HomeMy WebLinkAboutCCRes_91-08• No R-91-8 CITY OF FALCON HEIGHTS C O U N C I L R E S O L U T I O N Date 1/28/91 r ~ U A RESOLUTION ADOPTING THE FINDINGS AND REVOKING THE CONDITIONAL USE PERMIT (RESOLUTION R-89-5 AS AMENDED BY RESOLUTION R-89-18) PREVIOUSLY ISSUED FOR OPERATION OF A GAME ARCADE AT 1544 W. LARPENTEUR AVENUE WHEREAS, the City Council of the City of Falcon Heights adopted Resolution R-89-5 on February 8, 1989, amended by Resolution R-89-18 on August 9, 1989, granting a conditional use permit to allow a game arcade at 1544 W. Larpenteur Avenue in Northome Center, and WHEREAS, upon a routine annual review of the permit by the Planning Commission on December 17, 1990, the Commission determined that Conditions three, six, nine and ten were not being met as evidenced by police records, and WHEREAS, City Staff met with the business owners to discuss proposed solutions to assist the business with meeting the required conditions, and WHEREAS, the business owners explained the suggestions were not financially feasible for their business and that they were unable to meet the conditions, and, WHEREAS, on January 28, 1991, the Planning Commission reviewed the staff report and recommended termination of the conditional use permit, and, WHEREAS, on January 31, 1991, the business owners were delivered a court summons to a revocation hearing on February 13, 1991, and, WHEREAS, a duly noticed public hearing was held before the Falcon Heights City Council on February 13, 1991, and WHEREAS, following the public hearing, the Falcon Heights City Council adopted the findings as follows: o that conditions 3, 6, 9, and 10 of the conditional use permit as amended on August 9, 1989, relating to the security of the business and parking lot, the use of the rear exit, and the disruption of community standards of peace and quiet are not being met as evidenced in police reports on 1544 W. Larpenteur Avenue; r ~ LJ • o that the business owners concurred that the conditions are not being met; o that the business owners stated that they could not implement measures to meet the conditions; o and that the procedures for the revocation of a conditional use permit as identified in section 9- 15.04(5) of the City Code have been duly followed. • NOW, THEREFORE, be it resolved that the conditional use permit issued to business owners Messrs. Jim and Joe Sacco February 8, 1989 and as amended on August 9, 1989 for the operation of a pool and game arcade at 1544 W.
