REPORT ON PROPOSED CONDITIONS TO GOVERN AMUSEMENT ESTABLISHMENTS
INCLUDING POOL HALLS AND GAME ARCADES IN SECTION 9-10.01 SUB
2 P Q OF THE ZONING CODE
A brief discussion was held on possible conditions for amusement
establishments as drafted by Tim Malloy, Consulting Planner. It
was agreed that Condition E which reads in part,
• Adequate adult supervision will be required including a
minimum of two employees on the premises during all hours
of operation and until 1/2 hour after closing.

Commisioner Barry expressed concern that perhaps some conditions
may be impossible to meet. Commissioner Daykin asked whether
variances can be granted from these conditions. Hoyt answered
yes they could. She also reported that conditional use permits
go with the land not the business owner.
Chairman Boche suggested that operation of the business should
be governed by a license rather than a conditional use permit
since the license does not stay with the land and can be
revoked. Hoyt mentioned Little Canada and Roseville were
considering a licensing procedure. Councilman Ciernia suggested
we talk to the attorney for legal advise on this issue. Hoyt
will report back at the next meeting.

DISCUSSION OF THE ZONING CODE REGULATIONS GOVERNING DRIVEWAYS
AND OFF STREET PARKING REQUIREMENTS IN R-1 ZONES
Hoyt mentioned that last year she received many requests for
additional off street parking in R-1 zones. The zoning code
allows four off street parking spaces, however, the code does
not clearly define how to calculate this space. The zoning code
also needs revised driveway standards according to Terry Mauer,
the City Engineer. The Planning Commission recommended that
planner, Tim Malloy, be asked to assist with these code
revisions.

APPROVAL OF MINUTES:
Commission requested an amendment to the January 28 minutes to
include the findings for revoking the conditional use permit
issued for a game arcade at 1544 W. Larpenteur.
REPORT ON THE POSSIBLE REMOVAL OF POOL HALLS AND GAME ARCADES AS
CONDITIONAL USES IN A B-2 ZONE 9-10.01(2)(p)(q)]
City Planner Hoyt reported on the possible exclusion of, or
further restrictions on game arcades and/or pool halls as
conditional uses in the City's B-2 zone.
• Planner Hoyt explained that when considering whether or not to
remove billiard/pool hall and/or games arcades as conditional
uses from the zoning code, two questions need to be asked, 1)
"Is a pool hall and/or games arcade a desirable land use in the
City"?, and 2) "Is a pool hall and/or game arcade in a B-2 zone
compatible with other land uses in the City"?
Three site criteria were discussed. One, adequate parking in
front of the establishment with no rear exit to allow police to
better patrol; two, exits away from residential neighborhoods;
and three, highly visible entrances and exits for observation by
patrolling police.
Due to the close proximity of all businesses and residential
neighborhoods, the Commission agreed there was no appropriate
location for such an establishment in a B-2 zone in Falcon
Heights since the option of establishing minimum distance
requirements was not available to the City. Commissioner
Finegan moved and the Commission unanimously accepted to
recommend the removal of both uses from the zoning code, 9-
10.01(2)(p) - billiard/pool hall and 9-10.01(2)(q) - game
arcade.
Councilman Cernia will bring-this to the City Council as a
Planning Commission recommendation. If the Council approves, a
hearing notice will be published and a public hearing will be

held in March by~the Planning Commission.
REPORT ON THE PROPOSED INCREASE IN PLANNING RELATED FEES
Planner Hoyt announced she has been re-evaluating all planning
fees and recommended increases. After a brief discussion on the
fee changes, the Commission unanimously recommended staff take
the recommendation to the City Council for a final decision.
REPORT ON ZONING CODE REQUIREMENTS FOR RETROACTIVE SCREENING OF
EXISTING BUSINESSES
A complaint brought by Falcon Height resident, Mr. Warren
Peterson, against Hamline Hoyt Repair for having junk cars and
tires stored on his property at 1565 Hamline Avenue N. was
discussed. Planner Hoyt reported City Staff had talked to the
owner, and he is making every effort to be in conformance with
city code. The Commission then reviewed proper methods of
screening of property as required in the code. They agreed that
frequently screening would not be appropriate and/or possible,
but cleaning up the business property would be appropriate.
Discussion about the revision of the retroactive screening
requirement in Section 9-14.01(5)(b)(d)(e) of the code followed.
Because retroactive screening was frequently impossible or
inappropriate, it was suggested that the City set minimum
property upkeep standards for existing businesses. Chairman •
Boche asked staff to begin to draft specific things that are
enforceable that might be substituted for those that are now
unenforceable.
REVISED POLICIES FOR COMPREHENSIVE PLAN REFLECTING COMMENTS AT
JANUARY 28, 1991 MEETING
Changes suggested in the Comprehensive Plan by Commission are:

Objectives:
1. "To encourage the State Fairgrounds to remain in Falcon
Heights" be changed to read:

Planner Hoyt said the Comprehensive Plan should be ready for
final review and discussion at either the March or April
meeting. A public hearing will be held on the final draft. The
document will then be sent to the City Council for approval.

ITEM DESCRIPTION: A public hearing on a request for a
con i iona use permit to operate an amusement establishment
primarily for pool in the downstairs of Bullseye Plaza at 1559
W. Larpenteur Avenue.

EXPLANATION/DESCRIPTION:
On March 8, 1991, the City received an application for a
conditional use permit to operate a pool hall and 15 video or
pinball games in the downstairs of Bullse~e Plaza where the
Golf-O-Mat previously operated. The applicant was informed of
the possible conditions that the Commission/Council would attach
to the permit.
After the February Planning Commission and City Council
meetings, staff requested Mr. Dahl to provide additional
information. This included a security plan and a description of
his related business experience. Mr. Dahl did not submit the
additional information for review by the planner, Tim Malloy,
nor did he return telephone calls from the staff inquiring about
the applicant's intent to do this. Therefore, rather than spend
consulting time on reviewing a partially completed application,
staff recommends cancelling the public hearing and requiring Mr.
Dahl to reapply for the conditional use permit if the
information is not received by 4:30 p.m. on May 7, 1991.

In March the Planning Commission and City Council of Falcon Heights discussed
proposed amendments to the zoning code governing the operation of pool halls
and game arcades. These conditions are attached for your information.
Although the conditions are not currently part of the zoning code, they will
be adopted soon. Your proposed pool hall in the Bullseye Shopping Center
• will be expected to meet these criteria as well as other criteria that its
particular location might require.. These conditions are very similar to those
I gave you regarding J.J.'s Pool and Game Arcade. One of the new require-
ments is submitting a security plan for review by the local police department.
Tim Malloy, a planner with Dahlgren, Shardlow and Uban, will be reviewing
your application for a conditional use permit. He requested that you provide
a letter of intent for your business operation. This should include all the
activities you intend to offer (e.g, retail sales, tournaments), your
experience in operating and owning pool halls and any other relevant infor-
mation regarding the pool hall business or its location. He also wants
evidence of the parking agreement between the Bullseye Plaza and the Embers
that provides more parking than those adjacent to Bullseye and those north
of the Embers building. Such an agreement was arranged between Henry Kristal,
Embers, and Dennis Hunt, Bullseye Golf, a few years ago. It's important to
know if its still in place.
A public hearing on your application for a conditional use permit is
scheduled for April 22, 1991. In order to keep this on schedule, please
submit this additional information by 4 P.M. April 8th so the police and
planner Malloy will have adequate time to thoroughly review your complete „~~/,~~~

EXPLANATION/DESCRIPTION:
At its March meeting, the Planning Commission reviewed a set of
proposed conditions to govern the operation of amusement
establishments. The Commission requested the staff to report on
the reasonableness of putting these requirements into a license
rather than a conditional use permit because (1) they dealt with
business operations not the site, and (2) the license is subject
to annual renewal. Both Planner Malloy and City Attorney, Tom
Gedde, recommend these conditions be in the zoning code where
• they are easily administered and where a conditional use permit
is necessary to control where amusement establishments locate.
Without a conditional use requirement, these establishments
would be permitted uses, and not require Planning Commission
review and Council approval.
In separate discussions, Malloy and Gedde concurred that a
condition that terminates the conditional use permit with a
chance in business ownership is appropriate and legal in a
conditional use permit governing amusement establishments where
ownership and management are extremely important.

THE FOLLOWING IS THE PROPOSED LANGUAGE FOR SECTION 9-10.01 SUBD.

Amusement Establishments subject to the following conditions:
A. The operation of such establishments shall not
negatively impact the reasonable peace and quiet of
surrounding residential areas.
B. Hours of operation shall be limited to 10 a.m. to 12
Midnight. All existing curfews will be enforced on the
premises.
C. Implementation of a security plan, which must be
approved by the local law enforcement official, will be
required. The security plan shall include provisions
for the following; adequate security lighting,
controlling loitering and any disorderly behavior within
the building, in the parking lot or anywhere else on the
premises, prohibiting the sale, use or possession of
alcohol or any other controlled substance without a
• prescription.
D. Rear door will serve as an emergency exit only.
E. Adequate supervision will be required including a
minimum of two adult employees on the premises during
all hours of operation until closing. Additional
supervisory and/or security personnel may be required at
the City Council's discretion.
F. No person shall establish, maintain or operate an
amusement facility as defined in this ordinance without
a license issued by the City.
G. Compliance with all other applicable provisions of the
Falcon Heights City Ordinances shall be required.
H. Other conditions, as deemed appropriate by the City
Council, may be applied in response to site specific
conditions at the time the conditional use permit is
issued. Violation of and of the above stated conditions
or any other conditions included as part of the approved
conditional use permit shall be deemed ample grounds for
revocation of the permit.
I. The conditional use permit shall terminate upon a change
in business ownership and/or the closing of the
business.

Amusement Establishment: And building, area, or lace whose
princip a purpose is providing entertainment derived from the
operation of amusement devices.
Amusement Devices: Any game of skill or chance requiring the

ITEM DESCRIPTION: Summary of the City's Five Year Street
Improvemen rogram

EXPLANATION/DESCRIPTION:
Streets play a vital role in every city. Even in a small
developed city like Falcon Heights, the design and condition of
all streets impact traffic patterns and traffic flow as well as
residential landscapes and neighborhood quality throughout the
City.
Therefore, as a Planning Commission member, it is useful for you
to know what street improvements are planned for the City over
the next five years (see attachment 1). Please remember that
this is a plan. With the exception of Hamline Avenue and those
streets designated for 1991, each local and county street
project will be individually reviewed and completed as time and
budgets allow.
• Street reconstruction is financed in a variety of ways depending
upon whether it is a state highway, a county road, state aid
designated street (MSA), or a local street. Under the City's
current assessment policy, residential property owners pay based
upon a residential equivalent assessment rate of 50 percent of
the cost of typical reconstruction of a residential street
($48/ft in 1991).
