Meeting was called to order at 7:30 by Paul Kuettel, acting
chairperson, in the absence of Chair Lee Barry.
PUBLIC HEARING AND PROPOSED ADOPTION OF THE PROPOSED REVISIONS IN
THE CITY'S COMMERCIAL ZONING CODE.
Proposed revisions in the city's commercial zoning code are:
Chpt 9, §8.01 - Replace B-1 Limited Business District with
B-1 Neighborhood Convenience District
Chpt 9, §9.01 - Replace B-1-A Limited Business & Processing
District with
B-2 limited Business District
• Chpt 9, §10.01 -.Replace B-2 Retail Business District with
B-3 Snelling and Larpenteur Business
District
Related revisions:
Repeal Chpt 9, §11.01 - Existing Business District
Revise Chpt 9, §2.07 Subd. 1 Height Limitations to read: Any
structural height that exceeds the zoning code must have a
conditional use permit.

Some specific commercial changes related by Hoisington were:
Harvest States from B-lA to B-3
Hermes from B-lA to B-2
Hewlett Packard from B-lA to B-2
Thatchers Chiropractic Clinic and Super America be changed from
E-B to B-1
B & J Floral from E-B to B-1
One Hour Martinizing to remain E-B or change to B-1
Hamline Hoyt from B-2 to B-1
Snelling & Larpenteur from B-2 to B-3
After listing the proposed business zoning changes, Mr.
Hoisington said the commission should decide if One Hour
Martinizing should remain as an E-B zone (E-B allows uses that
currently exist but are not in harmony with nearby land uses, do
not conform to the comprehensive plan and would need to go to the
P.C. and C.C. for a change) or be changed to B-1 which may be
more generous and appropriate. He said the commission could
recommend rezoning both One Hour Martinizing and B & J Floral to
B-1 or leave One Hour Martinizing at E-B for further study.
Joyce Gimmstead, owner, has requested B & J Floral be taken out
of E-B.

Mr. Wehmann, representing Northome Shopping Center, questioned
why there was no provision listed in B-3, Snelling & Larpenteur
Business District, for jewelry stores - specifically, antique
jewelry. Administrator Hoyt answered that some uses are not
included because they are considered part of the commercial
development moratorium. She explained these uses will be looked
at more closely to determine if they should be allowed with
conditions placed on their license.
Tim Hilger, from Bullseye Shopping Center, asked if stores such
as Play It Again would be allowed. Hoyt explained that until the
moratorium is lifted, only businesses with new retail merchandise
would be considered. Businesses receiving and selling used
merchandise will be further reviewed.
Tim Hilger questioned renting out basement storage space in
Bullseye Plaza. He asked what the procedure would be in order to
do this and how long it would take to get it accomplished. Hoyt
replied that a conditional use permit would have to be applied
for giving the location and types of material to be stored. A
public hearing would be held after property owners within 350'
were notified by mail, and a notice published in the paper at
least ten days prior to the proposed hearing. It would then go

W. Ladner, Northome Center, asked why elevator space is
necessary. Hoyt said it would be more convenient to get goods in

Todd Young, Blomberg Building, questioned that if used goods
dealers were under the moratorium, why were two antique stores
allowed to open at 1583 Hamline. Hoyt answered that antique
stores are permitted uses. She agreed with Mr. Young that the
term, second hand store, is very broad.
Public Hearing closed at 8:05.
Commissioner Kuettel asked why the term "Miscellaneous retail
establishments including antique stores but excluding fuel
dealers" was listed this way in the list of permitted uses.
Hoisington replied this is the way Miscellaneous Retail is in the
• SIC codes. He said SIC codes change very seldom - perhaps every
5 years.
Attorney Peter Bachman said the ordinance (as drafted) references
the 1987 SIC manual, so the commission needs to keep abreast of
any changes which may occur.
Commissioner Paul Kuettel moved to recommend adoption of the
commercial zoning code with associated minor code revisions
indicating that One Hour Martinizing be changed from an E-B to a
B-1 zone. Seconded by Andrews. Unanimously approved.
PUBLIC HEARING AND CONSIDERATION OF REVISIONS TO THE COMMERCIAL
DEVELOPMENT MORATORIUM CHAPTER 5 SECTION 5.02 DEVELOPMENT
RESTRICTIONS AND APPLICABILITY
Chair Barry opened the Public Hearing at 8:15.
Administrator Hoyt reported that after the adoption of the
proposed revisions in the commercial zoning code, the moratorium
should be revised to allow businesses that are identified as
permitted or conditional uses in the revised commercial code to
apply for business licenses and permits according to routine
procedures. The moratorium will remain in effect for uses that
are not specifically identified as permitted or conditional uses
• or for those uses that are specifically identified as needed. to

There being no one wishing to be heard Chair Barry closed the
public hearing at 8:20.
Commissioner Lampi moved to adopt the proposed revision of 5-5.02
Development Restrictions and Applicability as stated in
Attachment 6-A. (attached) Seconded by Commissioner Andrews.
Unanimously approved.
REQUEST FOR A VARIANCE OF TWO FEET IN THE REQUIRED FIVE FOOT
SIDEYARD SETBACK FOR 1731 PASCAL STREET IN AN R-1 ZONE CHAPTER 9
§2.04, SUBD. 1(d) OF THE ZONING CODE
Mr. Ronchak explained to the commission that he wanted to replace
their single car garage with a double garage which would be 3
feet from the north property line and 5 feet from the rear
property line. He said the additional two feet is needed in
order to be able to get in and out the garage. When asked if any
neighbors objected, he said that none had and, in fact, there is
a six foot high fence on the property line involved.
It was noted that the 3 foot setback would not affect the
relationship of the garage to the neighbors to the north and that
in the Northome neighborhood, variances have been granted to
• replace existing garages with new double garages within 3 feet of
the side property line. Lampi moved to recommend approving the
request for a variance for two feet in the required five yard
setback. Seconded by Andrews and unanimously approved.
APPROVAL OF MINUTES OF 5/24/93, 6/7/93, AND 6/28/93
There being no corrections or changes, the minutes of the three
previous meetings stand as approved.
