Meeting was called to order at 7:00 p.m. by Chair Barry.
Planning commission minutes of November 27, 1995 were unanimously approved
as written.
REQUEST FOR A VARIANCE FROM CHAPTER 9-4.01 SUBD. 4(C) TO PERMIT THE
CONSTRUCTION OF A DOUBLE CAR GARAGE AT FRONT SETBACK OF 23 FEET
WHERE A 30 FOOT SETBACK IS REQUIRED AT 1596 NORTHROP STREET.
City planning consultant Philip Carlson explained that applicants Eric Schiffman and
Karen Kloser have a purchase agreement to buy asingle-family home at 1596
Northrop. There is presently a single car garage on the property and Schiffman and
Kloser want to be able to build atwo-car garage on the site that would encroach
seven feet into the front yard 1Folwell Street) setback. The applicants' plan is to
use part of the existing garage and construct additional garage space to build a 22'
by 24' two car garage. The present south half of the garage would be remodeled
to become part of the kitchen.
Mr. Carlson explained that granting a variance requires demonstrating a hardship
and that the city has nine criteria for granting a variance in the zoning code. He
said before any of these criteria are considered. He reviewed the nine criteria for
granting a variance and found that none of the conditions applied to this property.
He then indicated that if a variance were to be granted, the applicants would prefer
to wait five years before actually building the garage. The zoning code states that
a variance terminates after one year unless the decision granting the variance
states otherwise. Carlson stated five years is a long window of opportunity to
grant, but that a two year variance with a possibility of a one year extension might
be more reasonable. Mr. Carlson said that after careful consideration and study, he
that the alternatives available to the property owner demonstrated that there was
not a hardship. Therefore, he recommended that the planning commission
recommend denial of the variance to the city council, but that if the planning
• commission would recommend approval, it should be for a specific time (one or
two years) and conditioned on an accurate lot survey to verify dimensions of
• existing and proposed site improvements.
Dr. Schiffman said that he and his wife had studied several options for getting a
double garage on the site and he described why he was not in favor of any of the
proposals presented by Mr. Carlson because they were not as aesthetically
pleasing and nor functional for the current house and yard layout.
Following the commission's discussion of the proposal, Commissioner Treadwell
moved to recommend approval of the variance with the findings as described in
Planning Commission Resolution 95-07. Commissioner Wilcox seconded the
motion.
Commissioner Kuettel stated that he could not support the resolution in support of
the variance as there are other building options available to the applicant and
therefore there is no demonstrated hardship to support the variance request.
Commissioner Treadwell argued that the lot is unique in shape, that the setback
encroachment is minimal, and that the other locations for the garage would more
significantly impair sightlines along the two abutting streets.
The motion failed for lack of a majority with Commissioners Treadwell and Wilcox
voting in favor and Commissioners Barry and Kuettel voting against the motion.

ITEM: Election of a planning commission chair

EXPLANATION/DESCRIPTION:
The planning commission needs to elect a chair from among its members. The
chair serves a term of one year. The chair is responsible for calling meetings to
order and for carrying out meetings and public hearings in accordance with the
planning commission bylaws.
In the absence of the chair, the most senior member of the planning commission in
. attendance has traditionally assumed the chairperson's duties.

ITEM: Proposed change in planning commission meeting date to first
Tuesday of the month or alternative

EXPLANATION/DESCRIPTION:
The planning commission currently meets on the 4th Monday of the month and
their recommendations are acted upon by the city council on the 4th Wednesday of
the month. This time line can be cumbersome because of the short amount of time
between the two meetings. Both the planning commission and city council
agendas are prepared on the preceding Friday, so information about the planning
• commission's recommendations do not reach the city council until the night of their
meeting.
Periodically, there is a need for more time between the two meetings. Staff
sometimes needs to revise their staff report to the city council based upon the
planning commission's direction or an applicant may wish to revise his or her plans
prior to the city council meeting.
Therefore, staff proposed moving the planning commission meeting date to a night
on the 1st or 3rd week of the month to allow a complete week between the
planning commission and city council meetings. After reviewing the city's other
meeting dates, the best meeting date appears to be the 1st Tuesday of the month
(the 1st Monday of the month was eliminated due to elementary school PTA
meetings and the 1st Wednesday and Thursday were eliminated because of other
city meetings.) If the 1st Tuesday is not a possibility, the 3rd Monday or 3rd
Tuesday of the month would be workable alternatives.

ITEM: Review of proposed zoning code revisions

EXPLANATION/DESCRIPTION:
The attached zoning code revisions were first presented to the planning in
November, 1995. These are minor code revisions that clarify the current text an
make it clearer for both the public and the staff to understand these code d
provisions. The commission's changes were incorporated into the text and a public
hearing must be scheduled to incorporate these changes into the zoning code.
Action Requested:
• Review proposed zoning code changes
• By motion, schedule a public hearing for the next scheduled planning
commission meeting.
PROPOSED CHANGES TO CHAPTER 9 (ZONING CODE)
Purpose: To guarantee that if a garage (usually attached) is converted to dwelling
space that a new garage is part of the conversion plans. It also assures that any old
driveway access will be replaced with landscaping if it no longer serves a garage.
9-2.04 Accessory Buildings and Structures
Subdivision 1. General
Purpose: To make sure that alley access is maintained as the primary accessway
along alleys by eliminating any street access from properties that
currently use alley access only. (If a unique situation arose for using
street access, a variance might be in order.)
Purpose: To eliminate a section of the code that wasn't enforceable and doesn't
make sense in this day and age requiring that all be grated or pickets
rather than side by side boards.
9-2.05 Required Yards and Open Spaces
Subdivision 2. Permitted Encroachments on Required Yards: T h e

requirements except as restricted by other sections of this code.

Purpose: Clarifying when and where certain types of vehicles can be stored.
Essentially boats and unoccupied trailers (not campers, rvs) can be stored in the rear
yard 10 feet from a property line. Except for snow emergencies, no vehicles can be
parked on grass or boulevards.

And provided further that from November ~1~5~to April 1~, the unsurfaced
portion of the front yard of any property in a residential district may be
used for parking one passenger vehicle registered in the name of a
• resident, if there is a single driveway, and the vehicle is parked parallel
to the driveway and on one uniform side of the driveway, and the width
of the parking area does not exceed eight feet. For purposes of this
Code a "passenger vehicle" shall mean a two or four-door sedan or van
used primarily for transporting passengers, and shall not include pickups,
trucks, campers, recreational vehicles or buses.
Purpose: Remove the generality regarding carport or garage conversion. Keep the
number of off-street parking spaces as is -although circumstances vary
a lot.
e. Number of off-street parking spaces. At least two (21 and not more
than four (4) parking spaces permitted for each dwelling unit. At least

engineer and capable of carrying a wheel load of 4,000 pounds. All surfacing
must be completed prior to occupancy unless other arrangements have been
made with the Zoning Administrator.
Subdivision 6. Design and Maintenance of Off-Street Parking Areas:
d. Surfacing. All driveways and off-street parking areas shall be permanently
surfaced with either concrete or asphalt or impervious decorative pavement
• such as brick between the street and garage. (This does not require the
resurfacing of existing driveways with parallel tracks into one contiguous
surface.)
Purpose: Makes code conform better to Falcon Heights commercial areas and
replicates what currently is done. (Lot frontage and business would be
equal amount of signs.)

Purpose: The term "front" yard was left out when this was done in conjunction
with the 1991 street project where driveway width was an issue. It
essentially limits the driveway width and garage coverage based upon lot
width at 32% of the lot width.

ITEM: Resolution finding that the proposed modifications to the city's tax
increment development districts is consistent with the city's
comprehensive plan

EXPLANATION/DESCRIPTION:
The city is working with the firm of Casserly/Molzahn to update its tax increment
financing plan from the 1980's to plan for future public improvements that might
be completed with tax increment revenue. These are administrative changes to
permit the city flexibility for future public improvements. These changes do not
include any new tax increment districts or new development activities or changes
in land use. The proposed amendment to the plan includes changing the eastern
boundary of the development district from Arona Street west to Hamline Avenue.
This change permits the city to use tax increment property tax revenue that is
. being generated by past projects to finance public improvements, specifically those
planned with the Larpenteur Avenue project.
State statute requires that this change in the geographic boundary have planning
commission action to assure that the proposed change is consistent with the city's
comprehensive plan. The change in the boundary from Arona Street to Hamline is
consistent with the city's comprehensive plan which includes general plans for the
Larpenteur Avenue improvements and associated business district improvements.
The boundary change does not propose any change in land uses within the
expanded development district.
The action requires adopting a resolution because the city is combining two
existing development districts into an integrated development district.

• Enclosed please find a resolution for consideration by the
Planning Commission at its January 22, 1996 meeting.
Pursuant to Minnesota Statutes, Section X69.126, Subdivision 1, a
city must consult with its planning agency or department before
designating a development district. This requirement also
applies to a modification of a development district.
Currently the City has two existing development districts,
identified as Development District No. 1 and Development District
No. 2, which it intends to modify by expanding the boundaries of
each Development District to be inclusive of each other and to
include the additional parcels located east of Snelling Avenue,
south of Crawford Avenue, west of Hamline Avenue and north of
Hoyt Avenue (a map and legal description of which are attached).
This purpose of this enlargement of the two Development Districts
is to provide the City with greater capability is using the tax
increments generated from TIF Districts within the Development
Districts for public improvements.
The role of the City's Planning Commission is only to determine
that the objectives of the Development Program for each
.Development District are consistent with the City's comprehensive
plan and zoning plan. For example, if the City's comprehensive
plan provides that the additional parcels were to be used for
open space and the Development Program goals were for high
• density commercial uses, then there would be an inconsistency.
We understand that the City does not have this type of
. inconsistency. The role of the Planning Commission does not
extend to analyzing what parcels are located within a TIF
District, how tax increment is generated or how tax increment is
spent.

• RESOLUTION OF THE FALCON HEIGHTS PLANNING COMMISSION
FINDING THE MODIFICATIONS TO THE
DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 1
AND THE
DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 2
TO BE CONSISTENT WITH THE COMPREHENSIVE PLAN OF THE CITY
WHEREAS, the City of Falcon Heights is proposing to modify
its Development Program for Development District No. 1 and its
Development Program for Development District No. 2 (collectively
the "Development Programs" and the "Development Districts") to
reflect the increased geographic area of both Development
Districts pursuant to Minnesota Statutes, Sections 469.001 to
469.074, inclusive, and
WHEREAS, the Planning Commission has reviewed said
modifications to the Development Programs and has determined
their consistency to the zoning plan and development goals of the
City:
NOW THEREFORE, BE IT RESOLVED BY THE FALCON HEIGHTS PLANNING
COMMISSION that the proposed modifications to the Development
• Programs for its Development Districts are consistent with the
City's Comprehensive Plan.

The University of Minnesota Master Plan is nearing completion. The City
Administrator participates on the master planning committee. Her participation has
given the city an opportunity to express its concerns and keep informed of the
process. The draft plan contains many elements related to the St. Paul (Falcon
Heights) Campus. The attachments summarize the material. The complete
document provides more information on the entire St. Paul Campus plan.
General land use relationships
Here is a quick list of some of key points directly related to land uses that border
the neighborhoods and community.
1. Development patterns will be contained within the current design.
• 2. Encourage more campus housing in the Commonwealth Terrace area.
3. Create an attractive wetland area by Commonwealth Terrace/fairgrounds.
4. Enhance connections between the university and the surrounding
communities.
5. Preserve the open space including the university golf course and the
agricultural fields to the North of Larpenteur.
Implementation of the plan
The implementation of the master plan is critical to any plan that is created. The
implementation section of the plan is being revised. The administrator requested
that the implementation section include a specific step about when and how the
affected community would be notified of any projects or activities governed by the
master plan. This is currently missing and should appear in the next draft.
