RESOLUTION GRANTING VARIANCE FOR
UNIVERSITY GROVE SUBDIVISION NO. 2
On February 22, 1993, the Falcon Heights planning commission
recommended the following variances for University Grove Subdivision
Number 2, consisting of 2151, 2161, 2173, 2148, 2154, 2160 & 2170 Folwell
Avenue and 2141, 2147, & 2153 Hoyt Avenue, for approval by the city council.
Minor & collector street right of way. Chapter 9, Section 17.04,
Subdivision 2.
A variance of
50 foot right
Drainage & utility
Subdivision 4.
. A variance to
the platted 1.
10 feet for Folwell Avenue to permit a

easements. Chapter 9, Section 17.04,
allow no drainage or utility easements along
its of this subdivision.
The planning commission adopted the following findings for granting the
variances for University Grove Subdivision Number 2•
a. That the variance will not be detrimental to the public welfare;
b. That the granting of the variance will not substantially
diminish or impair property values or improvements in the area;
c. That the granting of the variance is necessary for the preserva-
tion and enjoyment of substantial property rights by re-establish-
ing previous property lines and right of ways;
d. That the variance will not impair an adequate supply of light and
air to adjacent property;
e. That the variance will not impair the orderly use of the public
streets;
f. That the variance will not increase the danger of fire or endanger
the public safety;
• g. That the legal boundary history of the tract is such that strict
adherence to the letter of the Chapter would result in undue
hardship to the owner.

RESOLUTION APPROVING PRELIMINARY AND FINAL PLATTING FOR
UNIVERSITY GROVE SUBDIVISION NUMBER 2
WHEREAS, the University of Minnesota has proposed re-establishing lot
lines for 2151, 2161, 2173, 2148, 2154, 2160 & 2170 Folwell Avenue and for
2141, 2147 & 2153 Hoyt Avenue that were inadvertently eliminated by a
previous action; and
WHEREAS, the University of Minnesota has submitted plans for
subdivision and platting of the above properties to accommodate the re-
establishment of lot lines as they were formerly shown in Auditor's
Subdivision 90; and
WHEREAS, the University of Minnesota applied for and was granted
• variances from Chapter 9, Section 17.04, Subdivisions 2 & 4 of the city's
subdivision ordinance; and
WHEREAS, the city planning commission following their public hearing
on February 22, 1993 recommended approval of the request;
NOW THEREFORE BE IT RESOLVED by the city council of the City of Falcon
Heights, Minnesota that the preliminary and final platting of the parcel of
land consisting of 2151, 2161, 2173, 2148, 2154, 2160 & 2170 Folwell Avenue
and of 2141, 2147 & 2153 Hoyt Avenue be approved to be University
Subdivision No. 2.
