To open a • B&B, the facility must meet the reouirements of the Minnesota Department of Health, the Minnesota Fire Code and the local Zoning Code. If any remodeling is done, it must conform to the Uniform Building Code. The Ramsey County Environmental Health Officer is responsible for licensing the B&B to meet the Minnesota Department of Health standards and other County requirements. The local Fire Marshal inspects the facility to assure conformance to the Fire Code. The local Building Inspector inspects any major remodeling to assure conformance to the Building Code. Under the Local Zoning Code, a B&B may be classified as a Home Occupation in an R-1 Zone. However, the B&B does not meet two requirements of a Home Occupation. The first is 9-14.01, Subdivision 25(d-5)~ which states that no accessory use shall be permitted in conjunction with a Home Occupation. This property has an accompanying accessory use, a swimming pool, which B&B guests may use. The second is 9-14.01, Subdivision 25(d-I6), which limits the hours of operation of a Home Occupation to 9:00 A.M. to 9:00 P.M. on weekdays and 10:00 A.M. to 6:00 P.M. on weekends. Obviously a B&B requires overnight accommodations. Because the B&B does not meet all the requirements of a Home Occupation, the property owners are seeking a Conditional Use Permit to operate the facility (9-4.01, Subd. I(j)). • HOME OF THE MINNESOTA STATE FAIR AND THE U OF M INSTITUTE OF AGRICULTURE i /k7e~w~ -z~'M E -1 ' ~ A ~A1 Ad~' E -2- Furthermore, a second Home Occupation, a business office, is proposed ' for the property. This Home Occupation meets all the applicable Code requirements. Therefore, a separate license may be applied • for independently of the Conditional Use permit for the B&B. There is no limit on the number of Home Occupations within a dwelling in the City Code. If_the Commission recommends that a Conditional Use Permit be granted to allow a B&B at 2129 west Larpenteur Avenue, the conditions must assure the City that the facility will not become a rooming house, public restaurant or hotel. The requirements for a Home Occupation and the Zoning Code substantially guarantee that the B&B will operate compatibly within an R-1 zone. However, I incorporated portions of B&B ordinances from the Cities of Stillwater, St. Paul and Minneapolis into the proposed Conditional Use Permit to assure its operation as an owner-occupied B&B. I also included restrictions on the number of guest suites and guests occupying the structure at one time so there is no over-crowding of the dwelling. The following conditions are proposed for your review, comments and revision: 1. The B&B must meet all the requirements of a Home Occupation 9-14.01, Subdivision 25 (d) with the exception of 9-14.01, Subdivision, 25 (d-5) and (d-6) as regulated herein. (See Attachment E-1F.) 2. The B&B shall be owner managed and occupied during • its operation. (The owner/manager occupation is what is distinctive about a B&B.) 3. The B&B shall be limited to two guest suites, a-ee 6. Meal service shall be limited to breakfast for over night guests. 7. Guests of the B&B may use the swimming pool as regulated by the Minnesota Department of Health. 8. The B&B may operate on a 24 hour-a-day basis. 9. The B&B shall meet all State, County and City regulations„ licensing and Code requirements including, but not limmited to, the Fire Code, the zoning Code and the Building code. 10. The B&B operation shall be reviewed six months after it opens and annually upon renewal of its municipal business license. 4. The B&B shall have a maximum of six guests occupying and/or renting the two guest suites at o~neV~(time. 5. The City Zoning Code, 9-2.05, Subdivision 2(a) requires a variance to construct a wheelchair ramp in the front yard. The front yard is the only suitable location for the ramp because the angle of steps, the location of the garage and the narrow gate prohibit construction of a ramp in the rear yard. The ramp is wood, sixteen (16) feet long and four (4) feet wide. It extends from the front entrance within twelve (12) feet to~fifteen (15) feet of the public sidewalk. The City Planner verbally granted a temporary variance to Mr. Horton on September 15, 1989 due to the emergency hardship. It was decided that the intent of the Code, 9-1.01(a) "to protect and promote the health, safety, and comfort of residents" covered this situation. Without the ramp, Mrs. Horton would be trapped in her home in a fire. The Chairman of the Planning Commission was informed of this action. The City notified the adjacent property owners of the variance request. Mr. Aschenbach expressed no objection over the telephone. Attachment: A. Nuisance Code 8-1.0]., Subd. 2. Junk, Trash, Rubbish and Refuse. Subdivision 2. Junk, Trash, Rubbish and Refuse. In any area within the City the storage or accumu]•ation of junk, trash, rubbish or refuse of any kind, except refuse stored in such a manner as not to create a nuisance for a period not to exceed thirty (30) days is illegal. The term "junk" shall include parts of machinery or motor vehicles.,. unused stoves or other appliances stored in the open, remnants of wood, decayed, weathered or broken construction materials no longer suitable for safe, approved building materials, metal or any other material or cast-off material of any kind whether or not the same could be put to any reasonable use. ' ('. ~ f S `1 COMPOSTING AND MULCHING: A GUIDE TO MANAGING ORGANIC YARD WASTES Composting is a microbial process that cumerts pl.int mate- rials such as grass clippings and Icwr~~ to a u~ihlc ur};anic soil amendment or mulch. C;ardc~ner~ h,rvc u~c~d < onrl a rat for centuries to increase soil organic matter and scrppl} some of the essential nutrients for plant growth. Aful< hing refers to the practice of applying a substance such as compost or grass clippings to the soil surface with the• purtx,~e of modifying soil temperature and moisture as well as controlling w-eeds and soil erosion. With the ban on outdoor burning and with laws which soon will limit dumpingof (caves and grass c liphings into landfills, composting and mulching have become attractive alterna- tives for managing yard waste and recycling natural materi- als. Grass clippings and leaves can be hauled to city composting areas as one means of disposal. How-ever, many homeowners may find it more convenient and economical to compost these materials in their ow•n back} ands. In either case, the finished compost can he used as a mulch or as a soil amendment to improve most garden ~cril~. This bulletin should help you learn huw~ to build and nnint,~in a c onrpust pile as well as how to use the compost in the yard and gar- den. • Why Compost? J Composting is an efficient method of breaking down organic materials into an end product that is beneficial to the soil and growing plants. Adding undecomposed materials directly to the sot{ without first composting may initially have some un- desirable effects. For example, i(largc quantities of uncom- posted leaves are incorporated into the soil, microbes will compete with plant roots for soil nitrogen during Icaf decom- position.This competition for nitrogen can result in nitrogen deficiency and poor plant growth. Adding composted mate- rial reduces the competition for nitrogen. Another benefit of composted material is that it is much easier to handle and mix with soil than uncomposted material. furthermore, im- provement of soil ph}-steal properties, such as infiltration, .drainage, and water holding capacity, will usually be faster if composted materials are added. Moisture: Adequate moisture is essential for microbial activ- ity. Adry compost will not decompose efficiently. tf rainfall is limited, it wil I be necessary to water the pile periodically to maintain a steady decomposition rate. Enough water should be added to completely moisten the pile, but overwatering should be avoided. Excess water can lead to anaerobic con- ditionswhich slow down the degradation process and cause foul odors. Water the pile so that it is damp, but does not re- mainsoggy. Particle size: The smaller the size of organic wastes, the faster the compost will be ready for use. Smaller particles have much more surface area that can be attacked by mi- crobes. Ashredder can be used before putting material in the pile, and is essential if brush or sticks are to be composted. Because microbes require a certain amount of nitrogen for their own metabolism and growth, a shortage of nitrogen will slow down the composting process considerably. Material high in carbon relative to nitrogen such as straw or sawdust will de- compose very slow~l} unless nitrogen fertilizer is added. Tree leaves are higher in nitrogen than straw or sawdust but de- comhosition of leaves would still benefit from an addition of nitrogen fertilizer. Grass clippings are generally high in nitro- gen and when mixed properly with leaves wiN enhance de- composition. Manure or blood meat can be used as organic sources of nitrogen. Otherwise, a fertilizer with a high nitro- gen content should be used. Other nutrients such as phos- phorus and potassium are usually present in adequate amounts for decomposition. During tl~e initial stages of decomposition organic acids are produced and the pH dropc. In the past, small amounts of lime have been suggested for maintaining and enhancing microbial activity at this time. However, high rates of lime will convert ammonium-nitrogen to ammonia gas which will lead to the loss of nitrogen from the pile. Research has shown that althou>~h lime additions may hasten decomposi- tion, tl-e loss of nitrogen from the pile often offsets the bene- fits of lime 11 ). In general, lime is not necessary for degradation of must yard w antes. The pH of finished compost is usuall} slightly alkaline ~rithout the addition of time. Coarser ma- terials will decompose faster if placed in the bottom layer. This layer should be watered until moist, but not soggy. A ni- ,~vr~ trogen source should be placed on top of this layer. Use one ~~~,~ to two inches of livestock manure, or use a nitrogen fertilizer such as ammonr nitrate or ammonium su a-Tf-te at a rate of ~ one third of a cup for every twenty five square feet of surface s''.area. If these nitrogen sources are not a~ ailable, one cup of y~~ 10-10-t O fertilizer per ?5 square feet of surface area "•ill also suffice. Do not use fertilizer that contains herbicide or pesti- cide. Grass • clippings tend to mat and should either be mixed well with other materials, or placed in layers only hvo to three inches thick. About a one inch layer of soil or completed compost can be applied on top of the fertilizer layer. One purpose of adding soil is to ensure that the pile is inoculated "•ith decomposing microbes. The use of soil in a compost pile should be consid- ered optional. In most cases, organic yard wastes such as grass clippings or leaves contain enough microorganisms on the surface to effect decomposition. Studies have shown that there is no advantage in purchasing a compost starter or in- oculum. Microbes multiply as rapidly from the soil andlor added organic wastes as from the inoculum. Those microbes already in the soil and on organic materials are just as effi- cient in decomposing the .waste as those provided by the commercial inoculum. Adding soil, however, will help re- duce leaching of mineral nutrients such as potassium re- leased during decomposition. Repeat the sequence of adding organic waste, fertilizer, and soil (optional) until the pile is completed, remembering to water each section. The carbon:nitrogen (C/N) ratio will determine ho~v long de- compositionwilt take. AC1N ratio of about ?0 is needed for rapid composting without nitrogen being tied up. If the C/N ratio is above 50, the process will be considerably slower. The C/N ratio of common organic yard wastes is provided in Table 2. Turning also exposes seeds, insect lar- vae, and pathogens to lethal temperatures inside the pile. Turning may be done by inverting segments of the compost, or by shifting the pile into another bin. The compost pile should he kc pt moist but not waterlogged. Odors may arise either from the acAlitiun of excessive amounts of wet plant material, like (roils ur grass clippings, or from overwatering. The pile should be turned when the temperature in thc~ center begins to cool. This will introduce ox)•gen and undecomposed material into the center and sub- sequentl~ regenerate heating. Vegetable wastes should be buried inside the pile to avoid attracting rodents. Other benefits of adding compost include improved seed emergence and wa- terinfiltration due to a reduction in soil eructing. Over time, yearly additions of compact +vill curate desirable soil structure, making the soil much easier to ~+ork. For im- proving soil physical properties, add ant in r,rl,or~te 1 - 2 inches of well decomposed compost in the tot, f, - 8 inches of soil. Use the lower rate for sandy soils and the higher rate for clay soils. To a limited extent, compost is a source of nutrients. How- ever, nutrient release from compost is slow and the nutrient content is often too low to supply all the nutrients necessary for plant growth. As noted in Table 3, there is a ~+ ide variation in nutrient content of municipal leaf compost. To obtain a completely pasteurized leaf compost, it is necessary to heat the material in an oven unfit the tempera- ture of the center reaches 160"F and is maintained for 30 minutes. Use of Cornpvst as a l~lulch Mulches are used in gardens to suppress weeds, reduce soil c~re,cinn, mcxli(y the coil teml,erature (cooler in the summer, +varmer in tlt<• +rintc•r}, and consen•e soil moisture. Yard waste compost makes an ideal mulch for annual and peren- nialgardens. All that needs to be done is to apply a 3 - 6 inch layer of comlxst around the base of the plant. Periodically throughout the summer, you ntay need to add more compost over the old layers to maintain the benefits of the mulch. The soil em~ironment beneath the mulch is favorable for promoting earth~rorms ~+ hash in turn are valuable for aerat- ing the soil. Organic matter is gradualh added to the soil as the mulch decomposes. For annual gardens, the mulch can be worked into the soil at the end of the season to further im- prove soil physical prolerties. For perennials, it maybe ben- eficial to remove the mulch in the spring to allow the soil to thaw out faster. As discussed above, a well decomposed yard waste compost will not tie up nitrogen. Therefore, additional nitrogen beyond that recommended for plant growth is un- necessary. If uncomposted or partiaHycomposted leaves are used, one tables{x~on of a (ti{;It nitrogen fertilizer should be applied to each bushel of mulch. In order to keep your lawn looking healthy and to control the amount of c tappings generated, several maintenance prac- tices should he tollo+red. It is important that mo++•ing height be prolx~rly adjusted. The height of the cut ++ill depend on the turfgrass varieties present in the (a++•n and whether the - lawn is in sun, full shade, or a combination of both. Lawns in full sun have the greatest potential for quick recovery after mowing and can therefore bc• cut shorter. Those in the shade • need all the available leaf surface possil,le for photosynthe- sis.Thus, grass in the shade should be cut slightly higher than grass in the sun. Where both conditions are present, an inter- mediate height is recommended. Some Suggested mowing heights are listed below: Fine fescue 1-1 /2 to 2-1/2 inches Kentucky bluegrass/perennial ryegrass 1 to 2 inches Kentucky bluegrass: Improved varieties 1 to 2 inches Common types 1-1/2 to 2-1 /2 inches Kentucky bluegrass/red fescue 1-1/2 to 2-112 inches Mowing frequency also has a direct impact on the amount of clippings generated. Mowing frequency depends on the cut- tingheight selected and how fast the turf grows rather than on specific time intervals such as once per week, etc. Ideally, no more than one third of the leaf surface area should be cut at any onetime and the clippings should be no longer than one inch. As an example, a lawn with grass three inches tall should be cut to about two inches. Excessive defoliation in a single mowing can make the I~Wn more prone to stress and disease problems. Be careful not toover-fertilize your lawn. Excessive fertiliza- tion (primarily nitrogen) will cause dense growth and unless the lawn is cut more frequently ,the clippings ++•ill be slow to r~ reach the sutl ,ind dccomlx,se. Reducing excessive thatch levels through (a~+•n renovation will improve infiltration of the grass c tappings down to the soil surface. It is best to mow your lawn ++•hen it is dry so clippings will be able to filter down to the soil without clumping. Either +vill do an acceptable job when sharpened and adjusted properly. Mover blades should always be kept sharp. Dull blades can significantly lengthen the recovery time for regrowth after mowing, and potentially increase vul- nerability tocertain diseases and environmental stresses. Ro- tary mowers are no+v available with a mulcher attachment for the blade. This will reduce the size of the clippings left be- hind and should result in faster decomposition of the grass blades. Hoy+•ever, if you are mowing on a regular basis and not removing more than one third of the grass blades at a tinx~, additional size reduction is not necessary. If grass growth is excessive it may become necessary to re- move the clippings. In this situation, lawn clippings can be used in the comlx~st pile as described above or they can be used as a mulch in the garden. If used as a mulch, care should betaken nut to over-apply fresh clippings as they tend to mat down and reduce water penetration. The presenters summarized the Draft LRT Plan. We were assured that the proposed alignments for the new corridor through the City *of Falcon Heights, which include the Fairgrounds, the University of Minnesota, and Fairview or Snelling Avenue is very preliminary. The analysis of the proposed alignments is planned for a later stage i;n the planning process. As the discussion progressed, it became clear that the Midway corridor is the only one being seriously studied for LRT due to its high transit ridership and connection between the downtowns of Minneapolis and St. Paul. .The high cost of LRT construction .without an easily accessible funding sout`ce raises questions about the LRT's feasibility. Nevertheless, the City may wish to comment on the Plan. by expressing (1) an overall interest in the concept, (2) a desire to be kept informed of plans, and (3) several questions and concerns about the proposed alignments through the City of Falcon Heights. COMPOST Chairman Black interrupted discussion and opened the Public Hearing PUBLIC on amendments to the Swimming Pool Ordinance, Section 9-14.02 of HEARING the City Code at 7:45 P.M. There being no one wishing to be heard, SWIMMING he recessed the public hearing and continued the discussion on POOL • composting. ORDIN. Discussion centered on several issues: size of the compost COMPOST area/structure, whether a structure should be required in all cases, placement on the lot, how enforcement should be handled and by whom, whether compost has to be generated on the property, and more specific language as to what is accepted composting practices and how should they be referenced. Boche moved, seconded by Finegan, to following changes proposed CHANGES to the nuisance and zoning code: Section 8-1.01, Subd. 2, remove TO CITY the wording "generated on the property"; Section 9-4.01, Subd. CODE 3(k), remove the wording "generated on the property" and remove ON the wording "by five (5) feet in length by five (5) in width" and COMPOST substitute "and not cover more than twenty-five (25) square feet"; AREA/ Section 9-2.04, Subd. 1(k), remove the wording "by five (5) feet STRUC- in length by five (5) feet in width" and substitute "and not cover TURF more than twenty-five (25) square feet". Upon a vote being taken, the following voted in favor thereof: Black, Boche, Daykin, Duncan, Finegan and Nestingen, and the following voted against the same: Barry. Carroll and Grittner were absent. Motion approved. APPROVEL • Duncan requested that the City Planner prepare suggested visual standards for remodeling projects as are used for new construction. He was of the opinion that this could eliminate the use of unsightly DUNCAN construction materials being used for remodeling over which we CHANGES presently have no precise wording in the City Code. Such wording REQUESTS should be prepared and reviewed at a future meeting. Planner Susan Hoyt Taff advised that she is working on the Snelling/ Larpenteur redevelopment, parking study and preparing slides, which would be available for public relations or any other presentations. PLANNER She is also reviewing Chapter 9 and will make suggestions for change. She then distributed portions of the park comprehensive plan and reviewed actions taken by the Park and Recreation Commission. The Commission discussed the Light Rail Transit Plan for Ramsey LIGHT County and encouraged as many members as could to attend the September RAIL 12th evening meeting. Planning Commission Minutes of August 30, 1989 DISCUSSION OF LAW ENFORCEMENT PROPOSALS FROM RAMSEY COUNTY SHERIFF'S DEPARTMENT AND CITY OF ROSEVILLE Council discussed the law enforcement proposals presented by the the Ramsey County Sheriff's Department and the Roseville Police Department at a workshop preceding the Council Meeting. The discussion was interrupted to open the public hearing scheduled for 7:30 P.M. 7:30 P.M. - PUBLIC HEARING ON PROPOSED IMPROVEMENTS OF HAMLINE AVENUE, LARPENTEUR TO ROSELAWN Baldwin opened the public hearing, noted the Affidavits of Publication and Mailing, and outlined the hearing process. Maurer then presented the improvement plan and explained the estimated costs and proposed assessments. BILL SOUKOUP, 1763 HAMLINE, asked what the new traffic count numbers indicated to which Maurer replied they were slightly • higher. Soukoup then addressed the following concerns: 1) the need to repair the Gottfried Pit with this project as he felt it was an optional issue, 2) the need for the sidewalk and suggested it be placed on the Roseville side, 3) questioned MINUT&~ SEPTEMBER PAGE 2 31, .1989 • whether of .not property owners would be assessed for the Gottfried Pit and sidewalk projects. Maurer replied that they will be utilizing materials out of the pit to replace soils on Hamline, that the lift station at the Pit is presently unsafe, and it is more economical to include the project in the large street improvement project than to do it separately at a later date. Baldwin informed Mr. Soukoup that there are no plans to assess for the pit improvement or for the pathway as it is part of the City's pathway network. Fenita Foley, 1905 Hamline, inquired about the envirorunental study results. Maurer replied that the environmental worksheet has been submitted to the County for review, and when the project enters into the final design it will then be determined whether or not an environmental impact study is necessary. Ms. Foley also inquired about the width of the boulevard and Maurer explained that the County has agreed to a 4 foot boulevard with deviations to 6 feet in Roseville and would probably be agreeable to the same in Falcon Heights. Ms. Foley stated she felt hopeless because. she did not think her voice was being heard by the Council. Baldwin explained that Council also feels hopeless at times, but that the County owns the land, and that the Falcon Heights Council is not the only governmental body in control of the street. He also stressed that the Council did get same changes made in the project. • TERRY SOUROUP, 1763 HAMLINE, questioned the cost listed on the hearing notice, 5370,000 when Maurer has presented an amount of $99,078. Maurer explained that the $370,000 was based on 1/4 (the area within Falcon Heights) of the entire $1,500,000 project but the city will be billed for approximately 5100,000 as its share. There being no others wishing to be heard, Baldwin closed the hearing at 8:10 P.M. Following a brief discussion, Council directed Maurer to request that Ramsey County narrow the boulevard to 4 feet. APPROVAL OF PROPOSED FIRE DEPARTMENT FUND RAISER Fire Chief Lindig requested that Council approve the Department's plan to hold a fund raiser at the Roseville Rnights of Columbus Hall on November 18, 1989 and stressed that the funds raised would be used for equipment. Following a brief discussion, P. Chenoweth moved approval of the fund raiser in the name of the Falcon Heights Fire Department with such funds to be used for equipment. Motion carried unanimously. FUNDING FOR NEW COPIER APPROVED • Council reviewed and discussed Accountant Tom Relly's memo dated September 13, 1989, documenting the seed for a new copier for the City Office, after which Cie mia moved authorization of an expenditure of up to 58,000 for a new copier. MINUTES SEPTEMBER 13, 1989 PAGE 3 PROPOSED ORDINANCE AMENDING SECTION 9-14.02 OF THE CODE RELATING TO SWIMMING POOLS DEFERRED TO 9/27/89 MEETING Wallin explained the Planning Commission unanimously recommended adoption of the ordinance following the Public Hearing held September 11, 1989. Council reviewed the proposed ordinance, min s~ questioned the 5 foot, non-climbable fence requirement and ~ concurred a four foot construction fence would not be necessary for above ground pools (which must be filled with water during .~I ~.-r~~t(.Q' construction) if the walls of the pool are at least 4 feet above C~ U'~~` grade. Wallin felt that if a perimeter fence is already in place, there should be no need to construct a second fence around the pool. PLANNER'S REPORT ON LIGHT RAIL TRANSIT NOTED Council briefly discussed the memorandtun dated August 28, 1989, submitted by Susan Hoyt-Taff, regarding the Light Rail Transit Plan for Ramsey County POLICING DISCUSSION RESUMED - CITY TO NEGOTIATE CONTRACT WITH ROSEVILLE POLICE DEPARTMENT . Some concern was expressed regarding terminating the long standing relationship with the Sheriff's Department; however, Council felt that a contract with Roseville might be more of a long range control on costs and that the Roseville proposal should be investigated. Wiessner was directed to negotiate a contract with the City of Roseville with the understanding that residents of both Falcon Heights and Roseville will receive the same service at the same per capita cost.
