November 12, 2003
Council member Kuettel convened the regular City Council meeting at 7:00 PM.
PRESENT: Council members Laura Kuettel, Robert Lamb, Peter Lindstrom and Richard Talbot
Also present: City Administrator Heather Worthington and Deputy Clerk

Absent with prior notice: Mayor Sue Gehrz
COMMUNITY FORUM: There was no commentary from the audience.
PRESENTATION:
Mr. John Zanmiller introduced himself to the Council. He explained that he is a member of the
West St. Paul City Council and also represents this area on the St. Paul Regional Water Utility
Board. He was appointed two years ago, as one of two suburban representatives on the Board.
In January, 2004, it will be Falcon Heights' turn to appoint a representative and he would like
Falcon Heights to allow him to continue that representation, instead of taking its position in the
Board rotation. Mr. Zanmiller proceeded to give a brief description of the St. Paul Regional
Water Utility and answered questions from the City Council.
APPROVAL OF MINUTES: The Council minutes dated October 22, 2003 were unanimously
approved as presented.
PUBLIC HEARINGS: None Scheduled
CONSENT AGENDA:
Lindstrom moved approval of the Consent Agenda, as outlined below. The motion was
unanimously approved.
1. General Disbursements through November 7, 2003
in the Amount of: $ 80,185.54
Payroll (10/15/03-10/30/03) in the Amount of: $ 11,981.44

Stipulation Settlement for Insty-Prints and JEMJAHS

Administrator Worthington said that last month the developer of the SE Corner project
negotiated a relocation settlement for $25,000 with Insty-Prints regarding the termination of their
lease in the Northome Shopping Center. Sherman and Associates has settled Insty- Prints claim,
and the Council may now consider the settlement for final approval. JEMJAHS will execute this
agreement after the city finalizes it.
Talbot moved approval of the stipulation settlement for Insty-Prints and JEMJAHS for payment
of $25,000 to Insty-Prints. The motion was unanimously approved.
Change in Rec~g Method from Five-Sort to a Two-Sort
Administrator Worthington said that earlier this year, the Solid Waste Commission voted
unanimously to allow E-Z Recycling to utilize atwo-sort method, rather than the five-sort
method required in the current contract. Staff toured the E-Z Recycling plant last week, and is
confident that they are capable of making the switch, with little or no increase in the amount
of residual material, and thus no negative environmental impact from switching to 2-sort.
Under the 2-sort system, corrugated cardboard is still collected separately from the two streams
ofNewspaper-Magazines-Mixed Mail-Cereal Boxes and Cans-Glass-Plastic. The city will
make sure that people know they must still flatten and bundle corrugated cardboard and put it out
separately. (So it is, technically, a third stream, for those who recycle corrugated cardboard.)
The Solid Waste Commission would now like to roll out this new method, update the contract,
and do resident education about the change in the upcoming newsletter and flyer. Chris
Reinhardt at E-Z has offered to distribute tags to residents at the November 21 or December 5
recycling pick-up to instruct them on the new sorting method.
Council member Lamb said this will be a simple method for the residents. Most people sort
paper, glass and metal. E-Z said their recovery rate is between 95%-98%. E-Z re-sorts
everything and the end result at their plant yields 2%-5% of residual non-recyclables. The goal
on the East Coast is 21 %.
Council member Lindstrom commented that E-Z does not own its own landfill so it is to their
benefit to maximize recycling.

Council member Lamb said that a lot of it has to do with the residents. If residents don't want
to sort into five categories, they can do just as good of a job on a 2-sort. The first sort is paper of
all types. The second sort is cans, glass and plastic. The third sort, if needed, is the bundling,
separately, of corrugated cardboard.
Council member Talbot asked if the new method will cost more. Council member Lamb said no,
it is the type of sort that E-Z uses anyway. The major effect will be on what residents have to do.
It will be a simpler method.
In response to a question from Council member Kuettel regarding bins, Administrator
Worthington said that residents can come down to City Hall and get a second bin for free. Or,
residents can still use paper bags. Council member Kuettel said that E-Z will continue to pick up
clean recycled clothing, batteries and used oil. She asked that she be able to take a peek at the
newsletter before it goes it in December.
Council member Lindstrom asked what percent of the community recycles and Administrator
Worthington said she will get that information for him.
Lamb moved that staff and the Solid Waste Commission be authorized to update the recycling
contract to require a 2-sort method, and commence with resident education about this change in
the upcoming newsletter and city flyer. The motion was unanimously approved.
REPORTS FROM COUNCIL MEMBERS:
Council members Talbot and Lindstrom thanked the residents who voted for them
on November 4. Council member Talbot said that he looks forward to serving the community
and working with the other good people on the Council for another four years.
INFORMATION AND ANNOUNCEMENTS:
Council member Lamb asked Administrator Worthington for an update on the Farmer's Market.
What kind of feedback came to the City and City Hall over the last few months? Administrator
Worthington said the Farmer's Market began in late May and continued through October. The
City only received one complaint and that was about aback-up beeper that had nothing to do
with the Farmer's Market. Early one morning there was a truck and trailer using the Twin Cities
Co-op parking lot for offloading purposes. There were no parking problems on Farmer's Market
days. If necessary, people utilized City Hall parking lots. People commented on how much they
enjoyed the Farmer's Market and want it to come back next year. Many of the vendors thought
this was one of the best locations in the Twin Cities. There was a variety of vendors to choose
from: Flower, vegetable, meat and cheese and bakery.

Administrator Worthington said that traffic was manageable. Only occasionally did people find
it difficult to make a left turn at Larpenteur. Overall, she would give it high marks. It was quite
popular. Council member Kuettel said that she thought it was really successful. Council
member Lindstrom said that he talked to a resident who was initially very skeptical. Now that
resident feels positive about it. Parking is not a problem and it is a great addition to the City.
Council member Kuettel mentioned that from November to April, the City sponsors the
Playroom at the United Church of Christ Nursery, Wednesdays and Friday mornings,
from 9:30 AM-12 noon. The fees are $2/visit for achild/adult and the family rate is $3/visit.
There are also multi-visit punch card rates. There will be an open house at the Playroom on
Saturday, November 22, from 10 AM-1 PM. The City also sponsors Saturday morning open
gyms at the Falcon Heights Elementary School, at no cost to the participants. Basketballs and
other equipment are provided, or participants can bring their own. Clean, dry footwear is
recommended for admittance to the gyms.
Council member Kuettel reminded the cable audience that the City needs people for its
commissions: Planning, Parks, Solid Waste, Neighborhood and Human Rights. Check the
City's web site for more information. Council member Talbot said that because of the incredible
volunteerism in Falcon Heights, it is one of the best-run cities in the state.
Administrator Worthington said that street sweeping began this week, but because of the
snow showers on Wednesday, the sweepers had to stop around noon that day. She asked
residents to not rake their leaves into the street because they will go into the storm sewers
and cause problems downstream. The street sweeping should be done by Friday, weather
permitting. If residents have questions, feel free to call City Hall at 651-644-5050.
The regular City Council meeting was adjourned at 7:45 PM.

ITEM: Consider the Vacation of Street Easements and an Alley

EXPLANATION:
Summary: The City proceeded with a condemnation of the frontage road adjacent to the new
Dino's parcel in late August. The city has agreed to vacate the easements on those parcels, and
convey the land to the two adjacent landowners, Dino Adamidis and Steve Wellington, for use
as parking.
The City will retain an access easement across the alley right-of--way, and across the parking lot
for purposes of access for residents adjacent to the new Dino's parcel. The access on the site
will not change from its current configuration, and will still allow residents and patrons of the
shopping center access to their homes via the alley, and the parking lot for the Falcon Crossing
Center via the alley and parking lot, as well as access for public safety vehicles.

NOTICE IS HEREBY GIVEN that the Falcon Heights City Council will meet on November 26,
2003 at approximately 7:00 p.m. at Falcon Heights City Hall, 2077 Larpenteur Avenue West,
Falcon Heights, Minnesota 55113, to consider the vacation of the street easements and alley
described as follows:
1. The easement for street purposes over the frontage road east of Snelling Avenue, between
Larpenteur Avenue and Idaho Avenue West, on property that will become part of the SE
Corner Redevelopment, legally described as follows:
That part of the Westerly 159.5 feet, except the North 49.5 feet thereof, of the Northwest
Quarter of the Northwest Quarter of Section 22, Township 29, Range 23 West, Ramsey
County, Minnesota, lying Northerly of the Westerly extension of the Southerly line of
Tract A, Registered Land Survey Number 2;
which lies Easterly of Line 1 described below:
Line 1. Commencing at the Northwest corner of said Section 22; thence run
Easterly along the North line thereof on an azimuth of 88 degrees 48
minutes 49 seconds for 159.53 feet; thence on an azimuth of 179 degrees
53 minutes 31 seconds for 89.90 feet to the point of beginning of Line 1 to

Date: November 26, 2003
A RESOLUTION VACATING STREET EASEMENTS AND ALLEY
WHEREAS, pursuant to Minnesota Statutes Section 412.851, after two (2) weeks'
published and posted notice of the hearing and after mailing written notice of the hearing at least ten
(10) days before the hearing to each property owner affected by the proposed vacation, the Falcon
Heights City Council has conducted a hearing to consider the vacation of the street easements and
alley legally described on the attached Exhibit "A"; and
WHEREAS, it appears that it is in the public interest to vacate the street easements and
alley.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon
Heights:
1. The street easements and alley legally described on the attached Exhibit A are
hereby vacated.
2. The City Clerk is directed to file a certified copy of this Resolution with the County
Auditor and County Recorder/Registrar of Titles.

ITEM: Purchase of New Playground Equipment for Community Park

EXPLANATION:
Summary: The Parks and Public Works 5-Year Capital Improvement Plan has the small play
structure at Community Park scheduled for replacement in 2003. $15,000 was budgeted for
replacement.
Reasons for replacing this structure:
• Parts made from treated lumber, which contains toxic chemicals
• Tires hold water, which can become a breeding ground for mosquitoes
• Slide is damaged
• Replacing splintered lumber creates a liability
• Surface and edging is not ADA compliant
• This small play structure is geared towards children 2-5. Community Park currently lacks play
equipment that encourages creative play. Staff provided the Park Commission diagrams of
different types of play structures that stimulate creative play. After reviewing these structures
the Park Commission preferred the "Schooner" (see attached illustration) model manufactured by
Play World Systems and distributed by Midwest Playscapes of Chaska, MN.
The total cost to install this structure, including ADA compliant curbing and surface is $21,500.
The Lauderdale/Falcon Heights Lions Club has donated $3,000 toward the purchase of this
playground. There was $6,000 budgeted for rubber ADA surfacing at the Grove Park in 2003. By
using ADA compliant engineered wood fiber the City saved $5,000. Staff recommends using
$3,500 of this money to help pay for the surface, curbing and installation of the new play
structure at Community Park.
On November 10, 2003 the Park Commission voted unanimously to recommend to the City
Council the purchase and installation of the "Schooner" play structure, at a total cost of $21,500.

Construction update SE Corner Redevelopment
November 2003 City of Falcon, Heights
This is the first of monthly construction updates on the SE Corner Redevelopment that
will be delivered to residents in the Northome neighborhood. The City will have these
delivered door to door at the end of each month, so make sure to check for future updates
as the project progresses. Regular construction updates will also be available on the
city's website:

Site Security
Security of the site during construction is very important. The St. Anthony Police will be
doing regular patrols, and a security company will on on-site after hours. If you see,.
hear, or observe anything out of the ordinary, please call 911 immediately. Thank

:Demolition
,~ ...The first phase of demolition is now complete. The remaining portion of the old
shopping center (the Mill End Store) will stand until the developer commences
construction on the multi-family building which will be located where the Pizza Hut and
Dino's currently stand. At this time, it is anticipated that the multi-family phase will
begin in Mazch 2004. The Dino's restaurant will relocate to the Northeast corner of
.Snelling and Larpenteur at that tune, and Pizza Hut will close for approximately one year
during the construction of the multi-family building, and will relocate into the
commercial/retail space in-that building when it opens in 2005.
Phase 1-Construction
The concrete footings aze now being poured for the Senior Building: on the corner of
Arona and Larpenteur Avenues. The. parking gazage underneath the building will be
completed between now and the end of the year. Construction on the building above
ground will continue throughout the winter. The building is anticipated to open in late
2004.
Storm Sewer improvements
The storm sewer pipe, which. runs from the redevelopment site to the Curtiss Field
retention pond, will be replaced. ,

This pipe runs south from the site underneath Idaho Avenue. The street will be excavated
in order to install the new pipe. This work will likely take place in late November and

For several months the Ramsey County Housing and Redevelopment Authority has been
discussing a possible HRA levy with the 18 suburban municipalities within the County. The latest
proposal, distributed to you on October 6`'', included a levy of $805,800 to be redistributed based
on population with each municipality determining how their funds are to be used in accordance
with state law. This could include support for projects within the community, pooling resources
with other communities for joint projects or purchasing services from the Housing Resource
Center.
•
On Tuesday, December 2 beginning at 9:00 A.M. the Ramsey County HRA will again discuss
the levy and.provide an opportunity for input from each of the municipalities. At this time the
Board will likely make a decision on whether or not to adopt the levy. While this is not a public
hearing, community representatives are encouraged to attend and provide comment on the levy.
Some communities have already sent letters which will be included as part of the information
packet for each commissioner. County staff will also be present to identify how the levy might
impact typical properties in a community.
If you wish to comment on the levy but cannot attend you may write a letter which will be
forwarded to each of the Corrunissioners. Letters should be addressed to:

Presentation Update

Thank you for the opportunity to speak to the Falcon Heights City Council on October 8, 2003,
regarding Minnesota's DWI laws. This memorandum is a follow-up to that presentation.
Between January 1, 2003, and October 31, 2003 our office has prosecuted over 500
misdemeanor crimes, as well as hundreds of petty misdemeanor offenses, for the City of Falcon
Heights. During that time, we also prosecuted 42 gross misdemeanor cases, which are initiated
when a formal complaint is issued by our office. 180 cases were scheduled for a pretrial
conference or omnibus hearing, and 49 cases were scheduled for a jury trial. Additionally, 46
misdemeanor and petty misdemeanor cases were scheduled for a court trial.
As stated during the presentation, almost 1/3 of the gross misdemeanor cases prosecuted by our
office are Second- or Third-Degree DWIs. The remaining gross misdemeanor cases comprise
charges such as Driving After Cancellation as Inimical to Public Safety, Giving a False Name to
Police, Furnishing Alcohol to a Minor, Obstructing Legal Process with Force, and Interference
with a 911 Emergency Call.
A majority of misdemeanor cases in Falcon Heights are license and insurance offenses, such as
Driving After License Revocation or Suspension, and Operating an Uninsured Motor Vehicle.
Other common misdemeanor offenses include Domestic Assault, Fourth-Degree DWI, Failure to
• Transfer Motor Vehicle Title, and both Falcon Heights and University of Minnesota ordinance
violations. Petty misdemeanors prosecuted by our office are violations such as Speeding, Failure
• to Obey a Traffic Control Device, Parking violations, and Possession of a Small Amount of
Marijuana.
Included with this memo are three attachments. Attachment 1 is the 2003 DWI Charging and
Sentencing Table. Attachment 2 is the 2003 Domestic Violence-Related Offenses Enhancement
Chart. Attachment 3 is flowchart illustrating the how criminal cases move through the
