ARESOLUTION GRANTING A CONDITIONAL USE PERMIT TO OPERATE A
SECONDHAND CLOTHING STORE AT 1583 N. HAMLINE AVENUE
WHEREAS, the City of Falcon Heights received an application from Dirk Bordsen,
owner of the shopping center at 1583 N. Hamline Avenue, on behalf of James Bonner,
proprietor of J.T.'s Feathered Denims, for the issuance of a conditional use permit to
operate a secondhand clothing store; and
WHEREAS, the city council did carefully consider the request on September 28,
1994 as well as the recommendations made by the city's planning commission after
holding the required public hearing; and
WHEREAS, it was determined that the conditional use permit meets all the
general and specific requirements set forth in Chapter 9-15.04 subd. 3 (a) of the zoning
• code; and
WHEREAS, the applicant and proprietor agreed to a number of conditions
pertaining to the operation of the business, as noted below; and
WHEREAS, the council inadvertently did not pass a formal resolution on that date
as required by Ramsey County for recording purposes.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Falcon
Heights that a conditional use permit for the operation of a secondhand clothing store at
1583 N. Hamline Avenue be granted subject to the following conditions:
1. The store is authorized to sell used clothing. The term clothing does not include
jewelry or precious metals not other items defined as secondhand goods in the
zoning code.
2. The used clothing shall be washed or dry cleaned prior to sale.
3. The hours of operation shall be limited to 9 a.m. to 9 p.m. Sunday through
Saturday.
4. The proprietor must secure and maintain a business license in Falcon Heights.
• 5. The proprietor must operate with a business license and tax identification
number, if the tax identification number is required by the State of Minnesota.

6. The store shall not exceed the maximum square footage permitted of 1,000
square feet permitted in the B - 1 district of the zoning code.
7. The business shall conform to the city's codes.
8. The store shall not receive direct drop-off of clothing from members of the public
at these premises.
9. There shall be no outdoor storage of merchandise.
10. The store's parking needs shall be accomodated within the shopping center's
parking lot and the immediate public parking spaces along the shopping center
and neighboring commercial uses.
1 1. Any change or expansion to the use shall require an amendment to the
conditional use permit.
