SUBMITTED BY: Susan Hoyt, City Administrator REVIEWED BY: Peter Bachman, City Attorney Fred Hoisington, Consulting Planner EXPLANATION: As the staff and consultant proceeded with the commercial zoning study begun last fall, it became clear that there are several commercial uses that cannot be easily included or excluded from the city's proposed Snelling and Larpenteur commercial district without determining the statutory authority the city has over certain uses, the possible secondary impacts of certain uses and the best way to control certain uses (i.e. zoning, conditions, licensing). Although the development moratorium on the city's commercial districts currently restricts most of these uses from the city because they are not specifically listed permitted uses in the city's zones, the moratorium will be more effective if these uses are specifically identified for two reasons. First, it will clarify any possible ambiguities in what uses fall. under the moratorium. Second, it will allow the city to remove most of the commercial uses from the development moratorium when the first phase of the zoning study is done and leave the more complex uses under the moratorium until the best way to regulate them is determined. PROPOSED AMENDMENT: This is a proposed list. It doesn't mean that these are all necessary. Please add, delete, comment. Add to Chapter 5 ~5 Subd. 3 c. Certificates of occupancy and business licenses may be granted to any new use that is specifically listed as a permitted use in the applicable zoning district. For purposes of illustration only and without intending to be an exhaustive list, the following uses are not specifically listed as permitted uses in any commercial zoning district and are subject to the moratorium: • Special Mtg 6/7/93 • Item 1 Page 2 1) Adult use establishments as defined. CITY -0F FALCON HEIGHTS ORDINANCE NO. 0-93-1 Amendment to Chapter 5 - Part 15 (existing code) Chapter 5 - Section 5 (proposed code) AN INTERIM ORDINANCE ESTABLISHING A DEVELOPMENT MORATORIUM ON THE CITY'S COMMERCIAL ZONING DISTRICTS Subd. 1 Authority. Pursuant to M.S. §462.355 Subd. 4, the city has the authority to establish interim ordinances to maintain the status quo while the city is conducting studies, has authorized a study to be conducted or has scheduled a public hearing to consider adoption or amendment of the comprehensive plan or official zoning controls. Subd. 2 Findings and purpose. In 1991 the city council adopted a comprehensive plan for the city. The Metropolitan • Council approved that plan in April, 1992. A recommendation in the city's comprehensive plan included studying and . -revising the city's commercial districts to conform to the plan and address future needs. In October, 1992, the city council contracted with the Hoisington Group, Inc. to carry out a planning study on all the city's commercial zones, to evaluate the appropriate uses in the commercial zones, to evaluate and recommend. changes in the commercial zoning designations, to work with the property owners to determine future needs and to make recommendations to the planning- commission and city. council for revising the commercial zoning code provisions. The Hoisington Group, Inca and the planning commission are currently working on this task. The city council has concluded that the granting of any permits or~development approval, as specifically set forth in Subd. 3, could destroy or impair the integrity.. of the planning process and that a development moratorium is necessary to preserve the status quo pending completion of the planning study. It is the intention of the city council to protect the described planning process and the health, safety and- - welfare of its citizens by adopting an interim ordinance for a reasonable period of time during the time period of the study, planning and implementation activities. • ~. No request for re-zoning, conditional use permit, variance, subdivision, building permit, business license, certificate of occupancy, or any other land use approval, affecting property located within the B-1, B-lA, B-2, and E-B zoning districts shall be accepted for processing or considered by the city .council except: a. building permits may be issued for interior remodeling of existing uses or any use permitted by paragraph c and d of this subdivision; . b. sign permits may be issued for sign changes for existing uses or for uses which are specifically listed as permitted uses in the applicable zoning district.; alp ~.~2s~ c . The city council may waive the moratorium requirements established herein with the following procedures: a. Any person seeking a hardship waiver shall -file an application with the city with a fee of $50.00 plus the applicable fee for the business license and land use permit, if any is required. Inaddition, the applicant shall cover the costs of all related. planning costs of the city's planning consultant . associated with the waiver. b. A requested hardship waiver shall.be scheduled for a hearing before the city council. c. A requested hardship waiver may be granted by a majority of the council members in attendance. • d. The council may grant a hardship waiver only if it _} . fends that: 1) the applicant has demonstrated a hardship by showing that the property cannot be put to a reasonable use without the waiver; 2) the waiver will not affect the integrity of the planning process and the .purpose for which the ordinance was enacted; ' 3) the application is consistent with the current status of the planning study; 4) the application~is for a use that is a listed permitted or conditional use in the applicable zoning district. e. The council may deny the waiver if it does not meet the criteria in this section or if it determines that its approval will negatively impact the planning study or the future .land use and development in the city. Subd. 6 Term. The following general changes have been made in the districts: • B-3 is now B-1 - Neighborhood Convenience • B-1 is now B-2 - Unlimited Business District • B-2 is now B-3 - Snelling/Larpenteur Business District (instead of central business district) • • These changes were made to keep the numbers consistent with other zoning codes and to eliminate the central business district term from the Snelling/Larpenteur area which has unique qualities that separate it from a typical central business district. • The B-2 district is designed to cover the unique blend of uses that are currently there and reasonable future uses. Section 301 of the Building Code is hereby deleted and the following is inserted in lieu thereof: Section 301. Permits Required. All persons, firms or corporations erecting, constructing, enlarging, altering, repairing, moving, improving, removing, converting or demolishing any improvement, building or structure in the city or causing the same to be done must obtain a separate building permit for each improvement, building or structure from the building inspector. This section shall also apply to all driveways, parking lots, fences and. signs. b. Definition of Cubic Feet Cubic feet means the total volume included within the surrounding exterior walls of a building or portion thereof, from the basement floor to the roof line. 304(b). The signs are removed within one (1) year unless an extension is given from the zoning administrator. d. Subdivision 13. Ground Signs. a. No ground sign shall be erected, constructed, altered, rebuilt, or relocated to a height exceeding twenty (20) feet above ground. b. The bottom of the facing of every ground sign shall be at least thirty (30) inches above the ground, which space may be filled with platform or decorative trim of light wood, metal construction, brick, planters or plantings, etc. c. No private sign shall be erected, constructed, or maintained within the boundary of any street, avenue, highway, alley or public ground of the city, county or state. • d. Portable signs supported by frames or posts rigidly attached to bases shall be so proportioned that the weight and size of the bases are adequate to resist the wind pressure specified in the building code. Such signs shall not exceed five (5) feet in height or fifteen. (15) square feet in area. e. Adult Use -Modeling Studio. An establishment whose major business is the provision, to customers, of figure models who are so provided with the intent of providing sexual stimulation or sexual gratification to such customers and who engage in "specified sexual activities" or display "specified anatomical areas" while being observed, painted, painted upon, sketched, drawn, sculptured, photographed, or otherwise depicted by such customers. Adult Use -Motion Picture Arcade. Any place to which the public is permitted or invited wherein coin or slug-operated or electronically, electrically or mechanically controlled or operated still or motor picture machines, projectors or other image-producing devices are maintained to show images to five or fewer persons per machine at any one time, and where the images so displayed are distinguished or characterized by an emphasis on depicting or describing "specified sexual activities" or "specified anatomical areas". Adult Use -Motion Picture Theater.
