Minutes of the July 25, 1994 were unanimously approved as written. PUBLIC HEARING ON REQUEST FOR A CONDITIONAL USE PERMIT FOR THE OPERATION OF A SECONDHAND CLOTHING STORE AT 1583 W. HAMLINE AVE. City Administrator Hoyt explained to the commission that Mr. J.T. Bonner wishes to open a used clothing store in the basement of the shopping center at 1583 Hamline Avenue, which is owned by Mr. Dirk Bordson. This requires a conditional use permit. She said all property owners within 350 feet of the proposed business were notified by mail of the public hearing and a legal notice was published in the local paper. Two calls were received. One caller was concerned about parking along residential streets. A second caller highly recommended Mr. Bonner's endeavor saying that he had donated much needed clothing to a family in the resident's church. Public Hearing opened at 7:05. The property owner, Mr. Bordson, and Mr. Bonner, the proprietor, were in attendance. Mr. Bonner, the store proprietor, spoke briefly saying the premises would be used for the sale of used clothing only. This clothing would come from church, school, garage, and yard sales. He said that he did not plan to take items on consignment. He said he had talked to other business owners in the building and received a positive response from them. His hours of operation would be weekdays 4 p.m. to 8 p.m. and Saturdays from 9 a.m. to 4 p.m. Public Hearing closed at 7:13. • PC Meeting - 9/26/94 Page 2 Hoyt explained that a conditional use permit goes with the property not with the business. She recommended making the conditional use permit broad enough to include secondhand clothing and clothing consignment shops in the event that Mr. Bonner goes out of business, the property owner may lease the business without requesting another conditional use permit. The planning commission must recommend approval of the conditional use permit unless the property owner cannot satisfy all the reasonable conditions governing the use. Commissioner Salzberg moved to recommend to the city council to grant the conditional use permit with the following conditions attached: 1. The store be authorized to sell used clothing. The term clothing does not include jewelry or precious metals nor other items defined as secondhand goods in the zoning code. 2. The used clothing shall be washed or dry cleaned prior to sale. • 3. The hours of operation be limited to 9 a.m. to 9 p.m. Sunday through Saturday. 4. The proprietor must secure and maintain a business license in Falcon Heights. 5. The store shall not exceed the maximum square footage permitted of 1,000 square feet permitted in the B-1 district in the zoning code. 6. The business shall conform to the city's codes. 7. The store shall not receive direct drop off of clothing from members of the public at these premises. 8. There shall be no outdoor storage of merchandise. 9. The store's parking needs shall be accommodated within the shopping center's parking lot and the immediate public parking spaces along the shopping center and neighboring commercial uses. 10. Any change or expansion to the use shall require an amendment to the • conditional use permit. PC Meeting - 9/26/94 Page 3 Motion was seconded by Treadwell and unanimously approved. REQUEST FOR A VARIANCE TO CHAPTER 9 §4.01 Subd. 4c OF THE ZONING CODE OF 26.2' FROM THE REQUIRED 30' REAR YARD SETBACK TO CONSTRUCT AN ATTACHED GARAGE AT 1437 W. CALIFORNIA City Administrator Hoyt explained that James LeJeune and Donna Tretheway, property owners, would like to convert their existing attached one car garage into a family room and add a bathroom and an attached double car garage. Hoyt stated that the zoning code, which requires a 30' rear yard setback for an attached garage, was not designed to address an attached garage accessed from an alley because there are very few attached garages with this situation. The uniqueness of this situation created a hardship and a need for a variance to construct an attached double garage with access from an alley. The proposed garage with the 26.2' variance was consistent with the neighbors garages and was screened by a fence and landscaping from the neighbors to the east and west. The new garage would have the access door on the alley 3.8' from the rear property line. Hoyt said that if the garage were detached and accessed from the alley, the minimum setback would be 5'. The 3.8' access was adequate to get into the garage. Hoyt further explained that the situation was unusual in that a building permit had been issued prior to the variance being heard by the planning commission. The building permit was issued for a set of plans that met the requirements of the zoning code. The property owners were informed that if the city did not grant the variance that they would have to construct a garage that met the zoning code. This procedure had been discussed with the city attorney prior to approval of the building permit. Hoyt said that the property owners provided the commission with a signed statement from their abutting neighbors stating that the neighbors did not object to the variance. Staff also notified the adjacent property owners about the variance request and received no calls. Hoyt said that there are three hardships associated with this request for a variance. • 1. Without a variance, the homeowner would have to build a detached double garage in the NE corner of the lot with a garage door off of the PC Meeting - 9/26/94 Page 4 alley. This alternative plan is less desirable in that several trees on the east side of the property would need to be removed. 2. The alternative plan would also involve building the garage in the largest contiguous landscaped area of the lot, substantially breaking up the greenspace of the yard. 3. One of the applicants has a disability that requires all living space to be on one floor. This eliminates the possibility of adding a second floor to the home and expanding the current garage. The applicant needs an attached garage to avoid the risk of falling on wet or uneven payment on the walk from the house to the car. Ms. Tretheway and Mr. LeJeune attended the meeting and stated their need for a variance. Salzberg moved to adopt the resolution approving the variance and to recommend to the council the variance be granted because the request meets the standards for granting a variance, specifically (b) which states that the variance will not diminish or impair property values, and (c), which states that the variance is necessary for the preservation and enjoyment of property rights. Seconded by Kuettel and unanimously approved. REVIEW OF THE 1995 PROPOSED CAPITAL IMPROVEMENT PROGRAM State statute requires the planning commission to review the city's proposed capital improvement program (CIP) to assure that it is consistent with the overall direction that the city is moving in its comprehensive plan. Hoyt walked through the CIP with the commission. After a short discussion, the commission recommended no changes in the CIP to the city council. ANNOUNCEMENTS/INFORMATION The commission briefly reviewed and discussed the ordinance revisions for garage as adopted by council 9/14/94. Dirk Bordsen, the property owner, and James Bonner, the proprietor of the business, were in attendance. Mayor Baldwin commented that he was not pleased to see that the owner and proprietor had decided to ignore city regulations by opening their store prior to being granted their business license. He noted that the store would be watched carefully in the future and all code violations will be addressed promptly. Motion by Councilmember Jacobs to approve the conditional use permit with the conditions as presented. Motion passed unanimously. DISCUSSION REGARDING AN ORDINANCE RESTRICTING HOURS OF AVAILABILITY OF TENNIS COURTS AT COMMUNITY PARK Parks and Recreation Director Carol Kriegler reviewed the current status of lighting at the Community Park tennis courts. She explained that current code calls for a 10:00 p.m. closing time for . all parts of the park except for the tennis courts, which are open 24 hours with a timed light. Kriegler said that she had received complaints regarding late night noise associated with tennis play. In response to these complaints, staff distributed a survey to abutting neighbors of the park in Falcon Heights and Roseville. Survey responses found that five residents had concerns about tha noise from the tennis courts. The parks and recreation commission reviewed the issue and by a 4-1 vote recommended that the court lights be turned off at 10:00 p.m. each evening. The council discussed several possible closing times and the merits and practicality of each. It was concluded that an earlier closing time was probably a reasonable request. The council noted that there were other tennis courts available within one mile of Community Park that are not near residential homes. A 10:00 closing time was agreed upon as that is the time that the rest of the park is closed. Motion by Councilmember Gibson Talbot to amend the Chapter 3-4.01 of the city code, establishing a uniform closing time of 10:00 p.m. for all parts of city parks. Motion passed unanimously. REPORT REGARDING IMPROVIIKENTS TO THE COMMUNITY PARK PATHWAY AND VITA COURSE E~~tCISE STATIONS • Parks Director Kriegler and Public Works/Parks Superintendent Klingenberg outlined proposed improvements to the Community Park pathway and exercise equipment. Klingenberg explained that about 1200 linear feet of the pathway at Community Park would be improved. The current pathway is rutted and is in need of rehabilitation.
