SPECIAL MEETING, THURSDAY, NOVEMBER 7, 1957
Meeting called to order et 7:35 P.M., the following council members being present:
William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee;
Willis W arkentien, Trustee; Clyde J. Sterrett, Clerk. Also present - William E.
Olsen, Treasurer; Frank N. Graham, Attorney.

d+'aithnvar3.an~e The council received a petition in regard to making house
petition connections to the sanitary stirrer, signed by Julius Fuith,
1765 Holton Street and 38 other residents on Holton Street,
Larpenteur and Pascal Avenues, asking that the Village xaive
any requirements for substituting cast iron pipes for under-
ground clay the pipes, which the petitioners believe xere
installed in their homes xhen built in 19l~5 or 1946, folloxing
World War II, xhen there was a shortage of construction
materials. The petitioners further stated that none of their
houses have been subject to difficulties because of the use
of clay tile, and that the additional expense of replacing it
with cast iron is unnecessary for public health or other
reasons. About 35 persons xere in attendance.
Attorney for Joseph Hamilton, St Paul attorney, said. he represeazted the
petitioners petitioners and that inasmuch as the petitioners' homes
mere built back in 191tb, that the installations met all the
effective requirements then so should not be in violation
of any subsequent requirements.
State Health The Clerk read a letter dated November 6, 1957, from the
Dept. letter Public Heal th Engineer, State of Minnesota, quoting the
Minnesota Plumbing code. on building drain requirements
and on health problems xhich may arise if there is sewage
or sewer gas leakage.
St Paul plumbing A note regarding discussion of the matter xith the Plumbing
inspector quoted Inspector, City of Saint Paul, xas also read, quoting the
Inspector as saying if the clay pipe xas properly installed
it should be as safe as cast iron, and that he didn ~ t think
there xas danger xhere the rater xas city rater and piped in.
Robert E. Greiling, In sparer to the question, if sautisfactory to make sanitary
Sanitary Server sewer house connection to the pipe, Mr. Greiling stated that
Engineer in his opinion the file met requirements xhere properly installed.
Petitioners Julius Fuith, 1765 Holton, and Patrick E. Cody, 1771 Holton,
spoke in behalf of the petition and detailed the large expense
involved for the petitioners if they are required to substitute
cast-iron p~pp for clay tile.
Village Plumbing A.J. Falkoski reported on one instance where iron pipe xas
Inspector connected to tile.
Village Attorney . Asked as to the responsibility of the Village in the matter;
Attorney Graham stated that on the basis of the information
presented to the council there trould be no legal liability
on the .part of the Village in his opinion.

Holton Street Utecht then introduced and moved adoption of the following
petition (cont'd) resolution:
Resolution - RESOLVED, that the request for variation in the building code
dated November 6, 1957, signed by 39 residents of the Village,
requesting a variation to permit sewer connections to be made
to existing clay the piping underneath the houses, be and it
hereby is granted, the council finding that the said variation
rill not materially affect adversely health, safety or general
welfare or public or private property; and that this resolution
is passed under the provisions of Ordinance No. 17.
Seconded by Shavor and the following vote taken and recorded:
Ayess Utecht, Shavor, Nilsen, Warkentien, Stewart

Passed by
unanimous vote. The resolution xas declared passed by a unanimous vote.
Gas service Letter of November 6, 1957 from our sanitary sewer engineers,
installations relative to the Power Company's plans to install gas services
at 178ts Simpson and 1$35 Holton Avenue in the near future,
xas referred to the Village Engineer for checking on backfill-
ing operations, on motion by Shavor, seconded by Utecht.
Permit for
Gas mains Letter xas read from the Village Engineer dated November 7,
Hemline from 1957, enclosing request from the Power Compargr to extend
Garden to serve the gas main from Garden and Hemline north along Hanline~
1807 Hemline Avenue to serve the property at 1807 N. Hemline. Shavor
moved that permission be authorized. Seconded by Utecht
and motion carried unanimously.
Street light, The Clerk reported that upon learning from the Power Compen y
Fry & Larpenteur that the street light on Larpenteur Avenue near Fry Street
is a County light, he xrote the.County Engineer requesting
that the location of the Aught be changed to the intersection
_ of Fry Street and Larpenteur. Nilsen moved approval of the
Clerk's request on the County Engineer. Seconded by Warkentien
and motion carried unanimously.
Metering station Letter of October 31, 1957 from the Power Company xas read,
electric service enclosing a card to be signed by the Village for commercial
authorized lighting service at the West side of Hemline and Hoyt (metering
station). Utecht moved that signing of the application card
b® authorized. Warkentien seconded and motion carried
unanimously.
C.M. Stowe, Mr. Stewe's letter of October 21, 1957 xas read, stating that

as to responsibility for payment oY assessments which might
Prior Ave.- become due in the event that the portion of Prior Avenue south
Falcon Wds Addn of Autumn Street is finished as a thoroughfare. Mr. Stowe xas
informed that a sum had been deposited with the Village sufficient
to complete this portion of Prior Avenue xhen the area to the
south of Falcon Woods is opened up. Also that angrone developing-
the area xould be required to put in sanitary sewer and pay for
it.

R.P. Rivard, Mr. Rivard inquired as to sewer rental charges being based
1802 N. Simpson on the size of the rater meter, and was given the information
on this matter as it appears in th~ninutes of October 21~, 1957,
page 922. Mr. Rivard reported that when installing sewer
service at his home, it was found that the stub in the street
was higher than the house outlet and that he incurred extra
footage expense because of this. After discussion, Mr. Betley
agreed to follow thru on the matter for Mr. Rivard.
Holton Street A petition signed by William M. Huber, 1892 Holton Street, and
petition 1!~ other residents on Holton Street, was presented to the
council. The petition requested the lowering of Holton Street
from Roselawn Avenue to a point ad3acent to the drainage area
located on the west side of Holton and north of Garden Avenue.
She petition said that the proposed lowering of the street
was to provide drainage of surface water away from the petitioners'
properties in order to prevent daieage to same, the petitioners
contending that grade corrections and raising of the street grades
caused the problem and that the cost of the proposed lowering of
the street should be borne by the overall severer and road pro3ect.
About 30 persons were 3.n the audience.
Engineers' Letter of November 1, 1957 from the pro3ect engineers and letter
letters of November !t, 1957 from the village engineer, were read. The
letters pointed out that some of the property owners on Holton
had requested that the storm water ditches on each aide of
Holton be filled, developing the drainage problem and pocketing
the water on lawns and along the street. Also that a check of
the profiles taken by the pro3ect engineers showed the elevation
of the street was lower than the elevation of the front lawn at
the house, and the shaping of the front lawns would require
only grading of that portion adjacent to the road. The engineers
stated to lower the street another foot would place this portion
of Holton Street under water in the spring and make necessary
re~a~ding of about 300 feet on Ruggles Avenue.
Discussion In the discussion that followed with the petitioners, it was
brought out by the engineers that the street is lower than the
original grade, but that some of the residents had requested
the contractor to fill the ditches in order to have boulevards
and to eliminate culverts under each driveway, resulting in a
drainage problem. Petitioners who were heard included:
John McDonough, 1891 Holton; Fred Gardner, 1880 Holton; Mrs.
William C. Reeves, 1877 Holton; Mrs. John McDonough and Don
Wallace, 1910 Holton.
Opening of The question of opening the ditches was discussed with
ditches discussed Contractor Peter Lametti. Engineer Batley said there was
enough time to open the ditches, but that lowering of the
street would be out of the question this fall.
Matter referred Utecht then. moved that the matter be referred to the
to Engineers project engineer and village engineer for their recommendation
as to a practical solution and for estimate of cost, to be
submitted to the council no later than next Thursday,
November 1l~, 1957. Seconded by Shavor and motion carried
unanimously.
