REGULAR MEETING, THURSDAY, OCTOBER 24, 1957
Meeting called to order at 7:30 P.M., the following council members being present:
William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee;
Willis Warkentien, Trustee; Clyde J. Stewart, Clerk. Also present: Ydilliam E.
Olsen, Treasurer; Frank N. Graham, Attorney.
Minutes of October 10, 1957 were approved as submitted.
Req'n. #132 office supplies for Clerk's office, was approved on motion
by Utecht, seconded by Warkentien.
Req'n. #133 2 floor mats, 42" adapter, fuses for roof siren and typewriter
Fire Dept. ribbon, approved on motion by Rlilsen, seconded by Utecht.
MGI License #105 issued to Burniece-'s Inc., of Minneapolis, was approved on
motion by Nilsen, seconded by Utecht.
Master Plumber's issued to the Axel Newman Heating and Plumbing Company, of
License #4 St Paul, was considered. On motion by Utecht, seconded
by Nilsen, the issuance of said license was approved by
a 3/5 vote of the council, Shavor and Warkentien voting
No.
Buster Plumber's issued to Wallace H. Johnson=Plumbing Company, of Minneapolis,
License #3 was approved unanimously on motion by Warkentien, seconded
by Nilsen.
master Plumber's issued to D.W. Hickey and Company, Inc., of St Paul, was
License #2 approved unanimously on motion by Utecht, seconded by
Y~arkentien.
Park and Letter of October 15, 1957, from Eugene A. Monick~was
Recreational read, regarding request of the Board of Ramsey County
areas Commissioners for suggestions as to areas suitable for
park and recreational development.
County wide
voters'registeration Letter was read from Donald T. Nystrom, Supervisor of
Elections, City of St Paul, relative to a meeting of the
Legislative Committee on Monday, October 21, at 8 P.M.,
in the County Board Room of the Court House, at which
the possibilities of a county wide voters' registration
system were discussed. Shavor and Stewart who attended
the meeting reported on high lights of the proposal and
the Committee's plan to acquaint other Ramsey County
communities with the proposal before acting on the matter.

Ahlberg culvert Letter of October 22, 1957, by Judd S. Mulally, Attorney,
matter representing Merlin A. Ahlberg, 1340 West Idaho,. was read.
The letter referred to a culvert which was recently installed
in the street adjacent to the Ahlberg property at the southwest
corner of Hamline and Idaho. It was stated. that Mr. .Ahlberg
feels that the culvert should be installed as provided for in
the council's resglution of September 12, 1957, instead of
terminating at the driveway ~f the Ahlberg garage. Attorney
Discussion Mulally and Mr. Ahlberg were present and discussed the
matterswith Engineers Steffes arxi Betley. Bair. Steffes said
it woulra change the Aresent contour of the boulevard if the

Ahlberg culvert ditch is closed for 6 to 8 feet beyond the driveway, or
matter (cont'd) if the contractor is successful in carrying it to the
alley between Idaho and Iowa. He estimated the additional
cost of carrying it to the alley at X550, It, was finally
agreed to have Mr. Steffes prepare a plan which Bdr. Betley
will take up with Mr. Ahlberg and then submit to the
council for action.
Drainage Drainage conditions on Crawford, Holton, Garden and Albert
Streets were discussed with Engineers Steffes and Betley.
Mr. Steffes said the contractors are going to keep blading
and working these streets until freezing sets in, in order
Motorists to dry them out and put in the best shape possible.
Trustee .Nilsen asked that the men operating the contractor's
equipment cooperate with and assist motorists when they
get stuck in the newly graded streets. Mr. Steffes said
instructions will be issued to do so.
Culvert Messrs. Paul M, Barry and Ralph E;. Pirnie, of Barry and
thawing Sewall Industrial Supply Company, Minneapolis, appeared
equipment before the council as requested and provided information
on questions relating to the thawing out of culverts and
on the use of their equipment in this connection. Units
described in their literature and discussed were:
#1250 C-P Gas engine driven unit, on 52--inch steel wheels,
suitable for mounting on truck, 120-gal capacity;
price, X915.
#1859 Gas engine driven unit on trailer,180 gal.cap., X1,979.
#1250 M Gas engine driven unit, mounted on three wheels,
120 gal. cap.; price, X1,098.
Gutter on Engineer Steffes reported on the condition of Garden street
Garden from between Pascal and Holton and his discussion of the situation
Pascal to with Reverend Trimble, pastor of the Falcon Heights Congregational
Holton to be Church. On recommendation of Engineer Steffes, it was moved
surfaced. by Stewart,that the gutter along the south side of Garden Avenue
from Pascal to Holton be surfaced with hot Unix approximately
2-feet wide, to provide for a permanent gutter at this time at
an estimated cost of X100.00, and that the Clerk be instructed
to write the Board of Trustees, Falcon Heights Congregational
Church, advising that this will be done and that they should
inform their contractors that they will be held responsible for
any damage to the gutter surface. Seconded by Utecht and
motion carried unanimously.
Cave-ins where The Mayor reported receiving a complaint from a home owner
stuff comes in that after his house connection was made cave-ins occurrdd
from main sewer where the stub comes in from the main sewer. Engineer
Batley reported that where water is used for settlement in
connection with sewer installation to the house and the
ditch is not compacted properly that such settlement will
take pl ace. The Clerk was asked to notify Village Plumbing
Inspector Falkoski to require installers to put in cribbing
and properly compact for the stub in the boulevard.

A.J. Steirrnrorth fir. Steinworth inquired regarding his previous request to
re street light have the street light on Larpenteur near Fry Street moved
and Fry Street so as to improve the lighting for motorists turning off
Larpenteur onto Fry Street. Shavor moved that the Clerk
make written request on the Power Company to change the
location of the light 300 feet west of Fry Street on
Larpenteur to the intersection of Fry Street and Larpenteur
Avenue, and if possible, place on the north side of Larpenteur.
Seconded by Utecht and motion carried unanimously. Dir. Stein-
worth also asked about keeping Fry Street passable. Mr. Steffes
told him the street would be bladed and kept passable.
Record of service Engineer Steffes' letter of October 2l~, 1957, relative to
cuts by Power Co. the Power Company's installation of gas services in the
Water Dept. to Village and inspections and records required in this ~,
be kept by Village connection, was read. The letter stated: "A record
Engr. should be kept of all service cuts made by the Northern
States Power Company or the Water Department of the City of
St Paul so that if the trenches settle or do not withstand
traffic and are to be repaired, we will be in a position to
distinguish these from the sewer trenches which may show
settlement in the spring. The responsibility for repair of
the street surface must be confined to the party responsible
for the settlement." After discussion, Utecht moved that
a copy of the letter be turned over to the Village Engineer
and that it be his responsibility to see that the roads are
put back in proper condition and to~keep said records, and
that the Clerk inform the Northern States Power Company of
the matter and ask that they report to the Village on all
service cuts. Seconded by Stewart and motion carried
unanimously.
Stabilization tests Letter of October 23 from br. Steffes relative to four
on Asbury from stabilization tests made on Asbury from Garden to Ruggles
Garden to Ruggles by the Twin City Testing and Engineering Laboratory on
September 6, 1957 was read, recommending payment of the
(Twin City Testing invoice in the amount of ~I~O. On motion by Shavor, seconded
Engr. Lab.) by Warkentien, the payment was authorized.
Lorch Bros. The Clerk reported receiving notice that Lorch Brothers,
gas installation of St Paul, had performed gas installation service at 1906
matter N. Pascal without license as required by our ordinance
and that he had no reply to his fitter of some time ago to
the Lorch Brothers regarding the matter. After discussion,
Stewart moved that the file be referred to the Attorney for
handling. Seconded by Utecht and. motion carried unanimously.
Extra Orders Nos. 7, Engineer Steffes presented extra orders to Peter Lametti
8, 9 and 10 Construction Company with details as to each as follows:

After discussion, Shavor moved approval of said extra orders.
Seconded by Nilsen and motion carried unanimously.

Investment of After discussion of thebalance which will be left in the
Construction Construction Account at The First National Bank of Saint
Account Funds Paul until May of 1958, Stewart moved the adoption of the
authorized following resolution:
Resolution - RESOLVED,_that the attorney be authorized to have The First
National Bank of Saint Paul invest this money in United States
_ Treasury Bills due April 15, 1958.
Seconded by Utecht and motion carried unanimously.
Northern States Power Utecht moved that the attorney be authorized to interpose the
Company law suit, necessary answer on behalf of the Village of Falcon Heights
as third party defendant in Northern S#,ates Power Company
law suit against the Peter Lametti Construction Co. Seconded
by Shavor and motion carried. unanimously.
Property on west side Attention was called to a sign displayed at the Lord Salisbury
of Arona between
L Shoppe stating, "Parking in the Rear." Improvements whicY~
arpenteur and Idaho have not been made on the property bordering AronaKbe~'~ween
Larpenteur and Idaho as agreed to by the owner, were also
discussed. The Clerk was asked to turn over his file on the
matter to Trustee ~arkentien who will check and report back
to the council.
Annual Village After discussion, Shavor moved that the polling places for
Election - .the Annual Village Election, December 3, 195?, be at the Village
polling places - Hall, 1641 West Larpenteur, for both Precincts Nos. 1 and 2,
hours open - and at the Falcon Heights School, 1393 Garden, for Precinct
Judges appointed No. 3; that the polls shall be open on .election day from 12 noon
to 8:00 P.M., and that an election board of two 3udges and
one clerk in each precinct be appointed as follows:

Deputy Clerk - The Cle rk reported on duties performed by the Deputy Village
appointment Clerk, Mrs. Ethel E. White, and the need for continuing the
extended appointment on a temporary basis during hours that conform
with the work load. Shavor moved that because of the reduced
work load in the Deputy Clerk's office that the matter be
left to the discretion of the Village Clerk and that the period
of employment be extended for not to exceed 90 days following
November 15, 1957• Seconded by Utecht and motion carried
unanimously.
Falcon Woods Letter of October 22, 1957 from ;~Ir. C.H. Sampier, 1997 Autumn
Addition Street Street, was read relative to the unsatisfactory condition of
the newly constructed street in Falcon 1~Yoods Addition. The
letter was referred to the Village Engineer.
Falcon Hts. Letter of October 21, 1957 from Engineer Ljungren was read,
Congregational reporting on an inspection made by Mr. Betley and tdr. Ljungren
Church - deposit in the area of the crossing that the Falcon Heights Congregational
returned. Church used for moving of its parsonage and that they could find
no damage to either the street or the sanitary sewer. On their
recommendation, Treasurer Olsen was asked to refund the Church's
$1,500 deposit check.
Sewer Rental Attorney Graham's letter was read, summarizing the discussion
rates relative to sewer rental rates, held in the office of Adrian
P. Minkel, Commissioner of Public Works, St Paul, on October
22, 1957, the meeting being attended by Commissioner Winkel,
Messrs. Seamor, Duvall, Steffes, Tews, Homboe, Graham and
Trustee Shavor. Mr. Seamor pointed out that St Paul sewer
rental charges were all based upon water meter sizes and that
those homes within the City with larger meters because of
low pressure were affected the same way as those in Falcon
Heights. He also said that St Paul residents paid in addition
to their annual sewer rental, a tax amounting to !ta to 5 mills
on the assessed value of their property, w hether severed or not,
which taxes are not paid by suburban residents. The Technical
Committee recommended that no change be made in the billing set
up by the Ordinance.

.Seconded by Warkentien and motion carried unanimously.
1958 On motion by 9Parkentien, seconded by Utecht, the following
Budget resolution was adopted by a unanimous vote, with request that
the Clerk certify same to the County Auditor:
Resolution - BE IT RESOLVED, By the Village Council of the Village of
Falcon Heights, that the following sums be and they hereby
are levied upon the taxable property of the Village of Falcon
