was approved on motion by Nilsen, seconded by Sterrett.
Reqn. #126 Requisition #126 covering office supplies needed for
the Deputy Village Clerk, was approved on motion by
Nilsen, seconded by Warkentien.
Ramsey Co. Letter of August 7 from the Board of Ramsey County
Governmental Commissioners,, requesting recommendations for
Study Com. appointments to the Ramsey County Governmental Study
appts. Commission was read, and on motionby Shavor, secorfbd
by Sterrett, referred to the Attorney for report after
checking the statute.
Cert. #3, Cert. #3, covering 3rd estimate for partial payment
3rd estimate for on contract dated May 3, 1957, to the Peter Lametti
partial payt. Construction Company, in theamount of X156,060.23,
on Lametti Ras considered. Warkentien moved that said partial
contract. payment be authorized. Seconded by Shavor and motion
carried unanimously.
On Sale beer Applications for seven "On Sale" beet licenses desired
licenses, State Fair by State Fair ground applicants, together with check
for X2l~5.00, covering license fees, were presented with
letter of transmittal dated August 12, 1957, from Mr.
H. D. Johnston, Superintendent, Space Rentals, Minnesota
State Fair, listing the applie~nts names and addresses.
On motion by Nilsen, seconded by Shavor, issuance of
said licenses was approved.
M.G.I. license #103 On motion by Warkentien, seconded by Nilsen, the
issuance of Master Gas Installer's license #103 to
Dahl's Gas Heating Company, was approved.
To remove rock Nilsen reported that in checking on the Craig Company's
from streets work in resurfacing of the streets that many rocks were
found in the street. After checking with the Attorney
and the engineer, it was decided, he said, that the
contract does not require the Lametti Construction Co.
to remove rock that was brought up from trench excavation.
The engineer recommended that the contractor be authorized
to use rake equipment for removal of the rocks at a rental
of X25 an hour. After discussion, Nilsen moved to authorize
the sanitary setter engineer, Mr. Steffes, to request
Lametti Construction Co. to bring in said equipment for
removal of the rock on those portions of the streets where
the rock was brought up from the trench excavation, the
work to be done as ~e~ermined by the Village Engineer and
Trustee Nilsen. Seconded by Shavor and motion carried
unanimously.

Addis Streets L~.mngren's inspection of the streets in the Falcon
(eont'd.) Woods Addition and their unsatisfactory condition for
stabilization, xas read and discussed.
Constable Nilsen moved that the Clerk be instructed to xrite
office abolished-

d Constable Henry J. Dachtera, advising him that the office

. of Constable, Village of Falcon Heights, has been
abolished as provided for in Ordinance No. l~3. Seconded
by Shavor and so ordered.
Village Engineer After discussion, Shavor moved that Trustee Nilsen be
requested to spend authorized to discuss with Vernon L~ungren, Village
more time on sewer Engineer, the need for his devoting more time to matters
& street resurfacing pertaining to construction of the sewer and street
matters. resurfacing, with request that L3ungren make xritten
report xeekly to Trustee Nilsen on any situations in
connection xith the installation of the scorer or resurfac-
ing of streets xhich he feels should be brought to the
attention of the council. Seconded by Nilsen and motion
carried unanimously.
Bills: On motion by Warkentien, seconded by Shavor, the folloxing
