HomeMy WebLinkAboutCCMin_57Dec19J~ REGULAR MEETING, THURSDAY, DECEMBER 19, 1957 Meeting called to order at 7:x+0 P.M., the following council members being present: William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee; Willis Warkentien, Trustee. Also present: William E. Olsen, Treasurer; Ethel E. White, Assistant Clerk, and Frank N. Graham, Attorney. Absent: Clyde J. Stewart, Clerk. In the absence of Mr. Stewart, Mr. Graham took the minutes of the meeting. The minutes of the December 5, 1957 meeting and the canvassing board meeting of the same date, were ordered approved as submitted. Harold C. Nilsen, Harold C. Nilsen submitted his written resigna- Resignation as.Tru~~ee tion dated December 19, 1957 to become effective as of 12:00 midnight, December 31, 1957. After discussion, Utecht moved that the resignation of Harold C. Nilsen as trustee, be accepted to become effective at 12:00 midnight, December 31, 1957. Seconded by Warkentien and motion carried unani- mously. 1 Muske building permit - A letter of William H.'Muske Co., Minnesota building, SW corner of Larp. Ave. St. Paul, dated December 18, 1957, inquiring whether and Pascal. a single family residence could be erected on a 50 foot lot, the Southwest Corner of Larpenteur Avenue and North Pascal Street, presently owned by Mary Ann Trantenella, was read. This property is the East 50 feet of Lot 7, Block 13, North- ome 3rd Addition and the ownership of Lot 7 had been split of record prior to August, 1946. Mr. Graham advised the Council that in his opin- ion this situation came within the exception to Section 5F8 of Ordinance #3. After discussion upon motion by Utecht, seconded by Nilsen and unanimously approved, Mr. Graham was directed to advise the Muske company that a permit for the erection of a single family residence on this lot would be issued upon application. Street Lighting Bill A letter of Harry 5. Bronson, County Engineer, dated December 4, 1957, relating to Village's share of street lighting costs on County roads was read and ordered filed. A copy of Mr. Bron- son's letter dated November 14, 1957, reporting that the street light at Larpenteur Avenue and Fry Street had been moved in accordance with the Village's request was read and ordered filed. Barthel Villas A letter from James F. Greenstein asking to be drainage matter advised of action taken in connection with the, low lots at Barthel Villas was read and ordered filed. Mr. Graham was directed to write Mr. Greenstein and advise him that the council had ordered the engineer to make a drainage survey of this area of the Village and that the council 939 Barthel Villas did not expect to take any action on this matter drainage matter until the survey had been completed. (cont'd. ) Water Meter Connec- A''letter from the Attorney dated December 9, 1957, tions listing water meter connections in the Village of Falcon Heights as of December 31, 1956, was read and ordered filed. Sewer Installers' Issued to Ed Kuether Plumbing and Heating Co. and Licenses ,#10 and Harold A. Woller, d/b/a Woller's Cesspool, re- #11 sp+~etively, were approved on motion by Nilsen, seconded by Warkentien. Master Plumbers' Issued to George W. Coverdale of George Coverdale Co., License #g was approved on motion by Nilsen, seconded by Warkentien. Sewer Charges - A copy of a resolution passed December 11, 1957, by Apartment and Cafes the St. Paul City Couneil establishing annual sewer maintenance charges for 1957 against 5 apartments and 2 cafes in the Village of Falcon Heights was read and ordered filed. Milner W. Carley A letter of Milner W. Carley and Associates dated letter. December 10, 1957, relating to charges was read and ordered filed. Bills On motion by Utecht, seconded by Nilsen, the following bills were ordered paid: Midway Ford X32.87 The Rose Tribune 20.00 Northwest Bell Telephone Co. 16.50 McClain Ec Hedman Co. 2.00 A. J. White 55.00 Briggs,Gilbert,Morton,Kyle Ec Macartney-legal services, November 202.00 Construction Account, First National Bank: r ggs, er ,Mor on, Ky e Ec Macartney-legal services,Nov. $325.00 Lametti Contract, A question was raised as to why Extra Order #11 Extra Order ,~11 in the amount of $523.41 relating to changes in the street grade on Holton Avenue from Roselawn to Garden was considered to be an Extra under the Lametti contract. .After discussion the matter was continued with the understanding that Engineer L,jungren be requested to bring in his profiles on this matter to the Village Council meeting on January 9, 1957. X340 Craig Company Mr. Steffes presented and explained Credit Memo Contract #1 in the amount of $596.80 and Extra Order #1 in the amount of $1, 368.50, under the Jay W. Craig Company contract and Certificate #g covering the third estimate for partial payment to Jay W. Craig Company in the amount of $14,883.58 cover- ing work to date. After discussion, upon motion by Utecht, seconded by Warkentien, and adopted by unanimous vote, the Mayor was authorized to sign the Credit Memo and the Extra Order and the payment covered by the certificate was authorized to be made out of the Construction Fund Account. East Snelling Drive Mr. Steffes discussed the additional work neces- South of Larpenteur sary to be done on East Snelling Drive between Hoyt and Larpenteur Avenue as required by the State of Minnesota. It appears that the State of Minnesota refused to accept patch work as required by the specifications and required that the entire drive be resurfaced resulting in an extra and additional cost to the Village. Toltz, King etc. Mr. Steffes presented bills of Toltz, King, Bills Duvall, Anderson ~ Associates, Inc. dated December 1~7, 1957, the first in the amount of $2,223.35 covering engineering services and inspection to date on the sanitary sewer and a second bill in the amount of $148.51 covering engineering services in connection with Holton Avenue drainage service. After discussion, on motion by Nilsen, seconded by Warkentien, payment of these out of the sanitary sewer construction fund account was authorized subject to checking and approval of the bills by the Clerk: Tree repair and Mr. Schultz was present and was requested to make trimming, an estimate of the damage to trees done by Lametti Construction Company on the trees north of Larpenteur, to be submitted to Lametti with a copy to the Village upon the understanding that any dangerous trees would be fixed up immediately at Lametti's expense. Sewer Connection Mr. Nilsen reported that the owner of a home located at the Northeast corner of Simpson and Crawf ord desired to connect to the sewer on Craw- ford rather than on Simpson, where the stub was located. After discussion, upon motion by Shavor, seconded by Utecht, the following resolution was unanimously carried: J 941 Sewer Connection RESOLVED that the owner of the premises at (Cont'd) the northeast corner of Simpson and Crawf ord, be authorized to connect to the trunk sewer on Crawf ord Avenue rather than at the stub on Simpson Avenue, provided that the installation be made in accordance with the Ordinance pro- visions and inspected and approved for the Village by the plumbing inspector, all costs to be borne by the home owner with specific care to be taken to see that the telephone cable and the water line on Crawford are not disturbed in making the connection. Ordinance No. 48 After discussion, Warkentien moved adoption of Ordinance No. 48, AN ORDINANCE AMENDING ORDINANCE N0. 46 REGULATING THE OPERATION OF THE MUNICIPAL SANITARY SEWER SYSTEM; REQUIRING CONNECTIONS TO BE MADE TO THE MUNICIPAL SANITARY SEWER SYSTEM, ESTAB- LISHING REGULATIONS AS TO TYPES AND KINDS OF WASTES THAT MAY BE DISPOSED OF BY THE USE OF THE MUNICIPAL SANITARY SEWER SYSTEM; PROHIBITING THE DISCHARGE OF ANY TYPE OR KIND OF SURFACE WATERS INTO THE MUNICI- PAL SANITARY SEWER SYSTEM AND PRESCRIBING RATES AND CHARGES FOR DISPOSAL SERVICES. Seconded by Nilsen and the following vote taken and recorded: Adopted - Ayes: Utecht, Shavor, Nilsen, Warkentien Nays: None The Mayor declared Ordinance No. ~+8 duly adopted and ordered publication of same. Police Radio Warkentien reported that Mr. Arndt had advised him that the radio had been installed in tyre police car and was ready for use. The County station expects to be on the air about January 1, 1958.. Special Meeting January 2, 1958 Adjournment: After discussion, on motion by Shavor, seconded by Warkentien, and unanimously adopted, it was resolved that a special meeting of the council be set for 7:30 P.M., January 2, 1958 at the Village Hall.
