HomeMy WebLinkAboutCCRes_94-15No. R-94-15 CITY OF FALCON HEIGHTS COUNCIL RESOLUTION Date: 3 2/ 3/94 -------------------------------------------------------------------------------------------------------------------- RESOLUTION AUTHORIZING THE PUBLICATION OF A SUMMARY OF THE ORDINANCES 0 - 94 -05, 0 - 94 -06, 0 - 94 - 07, 0 - 94- 08 Whereas, ordinances Nos. 0 - 94 - 05 through 0 - 94 -08 entitled 05 An ordinance amending certain sections of Chapter 9 of the city zoning code 06 An ordinance amending chapter 5, section 1.03 of the city code relating to regulation of specific businesses and products by adding regulating and licensing of therapeutic massage enterprises and precious metal dealers 07 An ordinance amending chapter 5, Section 4.01 of the city code relating to license fees for a precious metal dealer and therapeutic massage • enterprises 08 An ordinance amending chapter 5, sections 5.01, 5.02 and 5.04 of the city code relating to an interim development moratorium on commercial zoning districts WHEREAS, said ordinances contain several pages of text; and WHEREAS, the contents of said ordinances can be summarized as follows: Ordinance 0 - 94- 05 An ordinance amending certain sections of chapter 9 of the city code relating to zoning Amending Chapter 9 1.02 Subdivision 2 Definitions to include definitions of adult uses and related definitions, financial institutions, pawn shop, precious metals and related definitions, secondhand goods stores, and therapeutic massage enterprise. Amending Chapter 9 - 8.01 (B-1) the purpose and intent statement to be a neighborhood business district with uses that do not negatively impact neighboring residential properties, to add coin and philatelic store as a • permitted use, second hand goods store as a conditional use, and to add other requirements prohibiting the use of bars on windows and automatic security lock doors during business hours and exterior storage of merchandise. • Amending Chapter 9 - 9.01 (B -2) the purpose and intent statement to include uses that minimize the negative impact on adjacent residential neighborhoods, to replace bank with financial institution as a permitted use and to add other requirements prohibiting the use of bars on windows and automatic security lock doors during business hours and exterior storage of merchandise. Amending Chapter 9 - 10.01 (B - 3) Changing the name of the district to the Snelling and Larpenteur Community Business District, the purpose and intent statement to includes uses that provide neighborhood and community business services and do not negatively impact adjacent residential neighborhoods, to add bowling alley, coin and philatelic store, precious metal dealer and therapeutic massage enterprise to the permitted uses. To delete general merchandise stores as a permitted use. To add second hand ood s stores and >:>:>:<::>~:~:;~; >::»::.:>:::; ::<::":'.:::~::.::>::>:<>:::_>::>::>::.::::>::>::>::, conditional uses. To add pool tables and electronic games as an accessory use to a bowling alley. Ordinance 0 - 94 - 06 An ordinance amending chapter 5, section 1.03 of • the city code relating to regulation of specific businesses and products by adding regulating and licensing of therapeutic massage enterprises and precious metal dealers Amending Chapter 5 Section 1.03 to include licensing requirements for therapeutic massage enterprises and precious metal dealers. Ordinance 0 - 94 - 07 An ordinance amending chapter 5, section 4.01 of the city code relating to license fees for a precious metal dealer and therapeutic massage enterprises Amending Chapter 5 Section 4.01 to include investigation and licensing fees for therapeutic massage enterprises (5200 and 5 100) and precious metal dealers (5 1, 500 and 5 2,600). Ordinance 0 - 94 - 08 An ordinance amending chapter 5. sections 5.01, 5.02 and 5.04 of the city code relating to an interim development moratorium on commercial zonina_ districts • Amending Chapter 5 Section 5. 01 of the interim development moratorium to state that the planning study is completed on all uses except stores selling firearms and ammunition. Amending Chapter 5 Section 5.02 removing the interim development • moratorium on adult use establishments, personal service establishments, pawn shops, stores selling second hand goods, precious metal dealers, check cashing facilities and pool halls and video game arcades. Amending Chapter 5 Section 5.04 extending the term of the interim development moratorium until December 31, 1994. WHEREAS, Minnesota Statues Section 412,191 authorizes publication of ordinance summaries in lieu of publication of the entire text of ordinances under certain circumstances; and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FALCON HEIGHTS THAT the council hereby determines that publication of this resolution which includes the summary of ordinances 0 - 94 - 05 through 0 - 94 - 08 will clearly inform the public of the intent and effect of the ordinance. And that a copy of this resolution shall be published in lieu of publishing a copy of ordinances 0 - 94 -05 through 0 - 94 - 06 in their entirety.
