RESOLUTION GRANTING A VARIANCE FOR 1817 SIMPSON
WHEREAS, Margaret Sampson, 1.817 Simpson, has requested a variance
of three feet on the north sideyard setback for construction of a new garage;
and
WHEREAS, the planning commission at the August 23, 1993 meeting
studied and discussed the issue after which the following findings for
recommending the granting of the variance were submitted to the city council:
a. That the amendment to the variance will not be
detrimental to the public welfare;
b. That the amendment to the variance will not
substantially diminish or impair property values
or improvements in the area;
• c. That the amendment to the variance is necessary for
the preservation and enjoyment of substantial property
rights;
d. That the amended variance will not impair an adequate
supply of light and air to adjacent property;
e. That the amended variance will not impair the orderly
use of the public streets; and
f. That the amended variance will not increase the danger
of fire or endanger the public safety.
NOW THEREFORE, BE IT RESOLVED by the city council of the City of
Falcon Heights that the planning commission's findings be adopted and the
variance be granted as recommended by the planning commission.
